Florida Marine veteran who killed 2 police officers should get death penalty, jury decides

A Marine Corps veteran who fatally shot two Florida police officers should get the death penalty, a jury at the Osceola County Courthouse decided Wednesday.

Everett Glenn Miller, 48, was found guilty of murder in September for the August 2017 killing of Kissimmee officers Sgt. Richard “Sam” Howard, 36, and Officer Matthew Baxter, 26.

A judge will ultimately decide whether to follow the jury’s unanimous recommendation of the death penalty or sentence Miller to life in prison on Dec. 20.

Baxter was conducting a routine check on three people in August 2017 when Miller then drove up and asked why Baxter was “messing with people,” according to the Orlando Sentinel. Baxter called Howard for backup. After an argument, Miller pulled out a firearm and shot both officers in both the head and face, according to prosecutors. He was later arrested at a bar.

Miller’s defense lawyers argued that the Marine veteran was suffering from post-traumatic stress disorder (PTSD), which led to a mental breakdown in the summer of 2017.

INDIANA POLICE DOG SHOT DEAD WHILE CHASING SUSPECT IN WOODS 

Colleagues, friends and family testified that Miller had a successful career, which took a turn for the worse when Miller left a defense contracting job where he targeted enemy combatants with drone strikes. In the months before the killings, Miller lost his job at a packaging company, became homeless and broke up with his girlfriend, according to those close to him. He expressed remorse over killing innocent bystanders.

Witnesses said that leading up to the killings, Miller shocked those who knew him with anti-government and anti-law enforcement social media posts, talked about killing white men and expressed anger at high-profile police brutality cases that involved unarmed African Americans.

One month before the shooting, he was involuntarily committed for running in the streets with a high-powered rifle wearing only boxers. Worried that he might have PTSD because of his increased anger and irritability, Miller went to the Veterans Affairs (VA) medical center several times beginning in May 2017. The last time Miller went to the VA seeking help was four days before the shooting, clinical neuropsychologist Robert Cohen said.

State Attorney Ryan Williams argued that Miller had family members who cared about him and received treatment from the VA, but he missed appointments and refused to take medication.

“It’s worth noting every misstep we saw once Mr. Miller’s service was over was steeped in blame,” Williams said. “It was always someone else’s fault.”

Defense Attorney Roseanne Eckert argued that Miller was a loving father and son with an exceptional military career, but extreme emotional distress caused him to be manic and paranoid.

“There’s no doubt that Glenn Miller was out of his mind that summer,” she said.

Baxter had served with the Kissimmee Police Department for three years at the time of his death. He was survived by his wife Sadia Baxter, who is a detective with the department, and four daughters, who in 2017 ranged in age from 7 months to 7 years old.

Howard was a U.S. Army veteran and had served with the police department for 10 years. He left behind a wife and one child.

Mississippi couple facing jail time for living in RV after fire partially burned home

A Mississippi couple whose home was partially gutted in a fire are facing fines, court costs and possible jail time for temporarily living in an RV while they dealt with insurance issues.

Pam Navari says she and her husband lived in an RV in their driveway as they fought their insurance company over the settlement claim for a Christmas Eve fire.

The living arrangement was subsequently found to be in violation of their Madison homeowners association code, WAPT-TV reported.

Navari says the city alderman and mayor signed off on the plan and said they could get a permit if the plan was approved by the Annandale Estates association.

She says the family soon received a letter from the association saying the RV had broken its code; the letter said association officials “felt sympathy for us and our situation, but we needed to leave.”

A copy of the letter, posted on Navari’s Facebook page, urges the family to “remove the temporary housing structure by Sept. 5, 2019, to avoid any penalties.”

In a Facebook post, Navari said the association’s president previously told her the board had approved her family’s living arrangement. After obtaining the RV she found out he had lied and was no longer the president, she said.

“He is no longer the president; the board members were not even aware that he was planning (and) had moved out of Mississippi,” she wrote.

Navari did not immediately return Fox News’ request for comment.

Fox News attempted to reach the association; questions were directed to Madison City Hall.

Miriam Ethridge, Madison’s code enforcement officer, told Fox News that the story has been “blown out of proportion.”

She said Navari’s family was “cited for zoning issues. She had a court date, which they did not come to, and the judge put out a bench warrant for them.”

“They haven’t been levied any fines, they haven’t been threatened in any way, they’re going to get to tell the judge their story, and he’s going (to tell them) what they have to do,” Ethridge said. “You’re only hearing one side, and it is an exaggerated side. I can promise you, all this is going to come out sooner or later.”

The Navaris are scheduled to appear in court next month, WAPT-TV reported.

‘Potomac River Rapist’ suspect caught in South Carolina decades after DC-area attacks

The FBI and Washington, D.C. police have arrested a suspect known as the “Potomac River Rapist” whom they had been searching for since the 1990s.

Giles Daniel Warrick, 60, is accused of murdering one woman and sexually assaulting eight others in the Washington, D.C., and Montgomery County, Md., areas between 1991 and 1998.

Warrick was connected to the crimes via forensic evidence, officials announced Thursday.

Warrick is suspected of killing 29-year-old Christine Mirzayan in the summer of 1998 as she walked home from a cookout in Georgetown, D.C. He’s also accused of sexually assaulting eight other women, including an18-year-old babysitter and two women whose children were in the home at the time of the attack. His victims ranged in age from 18 to 58, officials said.

At the time of the attacks, Warrick worked in landscaping and as a contractor in the D.C. area. He had recently moved to South Carolina, where he was arrested, Montgomery County Police Chief Marcus Jones said, according to NBC 4 Washington.

The FBI said seven of the nine attacks were linked back to Warrick by DNA. All of the attacks were linked to his violent methods, they said.

A DNA test taken by a family member of Warrick led investigators to him. Officials compared DNA collected from the crime scenes to DNA publicly available in databases, Jones said.

DC police had offered a $25,000 reward for information leading to Warrick’s arrest and conviction.

Investigators are now examining other unsolved rape cases in the D.C. area to determine whether they could be the work of Warrick, they said.

Top House Republicans accuse Schiff of preventing impeachment witness from answering certain GOP questions
House Republican leaders, in a fiery news conference Tuesday, said House Intelligence Committee Chairman Rep. Adam Schiff, D-Calif., was almost acting like a “lawyer” for a witness in the latest impeachment hearing and kept him from answering certain questions from Republican members.

Reps. Steve Scalise, R-La., and Jim Jordan, R-Ohio, told reporters that Schiff shut down a Republican line of questioning during a hearing with Army Lt. Col. Alexander Vindman, who serves as a director on the National Security Council (NSC).  “When we asked [Vindman] who he spoke to after important events in July — Adam Schiff says, ‘No, no, no, we’re not going to let him answer that question,”‘ Jordan said.

In an interview on “Hannity” on Tuesday, Rep. Devin Nunes, the top Republican on the House Intelligence Committee, accused Schiff of “coaching” Vindman and called the impeachment process under Schiff and House Speaker Nancy Pelosi “unprecedented.”

Democrat says he won’t back House impeachment resolution
House Democrats on Tuesday introduced a resolution to formalize their impeachment inquiry and adopt rules to govern the proceedings, but one Democratic lawmaker doubts he will support it. Rep. Jeff Van Drew, D-N.J., said he hasn’t seen anything “impeachable” yet with President Trump and doesn’t think he will vote to formalize an impeachment inquiry. “I would imagine that I’m not voting for it,” Van Drew told a reporter from NBC News.

Van Drew, who narrowly defeated his GOP rival in 2018 in New Jersey’s 2nd Congressional District, has openly criticized impeachment, saying it would further divide the country and put members of his party at risk in the 2020 elections. He is among a handful of Democrats who continue to lean away from a formal push for impeachment despite ongoing depositions of witnesses by three House committees spearheading the probe.

A California public school district apologized Tuesday after a sex hotline number was printed on identification cards issed to middle school students, according to reports.

The Lancaster School District in northern Los Angeles County said New Vista Middle School intended to print a suicide prevention hotline number on the IDs but mixed up two digits, resulting in a sex hotline number unknowingly being printed instead, Fox 11 Los Angeles reported.

“Late yesterday we were made aware that the middle school student ID cards have the wrong phone number listed for the Suicide Hotline. The phone numbers have two digits transposed and this is a mistake. The number listed on the card is actually a sex line,” the district said in a statement.

“The middle school administrators will be collecting all student IDs today and we will be printing new student IDs and distributing them to our students. We are very sorry for this error and we are working hard to correct it.”

A Pennsylvania mother was arrested Monday after allegedly handing her 1-month-old baby to a bus driver before walking away and abandoning the infant, according to a report.

Police said the woman allegedly got on a bus in Bethlehem on Saturday and handed her baby to the driver before walking away, WPVI-TV reported.

The mother, identified as Ashley Walters of Whitehall, was arrested and charged with a misdemeanor count of child endangerment, the station reported.

Walters, 26, reportedly boarded the bus and then placed her son on the farebox. According to the criminal complaint, Walters told the driver to “call the police and that this was her son that she can’t take care of,” WPVI reported.

After she exited the bus, she reportedly walked away in tears.

Police later found Walters just a few hundred yards away, according to the news outlet.

Florida pastor accused of sexually abusing minor kills himself, police say

Florida pastor and popular Christian radio host who was recently charged with sexually abusing a teenage girl has killed himself, authorities say.

Bryan Fulwider, 59, was pronounced dead in his home late Sunday, Altamonte Springs police told the Orlando Sentinel. The pastor and former ‘Friends Talking Faith’ co-host had been out on bail since Oct. 17.

The Medical Examiner’s Office for Seminole County ruled Fulwider’s death to be a suicide. Fulwider was arrested earlier this month after a young woman told investigators he sexually abused her for years while he was her pastor.

The alleged abuse began in 2014 when the victim was 14 and Fulwider was the senior minister at the First Congregational Church of Winter Park. He faced multiple charges and could have been sentenced to life in prison if convicted.

“Fulwider’s day in court will never come because he knew all the truths I could tell,” the woman wrote in a statement published by the Sentinel.

Fulwider co-hosted the weekly “Friends Talking Faith” on Orlando radio station WMFE.

His attorney, Jacob Stuart Jr., said his client denied the allegations. He criticized the way Fulwider was portrayed in the media, legal system and in the community saying that his client was not treated by the standard of “innocent until proven guilty.”

“This was not the case when it comes to Reverend Fulwider, especially when the ‘charges’ were measured against his innocence and when the salacious sensationalism of the accusations were compared to the facts,” Stuart said. “Reverend Fulwider’s rights were denied.”

The Navy on Tuesday upheld the sentence of decorated Navy SEAL Eddie Gallagher for posing with the body of an Islamic State (ISIS) captive in Iraq in 2017.

Chief of Naval Operations Adm. Mike Gilday made the decision after carefully reviewing the trial transcripts and the clemency request by Gallagher’s lawyers, Cmdr. Nate Christensen, Gilday’s spokesman, said in a statement. The decision was first reported by the online military publication Task & Purpose.

Gallagher’s sentence had stipulated his rank be reduced to a 1st class petty officer from chief petty officer, a reduction which will cost him up to $200,000 in retirement funds. A jury also sentenced the SEAL to pay $2,697 per month for four months.

Under Navy law, Gallagher could have had his rank reduced from chief petty officer to the most junior enlisted sailor because of the time he served in custody, but Gilday opted not to impose that punishment.

Gallagher was acquitted in July of charges that he murdered the ISIS fighter, as well as charges of witness intimidation and assault. He was convicted on one count of taking a photo with a terrorist’s corpse and was sentenced to four months’ confinement in addition to the monthly restitution payments. Gallagher ultimately served no jail time and was only required to pay the forfeiture for two months because he spent nearly nine months in pre-trial custody.

“We are glad this is finally coming to an end but our family has suffered an immeasurable amount of injustice at the hands of the US Navy, UCMJ system, NCIS, JAGs, and even Eddie’s command at Naval Special Warfare,” Gallagher’s wife Andrea told Fox News in a statement.

“Our family will continue to fight for JUSTICE for Eddie and to ensure that every bad actor will be held accountable for their part in this travesty of justice,” she added.

The case was championed by President Donald Trump, who had intervened to free Gallagher from the brig and congratulated him in a tweet after he was acquitted of murder. Parlatore said the Navy’s case was fraught with misconduct by the investigators and prosecutors who were out to get Gallagher and that they will not be held accountable.

Gallagher’s trial came after a judge removed the lead prosecutor over a bungled effort that used software to track emails sent to defense lawyers in order to find the source of leaks to the media.

The judge determined the effort violated Gallagher’s constitutional rights and, before the case went to trial, reduced the maximum possible punishment for the murder charge from life in prison without parole to the possibility of parole.

Defense lawyers had argued that Gallagher was framed by junior disgruntled platoon members who fabricated the allegations to oust their chief. The prosecution said Gallagher was incriminated by his own text messages and photos, including one of him holding the dead militant up by the hair and clutching a knife in his other hand.
