Prison activist Mumia Abu-Jamal to get new appeals hearing

Westlake Legal Group og-fox-news Prison activist Mumia Abu-Jamal to get new appeals hearing philadelphia fox-news/us/crime fnc/us fnc Associated Press article 609a4ace-41fe-5130-88fe-727fe6283d07

A former Black Panther and death row activist convicted of killing a Philadelphia police officer will get a new appeals hearing after the city prosecutor dropped his opposition to it.

Sixty-four-year-old Mumia Abu-Jamal is serving a life sentence after spending decades on death row in the 1981 slaying of Officer Daniel Faulkner during a traffic stop.

A city judge granted him a new hearing in December after the U.S. Supreme Court said a former Pennsylvania justice who heard his appeal had a potential conflict of interest in a similar case.

District Attorney Larry Krasner initially fought the hearing, fearing the judge’s order could affect a large number of other convictions.

Krasner says Wednesday he’s dropped his challenge because Common Pleas Judge Leon Tucker has narrowed the scope of his order.

Videos of Robert Kraft at day spa will be released, prosecutors say

Florida prosecutors announced Wednesday they intend to release surveillance footage from inside the Orchids of Asia Day Spa where Robert Kraft and dozens of others allegedly paid for sex.

Palm Beach County State Attorney Dave Aronberg’s office reportedly cited a state law in arguing the release of the tapes cannot be further delayed unless they are barred from being made public by a judge, The Boston Globe reports.

The tapes’ release has been strongly contested by the lawyer for Lei Wang, who allegedly managed Orchids of Asia Day Spa, and the attorney for Robert Kraft, William Burck, who said last week the footage should not be made public because “it’s basically pornography.” He added the only reason the videos would be made public is “to get eyeballs and clicks.”

Wang’s lawyer attempted to argue the release of the videos be held off until the conclusion of criminal proceedings against his client, but Aronberg’s office isn’t backing down.

PATRIOTS OWNER KRAFT OFFERED PLEA DEAL IN FLORIDA PROSTITUTION CASE

“As the custodian of the records, [prosecutors] cannot delay the release of records to allow a person to raise a constitutional challenge to the release of the documents,” the office reportedly wrote. “The Public Records Act does not allow a custodian to delay the production of records to allow the resolution of a constitutional challenge to the release of the documents.”

Therefore, if the videos are released, it will be through the criminal case against Wang, not Kraft.

Kraft, 77, is facing two misdemeanor charges for soliciting prostitution, as a result of his alleged visitations to Orchids of Asia Day spa on Jan. 19 and Jan. 20. During his second visit, the billionaire is said to have engaged in sexual activity with Wang.

PATRIOTS OWNER KRAFT SAYS ‘I AM TRULY SORRY’ IN FIRST PUBLIC COMMENTS SINCE PROSTITUTION BUST

Kraft, who owns the New England Patriots, rejected a plea deal and pleaded not guilty to the charges against him. He released a public statement apologizing for his actions and said that throughout his life he has “always tried to do the right thing.”

“The last thing I would ever want to do is disrespect another human being. I have extraordinary respect for women; my morals and my soul were shaped by the most wonderful woman, the love of my life, who I was blessed to have as my partner for 50 years,” he said of his late wife Myra Hiatt Kraft. In 2012, he began dating 39-year-old actress and model Nicki Noel Lander.

At least 15 men, including Kraft, have requested that Judge Leonard Hanser issue protective orders blocking the public release of the video, but he has yet to make a decision on that issue.

A man suspected of using a samurai sword to kill his girlfriend last year at a survivalist bunker loaded with guns and ammo in northwest Washington was found dead in California, officials revealed Tuesday.

The Island County Sheriff’s Office said in a news release posted to Facebook a body pulled from the Feather River in Yuba City, California on April 7, 2018 has been identified as 35-year-old Jacob Gonzales.

The body was initially classified as a “John Doe” until November when investigators shared photos of tattoos on the body that led to tips that initially identified the body as Gonzales’.

Officials were eventually able to send DNA to a lab in California, which made the positive identification. Officials have not revealed a cause of death.

CAR BELONGING TO DECAPITATED WOMAN FOUND IN CALIFORNIA, CHARGES FILED IN SURVIVALIST BUNKER CASE

Gonzales had been sought by authorities in connection with the murder of 26-year-old Katherine Cunningham, whose decapitated body was discovered on March 3, 2018, near a survivalist bunker on the rural Camano Island, north of Seattle.

Near the headless corpse, investigators discovered a bunker dug into a hillside containing supplies, guns and ammo. Autopsy findings determined the 26-year-old woman’s cause of death was “homicidal violence with decapitation,” according to the coroner’s office.

“The subsequent investigation revealed that Katherine had been murdered on February 14th or 15th,” the sheriff’s office said Tuesday.

Cunningham’s vehicle was found abandoned on Interstate 5 in Yreka, Calif., roughly 560 miles away on Feb. 16 and towed three days later by the California Highway Patrol, before her body was discovered.

“After Katherine was discovered, an attempt to locate was put out on her missing vehicle and the California Highway Patrol notified the Island County Sheriff’s Office that they had the vehicle,” police said. “Deputies from the Island County Sheriff’s Office recovered the vehicle from California and towed it back to Washington where Detectives obtained a search warrant.”

Inside the vehicle, authorities discovered a samurai sword wrapped in a blanket that appeared to match the type of weapon used in the killing. Testing of the sword also found Cunningham’s DNA on the blade and Gonzales’ DNA on the handle, according to the sheriff’s office.

Authorities had been seeking Gonzales since March on a $1 million warrant. He was previously charged with 5 counts of unlawful possession of a firearm and one count of motor vehicle theft.

The sheriff’s office thanked the various agencies and tips from the public that helped with the investigation, and officials thanked the victim’s family.

“We would also like to thank Katherine’s family for their patience and their tireless efforts to keep Katherine in the public’s thoughts,” officials said.

A 17-year-old Florida girl stabbed an armed gas station clerk who had allegedly cornered her inside a bathroom and attempted to rape her at knifepoint, officials said.

The victim told police she entered a Chevron gas station in Dania Beach at around 3 a.m. on April to purchase two microwaveable dinners.

She had gone to use the restroom at the back of the store when the store’s clerk locked the front door and followed her inside, WSVN reported.

The girl ran out of the store but didn’t contact authorities because of her immigration status, the affidavit said, according to Local 10.

Police said another customer entered the gas station about 20 minutes later and Munshi called for help, claiming he had been stabbed by a shoplifter.

Munshi was questioned at the hospital and was unable to keep his story straight, WSVN reported.

Additionally, surveillance footage reportedly showed the events unfold as the victim had stated.

The father of a woman “infatuated” with the mass shooting at Columbine High School — and who triggered a manhunt and the shutdown of Denver-area schools Wednesday after she allegedly flew to the city and bought a gun — said he just wants his daughter to come home.

The Jefferson County Sheriff’s Office and the FBI said that Sol Pais, 18, is “considered to be extremely dangerous” after traveling to Colorado from Miami on Monday night before purchasing a pump-action shotgun and ammunition.

Pais had made threats to “commit an act of violence in the Denver metropolitan area” just days before the 20th anniversary of the attack, according to officials.

On Tuesday night, her father, in Surfside, Florida, told reporters through a closed door at the family home the experience was “like a bad dream.”

“She can come home. I think she wants to be ok,” her father told WSVN. “I think it’s maybe she has a mental problem.”

“They’re looking for her,” he told WSVN. “We don’t know what to do.”

A neighbor said the family moved to the area about 10 years ago, and that Pais was spotted in the neighborhood and attended Miami Beach High School.

Miami-Dade Public Schools confirmed in a statement that Pais is a senior at the high school.

“We are fully assisting the FBI in their investigation,” Miami-Dade Public Schools told CBS4. “As far as this case goes, I want to stress that, at this time, there have been no threats to M-DCPS schools. The threats appear limited to schools in Colorado.”

Another neighbor told CBS4 that Pais was a quiet person but well behaved.

“She always kept to herself. She never got in trouble at school,” Patricia Bilstin told the television station. “So surprising, and I feel sorry for the family.”

Authorities said Pais was last seen near Columbine, located just outside Denver, wearing a black T-shirt, camouflage pants and black boots. They appealed for anyone seeing her to call an FBI tip line at 303-630-6227, and said she is too dangerous to be approached by civilians. The alert also said police who come into contact with her should detain her and evaluate her mental health.

“This has become a massive manhunt…and every law enforcement agency is participating and helping in this effort,” Dean Phillips, special agent in charge of the FBI in Denver, said late Tuesday night.

“She can please come home,” he said. “I think she’s going to be ok.”

A baseball bat-wielding Florida woman slugged a man after he attempted to break into her parked vehicle and then charged at her Sunday.

Clarese Gainey, 65, of Gainesville, told WGFL she heard a noise coming from outside her home and peeked out the window. That was when she says she saw a large man — dressed only in his boxers — attempting to get into her car.

“I grab my bat, I brace myself, and I ease the door open,” Gainey told WGFL.

At that moment, the man — identified by police as 37-year-old Antonio Mosely — charged at her, authorities said, according to WGFL.

“I took that bat and hit him upside the head, like, ‘pi-yah!’ He said, ‘Ow!'” Gainey recalled.

The man reportedly fled to a nearby mobile home park but left behind a sock, shirt and pants.

“He was in his drawers,” she recalled.

A K-9 unit was able to track Mosely to a mobile home where officials said he was found with a pair of pants on. WGFL reported cocaine was found his pocket, and he was brought to Gainey for identification.

“I said, ‘That’s him right there,’” Gainey said.

Officers said they also noticed a large bump on the suspect’s head.

Mosley was charged with “attempted burglary to both an occupied and unoccupied conveyance and possession of a controlled substance,” the media outlet reported.

Gainey had a warning for the suspect, saying he “better be glad I didn’t have a gun.”

“Because I would have shot him,” she said.

Then, pointing at her baseball bat, she added: “But this is my gun right here. Because I would have gone ‘pi-yow!'”

Atsu Mable, in an appearance on “Fox & Friends” Wednesday, also said he forgives the two strangers alleged to have gone after him Saturday night in Germantown, outside of Washington, D.C.

“I have a message for love – that Jesus said in the Bible that you must love your neighbor, so I still love them,” he told Fox News. “I think whatever happened to me that day should not happen to anybody.

“I forgive them. I’m ready to make peace with them if I could see them again,” he added.

Mable said he then walked away but felt someone punch his back, and a fight ensued. Possessions belonging to Mable were taken by the suspects and destroyed during the brawl, the Montgomery County Department of Police said in a statement.

Officers later tracked down Jovan Crawford, 27, and Scott Duncan Roberson, 25, who were: “attempting to hide among a group of children playing basketball”.

Both men are now facing numerous charges, including robbery, attempted theft, and second-degree assault.

A former corrections officer in Maryland has pleaded guilty to attempted murder in a brutal attack on his wife.

The state attorney’s office described the crime Monday while announcing the plea by 46-year-old Armando Quispe Rodriguez.

Prosecutors say Keyia Rodriguez was asleep when her husband began hitting and stabbing her, and tried to escape, but he handcuffed her to a railing in the basement and bound her ankles. Then he kept stabbing her, a total of 23 times, and put a bag on her head and a belt around her neck in an attempt to suffocate her.

She didn’t die, however, and Armando Rodriguez eventually called 911 to their home in Bryans Road, calling it a “domestic situation.”

He faces life in prison at sentencing in August.

Isaak lived on property managed by the company, but police have said that while they have plenty of evidence — spent shell casings, a knife and gun parts — they still haven’t identified a motive. That was still the case as of Monday, Deputy Chief Lori Flaten said.

Jackie Fakler said RJR officials had few interactions with Isaak, who lived in a mobile home park the company had begun managing just last June. Marketing executive Ben Pace called those few interactions “all very normal.”

Fakler said rumors that RJR was raising Isaak’s rent or had ordered him to get rid of his dog are false.

“I don’t think anything could make sense out of it, no matter what,” she said.

Robert Fakler, 52, and employees Adam Fuehrer, 42, and married co-workers Lois Cobb, 45, and William “Bill” Cobb, 50, were shot or stabbed to death before the business opened that Monday. Jackie Fakler said the four victims typically came to work early. It also wasn’t uncommon to have an unlocked door while there were workers on the premises.

“This is like home to a lot of people, and it’s like being at home and leaving your front door unlocked while you’re home,” Pace said.

The victims were in different areas of the building and were killed within 13 minutes, according to Fakler. The Cobbs were in the office area; Fakler and Fuehrer in the back shop area.

Police followed evidence from surveillance video at RJR and other businesses to arrest Isaak three days after the slayings. Court documents allege Isaak took one of the company’s vehicles, drove about a block, then walked to his own truck parked in the area. Fakler said it wasn’t unusual for Bill Cobb to leave a company truck running with the keys in it.

“(Police) got a lot of footage everywhere,” she said. “I think they were able to track (Isaak) from here to him leaving town.”

After Isaak got back to Washburn, about 35 miles (56 kilometers) north of Mandan, he allegedly went back to work at his chiropractor office. A client of his, Dora Sorenson, has said Isaak “didn’t appear any different.”

Fakler said, “It doesn’t make sense how anybody could walk away, go to work. None of it makes sense.”

She and Pace credited police with making a quick arrest but said they are not privy to much more information than the public. Fakler said she’s relieved with the arrest “but then now you’re flooded with all the questions — why? What could have been so horrible that he had to take four people’s lives?”

Isaak remains jailed on $1 million bond. He hasn’t responded to interview requests and doesn’t yet have an attorney listed to represent him. He could enter pleas at a May 14 hearing.

Isaak could face life without parole if convicted. North Dakota doesn’t have the death penalty.
