Comparative Summary

This report by the foreign law research staff of the Law Library of Congress’s Global Legal Research Directorate includes surveys of the regulation and funding of two types of alternative maternity care providers, midwives and doulas, in ten countries around the world. The jurisdictions covered are Brazil, Canada, Hong Kong, France, Germany, Israel, Japan, New Zealand, Sweden, and England.

All researched jurisdictions regulate the work of midwives, which is not the case when it comes to doula activities.  In Brazil legislation is pending in Congress that would also regulate the work of doulas, and states and municipalities have already enacted such laws.  Although New Zealand does not regulate the activity, doulas may be required to comply with a code of consumer rights to the extent they provide health services to the public.  All other jurisdictions do not regulate doula activities. 

To work as a midwife in the countries surveyed usually requires previous qualification or experience.  In general, a person needs to have specific education and training, and pass an exam.  The exceptions are Sweden and Japan.  In the case of Sweden only educated and trained nurses can become midwives and in Japan a woman must first acquire the qualification for the national nursing examination and then receive the education for midwifery to qualify for the national midwifery examination.

Professional educational requirements for doulas in countries that do not regulate the activity are basically nonexistent.  Professional classes and voluntary certification for doulas are offered by professional organizations in Germany, Japan, Sweden, and the UK.  State law in Brazil requires a person to obtain a certificate of professional training to work as a doula.

Midwifery work in all the surveyed jurisdictions involves, to some degree, maternity care during pregnancy, labor, and the postpartum period.  Brazil has also created a subsystem of assistance that allows the parturient to designate a person to accompany her during labor, delivery, and immediate postpartum.  In addition a network was created within the country’s health system to provide women with health, quality of life, and well-being during pregnancy, childbirth, and the postpartum period, and to provide child development support through the first two years of a child’s life.

In the countries that acknowledge their work, the job of doulas focuses on what is considered nonmedical assistance and services, either in the form of physical assistance, emotional support, or therapeutic relief, as is the case in Hong Kong, Israel, and New Zealand, or in the form of housekeeping, cooking, childcare, and mental support for the new mother and her family, as occurs in Japan.  In Brazil, state law allows the presence of doulas during labor, delivery, and immediate postpartum. Sweden offers doulas in lieu of other support to women who do not have a support person to accompany them during labor, and in some regions of the country offers “cultural doulas” to work as interpreters and facilitators for immigrant mothers with limited language skills. 

Health care, which includes midwife services, is funded either by the government at the federal, provincial, territorial, or local level, as is the case in Brazil, Canada, Hong Kong, New Zealand, Sweden, and the United Kingdom, or by a national health insurance scheme as occurs in France, Germany, Israel, and Japan.  Doula services are not funded in the vast majority of the researched jurisdictions, with the exception of Brazil, which provides funding at the state and municipal levels, and Sweden, where municipal health care services may fund doulas in lieu of other support and cultural doulas.  Also, in Canada some private insurance companies have started to cover doula services.

A New York police K-9 was filmed taking down a suspect after the man punched a police officer in the face on Sunday.

Randy Martinez, a 23-year-old man who lives in Newburgh, said he was leaving his house with a friend when a man, identified as 31-year-old Tony Mann, wandered into his driveway and threatened him with a knife.

“I rolled down the window and was going to tell him he can’t be on my property, and then he takes out his knife, and I’m just like, ‘Oh, God, no. What’s going to happen?’” Martinez told the Times Herald-Record.

Martinez said he called police because he was “so scared,” as his loved ones were still in the house, and started filming the scene when authorities arrived.

In the video, a police officer is seen trying to talk to Mann, who appears to make strange movements before punching the Newburgh police officer, Roman Scuadroni, in the head. Scuadroni takes a moment before he opens his police vehicle door — letting loose his K-9 partner, Lee.

Lee quickly pounces on the suspect, chomping down on his arm, as the police officer puts his arms around Mann’s neck to try to restrain him. Mann is ultimately forced to the ground.

Another officer soon arrives on scene to help with the arrest, all while the dog is still actively pursuing Mann before he’s eventually pulled off by Scuardroni, who suffered minor cuts and injures.

Investigators said they found a folding knife on Mann, who was transported to a hospital emergency room for intoxication and to be treated for a minor dog bite.

He was reportedly charged with trespassing, third-degree assault, resisting arrest, obstructing governmental administration and second-degree menacing.

Clemson coach Dabo Swinney responded to allegations that the Tigers’ “Walk of Champions” tradition helped incite South Carolina fans ahead of their 2017 Palmetto Bowl matchup.

Gamecocks fans threw trash and bottles at Tigers players during warmups. The game was being played at Williams-Brice Stadium in Columbia, S.C. and Clemson won 34-10.

South Carolina coach Will Muschamp was holding his weekly radio show last week and the trash incident came up. South Carolina play-by-play broadcaster Tony Ellis suggested that Clemson’s tradition was to blame since they walked up to the goal line where the Gamecocks’ student section was.

“The Tigers put us in a tough position as well,” Ellis said, according to Clemson Maven. “One of the things that they do, and God bless them what they want to do in pregame they do, is grasp those arms and they walk from midfield towards our student section. Maybe that is something they could modify if they felt like it was provoking them in some way.”

Ellis added that there is an expectation for students to “act with class” during games and that throwing objects on the field was inexcusable.

Swinney wasn’t a fan of what Ellis said even if the host tried to soften the blow with the expectations of fans.

“It’s just ridiculous,” Swinney said, according to WYFF4-TV. “It’s not any type of taunting. It’s a unity thing for our team. It’s something we do every single game. If it was something we just did on the road, I could see that. … I don’t think anyone should be distracted by how a team warms up. You can yell and scream and holler and all that’s part of it. But when you start throwing things, it’s all fun and games until somebody gets their eye knocked out.”

Swinney added: “There’s right and there’s wrong, and we shouldn’t lose our perspective because of our passion for a game.”

Clemson is going into the game as the No. 3 team in the nation. The defending champions are 11-0 this season while South Carolina is 4-7.

The Gamecocks haven’t won the rivalry matchup since 2013.

An Indiana high school football coach died Monday after suffering a stroke during a playoff football game last week, officials said.

Phillip Bowsman had coached at West Washington High School in Campbellsburg for the last 16 seasons. He suffered a stroke due to a blood clot while coaching in the semi-state finals game against Indianapolis Lutheran, West Washington School Corporation officials said in a statement on Facebook. West Washington lost, 49-0.

“In true Coach Bowsman fashion, he made his final act of giving by being an organ donor,” the school district said in a Facebook post Monday. “Please take time [and] show love and support for all members of our community because his impact was great and this loss will affect many.”

The school district canceled classes Monday and Tuesday and offered counseling to those who were grieving the coach’s death.

Bowsman, who was in his 40s, was with the West Washington School Corporation for 19 years as a health and physical education teacher. He had been the high school’s athletic director for the last seven.

He was remembered as a person who was always there for his students when they needed him.

“If they needed a ride home, if they needed equipment, cleats, if they needed anything at all, just someone to listen to, he was there,” Cynthia Ball, a parent of a student-athlete, told WLKY-TV.

Bobby Cleek told the station that his son played for Bowsman more than 10 years ago and said the two always kept in touch.

“He coaches because of Phillip. Him and Phillip are still close and they talk all the time. He was just a really good guy,” Cleek said.

The school district said it was holding a walk to remember Bowsman and all were invited to attend.

People for Ethical Treatment of Animals (PETA) this week urged the University of Georgia to retire its live football mascot Uga, which has been a staple of the school for several years.

PETA tweeted a video showing Uga X, an English bulldog that has been the school’s mascot since 2015, sitting in his dog house to avoid the rain in a game between Georgia and Texas A&M on Saturday. The organization said Uga looked miserable and did not want to be forced into a “stressful situation” at Sanford Stadium.

On Tuesday, PETA doubled down on its call for the school to retire Uga.

Uga’s on-field home is an air-conditioned doghouse that is next to the cheerleaders’ platform. PETA came after Georgia earlier this year when Uga was nearly trampled by the University of Texas steer mascot prior to the two schools’ Sugar Bowl matchup.

A 13-year-old girl’s choice of “Joy to the World” for a piano assignment was rejected for being too “religious” by a California charter school before reversing the decision Tuesday.

Brooklyn Benzel, an 8th-grade homeschooler, was told by a South Sutter Charter School education specialist that her choice “would not be acceptable” Thursday after submitting a video sample of her playing the beginner version of the popular Christmas song.

But Julianne Benzel, Brooklyn’s mother who emailed back and forth with school officials, told Fox News her daughter wasn’t going to sing any words. She was just going to play the piano.

The school official suggested “Jingle Bells” as a “more cultural” choice “that won’t be “construed as religious” and rejected by the school’s auditors.

“You would think homeschooling would be the safest arena for conservatives,” Benzel said. “We are tired and extremely weary of our Christian faith being attacked in this country.”

The school official responded Tuesday after Benzel threatened legal action through the Pacific Justice Institute, which is suing the school for a similar case alleging religious discrimination against a piano teacher.

“Now that we can see that this was a nonsectarian assignment that Brooklyn chose to play ‘Joy to the World’ for, we are happy to accept it and add it to her portfolio,” the official wrote.

Brooklyn is also set to play her song at a retirement home for a Christmas concert in December. She chose the song because it’s one of her favorite songs during Christmastime.

Seven Islamist militants to be hanged for roles in Bangladesh terror attack that left American, 21 others dead

Seven Islamist militants are set to be hanged in Bangladesh for their roles in a 2016 terror attack that left 22 people, including one American, dead.

The siege on a café in Dhaka was carried out by five men who shot and hacked diners to death with machetes while taking others hostage. Following a 12-hour standoff, Bangladesh’s army stormed in and killed all five assailants. Thirteen hostages were rescued, but 22 people died during the attack, including an American, nine Italians and seven Japanese citizens, according to the BBC.

“The court gave them the highest punishment,” Golam Sarwar Khan, a prosecutor, is reported to have said to the media Wednesday after the sentences were announced.

AT LEAST SEVEN KILLED IN BANGLADESH GAS EXPLOSION

Bangladesh has accused a local militant group of being behind the attack and those on trial were suspected of supplying the attackers with machetes and assault rifles, in addition to helping them plan the siege, the BBC reported.

The lawyer of those sentenced to death said he would appeal their punishment. Some of the men, the AFP said, shouted “Allahu Akbar” as they were led to a police van outside of the courtroom Wednesday.

Eight other militants connected to the attack reportedly were killed in government raids in the months afterward.

Bangladeshi Prime Minister Sheikh Hasina in 2016 called the café attack “an extremely heinous act.”

From a “bomb cyclone” in the Northwest to parade-halting rain in the northeast, a vast area of the United States has been paralyzed, or could be soon, by a buffet of severe weather just ahead of Thanksgiving.

The widespread storms choked transportation across the center of the nation on Tuesday, bringing 30 inches of snow in some areas and causing closed interstates and hundreds of canceled flights. Little relief was expected on Wednesday, with forecasters projecting powerful winds in the Northwest, whiteout blizzard conditions in the Midwest and rain in the Northeast that threatens to shut down airports.

More than 55 million people were expected to fly or drive out of town during one of the busiest travel weeks of the year. At least, that’s how many had hoped to.

Heavy snows and whipping winds were expected in the Northwest through Wednesday morning in what the National Weather Service called a “historic, unprecedented” storm, unlike any that had hit the region since the 1960s. It was believed it would qualify as a bomb cyclone, a designation given when barometric pressure drops by at least 24 millibars in 24 hours.

Winds reached 106 m.p.h. on Tuesday near Cape Bianco, Ore., with sustained winds of 85 m.p.h., exceeding the 74 m.p.h. definition of hurricane force. Travelers were encouraged to stay off the roads, with as much as a foot of snow blanketing Northern California and Oregon.

The National Weather Service in Medford, Ore., said late Tuesday that “conditions should improve Wednesday afternoon.” Winds began gradually diminishing around midnight, forecasters said.

But the Sierra Nevada mountains were expected to be hammered by blizzards on Wednesday, with one to three feet of snow possible in areas.

The storm that buried much of the Midwest on Tuesday was expected to continue east through the region toward New England by Wednesday night. High wind warnings, with potential wind gusts of up to 50 m.p.h., were in effect from Kansas City to western Ohio.

In the upper Midwest, forecasters at the National Weather Service predicted “a swath of moderate to heavy snow” on Wednesday.

“Severe travel disruptions are likely for these areas,” forecasters warned.

Parts of Minnesota expected up to 13 inches of snow, with a winter storm warning in effect through noon Wednesday and delays piling up at Minneapolis-St. Paul International Airport. The National Weather Service in the Twin Cities said there had been “many accidents across central and southern Minnesota” on Tuesday night, advising travelers to “stay off the roads until you must travel.”
