Rep. Will Hurd, R-Texas, appeared on Fox News’ “The Story” Friday and discussed his upcoming retirement and his future in the Republican Party.

“I’m still a Republican,” Hurd told guest host Jon Scott. “Just because I’m not in Congress, [that] doesn’t change that. So I’m looking forward to continuing to make sure that the Republican Party looks like America.”

Hurd, who announced Thursday he will retire from Congress at the end of his current term, told Scott that he thought the Republican Party “can be more diverse” when pressed on the issue.

Hurd and Sen. Tim Scott, R-S.C., are the only two African-American Republicans in Congress.

When asked about Rep. John Ratcliffe, R-Texas, withdrawing his name from consideration for director of national intelligence, Hurd called Ratcliffe “a friend.”  Hurd, a former CIA officer, also said that he hadn’t been asked about the job.

“I don’t know Congressman Hurd, but I’ve heard he’s done a good job,” President Trump told reporters earlier Friday. “We differ on certain subjects but I’ve heard he’s actually done a good job. It’s too bad he’s leaving.”

The congressman declined to name anyone he’d like to see nominated for the DNI post but threw his support behind promoting principal deputy director Sue Gordon to acting director for the time being.

The New York Times reported Friday that the White House was planning to block Gordon’s ascension to acting director.

Hurd praised the men and women in the intelligence community and credited them for the lack of large-scale terror attacks since Sept. 11, 2001.

“The reason there hasn’t been [an attack] is because the men and women in the intelligence community are still operating as if it’s Sept. 12th because the men and women in our military are doing the same, as well as law enforcement,” Hurd said.

The attorney for eight Covington Catholic High School students told Fox News Friday his clients did nothing wrong during a highly scrutinized Washington, D.C. field trip that became a viral story earlier this year.

“They did nothing racist. They weren’t taunting, harassing anyone,” attorney Robert Barnes said on “The Story.” “They had no idea that they would have this social media lynch mob led by people like Maggie Haberman, a lead political reporter for The New York Times, or Senator Elizabeth Warren [D-Mass.] … both of whom refused to delete or correct or retract or issue any apology for their false statements about these kids.”

JUDGE DISMISSES COVINGTON STUDENT’S DEFAMATION SUIT AGAINST WASHINGTON POST

The lawsuit filed in Kentucky seeks damages for alleged defamatory comments by 12 individuals — lawmakers, journalists and social media personalities, according to Law & Crime.

The individuals include presidential candidate Warren and New York Times White House correspondent Haberman.

A field trip to the March for Life rally by a group of Covington students this past January drew international headlines after student Nicholas Sandmann was filmed in an apparent face-to-face confrontation with a Native American activist while wearing a MAGA hat near the Lincoln Memorial.

A lawsuit brought by Sandmann and his family against The Washington Post over its coverage was dismissed last week by a Kentucky federal judge.

Barnes told guest host Jon Scott that the students remain unnamed in the lawsuit to protect their anonymity and to avoid further threats.

“You had someone like [comedian] Kathy Griffin who called for them to be doxxed, called for them to be named and shamed. Many of them were doxxed in their local community. They received threats over the phone, threats through e-mail, threats to their homes,” Barnes said.

Scott asked Barnes why he thought this lawsuit would prove successful as opposed to the lawsuit dismissed earlier in the week.

Barnes said the Post lawsuit was filed by different attorneys under a “different legal theory,” adding that individuals are treated differently than institutions under Kentucky law.

“The reason they’re being sued is because they used their big platforms to lie and libel about these kids and have refused to issue any correction at all,” Barnes said.

A woman who was fatally shot by a Texas police officer said to be aiming at her dog has been identified as a local fire captain’s daughter.

The Tarrant County medical examiner identified the dead woman as 30-year-old Margarita Brooks; the Arlington Fire Department confirmed on Friday that Brooks was Fire Capt. Troy Brooks’ daughter, according to reports by NBC 5.

Emergency responders and the officer, 25 — he’d completed his training and was released from supervised patrol on July 1 — were responding to a welfare check in Arlington, where Margarita Brooks was reportedly passed out in a grassy area around 5:20 p.m., the Arlington Police Department said in a statement Thursday.

In body camera footage released Friday, the young officer can be heard calling out to Brooks, “Ma’am…are you OK? … Is that your dog? Can you get up?” A small dog, a beagle-Labrador retriever mix belonging to Brooks, appeared to charge at the officer.

That officer, whose name has not yet been released, drew his gun, shouting, “Get back,” before firing three times.

The woman can be heard screaming; the bullets apparently grazed the dog but hit Brooks in the chest.

She was rushed to the hospital, where she was pronounced dead.

Arlington Police Chief Will Johnson said Friday that criminal and administrative investigations are ongoing; at the moment, the officer has been placed on paid administrative leave.

“Preliminary information leads investigators to believe the woman was struck by gunfire from the officer,” the statement said.

“Our hearts are broken for the Brooks family and the police officer involved,” Johnson said. “Clearly, this is not the outcome our officer wanted or the department wanted. Ms. Brooks was never the target of force. We know as police officers that we are responsible for our actions.”

A Trump administration plan to withdraw several thousand of the 14,000 U.S. troops in Afghanistan if a peace agreement is reached with Taliban insurgents is welcome news.

U.S. officials told Fox News that negotiations are still underway with the Taliban, meaning the possible troop withdrawal is not final. The number of American troops that could be withdrawn has not been announced.

Zalmay Khalilzad – the former U.S. ambassador to Afghanistan, who was born in that country – is leading the talks with the Taliban. He has hinted that a peace agreement could be reached within days.

We should all hope for an agreement ending the long war in Afghanistan. The U.S. has nothing left that we can accomplish that justifies keeping a large military presence there.

For the past 19 years we have spent massive amounts of time, energy and money in an attempt to make Afghanistan a stable country free of Islamist insurgent forces. Most significantly, more than 2,430 American troops have been killed in the war in Afghanistan since 2001.

The Taliban ruled the country at the time of the Sept. 11, 2001 terrorist attacks on the U.S. The U.S. invaded Afghanistan and with the help of Afghan forces ousted the Taliban government, which was protecting the Al Qaeda terrorist group that carried out the Sept. 11 attacks.

But despite losing power, the Taliban – along with Al Qaeda and ISIS fighters – have battled U.S., Afghan and allied coalition forces in the years since.

At the height of the war in 2011, there were about 100,000 U.S. troops in Afghanistan.

We have to be honest and admit that we cannot totally eliminate the Taliban, other Islamist groups and their influence in Afghanistan. So our best realistic option is to make a deal with the least bad elements and move on.

The argument against further U.S. troop withdrawals made by many – including Sen. Lindsey Graham, R-S.C. – is that we can’t leave Afghanistan because Al Qaeda may reconstitute there and plan another attack against the U.S.

“One thing I know for certain – Al Qaeda and ISIS will never be at the negotiating table,” Graham said.

Graham is right that the two terrorist groups should not be involved in peace negotiations. But that’s not a good reason to turn Afghanistan into the quagmire we choose to never leave.

Any deal we make with the Taliban is predicated on the idea that Al Qaeda and ISIS will not be allowed to operate in Afghanistan. If that provision is violated, we can always come back from the sky with a rain of Hellfire missiles to destroy any foothold the terrorists claw out.

MORE FROM OPINION

We have allowed Afghanistan to become a symbol of our resolve to never allow another Sept. 11. But that ignores the global nature of al Qaeda, ISIS and the Islamic Jihad terrorist group.

There are any number of other places equally or more likely to host a resurgence of terrorism that could target the U.S. or other nations.

Many of the terrorists who have fought in Afghanistan and Iraq are scattered around the Middle East and other parts of the world. They could avoid raising a flag anywhere and simply skulk in the shadows and allow their fighters to wreak havoc in their home countries and elsewhere.

ISIS leader Abu Bakr al-Baghdadi has been reported to be in Libya taking advantage of its status as a failed state, for example.

The U.S. military is deeply invested in not “losing” the war in Afghanistan. The current leaders of our armed forces have been fighting this war most of their careers. But there is no path to winning it and we need to accept that.

If there was a path to victory in Afghanistan, we would have made some demonstrable progress in the almost two decades we have been fighting there. The best and most painful description of our efforts I’ve heard is that we haven’t fought a 19-year war – we’ve fought the same war 19 times.

We rotate units in, and they have to learn their area of operations and the local forces and leaders located there. The U.S. troops do their best for one fighting season, then they rotate right back out. Rinse and repeat. Or not. And that is where we are today.

Since our strategy has denied us victory in Afghanistan, we must change our strategy. Staying in Afghanistan another 19 years or longer and doing nothing differently will at best maintain the status quo.

The fight against the Islamists has two facets. One is direct conflict with their terrorist and armed factions. The second is a battle to show the bulk of the Muslim world that this regressive and oppressive ideology is not their destiny.

Muslims can live in the modern world without compromising their identity and religion. Saudi Arabia serves as the “Custodian of the two Holy Mosques” and it is embarked on a modernization program that drives the Islamists crazy. The Saudis are showing a path forward from the 7th century vision of Al Qaeda and ISIS.

No one should trust the Taliban – members of the group are barbaric and evil. But they are resilient and they are staying.

So we should make a deal with the Taliban, while expecting they will not abide by it unless forced. We can offer some incentives for economic development, but also assume that endemic corruption will suck most of that dry.

The only thing that will prompt the Taliban to honor any agreement is fear of retribution if they do not. The advantage for us is we can bring that kind of pain in an asymmetric way rather than our current model of trying to control the situation on the ground.

The hellish terrain and tribal nature of Afghanistan has shown us exactly what it showed everyone from Alexander the Great, to the British to the Russians. You cannot conquer Afghanistan – you can only hope to lease some peace.

That is what we must do now. We must pay some people we rightly despise for a promise to keep some even worse people from using Afghanistan as a base.

We should have no illusions that a peace agreement in Afghanistan is a victory in the traditional sense. But it is also not a defeat, and sometimes that is good enough.

Chief: Alabama officer accused of fake shooting in alleged case of ‘stolen valor’

An Alabama police officer is accused of staging a shooting and making a fake a distress call last month in what his police chief called a case of “stolen valor” and “stolen honor.”

Birmingham Police Officer Keith Buchanan was arrested Thursday and charged with making a false report and discharging a firearm in the city limits, Al.com reported. He had already been placed on administrative leave when he was taken into custody.

Prosecutors believe Buchanan notified a police dispatcher that he was making a traffic stop just after 1 a.m. on July 21 near the city’s border with Tarrant. Minutes later, he allegedly put out a call about shots fired and never finished his radio transmission.

Dispatchers were unable to reach him for close to 30 minutes. A Tarrant officer found Buchanan’s patrol vehicle with bullet holes but couldn’t find him.

He was ultimately located uninjured a short distance away near railroad tracks.

Birmingham Police Chief Patrick Smith said Thursday that an investigation couldn’t corroborate Buchanan’s story of events. He was relieved of his duties last week.

“This officer did a lot on that night to present a false image of heroism,” Smith told reporters during a news conference. “He endangered the lives of the community by discharging his firearm, and also other officers, as they responded from all over the city to be at his side and do everything that they can to help.”

Smith said Buchanan’s actions only helped to tear down the trust built by the police department and the community. He called it a case of “stolen valor” and “stolen honor,” a reference to those who lie about heroic acts  to reap profit or gain accolades.

Buchanan faced discipline issues in 2016, 2015 and 2014, for filing a false report and keeping a stolen gun from a theft suspect for four months without notifying a supervisor, according to the news outlet.

Fox News’ Greg Gutfeld questioned Democratic presidential candidates’ strategy of attacking former President Barack Obama during this week’s debates, saying the former commander-in-chief is being judged by “extreme criteria.”

“Every idea 10 years ago that was seen as sensible is now judged by these extreme criteria that combine intersectionality and identity politics,” Gutfeld said Friday on “The Five.”

“Ok. Let me get this straight. Democrats hate Obamacare AND hated his immigration policies? What planet are they from?” MSNBC host Joe Scarborough tweeted.

The host of “The Greg Gutfeld Show” questioned the logic of the attacks, saying that they only justify President Trump’s points.

“They’re just proving that Trump was right. These problems already existed before Trump became president,” Gutfeld said. “He’s only been here for three years. Immigration and health care and deficits and trade — all this stuff was there and some of it for decades.”

Gutfeld added that while candidates may be right to judge Obama negatively, the reason they are doing so is because of shifting views within the party.

“So maybe they’re right to go after Obama,” he said. “But the reason why they’re going after him, right, is because … they’ve moved the goalposts.”

Rosselló officially resigns as Puerto Rico governor, Pedro Pierluisi to be sworn in as replacement

Outgoing Puerto Rican Gov. Ricardo Rosselló made his resignation official Friday and announced he will swear in veteran politician Pedro Pierluisi as the island territory’s new chief executive.

In an emailed statement, Rosselló’s office said Pierluisi, 60, did not need to be confirmed by both chambers of Puerto Rico’s legislature because he was named secretary of state, the next in line to be governor,  in a recess appointment earlier this week.

The statement did not say when Pierluisi would be sworn in but was sent a few minutes before 5 p.m., the hour when Rosselló had promised to step down.

Rosselló announced July 24 that he would resign after two weeks of protests over mismanagement and leaked chats that showed him and his top aides denigrating victims of Hurricane Maria and other Puerto Ricans.

Pierluisi was confirmed as the secretary of state Friday by a 26-21 vote, with one abstention, in the island’s House of Representatives. He was nominated by Rosselló. Both are members of the pro-statehood New Progressive Party.

NEXT IN-LINE TO BE GOVERNOR OF PUERTO RICO SAYS SHE HAS ‘NO INTEREST’ IN THE POSITION

The issue over who is rightfully governor will almost certainly go to court. Some believe that because the legislature wasn’t in session when Pierluisi was appointed, he is the secretary of state unless the legislature rejects him.

Others say he still needs to be confirmed by the island’s Senate. Adding to the confusion, one constitutional amendment states that everyone in line to become governor has to be confirmed by both the House and Senate, except for the secretary of state.

Senate President Thomas Rivera Schatz, a member of Rosselló’s party, said the outgoing governor “did not respect the demands of the people” and has vowed to vote against any nominee put forward by him. Rivera Schatz is seen as a possible candidate for governor in next year’s scheduled election. Several legislators have said they prefer Rivera Schatz over Pierluisi, but the Senate leader is a powerful figure deeply associated with Puerto Rico’s political and business elite, and his elevation to the governorship could re-ignite popular outrage.

Rivera Schatz has scheduled a Senate hearing on Pierluisi for Monday.

If Pierluisi doesn’t become governor, Justice Secretary Wanda Vazquez would have been next in line. An ally of Rosselló who is widely unpopular and the target of protests herself, she said last month she doesn’t want the job.

Several lawmakers have accused Pierluisi of having a conflict of interest because he worked for a law firm representing the federal control board that oversees the island’s finances. Many have called for the board to be abolished amid crippling austerity measures. Pierluisi’s brother in law is the board’s president.

“Who better than me to advocate for our people before the board?” Pierluisi said recently in opening remarks at a House hearing on his nomination. “Who better than me to facilitate the process that will force the board to leave? That is what we all want.”

The board was created by Congress to supervise the restructuring of more than $70 billion in debt after Puerto Rico declared bankruptcy. Pierluisi said he is against several austerity measures supported by the board, including laying off public employees and eliminating Christmas bonuses.

“The people want a change, and I don’t blame them,” he said.

Pierluisi formally served as the island’s non-voting member in Congress from 2009 to 2017 and was defeated by Rossello in the 2016 primaries. He served as justice secretary under Rosselló’s father, Pedro Rosselló, when the elder Rosselló was governor.

Several fans at a Baltimore Orioles game were escorted out of Camden Yards during Thursday’s game against the Toronto Blue Jays after unveiling a large banner supporting President Trump‘s reelection.

The red, white and blue banner read “Keep America Great!” and “Trump 2020.” It was rolled out in the eighth inning and was in full view for roughly 10 minutes before security came and had the fans take it down.

Fans chanted, “Take it down,” shouting at the men behind the banner, The Baltimore Sun reported.

Camden Yards has a policy on banners, according to the Orioles website. Banners may only be displayed before and after games and between innings.

“Banners are subject to confiscation if the content is commercial, political, and/or in bad taste according to the Orioles’ discretion,” the policy further states.

The banner issue arose with Trump still grappling with the backlash over comments he made about the city and Rep. Elijah Cummings, D-Md., whose district covers part of Baltimore. In a multiday tirade, Trump said the city was a “rodent infested mess” and a place where “no human being would want to live.” Some critics saw the remarks as evidence of racism. Trump, in turn, has denied being a racist” while standing by his criticisms.

Twin brothers pulled over in Ohio for near-identical license plates while en route to Twins Festival

It’s safe to say: good things come in twos.

Twin brothers driving near-identical vehicles were pulled over Thursday while driving to the annual Twins Day Festival in Twinsburg, Ohio, after state troopers suspected the pair each had the same license plate number.

Andy Baker told FOX8 he and his identical brother Chad were heading to the festival from Nashville, Tenn. in separate blue Teslas when state troopers stopped them, although they were not speeding.

One trooper suspected the twins had the same license plate, making him do a double-take. Both license plates appeared to read: “SUBJ TO” to the officer — but moments later he stood corrected.

“He says, ‘Do you know why I pulled you over? You guys have the same license plate,” Andy told the station. “I said, ‘Incorrect’.”

Two twin brothers, who were sporting matching vehicles, were pulled over Thursday afternoon while driving to the annual Twins Day Festival in Twinsburg, Ohio after state troopers suspected defective license plates. However, one is an O, the other is a zero.

The two twins are real estate investors, and “subject to” is a term used in the business. “One is an O, the other is a zero,” said Andy.

Last year, the twins were pulled over by Ohio authorities for speeding while driving to the festival at 58 mph — making this their second run-in with the law.

Last year, both Bakers were ticketed, but this time their luck held and the state trooper let them go.

“Nobody likes getting pulled over by police, we were both nervous, but it’s a great story and we will tell it all weekend.”

CNN anchor Jake Tapper criticized President Trump Friday over remarks Trump made at a rally about conditions in Baltimore, accusing the president of exploiting the city’s homicide rate to “score political points.”

During his Cincinnati rally on Thursday night, Trump told his supporters that the homicide rate in Baltimore is “significantly higher” than in El Salvador, Honduras, and Guatemala. He then asked the audience to suggest other places.

“Give me a place that you think is pretty bad, give me a place,” Trump told the crowd before someone shouted “Afghanistan.”

“I believe it’s higher than Afghanistan,” the president added.

Tapper, who was one of the moderators at CNN’s Democratic debates this week, slammed Trump for making sport about “dead Americans.”

“President Trump in a reelection rally in which he is, of course, running to again represent all Americans, last night seemed to make sport of Americans being killed in an area of the country that’s being run by his Democratic rivals,” Tapper began. “The president there using the homicide rate of an American city to try to score political points, actually asking for audience participation … Again, these are dead Americans that he’s talking about.”

“The Lead” anchor then invoked a tweet Trump posted in 2015 during riots in Baltimore following after the death of Freddie Gray in police custody.

When another Twitter user suggested that the Obama administration “drop” Trump into the city to show President Obama “how it’s done,” the then-real estate mogul claimed he would “fix it fast.”

“Now that he’s president, Mr. Trump seems to take no responsibility at all for the city he too represents in Washington,” Tapper said. “He doesn’t seem to be doing anything to quote ‘fix it fast.’ These homicide statistics are not fodder to be used for fun at rallies, they’re tragedies!”

“If these statistics indicate a failure of the leaders of Baltimore and the leaders of Maryland, and they do, they’re also a sign to Baltimore residents that their president is failing them as well,” Tapper added. “A man who had said he would ‘fix it fast’ just weeks before he announced that he was running for president, but someone today who seems more inclined to look at the homicide numbers as something to exploit on the campaign trail, almost gleefully.”
