Two 13-year-old boys in Tennessee pleaded guilty to raping a 15-year-old girl and were convicted, but the judge sentenced them to just six months’ probation.

The law as it’s written protects juvenile sex offenders from prosecution to the fullest extent, but the victim, her family and an incensed local state representative are working to change the law.

“I got raped,” said the victim, who has not been identified publicly, according to Fox 17 Nashville. She said she’s uncomfortable describing the scene one month ago when two boys she thought were friends held her down in a home as they raped her and filmed it.

“I didn’t want to say, because I was afraid nobody’s gonna believe me,” the victim said. But once she opened up to her parents, they immediately went to the police.

“I just always thought it would be, you know, kids being mean, teasing or fighting, but not rape,” her mother said told Fox 17.

“The only thing I really recall the police saying to me was essentially begging me to let them handle it,” her father said.

Police investigated and found the video evidence of the crime.

The two boys were tried in court and pleaded guilty. The judge sentenced one of the boys to six months’ probation. The other, who had a criminal history, was given six months’ probation but is required to serve it in the custody of the state.

“They pleaded guilty and said, ‘Yes, I did this thing,’ and then the sentencing guidelines mandate that they can go home,” the victim’s father said.

And, because they were under 14 years old, they were not placed on a sex offender registry.

The light sentence was attributed to the Juvenile Reform Act, which serves to protect minors from harsh sentences. In an email to the family, the assistant attorney general quoted several parts of the act.

“All of them [the police] did absolutely fantastic work until it came down to the moment where we were going to get something back by knowing that they would have at least some sort of punishment for the things they did to my daughter, and it couldn’t happen because of the way the law is written,” the victim’s dad told Fox 17.

State Rep. Jason Hodges heard of the injustice and is now working on two bills to try and change the law.

“Obviously, as a father, I was disgusted, and as a citizen of that community, I was disgusted,” he told Fox 17. “You know, rape is obviously a serious offense, and whether you’re 13 or 30 you should know better.”

One of Hodges’ bills would allow minors 13 and under to be charged as adults in the case of rape. The other would allow a judge to decide if he or she wished to put minors 13 and under on a sex offender’s registry.

Alabama girl Kamille ‘Cupcake’ McKinney’s cause of death revealed in court warrant

Police have determined that Kamille “Cupcake” McKinney — a 3-year-old girl kidnapped from a birthday party in Birmingham, Ala., whose remains were later found in a dumpster — died by asphyxiation, or suffocation, according to court warrants read by a judge Friday.

Patrick Devone Stallworth, 39, and Derick Irisha Brown, 29, made their first court appearances after the Jefferson County District Attorney charged them each with capital murder on Thursday.

They are accused of snatching the child from an outdoor birthday party on Oct. 12 around 8:30 p.m. at the Tom Brown Village housing community and later dumping her body in a trash bin close to where the suspects lived.

Kamille’s body was found on Oct. 22 after a 10-day search.

Birmingham police arrested Stallworth and Brown the day after McKinney went missing and impounded a Toyota SUV after authorities said Stallworth was identified as the man seen in surveillance footage at a nearby store around the time of the child’s abduction.

Police said there is no connection between Stallworth, Brown and McKinney’s family.

Jefferson County Circuit Judge Clyde Jones read both Stallworth and Brown’s capital murder warrants at their initial court appearance on Friday.

Stallworth told the judge: “I don’t understand why I was charged with [the] murder of this child,” when asked if he had any questions about the warrant, according to a local Birmingham news report.

The judge told Stallworth that his lawyer would explain the charges to him and that the state will present evidence against him at a preliminary hearing if he chooses to have one, but Stallworth said he plans to hire his own attorney within the week.

Brown was appointed attorneys from the Jefferson County Public Defender’s Office to represent her in the capital murder case; they were already representing her in an unrelated matter.

The two are being held without bond at the Jefferson County Jail and could face the death penalty if convicted.

McKinney’s father said his daughter was fondly regarded as Cupcake because “when she came out, she was all cute and red with little brown eyes and I said, ‘That’s my cupcake.’”

A Celebration of Life ceremony for McKinney is scheduled for Sunday, followed by visitation and burial.

Pennsylvania woman charged with murder in death of 2-year-old girl cops say was abducted

A Pennsylvania woman is facing murder charges after a 2-year-old girl was abducted and later found dead, police said Friday.

Sharena Nancy, 25, of Penn Hills, had previously been charged with kidnapping in the case.

Alleghany police announced the murder charges and said Nancy abducted Nalani Johnson in Penn Hills on Aug. 31.

Investigators quickly identified Nancy as the kidnapper and apprehended her a few hours later, according to police.

“However, Nalani remained missing,” police said. “A search for Nalani continued until shortly after 4 p.m. on Sept. 3 when she was discovered deceased in Pine Ridge Park, Indiana County.”

Police said Nancy took the child after an argument with a friend of Nalani’s father, 21-year-old Paul Johnson, the Pittsburgh Post-Gazette reported Friday.

Nancy and Johnson had an on-and-off relationship, police said.

In interviews with police, Nancy claimed Johnson had instructed her to drive Nalani to a woman who was willing to pay $10,000 for the toddler, the paper reported.

Investigators have found nothing to corroborate her claim, according to the paper.

California wildfires: Newsom issues proclamation, Kincade fire may have been sparked by transmission line

California Gov. Gavin Newsom on Friday afternoon issued an emergency proclamation for Sonoma and Los Angeles counties due to the effects of the Kincade and Tick fires, which have “destroyed structures, threatened homes, & caused the evacuation of tens of thousands of residents.”

Meanwhile, the state utility that has been criticized for imposing blackouts in order to prevent such wildfires says a transmission line that it didn’t shut off may have been the source of a blaze that on Friday was raging out of control in the Golden State.

The Kincade fire near the Northern California town of Geyserville so far has burned at least 49 buildings and 34 square miles and prompted evacuation orders for some 2,000 people.

It was driven by the strong winds that had prompted Pacific Gas & Electric to impose sweeping temporary blackouts affecting a half-million people in Northern and Central California. PG&E resorted to the shutoffs after fallen power lines and other electrical equipment were blamed for several blazes in recent years.

However, PG&E said Thursday it didn’t de-energize a 230,000-volt transmission line near Geyserville that malfunctioned minutes before the fire erupted Wednesday night. The company reported finding a “broken jumper” wire on a transmission tower that evening.

PG&E WORKER TARGETED IN ‘DELIBERATE ATTACK’ IN CALIFORNIA

PG&E CEO Bill Johnson said it was too soon to know if the faulty equipment ignited the fire, adding that the tower had been inspected four times in the past two years and appeared to have been in excellent condition.

In shutting off the electricity, PG&E cut power to the distribution lines that supply homes, but not to its long-distance transmission lines.

The disclosure comes after a PG&E worker was targeted in an attempted attack earlier this week, officials said.

In that incident, the worker’s front passenger seat window was reportedly shot at by a projectile. The employee was not injured in the incident and the projectile was believed to be fired by a pellet gun.

PG&E President and CEO Bill Johnson had called the incident a “deliberate attack” and called on communities to stop such acts of “violence,” according to SFGate.

Russia’s Maria Butina released from Florida prison, set to be deported

Russian citizen Maria Butina was quietly released from a Florida prison Friday morning and is now set for speedy deportation after having served most of her 18-month sentence for pleading guilty to acting as an unregistered agent for the Kremlin, Fox News has learned.

The 30-year-old initially was scheduled to be released from a prison in Tallahassee, Fla., in November, but because of her credit for good behavior – and a change in federal law – her release date was pushed up, Butina’s attorney, Robert Driscoll, told Reuters.

Driscoll added that Butina, who prosecutors said conspired to influence American conservative activists and infiltrate the National Rifle Association, is expected to be detained by U.S. immigration authorities immediately after her release to be deported back to Russia. U.S. Immigration and Customs Enforcement on Friday morning issued a statement confirming officials had taken custody of Butina.

Prosecutors last year claimed Butina used her contacts with the NRA and the National Prayer Breakfast to develop relationships with U.S. politicians and gather information for Russia.

BUTINA SAYS HER ‘REPUTATION IS RUINED’ AFTER SENTENCING

Butina’s boyfriend, conservative political operative Paul Erickson, identified in court papers as “U.S. Person 1,” helped her establish ties with the NRA, officials said.

In their filings, prosecutors said federal agents found Butina had contact information for people suspected of being employed by Russia’s Federal Security Services, or FSB, the successor intelligence agency to the KGB. Inside her home, they found notes referring to a potential job offer from the FSB, according to the documents.

Investigators recovered several emails and Twitter direct message conversations in which Butina referred to the need to keep her work secret and, in one instance, said it should be “incognito.” Prosecutors said Butina had contact with Russian intelligence officials and that the FBI photographed her dining with a diplomat suspected of being a Russian intelligence agent.

Russian President Vladimir Putin previously has spoken out against Butina’s plight, saying “it’s not clear what she was convicted of or what crime she committed.”

“I think it’s a prime example of ‘saving face’,” he was quoted by Reuters as saying in April of last year. “They arrested her and put the girl in jail. But there was nothing on her, so in order not to look totally stupid they gave her, fixed her up, with an 18-month sentence to show that she was guilty of something.”

Butina said during her sentencing hearing she is “truly sorry” and regrets not registering as a foreign agent.

“I feel ashamed and embarrassed,” she said, adding that her “reputation is ruined.”

Texas man allegedly rapes dancer at strip club, report says

A Texas man was arrested on Wednesday after he allegedly raped a dancer at a Taylor County strip club after asking for a private dance, a report said.

Police were able to track down Zachary Lee Johnson, 28, after they were given his phone number from another dancer, the Dallas Morning News reported.

The alleged incident occurred at Cloud 9 in the early morning hours on Wednesday. He is accused to repeatedly raping the woman in one of the club’s rooms, the report said. Police said the woman was eventually able to flee.

He was charged with one count of sexual assault and released on $30,000 bond, the report said. It is not clear if he has a lawyer.

Texas murder suspect bought chainsaw the day girlfriend went missing, cops say

Authorities in Texas are searching for a man they believe killed his girlfriend — then dismembered her with a chainsaw.

Investigators are offering a reward of up to $5,000 for information on Erik Arceneux, 47, who has now been formally charged with the murder of Maria Jimenez Rodriguez — a paralegal and mother of a 5-year-old girl —more than a year after she failed to show up for work.

The woman’s body hasn’t been found, but authorities say they have video evidence and a signed receipt proving that Arceneux purchased a chainsaw and trash bags on the day the girlfriend, who was 29 at the time, went missing.

According to Houston’s FOX 26, police searched Arceneaux’s home Oct. 18 and found drops of blood on a wall but haven’t confirmed whether the blood was the victim’s.

BURNED REMAINS IN ILLINOIS IDENTIFIED AS WOMAN MISSING SINCE 2010

In June 2018, co-workers and family members became concerned when Jimenez Rodriguez failed to show up for work. Soon afterward, some started receiving odd text messages from the woman’s cell number that didn’t appear to have been written by her.

One message referred to the missing woman having to go back to the babysitter for “Dest” – meaning her daughter Destiny.

“We knew something was wrong,” the woman’s boss, Sam Milledge, told Houston’s KTRK-TV, “because she doesn’t refer to her daughter Destiny as ‘Dest’.”

At some point before he disappeared, police spoke with Arceneaux, who told them he hadn’t seen the victim on the day she vanished. But phone records show both of their phones were at his house that day, FOX 26 reported.

Those who knew the girlfriend say Arceneaux was a gym trainer who seemed to have become obsessed with the woman, according to the station. Court records indicate he has a violent past and once drove around Houston with a gun pointed at a different woman, threatening to kill her, the report said.

Neighbors near Arceneaux’s last known address told the station he hasn’t been seen in months.

Missing Tennessee mother’s body found, 2 men charged with abuse of corpse, investigators say

The body of a Tennessee mother who was reported missing nearly two weeks ago was discovered on Wednesday and two men were charged with abuse of a corpse, investigators announced Thursday.

Carolyn Pope’s body turned up near power lines in Hickman County, Tenn., which is about an hour from Nashville, a news release from the Hickman County Sheriff’s Office said.

A tip led investigators to the 30-year-old mother, WKRN-TV reported, citing Hickman County Sheriff Randal Ward. Her body reportedly was found wrapped in a blanket, under a plastic sheet and debris in a gully near a heavily wooded area.

Pope lived in Fairview, about a half-hour from Nashville, with her grandmother and 5-year-old daughter.

Pope’s grandmother filed a missing-person report on October 13, the sheriff’s news release said, adding that she was last seen at a home the day before. Since then, the sheriff’s office and Tennessee Bureau of Investigation conducted several search warrants at different homes, on multiple phones and vehicles.

Warrants for Mitchell Hinderliter and Christopher Hall, both of whom were in jail on unrelated charges, were written for abuse of a corpse, tampering with evidence and false reports, the sheriff’s office added.

It was unclear what possible ties the men may have had to Pope. Her car reportedly was recovered on Hinderliter’s property during the investigation.

“Her 5-year-old is going to take it really hard. I mean her mom was her superhero, she was her superwoman,” Gonzalez reportedly said. “She would do anything for her. She’s been wondering where she is at, will she ever come home, when she’s going to see her or talk to her and it’s heartbreaking that she has to go through this. It’s heartbreaking that she’s going to grow up not knowing her, you know, only having the memories.”

The investigation was ongoing and more charges connected to Pope’s death were expected after the final report from the medical examiner, the Hickman County Sheriff’s Office said.

A suspect has been arrested in Florida, accused of pouring gasoline over a woman and lighting her on fire in a Taco Bell, police said.

The suspect, Mia Williams, 32, was arrested Thursday morning, according to Tallahassee police.

Williams, whom police said identifies as a black female, set the unidentified victim on fire Wednesday night before fleeing on foot.

The injured victim was taken to the hospital with serious burns, police told NBC.

Court records showed that Williams was charged with premeditated murder, aggravated assault and resisting an officer without violence, The Tallahassee Democrat reported.

The suspect was booked into the Leon County Detention Center and is scheduled to appear in court on Friday morning.
