Harold Finch Comments on a Tale of Two Pictures (Me, too)

Intrepid independent researcher @NameRedacted was suspended multiple times on Twitter for what amounted to hurting the feelings of leftists and challenging their blatant lies. In his final incarnation, he was “Harold Finch,” and after being suspended for the final time has subsequently moved to Telegram where he runs a repository consisting of important factoids, linked articles, and personal commentary available to the masses. He can be found here.

Sometimes his poignant commentary deserves a much wider audience, and San Fran Nan’s staged walkout of the meeting with President Trump the other day provided the impetus for this blast. I will add my own two cents at the end.

Before getting to our commentary, here is the what transpired at the meeting:

President Trump and House Speaker Nancy Pelosi, D-Calif., heated up their ongoing war of words after a White House meeting on Syria devolved into name-calling and led to Democrats storming out, with both sides accusing the other of a “meltdown.” Pelosi, along with Senate Minority Leader Chuck Schumer, D-N.Y., and House Majority Leader Steny Hoyer, D-Md., walked out of the meeting Wednesday afternoon, which had been intended to discuss the administration’s decision to pull troops out of northern Syria. That decision has sparked bipartisan criticism that the decision betrays the Kurds, while giving a boost to ISIS.

White House press secretary Stephanie Grisham dismissed the [Democrat] reports about the meeting [Cvrk comment: they ran to the press microphones in a staged event after walking out of the meeting to spin it like they always do]:

“The President was measured, factual and decisive, while Speaker Pelosi’s decision to walk out was baffling, but not surprising,” Grisham said. “She had no intention of listening or contributing to an important meeting on national security issues. While democratic leadership chose to storm out and get in front of the cameras to whine, everyone else in the meeting chose to stay in the room and work on behalf of this country.”

This White House meeting that included hysterics by Nancy Pelosi can really be defined as a tale of two pictures. The first is unhinged Pelosi lecturing the man who writes the letters to the families of the fallen soldiers (the meetings centered on “Turkey and the Kurds”). Check out the first picture here:

Note carefully that her body language screams out of control, rude, and disrespectful. And Chuck Schumer smirking like a childish teenager watching the mouthy kid run her mouth at the Teacher. This is supposed to be a national security meeting on events in Syria. The Democrats are acting like they are the Commander in Chief berating an officer who is giving them advice they don’t want to hear. They’re drunk on Power. They’re demanding the President start a war with a NATO member and sacrifice our soldiers, all while they refuse to vote to authorize use of force much less vote to declare war on Turkey. That means this cry for war isn’t even a serious one. They don’t believe in it enough to hold a vote. They want President Trump to get into an ugly quagmire that bleeds us white to help them in 2020 election. They don’t care about Kurds. They CERTAINLY don’t care about American Soldiers, Sailors, Airmen, Marines.

Then there is the second picture which is QUITE a contrast!

In this picture, we have the President, the Secretary of Defense, the National Security Advisor, the Chairmen of the Joint Chiefs of Staff, the House Minority Leader, and others. In this picture, the President’s body language says he rejects her attack and is insulted. You can see it in his face he is insulted. This man writes every letter to families of those Mil families who loved one’s life is lost. He sees their pain up close & face to face. Their lives matter to him. He’s sitting down. He’s not aggressive in posture, but he’s offended.

The Chairman of JCS is looking down ignoring Pelosi. See his shoulder? US Army Special Forces & Ranger Tabs. Chest full of medals. He doesn’t take her seriously. His hands clasped likely praying. This is serious business. Everyone on this side of the table is sober & here for serious business. No laughing. No mocking. No insults. The SECDEF is clearly tense, with hands clasped, lips parsed, and a stern brow. He’s seething mad but determined to hide it.

Everyone else on the President’s side of the table, including the House minority leader Kevin McCarthy, is embarrassed by and disgusted with Pelosi, Hoyer and Schumer. It’s clear the three of them never intended for this to be a good faith meeting. This was Pelosi threatening the President and he, his advisers, the Republicans, and the national security staff having none of their childishness. No one accepted the Democrats’ putting politics before America’s national security and the lives of our troops. The only skin in the game that the Democrats have is crass partisan politics; the lives of our troops are merely chess pieces in their quest for political power.

This is the aftermath: when Nancy Pelosi, Chuck Schumer and Steny Hoyer couldn’t force the Commander in Chief into a bloody quagmire in Syria a year before a presidential election, they threw a temper tantrum and stormed out.

Let me be blunt: the Democrats don’t give a flying f**k about America, our troops, the Kurds, or about YOU whom they are supposedly serving. The *ONLY* thing the Democrats care about is obtaining AND KEEPING political power AT ANY COST.

The moral of this sordid story is, Ddn’t ever let these dangerous people have power. It is CRITICAL to the safety of our nation that we take the House away from Pelosi &and further marginalize Chuck Schumer. You have a choice in 2020, America: a president and Congress who want the wars ended and the troops to come home, or a resident and congress who want endless wars and endless sacrifice of American lives to keep them in power. Choose wisely.

A couple of points to add to Finch’s excellent synopsis:

  • San Fran Nan is concerned that pulling out 26 (!) special forces soldiers off the Syria-Turkey border is going to let ISIS back in the game? That’s laughable, particularly after her total silence during the years in which Obama allowed ISIS grow from nothing into a threat!
  • This isn’t the first time that they’ve pulled this stunt (running to a media microphone to spin a contentious meeting with @POTUS). This is what career politicians do; non-politicians and problem-solvers like @POTUS work through differences and deliver the goods!

The Feds Must Stop Smoking What Musk Is Smoking

 

Please allow a personal point of privilege at the outset:

I REALLY like Mike Pence.  Zero sarcasm – I think he is a really good guy.

Pence once saved my professional bacon – now more than a decade ago.

I had scheduled a huge Capitol Hill anti-Fairness Doctrine press conference.  Lots of Senators and Congressmen were part of the itinerary – including then-Congressman Pence.

One of the Senators’ offices had secured for us a Senate press room – which then turned out to be not so secured.  It was double-booked – and we were out.

Pence stepped right up – and had his staffers scramble and secure us a place on the House side to host it.

Not a huge deal in the grand scheme of things.  But emblematic of the man I got to know a little over the years.

I was absolutely thrilled when Donald Trump chose Pence to be his vice presidential candidate.  It was a brilliant decision.

Pence is a solid conservative – who bolstered a presidential candidate whose conservative bona fides were at that time understandably in question.

After winning the election, I then remember Pence being excoriated stupidly and ridiculously – for wisely not having one-on-one private meetings with women not his wife.

Pence was lambasted by the Left as being a prude – who was holding back his (very many) women staffers by not granting them equal access to…what, his hotel room on business trips?  Grabbing a coffee in the lobby is anti-women?

Five seconds later, the Harvey Weinstein story broke and the #MeToo “movement” swept the media landscape.  One Democrat after another was revealed to be a women-assaulting ass hat.

Proving Pence and his personal policy – were wise and right.  And the Leftists in and out of the media who attacked him – were stupid and stupid.

I think Pence is the perfect presidential successor to Trump.  We the People will get all the great policy substance – with a much more low-key style.

I don’t mind Trump’s style.  In fact, I thoroughly enjoy it.  I enjoy most people from Queens, Brooklyn and the Bronx – most of whom are nigh exactly like Trump.

But if eight years delivers US to a critical density of Trump Fatigue – President Pence is the perfect national palate cleanser.

All of this is to say – I have long very much liked and respected now-Vice President Mike Pence.

Which is why his one political and policy blind spot – is so very out of character.  Pence appears to suffer from Elon Musk Syndrome.

Pence is by no means alone in being afflicted with Elon Musk Syndrome.  It is a condition – run rampant in Washington, D.C.

Elon Musk Syndrome – is being enamored with government money sopper Elon Musk.

That $5 billion tally – was tallied in 2015.  Musk’s take is MUCH huger now.

Musk’s far-and-away greatest skill?  Convincing lots and lots government officials to keep giving him gobs and gobs of our money.

Imitation is the sincerest form of flattery, even if it involves progressives copying Donald Trump.

Ripping a page right out of Donald Trump’s election playbook from 2016, the group Demand Justice has called for all the Democrats running for President declare publicly who that would nominate out of the handy dandy list they provided.

How convenient and very copy cat-ish of Trump 3 years ago.

According to The Washington Post

Democratic presidential contenders are coming under increased pressure from their base to take a page from Donald Trump’s 2016 playbook and release a shortlist of potential Supreme Court nominees — one part of a larger strategy from party activists to make the courts a central issue in the 2020 race.

Demand Justice, a group founded to counteract the conservative wing’s decades-long advantage over liberals in judicial fights, will release a list of 32 suggested Supreme Court nominees for any future Democratic president as they ramp up their push for the 2020 contenders to do the same.

The slate of potential high court picks includes current and former members of Congress, top litigators battling the Trump administration’s initiatives in court, professors at the nation’s top law schools and public defenders. Eight are sitting judges. They have established track records in liberal causes that Demand Justice hopes will energize the liberal base.

Seems like the progressives have FINALLY learned the lesson of paying some attention to the third branch of the government.

Now you can go ahead and take a look at that list and if you are like me, be absolutely puzzled by who all those people are. Lucky for us commoners, Carrie Severino from the Judicial Crisis Network just yesterday wrote a piece over at National Review called Demand Justice’s SCOTUS List Is Too Extreme Even for Obama that helps give us an idea of the backgrounds of these folks.

Demand Justice’s list has 32 names on it. Only four of those are Obama-nominated judges. Shockingly, only eight have any judicial experience at all! While President Trump’s list of Supreme Court nominees currently includes 24 individuals, of whom 23 are experienced federal or state judges, the extremists at Demand Justice have clearly taken a different tack. Their list — which they are lobbying Democratic candidates to adopt — is wholly consumed by far-left activism and identity politics.

They see the courts as their ticket to implementing their radical policy agenda, which includes gutting the First and Second Amendments, establishing a right to illegal immigration and abortion on demand straight through birth, and destroying our economy by imposing burdensome regulations on everyone from Main Street to Wall Street.

When I first read this I thought, well maybe the Obama nominated judges that were confirmed don’t have enough seasoning yet. Then further on reading, I find out that 24 of them don’t have ANY JUDICIAL EXPERIENCE at all.

Did no one pay attention during the Harriet Miers fiasco under Bush 43?

So the left has put together a list of people that they want on the court that the vast majority have ZERO experience on the bench. They are straight-up activists. I actually admire Demand Justice brazen truthfulness here in trying to push this on the Dems.

Severino commented on twitter about how the candidates when finally asked ran from the subject and tried to change the subject like it was the plague.

What this tells me is that the left is organizing to do the same thing conservatives have done but the candidates are not focused on this at the stage of the game they are currently in. This might change after a nominee is picked but for now, it looks like they are more interested in impeachment than who they would put onto the court.

That works for me.

Almost certainly the most offensive aspect of our fake “free trade” with Communist China – is their titanic theft of our Intellectual Property (IP).

Over the decades of fake “free trade” – Communist China has stolen trillions of dollars of our IP:

We’ve been fake “free trading” with China since the early 1970s.

But as a safety, let’s only calculate Chinese IP theft – since we quite stupidly granted them membership in the World Trade Organization (WTO): December 2001.

And as another safety, let’s take the lowest number in China’s annual IP theft range.

That’s $225 billion in Chinese IP theft.  Every year – for eighteen years.

That makes the most conservative estimate – more than $4 TRILLION in Chinese IP theft.

And it’s not just the money – though the money is gigantic.

Totalitarian Communist China is rapidly becoming our equal on the global stage.  A truly disconcerting concept for anyone who likes, you know, freedom and peace.

And totalitarian Communist China got here not by their own creation and invention – but by stealing ours.  For decades.

Intellectual Property isn’t just about licensing patents, trademarks and copyrights.

IP is about protecting the property of the minds of men.  So we can all have access to and use those creations and innovations – to improve our lives and advance our society.

Communist China outsourced their IP creation – to US.  Advancing their totalitarian state not by their ingenuity – but by stealing ours.

And for decades, the Swamp Creatures – did absolutely nothing about it.

Except secure mass Communist China money transfers to their families and friends.

This has been a MASSIVE, government-forced transfer of IP and its attending wealth and societal benefit.

What Did Government Use for Light Before Candles? Electricity

 

The answer to everything even remotely policy-related – is less government.

Because the original sin of everything even remotely policy-related – is too much government.

Want to solve our health care “crisis” – ???  Undo the original government sins.

After World War II – taxes were kept at during-WW II levels.  So in an end run around this too much government – the private sector started offering employees untaxed “benefits”…including health insurance.

Post-WW II set up a bizarre, antithetical-to-Reality system…where health insurance isn’t tied to the person – it’s tied to the person’s employer.  Which is inherently very stupid.

Post-WW II set up a bizarre, antithetical-to-Reality system…where health insurance stopped being a catastrophic policy, and started paying for EVERY encounter with a health care provider.

Car insurance pays when you wrap your car around a tree.  Imagine how stupid and expensive it would be – if they were paying for everything up to and including oil changes and windshield wipers.

Post-WW II also set up a bizarre, antithetical-to-Reality third-party-payer system.  The doctor and patient are in the room negotiating services and terms – the guy picking up the tab is not.

Which guarantees skyrocketing prices and costs.  Because human nature.

A buyer wants to buy as much as he can.

A seller wants to sell as much as he can – for as much as he can.

The check and balance upon these billions of daily commercial exchanges – is the buyer’s wallet.

The buyer wants to conserve his coin – so he perpetually looks for the best deals.

The seller wants to sell – so he and the buyer negotiate mutually agreeable deals.

If the guy picking up the tab isn’t involved in the process – price is no object.  And things quickly get REALLY crazy.

Seven decades of third-party-payer health insurance later – things have become really, REALLY crazy.

You want more government further screwing up health care?  There’s plenty, you know.

Medicare, for instance.  You know, the third-party-payer government health care plan for senior citizens.

Medicare is currently at least $40 trillion short.

Medicare doesn’t actually completely cover seniors – so the private sector has to backstop the government.  Medigap, anyone?

And Medicare actually pays medical providers ridiculously low rates for medical goods and services.  So since Medicare’s inception – medical providers have been price-shifting to the private sector.  Charging the private sector much, MUCH more – to subsidize the government.

Steadfastly impervious to facts, Leftists everywhere want to murder private health insurance – and force feed us all into Medicare’s bankrupt, gaping maw.  Medicare for All – is medical care for none.

The solution to this titanic government-caused mess – is less government.  Not more – less.

Allow people to purchase policies in any of the fifty states.

Equalize the government’s treatment of individual-purchased and employer-provided insurance.

And begin to roll back the government’s third-party-payer involvement in…everything.

Another area where government keeps rigidly insisting on inserting itself – is the Internet.

The Internet is perhaps the most successful endeavor in human history.  Nothing has grown bigger, better and faster.

The federal government did in fact create the Internet.  And for decades, it just sat there – inert…gathering dust.

Until the 1990s.  When the government privatized the Internet.  At which point – KABOOM.

United States’ private Internet Service Providers (ISPs) spent the next quarter century investing $1+ trillion dollars building the networks.  Taking us from 14k dial-up snail speeds – to multiple gigabyte hyper speeds.

Which paved the way for millions of other companies to invest trillions of additional dollars creating and developing…everything we know on the Web.  And a whole lot of stuff we don’t.  (It’s a BIG Internet.)

Government controlling the Internet – kept it an unknown, unused bit of nothing.  For decades.

The private sector handling the Internet – created the free speech-free market Xanadu we all know and love today.

Steadfastly impervious to facts, Leftists everywhere want to roll back this titanic private sector success – and revert to a government-controlled Internet.

They want to re-impose the very ridiculous Network Neutrality.  Which an avowed Marxist describes thus:

“At the moment, the battle over network neutrality is not to completely eliminate the telephone and cable companies. We are not at that point yet. But the ultimate goal is to get rid of the media capitalists in the phone and cable companies and to divest them from control.”

How very Venezuela of them.

To “get rid of the media capitalists in the phone and cable companies and to divest them from control” – you need government Internet as a replacement.

Which Leftists have already long been funding.  How’s that been going?  Remarkably like government health care.

Broadband Boondoggles: A Map of Failed Taxpayer-Funded Networks:

“Unfortunately, these municipal networks often don’t deliver or fail, leaving taxpayers to foot the bill.

One of the angles Leftists attempt to work in defense of their government Internet efforts – is the lack of Internet access in America’s rural areas.

For those of you who are government school victims – the United States is a VERY large place.  Reaching the US’s very many uber-rural areas with uber-fast Internet – ain’t easy.

That being said, this alleged problem – is already exceedingly overblown:

“(T)he (Federal Communications Commission) FCC still bizarrely only counts a hardline (terrestrial fixed) Internet connection as a connection.  Meaning buried cables criss-crossing America – all the way into your abode.

“But nearly everyone in America has a 4G (Fourth Generation) wireless smartphone. On which you can seamlessly stream High Definition (HD) video – the most bandwidth intensive thing currently to do on the Internet.  (And we’re but a few years away from exponentially-faster-5G).

“And then there is Satellite Internet – for the remaining very few who are bereft of both wired and cellular wireless.

“And those…speeds that serve as the FCC minimum?  They are WAY faster than 98+% of Americans currently need.

“The Truth About Faster Internet: It’s Not Worth It:

“‘Typical U.S. households don’t use most of their bandwidth while streaming and get marginal gains from upgrading speeds.’

“So even while streaming High Definition (HD) video – the most bandwidth intensive thing currently to do on the Internet – ‘typical U.S. households don’t use most of their bandwidth.’

“In other words – just about everyone in America has more-than-sufficient access to the Internet.”

As just mentioned, government has for decades been trying to replicate private ISPs.  And as just mentioned – has been perpetually, miserably failing.

And wait: Here come’s the private sector – yet again riding to the government’s rescue.  And all the rest of us too.  Via the aforementioned 5G wireless network:

“(T)he 5G wireless network – is going to blow the doors off of even the existing, massive private sector success.

“And thereby blow an even larger hole in the Left’s demands for government Internet.

“How 5G Will Solve Rural Broadband:

“‘Starting with advanced versions of 4G LTE and then continuing with 5G, wireless technologies will not only displace many wireline endpoints in dense population areas, but also in low population density areas, including rural areas….

“‘The cost advantage of wireless connections is overwhelming.

“‘A spokesperson for the Wireless ISP Association (WISPA) estimates that a wireless connection to a rural endpoint costs one-fifth to one-tenth of a wireline connection….

“Translation from Tech-to-English:

“The Left’s idea to get into the government into the broadband business – is currently very stupid and dishonest.

“Thanks to the private sector.

“And the Left’s idea to get the government into the broadband business – is about to get exponentially stupider and more dishonest.

“Thanks to the private sector.”

Because service to every single nook and cranny of the United States – is about to get massively faster wireless Internet service.

Thanks to the private sector.

Yet again saving us from government.

And yet again saving government from itself.

Lindsey Graham Talks Turkey (Interview With Kilmeade)

This morning, Brian Kilmeade aired an interview he did with Lindsey Graham while he was in South Carolina yesterday. They covered both the recent developments regarding Syria and Turkey and the ongoing impeachment imbroglio.

Graham reiterated points he made earlier in the week, as covered by my colleague, Brandon Morse, including his threat/promise to sanction Turkey heavily if it continues to invade Syria:

GRAHAM: I’m more concerned than ever. The Kurds were talking to Assad because they’ve got no other place to go. Turkey said today, we’re not going to take over the ISIS prisoner camps except in the areas that we occupy. Our Kurdish allies are being killed by Turkey as I speak.

….

What we’re doing to the Kurds is dishonorable and it’s dangerous for us because if Turkey keeps coming into Syria and going after the Kurdish fighters who fought with us to defeat ISIS, then ISIS will break out in Iran and Assad will be the biggest winner.

I talked with the president. I hope he’ll change course. I’ve got sanctions against Turkey that I will introduce next Tuesday. These are sanctions from hell. I’m going to break Erdogan’s economy and cut off all aid to the military. And it really pisses me off, Brian, that F-16s designed in — by the Americans are being used to bomb the Kurds by Turkey. (emphasis added)

These comments are more in line with the comments he’s been making publicly since the President announced Sunday his intention to pull out troops. As noted by fellow RedStater Bonchie last evening, Graham’s comments to Russian pranksters posing as the Turkish Defense Minister held a slightly different tone. Still, they’re not wholly inconsistent. I’d characterize them as…carefully nuanced. In fact, in the interview with Kilmeade, Graham acknowledged the thorny situation involving the YPG Kurds and Turkey:

GRAHAM: OK, so what I said three years ago, the YPG Kurds are the cousins of the PKK. They’re a terrorist group inside of Turkey. The PKK is seen as a terrorist group by the United States. The YPG is a Syrian offshoot of that group. They were the only ones that would fight with us — a few Arabs — to destroy ISIS, so we had to make an alliance with the Kurds because nobody else would help us.

We owe it to them to not abandon them, but we owe to them to not abandon them, but we owe it to Turkey to keep this group they consider to be terrorists away from the Turkish border. That’s what the safe zone was about. It was working until President Trump gave in to a threat by Erdogan.

Graham elaborated on the “fix” he would recommend:

KILMEADE: — is there a fix?

GRAHAM: Yes, yes. Here’s the fix. Join my effort to sanction Turkey for their incursion into Syria. We’re hitting their energy sector. We’re going to cut off all military aid. We’re going to hit their economy and really cripple Erdogan. If you join in with the congressional effort to sanction Turkey, he will get out because we’ll break his economy. And the sanctions stay in place as long as Turkey is in Syria.

Number two, you should send some soldiers in to make sure that these ISIS prison camps, that they don’t break out.

KILMEADE: Right now. Right now.

GRAHAM: Right now. Mr. President, while you have a chance, there are about 12,000 ISIS fighters who are going to break out if you don’t do something. So what I would do is tell Erdogan we’re going to send in, you know, whatever number you need — talk to General Keane — to secure these prison camps. And if you come anywhere near us, we will blow you out of the sky and blow you up.

Now, if he did that, we could reset. And how does this end? Have a safe zone between Turkey, because they feel threatened by the Kurds. We can tell Turkey we’ll keep the YPG Kurds away from the Turkish border, we’ll have American, Turkish, and international forces patrolling this safe zone, we can watch ISIS together, and we can put Syria back together again, get a peace deal in Geneva.

Graham notes that he’s spoken to President Trump directly on the issue. Clearly, he’s hoping to nudge the President via his public comments, as well. Will it work?

I’ve seen sound arguments on both sides of the issue. Mike Ford, for instance, has written a compelling series of articles on the topic right here this week. I know that Graham generally is considered a hawk (and rightly so) and has interventionist instincts that diverge from Trump’s. His proposed “fix” makes a lot of sense to me, however. Barack Obama spent his first two years as President – enjoying a Democrat-controlled Congress that was as awful for America as he was.

The Democrat Congress passed a lot of really awful legislation – which Obama very happily signed.

We the People loathed said legislation.  So We incepted the Tea Party Movement – and elected a Republican House majority the very next chance we had.

We did this – to impede the previously unimpeded flow of really awful Democrat legislation to which we had been subjected.

Obama’s response to our electoral blockade?  Let’s just say it wasn’t self-reflective – or respectful of our wishes:

“We are not just going to be waiting for legislation….I’ve got a pen – and I’ve got a phone.  And I can use that pen to sign executive orders and take executive actions and administrative actions….”

But wait a second….  Here’s Obama in 2008 – running for the gig:

“We’re not going to use signing statements as a way of doing an end run around Congress.”

I much prefer Obama – Edition 2008.

Why any Republican would seek to emulate Obama 2.0’s executive fiat policy – is light years beyond me.

But that’s exactly what some Republicans may be trying to do.

“Behold – Tennessee Republican Senator Lamar Alexander.  Who very recently penned an editorial defending his government-expanding decision.  His very own title – admits the inherent error.

“‘Lower Health Care Costs Act’ Aims to End Surprise Billing

“Your legislation ‘aims to end surprise billing’ – ?!?

“Government is the worst shot in the history of aiming.

“Obamacare aimed to ‘reduce premiums by $2,500 per year.’  They DOUBLED.

“I guarantee you no one around at Medicare’s inception said they were aiming to put US taxpayers $38 trillion underwater.  Yet that’s what it’s done.

“Yet Senator Alexander #Persists.”

While Alexander #Persists in the Senate – Texas Republican Congressman Kevin Brady may be in the throes of #Persist in the House.  And may be – looking to go one awful step farther.

Massachusetts Democrat Congressman Richard Neal realizes this legislative duck his dead.  So Neal is looking to end run the Congress to which he was elected – and obviously shouldn’t have been:

“House Ways and Means Committee Chairman Richard Neal (D-Mass.) is proposing a new way to move forward on crafting rules to protect patients from surprise medical bills….

“In a letter to Democratic lawmakers…Neal is proposing a new solution that would essentially punt the details of the fix to a committee consisting of stakeholder groups and the departments of Health and Human Services, Labor, and Treasury.

“The committee would come up with recommendations that would then be issued in a regulation from the administration.”

This is a Congressman – and the Chairman of an allegedly important Committee.  His constituents elected him to the Legislative Branch – thinking they were electing someone to draft and vote upon legislation.

And this person is looking to “punt the details of the fix to a committee consisting of stakeholder groups and the departments of Health and Human Services, Labor, and Treasury.”

Which is an entire gaggle of people – whom NO ONE ELECTED.

This is an unelected gaggle – made up of industry lobbyists…and career Swamp bureaucrats.

Now, we know lobbyists write most of the bills Congress extrudes. Here, gone is even the pretense of legislators legislating.

This unelected gaggle would draft a…not a bill, because that’s what Neal and his colleagues are supposed to draft.  This unelected gaggle would draft a…something.

And then the three departments’ worth of unelected bureaucrats – would unilaterally impose what they’ve unilaterally concocted.

NONE of this has ANYTHING to do with the Constitution – or the representative republic the Constitution created.

If We the People don’t like what these clowns have done to us – we can’t do a thing about it.

Where are the Republicans on this unilateral assault on our Constitution, government and freedom?

The answer isn’t heartening:

“Neal wrote in the letter that he is ‘optimistic’ that Rep. Kevin Brady (Texas), the top Republican on the committee, will agree to his proposal.

The ONLY government attempt – MUST come directly from the Legislative Branch.

Your inability to pass this awful piece of legislation – is what the FBI used to call a clue.

You can’t pass this awful piece of legislation – because members of the Legislative Branch have rightly deemed it awful.

This is supposed to mean – the bill dies.

It is NOT an invitation to outsource your gigs.

It is NOT an invitation to hand off crafting law – to unelected lobbyists and bureaucrats.

It is NOT an invitation to the impose this unconstitutional creation – via Obama-esque unilateral fiats.

Congress:

Do your jobs.

Which very often means – doing nothing at all.

Trump Is Correct on Net Neutrality Court Win – But That Wasn’t the Whole Ruling

President Donald Trump early Monday morning Tweeted:

“We just WON the big court case on Net Neutrality Rules! A great win for the future and speed of the internet. Will lead to many big things including 5G. Congratulations to the FCC and its Chairman, Ajit Pai!”

All of which is absolutely correct.

The US Court of Appeals for the DC Circuit did in fact rule the Trump Administration’s decision to undo the Barack Obama Administration’s unilateral, illegal imposition of the ridiculous Network Neutrality – was Constitutional and legal.

The courts upholding the Trump Administration restoring order – after lawless Obama Administration illegal, unilateral power grabs – is by no means a fait d’acomppli.

Appeals Court Upholds Block on Trump’s Attempt to End DACA

The Obama Administration – under its unilateral, illegal Deferred Action for Childhood Arrivals (DACA) – declared ill-defined, amorphous amnesty from prosecution for millions of illegal aliens.

Somehow, multiple clowns in gowns have ruled the Trump Administration’s attempt to revert to immigration law actually passed by our elected Congress – is illegal.  The courts – are thereby codifying the Obama Administration’s lawlessness.

So we are thankful for the DC Circuit’s excellent tether to Constitutional sanity with its Net Neutrality rollback ruling.

Most unfortunately, the Court left open a hole huge enough for a Leftist caravan to roll on through:

“The federal appeals court’s decision upheld the FCC’s reclassification of broadband Internet access service as an information service, rather than as a telecommunications service, but argued that states can pass their own net neutrality legislation.”

Emphasis ours – because that is a TERRIBLE ruling:

“This…(is) a clear violation of the (Constitution’s) Commerce Clause:

‘[The Congress shall have Power] To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes.’

“The Commerce Clause was – like all of the Constitution – a government-limiting entry. It was written to prevent states from big-government-imposing barriers to interstate commerce.

“How to Understand the Commerce Clause in One Simple Sentence:

“‘Congress has the authority to regulate trade between the states; or in other words, the process of goods and services moving from one state to another. Not the products themselves. Not the process of creating those products. Just the act of the products moving from state to state. That’s it.’

“Get that eminent simplicity?

“Let us…focus on the ‘trade between the states…(and) the process of goods and services moving from one state to another.’

“Bits on the Internet – criss-cross state and international borders hundreds of millions of times a second.

“To think that a single U.S. state here or there has the prerogative to regulate something that is so obviously a Commerce-Clause-federal-responsibility – is warped, ideological nonsense.

“It violates both the letter and the spirit of the deregulatory Commerce Clause.

“Because it exponentially grows government.”

Indeed it does.  To trained lawyers appointed as judges – all of this should be quite obvious:

“(T)he WORLD Wide Web is clearly a federal government issue.  The Feds determine our nation’s Internet policy.  And then The Feds negotiate Internet interactions with other nations.”

The federal government cannot successfully do that – if its policy is incessantly being exceeded or undercut by a state here or there.

State-by-State Net Neutrality Laws Breakdown:

“More than half of states in America are opposing the FCC’s ‘Internet Freedom’ bill with local Net Neutrality state laws.”

Washington Governor Signs First State Net Neutrality Bill

California’s Net Neutrality Bill Is Back and as Tough as Ever:

“‘This will be the most comprehensive and the strongest net neutrality protection in the United States, where we are restoring what we lost when Donald Trump’s FCC obliterated net neutrality,’ (Democrat state Senator Scott) Wiener told reporters….”

So the DC Circuit Court’s ruling – undercuts its ruling.

Their Honors ruled the Trump Administration can restore order – until the many states destroy order.

Internet Service Providers (ISPs) – will be forced to deal with an insane patchwork quilt of fifty different Net Neutrality regulatory regimes.

Complying with this nightmare mess – is going to cost ISPs a LOT of time and money.

Time and money I’d rather them spend – on increasing speeds and decreasing prices.

The federal government will have to take this titanic mishmash of fifty-state-regime Brunswick Stew (a dish famous for containing any and everything).  And try to cobble together a semi-coherent federal policy.  So as to try to incorporate our Internet – with the rest of the planet’s Internet.

Are you familiar with the expression…?

A Camel Is a Horse Designed by a Committee:

“An expression critical of committees – or by analogy, group decision-making – by emphasizing the ineffectiveness of incorporating too many conflicting opinions into a single project through compromise.

“In this figure of speech, the distinguishing features of a camel, such as its humps and poor temperament, are taken to be the deformities that resulted from its poor design.”

Imagine a REALLY surly camel – with fifty different humps.

That will be US Internet policy.

An incoherent mess.  Caused by federal officials having to constantly look over their shoulders for fifty different, often shifting Net Neutrality regulatory mandates.

Rather than looking forward – at how to best situate US in the global Internet regime.

This ain’t great for our nation.

This ain’t in compliance with the Constitution’s Commerce Clause.

The latter, of course – guarantees the former.

Because, as always – the further we get from Constitutional compliance…the worse things get for us all.

Man’s Reach Should Exceed His Grasp

 

The spark of creation – is truly a gift from God.

The ability to use one’s mind to bring forward something from nothing – literally gets us about as close to our Creator as can be expected on this planet.

While I know not everyone ascribes an other-worldly power to creation – I know others appreciate it.

Entrepreneur extraordinaire Peter Thiel – certainly, for whatever his reasons, values creation.

Thiel’s ability to create – made him a billionaire.

And Thiel re-demonstrates his appreciation of creation every day – as a venture capitalist.  He looks for other creations he thinks are worthy – and puts his money where their ideas are.

Thiel co-wrote the book “Zero to One: Notes on Startups, or How to Build the Future.”  Which is an edited collection of class lectures he’d given – on the vital import of creation.

In it, Thiel describes “One to…” – the replication of an idea.  You have a product that works in the US – so you start selling it in Europe.  And Asia.  And.…

But before you can go from “One to…” – you must go from “Zero to One.”  Before you can re-create – you must create.

I am a retired musician.  I failed to sell the fifteen million records I had in mind – but I long engaged in the pursuit thereof.

I created the songs we played (when we weren’t in college bars – and had to recreate songs other people wrote that the audiences recognized).

My “writing process” – was to me nothing short of miraculous.  The songs would literally roll over me like a wave.

I would go from nothing – to having words and music totally done…in like thirty seconds.  Maybe a minute.  It was crazy.

And all along the way, I have been writing prose.  My first published thing was a fictional short story in fifth grade.

For these reasons – and thousands more – I have always valued creation…and the creators.

Not just because of the things I can create.  But most especially because of the things I can not.

Radio impresario Rush Limbaugh has a personal and highly effective definition of art – for people who can not create it:

“Art is something I can not do.”

I think the creation of anything real – is art.

The movie “Flash of Genius” – is the Hollywood interpretation of the true story of inventor Robert Kearns.

Kearns invented the intermittent windshield wiper.  Prior to his flash of genius – and his diligence in bringing it to physical reality – wipers were either off…or on very, very fast.

Kearns’ intermittent wiper – dealt with intermittent precipitation.  Simple, eloquent brilliance.

Kearns created his wiper in the late 1960s.  He patented it.  And then pitched it to Detroit’s Big Three automakers – General Motors, Ford and Chrysler.  Trying to entice them into licensing his creation.

All three declined.  And then all three began producing cars – with intermittent wipers.  Big Business – had yet again screwed the Little Guy Inventor.

Kearns spent the next several decades as an automotive Don Quixote – trying to tilt the Big Three into admitting they’d stolen his idea.

Kearns’ pursuit of justice – cost him his family.  His wife left him under the stress and strain – and took their six children with her.

Over the decades, Kearns was repeatedly offered increasing sums of money.  But he refused them all – because the coin wasn’t accompanied by their admissions the creation was his.

In the movie, someone exasperatedly says to Kearns: “It’s just a windshield wiper.”

To which Kearns rightly, righteously replies: “To me – it’s the Mona Lisa.”

To clean-up-quote “The Shawshank Redemption” – “That’s…right.”

Human nature informs us here of two immutable things.

One:

A society that appreciates and respects creation and creators – is a place of light and jubilation.

When creators can benefit from their creations – they share them with all of us.  And then we all benefit.

Our lives are easier, and better, and richer – thanks to the creators’ creations.

In a society that appreciates and respects creation and creators – creators are compensated.

If a creator make things better for hundreds of millions of people – the compensation certainly should be at least in the millions of dollars.

And in a society that appreciates and respects creation and creators – no one begrudges the man his millions.

But…Two:

A society that steals the creations from creators – is a place of darkness, resentment and anger.

Creators who have their creations taken from them – will do everything they can to keep them secret.  And even worse – stop creating them.

Which means we all are deprived of them.

Our lives are then harder, and worse, and poorer.

We are left dirty, angry and crouched.  Huddled around open fires in caves – fighting each other for whatever scraps we can find.

In 1651, Thomas Hobbes published “Leviathan.”  In which he describes this latter, awful state of man:

“In such condition there is no place for industry, because the fruit thereof is uncertain, and consequently no culture of the earth, no navigation nor the use of commodities that may be imported by sea, no commodious building, no instruments of moving and removing such things as require much force, no knowledge of the face of the earth, no account of time, no arts, no letters, no society, and which is worst of all, continual fear and danger of violent death, and the life of man, solitary, poor, nasty, brutish, and short.”

All of which is why Abraham Lincoln:

“Called the introduction of patent laws one of the three most important developments ‘in the world’s history’ – along with the discovery of America and the perfection of printing.”

Because prior to Intellectual Property protection, life for just about everyone throughout human history – was “solitary, poor, nasty, brutish and short.”

Life with respect for individual property – is the United States.

Life with a mandate of communal property – is Venezuela.

We’ll close with with one final juxtaposition – this one in Afghanistan.

Give or take 1,700 years ago – creators therein created two towering, astonishing and beautiful stone Buddhas.

And in 2001, the Taliban destroyed them.

In which society do you wish to live?
