The Hill just republished a story about migrant children quietly being adopted by U.S. citizens after their biological parents are deported. The article features a young El Salvadoran woman named Araceli Ramos. She ran away from her abusive husband, taking their daughter Alexa with her, to seek asylum in the U.S. Usually, a woman fleeing from abuse would be granted asylum, however, due to outstanding criminal charges against her, she was refused. The story can be viewed here.

Araceli was sent to a detention facility and her daughter was placed in foster care with a U.S. couple in Michigan. After several months in detention, Araceli, unable to find an attorney, was deported. She claims that an immigration agent forced her to sign a waiver to leave her daughter behind.

Araceli tried to get her daughter back, but the foster family had grown fond of her and allegedly ignored repeated requests from DHS to return her. According to The Hill:

When officially ordered to return Alexa to her mother in December of 2016, the foster parents, Sherri and Kory Barr, sued claiming that she would be abused if returned home. A Michigan judge granted them guardianship.

After pressure from social media and the Salvadoran government for the family to be reunited mounted, the Department of Justice (DOJ) weighed in, saying that “the Barrs obtained their temporary guardianship order in violation of federal law.”

The Barrs’ attorney and the Michigan judge were also found to have violated federal law by not notifying Alexa or her mother about the guardianship proceedings.

Alexa was finally returned to her mother in February 2017. Once returned home, Alexa took time to adjust to living in El Salvador, initially pining to return to Michigan and refusing to eat or play.

In a statement to The Hill, a DHS spokeswoman said that all of the cases the AP reviewed came under the Obama administration, emphasizing that all of the adoptions were done legally.

It looks like human rights warrior and 2020 presidential candidate Rep. Joaquin Castro (D-TX) missed that line in the story. He’s been very busy these days campaigning to be Sen. Elizabeth Warren’s (D-MA) running mate and immediately took to twitter to blame Trump.

The Trump Administration intentionally separated kids from their parents and then put the kids up for adoption — permanently separating them. This is a human rights violation committed by the United States government.

And it looks like journalist failed to read carefully as well. She went so far as to say that “forcibly transferring children of the group to another group” is among the acts the United Nations considers to be genocide.”

Yikes!

One of her followers responded: “TRUMP/GOP guilty of GENOCIDE”

After several responses, one of her followers actually read the story and pointed out the line they’d all missed:

Will Joaquin apologize? Probably not. He’ll just let people go right on thinking that Trump is a violator of human rights because it serves his agenda. Remember when he posted a list of the largest GOP donors in Texas a while back. Rather than apologize, he doubled down. That’s just how he rolls.

What started as a textbook example of executive lawmaking by fiat that turned into a textbook case of results-oriented judicial rulings is now headed to the Supreme Court.

Of course, I’m talking about the Deferred Action for Childhood Arrivals, or DACA, program.

The executive lawmaking by fiat took place in 2012 when President Obama basically gave the finger to Congress and announced that he was going to contravene black letter law and exempted some illegal aliens from being eligible for deportation.

The method he used for this was not an Executive Order or the APA rule-making process, it was established by a memo former DHS Secretary Janet Napolitano sent out to her field staff directing them to not deport illegal aliens who allege that they were brought to the US as children. That’s it. That was the depth of the analysis and consultation. A. Memo. A similar program, Deferred Action for Parents of Americans, was ruled unconstitutional by a federal appeals court which should have been a hint that it wasn’t on the up-and-up. But when Jeff Sessions got around to pulling the plug on DACA, lawfare ensued and the administration was told it could not rescind the Napolitano memo.

Just stop for a moment and consider this. Federal courts literally told the Trump administration that they could not rescind a memo written five years and three Homeland Security secretaries earlier. Logically, this means a cabinet secretary’s memo is more powerful than an actual law because it takes no consensus to issue it and it can’t be withdrawn when management changes.

The Trump administration appealed this to the Supreme Court and the case is to be heard in November. Today, however, we got a glance at the argument.

Justice Department lawyers told the Supreme Court on Monday that President Trump acted lawfully in September 2017 when he decided to end an Obama-era program that protects young undocumented immigrants from deportation.

In a legal brief submitted to the court, the lawyers asserted that the president was fully within his rights to eliminate the program, known as Deferred Action for Childhood Arrivals, or DACA, and said the lower courts were mistaken when they said Mr. Trump’s action almost two years ago was arbitrary.

The Department of Homeland Security “correctly, and at a minimum reasonably, concluded that DACA is unlawful,” the lawyers argued, disputing the conclusions by the lower court judges about the three reasons the administration gave for ending the program. “None of those three grounds is remotely arbitrary or capricious, let alone all three.”

The Supreme Court is scheduled to hear arguments about the fate of the program in November. The justices could decide the case next spring or summer, just as the presidential election campaign is in full swing.

The government’s brief, filed late Monday, is the first salvo in what could be one of the biggest legal tests of the president’s immigration agenda. The outcome of the case will probably determine whether Mr. Trump can make good on a central campaign promise.

I think that it is a safe bet that this version of DACA is dead. Given the way the Supreme Court has ruled, it is very difficult to see the same majority that has upheld President Trump’s actions on immigration so far suddenly decide that this administration must continue to carry out the policies of the previous one given the lack of fact finding or public comment or anything more than one person signing a memo.

That, of course, creates a whole new series of problems for Democrats and Republicans. The Democrats threw away a perfectly good chance to reach an permanent DACA settlement early in Trump’s presidency but decided they would much rather have the issue to fund-raise off from than having a solution. The House Democrats will have to propose some kind of bullsh** bill, the question then being will they overreach and propose something that can’t pass (energizing the open borders types but putting red and purple district Democrats on record on a massive amnesty bill)? Or will they actually try to find a bill the Senate can live with? That, of course, was a rhetorical question. For the Republicans the question is do they hold firm or cave? And will President Trump create his own DACA once the Obama one is dead or will he start deporting DREAMers?

Because it is an election year, neither side will have much of an incentive to compromise. And, to tell you the truth, I’ve sort of lost sympathy for the whole DREAMer nonsense and I suspect that many in the GOP and in the country at large are also close to having their give-a-sh** circuit breaker trip along with me.

Immigration Enforcement on the Job Site Works
It looks like the Democrat canard, “Americans just won’t do those jobs,” has been put to rest—and it didn’t take long at all. As I predicted, rounding up illegals working in American facilities and sending them home would likely have a positive effect on the prospects of some American workers. From yesterday’s WAPT Channel 16 ABC News

FOREST, Miss. —
A Mississippi food plant that was part of one of the largest immigration raids in U.S. history held a job fair Monday.

Looks like Koch Foods is trying quickly make up for that sudden worker shortage. As I predicted, this would cause the hiring of more Americans and likely have an impact on wages.

From USA Today

Kamerio Whitley, a resident of the nearby town of Morton, spoke to reporters after he left the building. He said there were several positions available at the plant, including forklift operators. Whitley said he applied for a job working at the plant’s rehang table, where workers hang frozen chickens. The job starts at $12 an hour, which is decent pay for the area, Whitley said. “That’s not bad to start, and it can always go up,” he said.

“Decent pay for the area…That’s not bad to start, and it can always go up.” Indeed. My bet is that it will indeed go up. If President Trump continues these type of operations that protect American workers by rounding up illegal aliens and sending them home, then there will be somewhat of a labor shortage. That will cause a number of things to happen:

—Increases in starting wages to get Americans off the bench and back into the workforce.

—This might cause some modest price increases, which in turn will…

—Cause some investment in technology to support those higher wages.

—Workers re-entering the workforce will take some pressure off of the “safety net,” translating into Federal & State budget savings (which will, of course, be promptly spent by both sides to purchase more votes).

By attacking multiple issues simultaneously, President Trump has had the effect of throwing three strikes in a row in bowling, where he gets more “points” for each policy he executes than he would if these policies weren’t all mutually supportive. And just think, it all started with some modest regulatory and tax reform.

When the smartest minds in California are this ignorant of the laws…

Kamala Harris is having a tough week. She was shown to be lying over the Michael Brown anniversary, was challenged and embarrassed by a nursing-home denizen, and her campaign is struggling mightily it seems in getting donations to keep it afloat. Now she has weighed in on another Trump proposal, and it only adds to her dysphoria.

The latest policy initiative to get the Dems in a dander is to instill a hardline restriction on the number of federal benefits immigrants can retain. It is an effort to get these residents off of government dependency and have them actually become a contributing member of the society that sought out to join. There is some confusion with the angry reactions from Democrats on the issue.

One of their prevailing arguments of late has been that immigrants are workers who actually provide net gains for the country by arriving. Now when the administration has announced they are holding firm on these built-in restrictions the Democrats are singing not only a different tune but one in a completely different genre. The new claim is immigrants will now be forced off of certain vital needs, which were previously claimed to be met with their positive-net work economic influence. It is outrage du jour.

In a mostly scathing article on the policy Think Progress detailed all of the negatives this would have on the immigrant community. The outlet quoted the National Immigration Law Center: “This news is a cruel new step toward weaponizing programs that are intended to help people by making them, instead, a means of separating families and sending immigrants and communities of color one message: you are not welcome here.”

Kamala has come forward to of course label this policy as the latest proof of Donald Trump’s racism.

California Governor Gavin Newsom has also vilified Trump over this enforcement. He invoked the need of these programs for their “basic survival”, in direct opposition to the claims they are contributing members to our society. Of course, for Newsom to say this brings up all of the lack of assistance he has been able to provide for the mounting homelessness problem sweeping his state. That is — actual citizens of this country.

All of these players — Harris, Newsom, immigration policy centers — have done one of two things here; displayed their arrogant ignorance, or they are outright lying. Neither is a positive. What the Trump administration is doing here is not instituting some new executive order — they are merely enforcing standing immigration law. This particular legislation has been made to see to it that those arriving to this country are doing so with the goal of assimilation and contribution.

And this has been the case for decades. Harris and Newsom are displaying rampant obliviousness about something that was passed in 1996, signed into law by William Jefferson Clinton. With Newsom this is hardly a surprise. He has shown a particular contempt for many federal guidelines on immigration, from establishing sanctuary cities to refusing to work with immigration officials and vilifying ICE. Whether unaware or hostile to this law, it is right in line with his character.

For Kamala, in particular, this is a bad look. As former Attorney General of California, she should be apprised of this type of legislation. She refers to Trump being ignorant of the history, yet here she is displaying rampant ignorance about federal law, and one pertaining to her home state. For a candidate trying to lay claim to the White House this becomes just another troubling component to her campaign.

Here we go for another round of court battles to the Supreme Court.

In what has been one of the options President Trump has been thinking about using to add the ” ARE YOU A CITIZEN OF THE UNITED STATES” question to the census will become reality by Executive Order later today.

According to NBC News

President Donald Trump is expected to announce an executive action on getting the citizenship question added to the census, according to an administration official.

Trump announced on Twitter Thursday morning that he will hold a press conference in the afternoon to discuss his latest efforts at including the citizenship question as part of the census.

Here is the tweet from the President that the NBC story above refers to.

This action, of course, will need to be raced back to the Supreme Court Of The United States to see how Chief Justice John Roberts can twist common sense once again to screw something up.

While I’m not a fan of ANY President using the Executive order willy nilly this case seems pretty simple to me. The Executive Branch has to make sure that a census goes out every TEN years. That a question on there asking simply if you are of a citizen of this country is causing people like Nancy Pelosi to lose what little is left of her mind is odd. Put the question on the damn thing.

More will be coming from this today in regards to how Trump plans to rattle Zuck and Jacks chains I’m sure so get ready to rumble America. This summer is just heating up.

Please watch the following 30 second clip of House Speaker Nancy Pelosi criticizing President Trump’s planned Immigration and Customs Enforcement (ICE) raids on illegal immigrants. She spoke at a “Speaker in the House” event hosted by New York Rep. Grace Meng. The deportation operation was scheduled to take place last weekend, however it was called off after information about specific locations was leaked.

The plan had called for about 2000 illegals who have failed to comply with court orders to leave the U.S.  Each had been offered legal assistance and a 30-day pass in February.

Here is what Pelosi had to say:

When I saw that the president was going to have these raids, I mean it was so appalling. It’s outside the circle of civilized human behavior to just be kicking down doors, splitting up families, and the rest of that, in addition to the injustices that are happening at the border. We have legislation to go forward to address those needs, but in terms of interior enforcement, what’s the – what’s the point?

The most powerful Democrat in the U.S. government, the leader of the House of Representatives, which is charged with passing legislation asks “what is the point” of enforcing U.S. immigration laws?

Because we are a nation of laws Nancy and generally, we follow the existing laws until Congress passes new ones.

In the video below, Pelosi discusses her Friday evening phone call with the President. She said she told him that,  “a violation of status is not a reason for deportation.” She told her audience,

That’s just not so. If you have some case you want to make about somebody who’s been accused … that has nothing to do with violation of status because then we’re talking about over 10 million people who may be subjected to this treatment, and what we need there is comprehensive immigration reform with a path to citizenship.

Later on she added, “You cannot be ignoring the rights of immigrants to our country.”

Actually Nancy, a violation of status is a reason for deportation.

Pelosi’s comments were echoed by 2020 hopeful Sen. Bernie Sanders (I-VT) in an appearance on CBS News’ “Face the Nation” on Sunday.

Host Margaret Brennan asked, “There are ICE raids set to start Sunday morning. Estimates of some 2000 people or so who will be targeted, is this appropriate?”

Sanders replied, “No, it’s not. It is absolutely not appropriate.”

Brennan questioned him further. “But specifically on this point, the two thousand that are supposed to be targeted haven’t shown up for a court date so essentially they’re- they’re not following the asylum process. The legal standards when they’re here. So should they be prosecuted, should they be deported?”

Bernie responded, “I don’t- I don’t like this deportation thing at all and I think Trump uses this as a beginning to do worse things to come.”

Two long-time lawmakers have criticized the President for enforcing U.S. laws? One questions the point of the laws. The other says he doesn’t “like this deportation thing at all.” And many others share this view.  They just don’t state it quite so bluntly.

Just one question. If lawmakers are allowed to pick and choose which laws to enforce, what’s the point of enforcing any laws?

Occasionally, a story just writes itself and is done by a tweet.

I think it is safe to say that Donald Trump, who is in his 70’s, has taken to twitter like a 20 something and with the same zeal. Even before he was President, Trump loved to tweet out his comments on whatever the topic of the day was. Gone are the days of seeing the POTUS account tweet something and look for the tag B.O. at the end of a tweet to see if it was Barrack Obama, you know Trump is doing all the tweeting.

So it is not really a surprise that he has carried that penchant for tweeting over to his Presidency and people both love it and hate it with a passion. This tweet from yesterday I feel perfectly sums up his style of pushback using Twitter as his main weapon.

I know it is not at all “Presidential” to hit back at the Corrupt Media, or people who work for the Corrupt Media, when they make false statements about me or the Trump Administration. Problem is, if you don’t hit back, people believe the Fake News is true. So we’ll hit back!

President Trump does not want to go through the normal channels of how to respond to something, he wants to hit the twitter app and push to 280 characters as fast as he can to roll back the narrative. This tweet shows that he is readily admitting this is not how POTUS business has been done before and he really doesn’t care.

He is going to fight back. Case in point.

Currently, the media has been running wild about the deal announced to avoid tariffs on Mexico made by POTUS in a tweet Friday. The New York Times ran this piece Saturday about it Mexico Agreed to Take Border Actions Months Before Trump Announced Tariff Deal. The crux of the story is that this was brokered back in March so big whoop dee doo.

No matter how you feel on tariffs is not the point at this moment. Here we were in June and they still had not implemented the measures to slow down illegal immigration on the Mexcian southern border. Trump just sped that process up to get it going ASAP.

So instead of waiting for others in the media to fact check with NYT, Trump took to Twitter for these statements…

If President Obama made the deals that I have made, both at the Border and for the Economy, the Corrupt Media would be hailing them as Incredible, & a National Holiday would be immediately declared. With me, despite our record setting Economy and all that I have done, no credit!

When will the Failing New York Times admit that their front page story on the the new Mexico deal at the Border is a FRAUD and nothing more than a badly reported “hit job” on me, something that has been going on since the first day I announced for the presidency! Sick Journalism

Now I fully understand why people don’t like this. We generally like our Presidents very polished and measured in how they act and what they say. President Obama was very smooth and was very adept at smacking people down but making it sound peachy, even when he was kinda calling you a racist. This isn’t Obama’s first foray into a racially charged situation.

Trump is 100% the opposite and his loyal base would have it no other way.

Does this drive his communications staff bonkers? No doubt. Could this blowback on him? Sure.

Yet we currently have a President who has been more accessible than any other in my memory, in front of a camera, on the radio or on his weapon of choice. Twitter.

America will never be the same.

Last week, the House passed the American Dream and Promise Act which “seeks to provide permanent status not only to undocumented immigrants brought to the U.S. illegally as minors, known as Dreamers, but also to those living in the U.S. under the Temporary Protected Status (TPS) and Deferred Enforced Departure (DED) programs.”

A group of Democratic Senators have called on Senate Republicans to do the same. They say the U.S. has “an obligation” to pass amnesty. Sens. Dianne Feinstein (CA), Chris Van Hollen (MD), Ben Cardin (MD.) and Tim Kaine (VA) have “introduced the Safe Environment from Countries Under Repression and in Emergency (SECURE) Act, which would allow qualified Temporary Protected Status (TPS) and Deferred Enforced Departure (DED) recipients to apply for legal permanent residency.”

Feinstein believes these individuals have “earned the right” to be protected. A statement which appears on her website reads, “The Senate needs to follow the House’s lead and pass these important protections for immigrant families who have been living and working in the United States for decades. After fleeing wars and natural disasters, these families have established deep roots in our communities and earned the right to remain together here in the United States.”

Van Hollen issued a statement, which said: “The House has done its job for Dreamers and TPS recipients – now the Senate must do the same. These families, including nearly 30,000 TPS recipients in Maryland, have lived here legally for years. We cannot in good faith send them back to some of the most dangerous places in the world. This legislation, coupled with critical protections for Dreamers, will give these families certainty and security.”

Cardin went even further saying that the U.S. has an obligation to act.

The Senate must act and the president must sign into law protection for Dreamers, who mostly have known no other country but America, as well as Temporary Protected Status (TPS) and Deferred Enforced Departure (DED) recipients, many of whom have been here for decades as violence and repression continue to rage in their home country. These individuals have lawfully lived and worked in the U.S. as our neighbors, as they sought refuge in the U.S. We have an obligation to take action and give needed predictability and safety to people who are in an uncertain status. We need to stand up for the American values of compassion and diversity that have made this country stronger.

“It’s on the Senate to do the same,” said Kaine. “These people are here because of circumstances beyond their control, and they have become established, productive members of our communities who deserve to remain in the country they now call home.”

Temporary Protected Status (TPS) is a program which was created under the Immigration and Nationality Act of 1990 (INA). It provides “temporary legal status to illegals who cannot return to their country of origin due to ongoing armed conflict, natural disaster, or other extraordinary reasons.”

But why is it the “obligation” of the American taxpayer to protect people who have entered the U.S. illegally? Because it will guarantee that Democrats maintain power for years to come? The cost to our country is enormous and it is straining our resources.

In an earlier post, I wrote about the budget agreement reached over the weekend in the California state legislature which will provide full health benefits to 90,000 illegals. In the meantime, they are imposing the “individual mandate” on U.S. citizens who do not purchase health insurance, in most cases because they can’t afford to do so, to pay for it. Let’s take care of low-income, uninsured Americans first, why don’t we, before taking care of illegal immigrants.

Koch Brothers Never Were Conservative

Sarah Palin was right about “Crony Capitalists.” The Headline reads, “Koch Network Willing to Back Dem. Candidates In 2020.” Well No Kidding!” In the June 7th issue of National Review Online, Jack Crowe announces what we’ve all known for a long time (well, at least for the 31 months since Donald J. Trump’s unexpected thrashing of the criminal crone from Chappaqua) the Koch Brothers never were conservatives.

Americans for Prosperity (AFP), the political arm of the billionaire Koch brothers’ sprawling influence network, which has traditionally confined its support to Republicans, plans to pursue a “bipartisan approach” when determining which candidates to back in the 2020 election cycle.

Crowe elaborates

In a memo distributed to employees Thursday and obtained by CNBC, AFP CEO Emily Seidel announced that the group will evaluate candidates entirely based on their support for its preferred policies without respect to party affiliation.

“AFP or AFP Action [the group’s super PAC] will be ready to engage contested U.S. Senate, U.S. House, and state-level primary races, including Republican, Democrat, Independent or otherwise, to support sitting legislators who lead by uniting with others to pass principled policy and get good things done,” Seidel’s memo said.

It gets better yet. Here is the money quote (emphasis, all mine)

The Koch network, collectively referred to as “Stand Together,” has struggled to find a political home since President Trump took office.

Imagine that! A political group that refuses to assist, nay actively undermines President Trump’s signature campaign issue: Immigration both legal and illegal, struggling “to find a home.”

If you want a home, I suggest you come out and actively support President Trump’s agenda. Here’s a challenge for you. How about you match Brian Kolfage’s GoFundMe effort, with a direct donation of your own to his citizen-supported Border Wall Program. If you do that, you’ll likely find the welcome mat out for you as you board the Trump Train. If you can’t bring yourself to help actively protect your fellow Americans, I suggest that you go ahead and come out of the closet and affiliate with the Democrats.

In a continuing campaign of unconstitutional lawfare against this administration, yet another leftist DISTRICT Judge believes he can decide U.S. National Immigration Policy.

A federal judge on Monday blocked an experimental Trump administration policy that requires asylum seekers to wait in Mexico while their cases make their way through the immigration court system, a major blow to President Trump as border crossings have surged to their highest point in more than a decade.

U.S. District Court Judge Richard Seeborg in San Francisco enjoined the Migrant Protection Protocols policy days after outgoing Homeland Security Secretary Kirstjen Nielsen pledged to expand the program. The policy began in January.

This obviously unconstitutional ruling prohibits President Trump’s program of requiring asylum seekers to wait in Mexico for their hearings, as opposed to allowing them to disappear into the interior of the United States, never to be seen again—unless caught committing a murder or a kidnapping. As I’ve noted here, here and here, the leftists are all about lawfare.

It’s time President Trump used some lawfare of his own—aggressively. This could be the case where the President makes his stand. He could issue a Presidential Finding that “hereby determines that the Federal District Court in San Francisco does not have standing to issue such an enjoinment of Federal Protocols affecting the entirety of the United States Immigration Policy. Moreover, the lowest court that has standing to make such a determination is the DC court of Appeals.”

Of course, there will be the usual caterwauling from the left and their enablers, the Vichy Republicans. But with over 1 million illegal aliens already tagged for deportation, but lost in the interior, we certainly can’t afford to add to that number to the tune of over 100,000 per month.
