Yesterday, Rep. Pramila Jayapal was acting chair of a House Judiciary Immigration and Citizenship Subcommittee meeting at which former ICE Director Tom Homan was testifying. Republican Rep. Andy Biggs offered Homan some of his time to respond to “anything” he had heard during the lengthy hearing. Homan took the opportunity to address comments made by Rep. Jayapal.

“I’d like to respond to acting chairman Jayapal and your comment about the Trump Administration moving money around for more detention beds,” Homan said. He continued, “I’d like to remind you under the Obama Administration we did that most of the years he was president. We moved money around DHS, it’s called reprogramming. We did that under the Obama Administration and I don’t remember any hearings on that.

“And also, I’d like to remind you that under the Obama Administration, I mean you’re quick to point out, the cages were built under the Obama Administration. I was there. Family detention, we had 100 family beds under the Obama Administration, we built 3,000 more. So when there was a surge in FY-14, FY-15 on the border, Congress was quick to give all the money we needed the detention facilities, transportation contracts. We reprogrammed money the majority of the years he was president. That was fine.”

When Homan was finished, Rep. Jayapal replied, “Since you addressed some comments at me I’ll just say that I didn’t like it under the Obama administration either.”

“But being honest with the American people,” Homan interjected.

“Excuse me,” Jayapal said, banging her gavel.

“You can’t point out faults in the Trump administration when it happened under the Obama administration,” Homan said as Jayapal banged the gavel again.

“That’s dishonesty,” Homan said. Bang!

“It’s pathetic and it’s sad,” Homan concluded.

Rep. Jayapal then reminded Homan that he had testified in favor of an Obama administration border effort in 2016.

“May I respond to that?” Homan asked.

“No, you may not,” Jayapal replied.

“Of course not,” Homan said.

And that’s just a warm-up to what happens in the second half of this clip. Rep. Jayapal asked Homan to “respect the chair’s authority” and when he interrupted again and called the hearing a “circus” she shouted his name and slammed the gavel down repeatedly.

The cynical part of me thinks Homan is doing this, at least in part, because Corey Lewandowski got favorable reviews from the White House for not showing much respect for his congressional interrogators at a recent hearing. Homan did appear on Fox & Friends this morning to recount his appearance.

On the other hand, the Democrats’ treatment of ICE, including claims that detention centers are “concentration camps,” has made this such a partisan circus that it’s impossible to fault Homan for saying so. Rep. Jayapal, it should be noted, was the co-sponsor of an “Abolish ICE” bill last year, so that may be one reason there appears to be no love lost here on either side.

The Senate voted today to put an end to President Trump’s emergency declaration on the border. Eleven GOP Senators joined Democrats in voting to end the emergency by 54-41. This is the second time the Senate has voted to override the president’s declaration. The first attempt was vetoed by Trump earlier this year:

Mr. Trump made the declaration so that he could unilaterally build a border wall despite the fact that Congress did not appropriate the funds for him to do so. Under the declaration, President Trump diverted funding from congressionally approved military construction projects to pay for border barriers.

The administration has so far reprogrammed about $6.1 billion in funding for the construction of border barriers.

In March, the Senate voted to reject the emergency declaration, but the president promptly vetoed the measure and instructed the Department of Defense to divert funds for a border wall. The House of Representatives failed to override the veto.

Twelve Republicans joined the Democrats last time around. The Hill points out that Senate Democrats can keep doing this every six months:

Under the National Emergencies Act, Democrats can force a vote on ending Trump’s emergency declaration every six months. The Senate previously voted to end it in February, with 12 Republicans voting with Democrats, but the House was unable to override a veto.

“It’s a vote the Democrats can insist on. I’m pretty sure there’s no Republican insisting on taking that vote again,” said Blunt, a member of GOP leadership, referring to the second vote.

Republicans have pushed to have Congress backfill the money transferred from the Pentagon, but Democrats are resisting those efforts. Meanwhile, construction of the border wall is going forward. The DoD announced earlier this month that about one mile of new border wall is being built per day:

At present, about a mile of border wall is being built each day, Jonathan Rath Hoffman, assistant to the secretary of defense for public affairs, told reporters at a Pentagon news conference today.

The Army Corps of Engineers is the executive agent for DOD’s border wall construction. In April and May, the Corps awarded about $2.5 billion in projects to build a portion of the wall that will span 129 miles in New Mexico, Arizona and California, Hoffman said.

As of this week, virtually all of that $2.5 billion has been obligated and is on contract, and officials expect to have the remaining $3 million obligated before the end of this month, he said.

The latest attempt to undo the emergency declaration will be vetoed once again and Democrats will try presumably try a third time to end it in another six months.

Trump stood before the General Assembly and laid down to the other nation’s leaders that if they want freedom, then they must embrace their own country and fight for Democracy.

“The truth is plain to see,” he continued. “If you want freedom, take pride in your country. If you want democracy, hold on to your sovereignty. And if you want peace, love your nation. Wise leaders always put the good of their own people and their own country first.”

“The future does not belong to globalists; the future belongs to patriots,” he said. “The future belongs to sovereign and independent nations who protect their citizens, respect their neighbors, and honor the differences that make each country special and unique.”

This was a very pointed statement as, outside of the United States and its battles with border security and Democrats who are pushing for open borders, other countries have also opened their borders to refugees who have, in turn, increased crime and violence and put a burden on the populace and its government.

Moreover, Britain is currently in a pitched battle with the European Union for independence.

Trump has set a very stark example of his words, which he called an “exciting program of national renewal.” This involves forcing other NATO members to pay their fair share instead of the United States carrying most of the cost, as well as the border wall itself.

Judging by the economic prosperity of the United States, it’s hard to argue Trump’s point. The U.S. has only increased in power while other countries considered to be more progressive have run into issue after issue thanks to their globalism.

There’s been some rapid fire developments involving President Trump’s new asylum rules, which require seekers to apply in the first safe country they come to. This is to prevent economic migrants from country shopping and abusing the already overwhelmed asylum process. Seems like common sense, right?

Well, if you are a judge on the 9th Circuit, not so much. Judge Tigar originally put a nationwide injunction in place. Then the 9th Circuit Court of Appeals overruled him. Then he simply put the injunction back in place. The Supreme Court had seen enough though and finally made a ruling vacating the entirety of the injunction and slapping Judge Tigar back down to earth.

While the decision was 7-2, this didn’t sit too well with Justice Sotomayor, an Obama appointee to the highest court. She ranted against her colleagues for the decision they made.

“Once again the Executive Branch has issued a rule that seeks to upend longstanding practices regarding refugees who seek shelter from persecution,” Sotomayor wrote in her dissenting opinion. “Although this Nation has long kept its doors open to refugees — and although the stakes for asylum seekers could not be higher — the Government implemented its rule without first providing the public notice and inviting the public input generally required by law.”

You know what this sounds like? A baseless emotional appeal. The vast majority of asylum seekers are not escaping persecution. For those that are, Mexico provides a safe haven for them to evade immediate danger. The point of asylum is not to go find a better life and opportunity. It’s to prevent bodily harm. Trump’s new policy, partnering with the Mexican authorities, does just that.

We simply do not have the resources to accept every single person who wants to claim asylum. Especially not when well over 80% of cases are fraudulent.

Sotomayor also slammed the Trump administration for requesting the Supreme Court to allow the rule when lower courts ruled against the move. “Unfortunately, it appears the Government has treated this exceptional mechanism as a new normal,” she wrote. “Historically, the Government has made this kind of request rarely; now it does so reflexively.”

“This is an extraordinary request,” Sotomayor continued. “Unfortunately, the Court acquiesces. Because I do not believe the Government has met its weighty burden for such relief, I would deny the stay.”

When you’ve got a judge going completely rogue in the 9th Circuit, flaunting even the decision of the appeals court, how exactly does that not meet the burden for the Supreme Court to step in? Heck, that’s part of the reason the Supreme Court exists. To be the final arbitrator of such issues.

Past that though, you know what you don’t see in Sotomayor’s angry dissent? An appeal to the law. Nowhere does she list out why Judge Tigar’s decision was proper in the first place. She doesn’t explain why the DOJ is wrong to seek relief in the face of an activist judge that won’t obey higher rulings. Instead, all you get are emotional ravings.

That may be fine for political punditry. It’s not fine for the Supreme Court. Sotomayor is a partisan actor. Nothing more. Every single decision she makes is based on whether it follows liberal orthodoxy. While the left complains about “right wing” judges simply following the constitution, the left wing judges on the court continue to scoff at the plain text of the law in order to bend the country to their preferred outcome.

So while Sotomayor may be taking aim at her colleagues, her statement says far more about herself than it does them.

Border apprehensions dropped 30% in August

Some good news on the border. Apprehensions of illegal immigrants dropped again in August, making this the third straight month of decline. From Politico:

Border Patrol arrested roughly 51,000 migrants in August, a 30 percent drop from the previous month…

Acting Homeland Security Secretary Kevin McAleenan addressed the falling arrests Wednesday during a press conference with Trump at the Oval Office. McAleenan said border arrests had been more than halved in August compared with the May peak, but told reporters that finalized statistics were being compiled and would be released next week.

Trump praised Mexico’s recent efforts to halt migration during the press conference, which centered on the response to Hurricane Dorian as it approached the Carolinas.

“The numbers are really good,” Trump said of the still-unofficial August arrest figures. “I want to thank again the country of Mexico. They have 25,000 soldiers now right protecting our border. And they’ve done a fantastic job, so we appreciate that very much.”

The 30% drop in August follows a 24% drop in July. However, the current numbers are still above average for the past two years. What’s significant about this drop is the timing. If you look at a graph of border apprehensions you’ll notice they follow a seasonal pattern, often peaking in the spring and then dropping off during the hot summer months. But the numbers often pick up again in August and September. As Politico notes, “Border arrests rose from July to August in eight of the last 10 years, which suggests the current drop is not related to recent historical patterns.” So while we’re not out of the woods yet, if we see one more month of declines (for September) then we’ll definitely be bucking a trend.

Most observers agree that Trump’s “remain in Mexico” policy has a lot to do with the change. That policy sends asylum seekers back to Mexico to await a decision rather than releasing them into the United States. In July the Texas Tribune reported there was some evidence that asylum seekers sent back to Mexico were choosing to give up and go home.

One potential sign that many are giving up: a government official in Washington familiar with the MPP initiative said an estimated 40 percent of the migrants returned to Juarez, Mexico, from El Paso did not show up for their initial court hearings. The official did not have permission to comment on the record and spoke on condition of anonymity.

One major reason people might be giving up: Gang violence connected to the drug trade has spiked in Mexico recently with a record-setting 33,000 murders recorded in 2018. Some Central American migrants are deciding they are better off heading home.

A majority of the people making asylum claims will not be found eligible because they are, in fact, economic migrants. You can see that in this PBS News Hour report published Wednesday. Also in this report, Sec. McAleenan says the number he is hoping to reach is about 20,000 apprehensions per month. That’s the point at which the Border Patrol will no longer trying to manage a crisis.

“Fox & Friends”: Trump never should have said that Mexico will pay for the wall

Via the Daily Beast, a clip that’s surprising in lots of ways — starting with the fact that F&F is famously one of the most pro-Trump shows on Fox. This isn’t Shep’s midday Hour of Glower. This is the program that used to have Citizen Trump call in every week before he became a candidate and riff for 45 minutes on the news du jour.

It’s surprising in that the subject matter is bad for POTUS no matter how happy a spin the hosts might try to put on it. “School construction among projects being cut to pay for Trump’s border wall” is a poisonous headline even when it comes with the footnote that the Pentagon plans to fund those projects eventually. Ainsley Earhardt does her best in the clip to bail Trump out, noting that if House Democrats are so bothered by military schools not being funded they can just pony up the dough to do so. But that would be tantamount to funding the wall directly: If Trump reprograms X number of defense dollars for the wall and Dems then replace that money in the defense budget, they’ve effectively cut Trump a check for the wall itself with the Pentagon as a middleman. They’d have rewarded him for his hardball tactic of reappropriating money for the wall unilaterally on national-emergency grounds over Democratic objections.

It’s surprising too that Brian Kilmeade and Steve Doocy are so skeptical of the “Mexico will pay for it” nonsense given that, at last check, it remains Trump’s official position. He’s spent two years backing away from the idea of the president of Mexico presenting him with a six-foot-long sweepstakes check for $25 billion or whatever, but his desperation to be seen as having kept a core promise to fans has led him to claim that Mexico will pay for the wall — either through fairer trade via the USMCA, through taxes on remittances, or what have you. To have “Fox & Friends,” of all shows, openly scoffing at the idea in front of an audience of Trump fans is shocking. The president hasn’t given friendly media permission to tell the truth about this!

Maybe most surprising is that Fox hosts who usually enjoy his favor are willing to risk his wrath at a moment when tensions between Trump and the network are higher than they’ve been since the start of the GOP primary debates in 2015. It was Kilmeade, in fact, who pressed Trump about that in a radio interview last week, asking him why he had a problem with Fox airing diverse viewpoints. Trump dodged the question and Kilmeade didn’t pursue it, but if F&F is now willing to call BS on the idea of Mexico paying for the wall, maybe the word has gone out to Fox hosts that they have a freer hand than they used to in questioning Trump dogma. For the moment, I mean: It’ll be high treason for them to reiterate this point on air a year from now, when the political stakes will be as high as they can get.

Louisiana Sen. John Kennedy has strong words for congressional Dems following staffers being banned from the border.

Staff serving the Democrat-led House Oversight Committee were given the heave-ho Wednesday due to previous bad behavior.

The Department of Homeland Security (DHS) has barred Democratic staffers from the House Oversight Committee from visiting Customs and Border Protection (CBP) facilities at the U.S.-Mexico border as part of a planned trip this week after committee staff allegedly were “disruptive” and refused to follow instructions during their last trip, Fox News has learned.

Committee Chairman Elijah Cummings, D-Md., had sent his staff to visit border facilities for “oversight inspections” last week and planned to send staff again to view Immigration and Customs Enforcement (ICE) and CBP centers.

But sources told Fox News that DHS has revoked access to CBP facilities for the upcoming visit, citing staff behavior that “interfered” with law enforcement operations — including refusing to leave one site after their scheduled window, skipping some tours and being “rude” to officers. A DHS official said that ICE visits will still be allowed this week, but with a two-hour time limit. One of those visits took place on Tuesday.

John laid into his across-the-aisle colleagues while speaking to FNC host Sandra Smith:

“Whether you’re a member of Congress or not, if you go to the border you have to follow the rules. It’s not the big rock candy mountain down there, it’s a law enforcement crisis. If somebody follows the rules and they’re a member of Congress, they should be allowed to go. But if they don’t they shouldn’t.”

That seems sensible.

The senator explained, however, that it’s not just an issue of behavior, but ideology:

“But let’s face what this is all about — not all of them, but many of my Democratic friends now believe in open borders. They think anybody that wants to come into America should be able to come in, they should be eligible for welfare, and food stamps, and free health care. And they should be able to stay on those programs as long as they want. And if you disagree with my Democratic friends, you’re a racist.”

Ever been on the pipe? John thinks Democrats have. Or, at least, they act like it:

“Now, they’re entitled to their opinion, but I’m entitled to mine and I think their argument is pernicious, I think it’s malign, I think it’s on-the-pipe crazy. I think vetting people who want to come into your country is not racist, it’s prudent, if for no other reason but public safety.”

He also asserted the Dems are full of it — they’re “playing games” with border issues, “[throwing] up roadblocks” under various guises, when they really just want open borders.

But, you, know, that’s what the pipe does:

“Now all of my colleagues on the Democratic side — I don’t want to, many of them are in good faith, but there’s some who go down there and they do everything they can to disrupt law enforcement. They hate border security, they hate Border Patrol, they hate ICE, they believe in open borders, and if you disagree with them you’re a racist and I just think that’s on-the-pipe crazy.”

Blue state politicians certainly have redirected their leadership in terms of border control and national security. Not so long ago, they had a guy in office who was, apparently, a stranger to pipin’ hot madness. I give you a Democrat who has in no way ever done drugs — Willam Jefferson Clinton:

The Department of Homeland Security made a decision this week to ban Democrat staffers working for the House Oversight Committee from visiting border facilities. This came after reports of disruptive behavior and a refusal to follow rules on previous trips.

The Department of Homeland Security (DHS) has barred Democratic staffers from the House Oversight Committee from visiting Customs and Border Protection (CBP) facilities at the U.S.-Mexico border as part of a planned trip this week after committee staff allegedly were “disruptive” and refused to follow instructions during their last trip, Fox News has learned.

Committee Chairman Elijah Cummings, D-Md., had sent his staff to visit border facilities for “oversight inspections” last week and planned to send staff again to view Immigration and Customs Enforcement (ICE) and CBP centers.

But sources told Fox News that DHS has revoked access to CBP facilities for the upcoming visit, citing staff behavior that “interfered” with law enforcement operations — including refusing to leave one site after their scheduled window, skipping some tours and being “rude” to officers. A DHS official said that ICE visits will still be allowed this week, but with a two-hour time limit. One of those visits took place on Tuesday.

“Due to the operational burden placed on the field by their refusal to comply with instruction during last week’s STAFFDEL [staff delegation visit], CBP pulled the trip in which more site visits were to take place at CBP and ICE facilities this week,” a senior DHS official told Fox News in an email Wednesday. “DHS communicated to the committee that due to their conduct, CBP could not support visits from the committee this week.”

Some will get upset about this but I’m fine with it. CBP and ICE can not do their jobs properly with Democrat staffers running around politicizing everything and refusing to listen to instructions and follow schedules. These facilities have limited resources and the agencies running them hold legal liability for those in their care. Staffers were said to have been flouting the regulations on taking pictures, overstaying tours, showing up late for others, and making demands of DHS that were not disclosed in earlier communications.

Democrats are claiming this hampers their oversight role but that’s nonsense. Any Congressional member is still perfectly capable of getting on an airplane and visiting themselves. There’s no mandate that the administration must accept whoever Congressional members send down to “inspect” things.

Further, nothing Congress is doing has been attempted in good faith. They’ve routinely lied about conditions at the border while ignoring the impossible position DHS has been put in. Meanwhile, they’ve sought to stifle funding that’s desperately needed to house people properly, all while they complain people aren’t being housed properly. Comparisons to Nazis and the Gestapo have also been made Congressional members in public settings.

There’s no reason that DHS should go out of its way to accommodate people who refuse to treat them fairly in return.
