Lawyers for Massachusetts woman who encouraged boyfriend’s suicide appeal to Supreme Court

Lawyers for the Massachusetts woman who was convicted of involuntary manslaughter for encouraging her suicidal boyfriend to kill himself urged the U.S. Supreme Court on Monday to throw out her conviction because it violated her right to free speech.

Michelle Carter’s lawyers called her conviction in Conrad Roy III’s death “unprecedented,” saying it raises crucial questions about whether “words alone” are enough to hold someone responsible for someone’s suicide.

“Michelle Carter did not cause Conrad Roy’s tragic death and should not be held criminally responsible for his suicide,” Daniel Marx, one of her lawyers, said.

Carter was jailed in February after Massachusetts’ Supreme Court unanimously upheld her conviction in the death of the then-18-year-old Roy. Carter, now 22, is serving a 15-month sentence.

The court agreed with a judge who found that Carter caused Roy’s July 2014 death when she told him in a phone call to get back in his truck as it was filling with carbon monoxide and didn’t call Roy’s family or the police.

The phone call wasn’t recorded, but the judge focused on a text message Carter sent a friend two months later in which she said Roy had gotten out of the truck because he was scared and she told him to get back in.

TEXAS MAN FATALLY SHOOTS HIS SISTER BEFORE TURNING GUN ON HIMSELF IN SUSPECTED MURDER-SUICIDE

Carter’s lawyers said in their Supreme Court petition that the Massachusetts justices acknowledged that not everyone who verbally encourages someone to take their own life should be prosecuted but provided “no guidance to distinguish sympathetic cases of assisted suicide from culpable cases of unlawful killing.”

Arizona man fatally stabbed teen listening to rap because he felt ‘unsafe,’ police say

Witnesses told police that Michael Adams, 27, walked up to a 17-year-old who was listening to rap music and stabbed him the throat, Phoenix’s Fox 10 reported. The teen – identified as Elijah Al-Amin –reportedly stumbled outside the Circle K and died.

Adams allegedly told officers he felt “unsafe” by the teen’s choice of music. He allegedly said he had been attacked before by people listening to rap, the station reported.

He allegedly said he wanted to prevent an attack, but admitted the victim did nothing to provoke him.

The Arizona Department of Corrections said Adams had been released from jail two days before the alleged stabbing. Adam’s lawyer told Fox 10 that his client has a history of mental illness and was released from jail without medication.

Washington man severely burned after saving 8-year-old niece from fire says ‘I’d run back in there and do it again’

A Washington man, who has been hospitalized with serious burns all over his body after he rushed into a burning home to save his 8-year-old niece, told reporters from his hospital bed that he would do it again.

Derrick Byrd, 20, of Aberdeen, which is about a two-hour drive from Seattle, told KOMO News, “I’d do it again, I really would.”

He added, “I’d run back in there and do it again even if I got burned worse or died.”

Byrd was airlifted to a nearby hospital with second and third-degree burns on his face, back and arms after the Thursday morning fire in his home, the station reported.

Byrd said when the fire broke out he immediately tried to help his sister get her three young children out of the home through the second-floor window.

“I ran downstairs even though I got burned, started catching the kids,” he said.

Byrd told the station he caught his 6-year-old nephew and his sister’s baby but her 8-year-old daughter, Mercedes, was too afraid to jump.

He said when his sister fell off the roof, Mercedes fell back into the burning room.

“She was screaming my name,” Byrd told the station. “So, I wasn’t just going to let her sit there. I wasn’t going to let my niece die.”

He said he ran upstairs, “pushed right through the fire” all while he could feel it burning him.

“Then, I got her, I took my shirt off and put it around her face so she wasn’t breathing any smoke and then I just carried her out, as fast as I could,” Byrd told the television station.

He added, “Even though I got burned, I really didn’t care though. I’d rather me get burned than her. She’s young, you know. She’s still got a lot of stuff going for her. She’s a good kid.”

Crews also airlifted Byrd’s niece and 6-year-old nephew to a local hospital.

When asked what his reaction was to people calling him a “hero” Byrd told the station, “I can’t say a hero. I just say I care for my niece and nephew. I wasn’t going to let them die.”

Alabama man arrested after biting off woman’s finger, police allege

Police in Alabama said they arrested a man early Sunday morning after he bit off a woman’s finger during a fight.

Lt. Michael Johnson with the Huntsville Police Department told Fox News police got a call about a “physical altercation” between Shay Michael Thome, 48, and his wife, who was threatening to leave.

Johnson said the couple reported there’d been some “tension” in their relationship and Thome’s wife was in the process of gathering her stuff to leave when the incident happened. Police said the couple was arguing for a couple of days prior to the fight but she did not report any domestic violence to police in the days prior to that night.

Johnson told Fox News that Thome came home while his wife’s friend was helping her gather her belongings. He said Thome grabbed her friend’s hand and bit off her pinky finger.

Police said Thome then started “assaulting” the friend “with his fists.” Johnson said Thome’s wife came running into the room and was trying to get him off her friend when he bit his wife’s hand as well. Johnson said Thome “did not cause a serious injury” to his wife.

“This is probably one of the most unique assaults we have ever seen,” Johnson told Fox News, calling the incident “wild.”

Family in shock after toddler daughter of Indiana cop dies in fall from grandfather’s hands on cruise ship, reports say

An Indiana family is in shock after a 1-year-old girl — daughter of a South Bend Police Department officer — slipped from her grandfather’s hands and fell to her death from the 11th story of a cruise ship docked in Puerto Rico, police said Monday.

“They’re in shock,” Police Sgt. Nelson Sotelo told The Associated Press, noting that the family of the child will remain in the U.S. territory until the investigation is complete.

He said officers have not yet been able to interview any relatives.

The South Bend Police Department said in a statement, as USA Today reported, that the girl was the daughter of Officer Alan Wiegand: “The South Bend Police Department offers its sincerest condolences to Officer Alan Wiegand and his family during this difficult time following the tragic loss of their child while in Puerto Rico. The department asks the community to pray for the entire Wiegand family as they grieve and to respect their privacy.”

Authorities said the girl was traveling with her parents, two siblings and two sets of grandparents aboard the Freedom of the Seas, which docked in Puerto Rico on Sunday after a week-long trip through the Caribbean.

The death occurred Sunday afternoon at the Panamerican dock in the capital of San Juan.

Puerto Rico Ports Authority spokesman José Carmona told the AP that the family was gathered in or near a dining hall on the 11th floor and that the grandfather sat the toddler on the edge of a window and apparently lost his grip. He said officials are investigating whether the window was already opened or if someone had opened it.

Sotelo said the toddler’s maternal grandfather, Salvatore Anello of Valparaiso, Indiana, is under investigation. He said the rest of the family is from Granger, Indiana.

Royal Caribbean Cruises called it a tragic incident and said it was helping the family. A spokeswoman said the ship departed Puerto Rico on Monday for St. Maarten on a new itinerary and declined further comment.

A teen was arrested Monday in the Texas Fourth of July road rage shooting that caused fireworks to explode inside a moving pickup, burning two small children and their parents.

Bayron Rivera, 18, was charged with four counts of aggravated assault in connection with the incident near Ella, Harris County Sheriff Ed Gonzalez told a news conference. Rivera was arrested after surrendering to deputies Sunday night.

“This started as a road rage incident,” Lt. Jeff Stauber, commander of Gonzalez’s Violent Crime Unit. “Both parties had an opportunity to break it off somewhere during the incident.”

Gonzalez said about 20 minutes elapsed between the initial encounter and the gunfire.

The shots were fired from an AR-15 rifle, which was recovered, the sheriff said. The shots set off fireworks the family had just purchased.

A day after the shooting, Gonzalez released surveillance video showing the pickup pulling out of a gas station after being shot at and then bursting into flames as the fireworks ignite.

Investigators said they looking for a Ford Expedition seen in the video that they believed the gunman was driving and that fled the scene.
