She could be growing tomatoes.

She could be digging in the dirt, sporting her wide-brimmed straw hat.

She could be enjoying retirement, having lived in the White House and served in government.

Or she could be running for office again.

Or running a frozen banana stand.

Or anything else in the present, headed for the future.

But for some unknown and paralyzing reason, Hillary Clinton cannot let it go.

She can’t catch up to November 9th, 2016 — the day she awoke to a lost campaign.

She’s still somewhere — or, somewhen — on November 8th or before.

It’s been nearly three years.

But bitterness is a heck of a time machine.

And Hillary’s DeLorean-ensconced.

Hence, the former First Lady took to Twitter to offer something not only resentful but also ridiculous. 

She quoted civil rights attorney, Democratic Texas Rep. Barbara Jordan from 1974:

“If the impeachment provision in the Constitution of the United States will not reach the offenses charged here, then perhaps that 18th-century Constitution should be abandoned to a 20th-century paper shredder!”

Barbara was referring to the shenanigans of Richard Nixon.

Hillary was, of course, referring to the impeachment of her hus– I mean, Donald Trump.

So Trump’s offenses are so extreme that the founding document of our nation should be shredded if they don’t apply?

I have a suggestion: How about, instead, say something not completely absurd? Just an idea.

But let’s go with this.

Is impeachment reasonable?

As I covered previously, Tucker Carlson and Neil Patel say no:

The key question with Trump’s Ukraine call, though, is whether the president’s actions, advisable or not, rise to the level of an impeachable offense. It’s hard to argue they do. The president did not, as was first reported, offer a quid pro quo to the Ukrainians. He did not condition any U.S. support on a Biden investigation. The Justice Department has already looked at the totality of the call and determined that Trump did not break the law.

Additionally, though impeachment may be, for Hillary, a shot of the ol’ euphoria like a grand inhalation at the dentist’s, on the other side of the proceedings will lie something else shredded: the Democrats’ hope for 2020 success. For reasons stated here, here, here, and here.

And the failed 2016 candidate’s helping it right along.

She shoulda stuck with the tomatoes.

But she’s stuck far behind in the past. And she can’t ketchup.

A lot of information is coming out now which is effectively destroying the credibility of the complaint of the Ukraine whistleblower, from the knowledge that the whistleblower had contacts with Rep. Adam Schiff (D-CA) while Schiff was saying publicly that he had no contacts, to the Volker testimony that was just released completely blowing the claims in the complaint out of the water.

We also found out the person is, big surprise, a registered Democrat.

But now there’s more information and it may spell big trouble for the whistleblower, if true.

From The Federalist:

According to Fox News investigative reporter Catherine Herridge, ICIG Michael Atkinson testified before the House Permanent Select Committee on Intelligence (HPSCI) that the anti-Trump complainant, whose identity has not been made public, did not inform the ICIG in his complaint that he or his team had already contacted Democratic staff working for Rep. Adam Schiff, D-Calif., the chairman of the House intelligence committee.

Another contact involved the whistleblower writing a letter to Schiff on August 12, informing him about his concerns. The letter contained an attachment which has not been released. But the complaint was allegedly dated August 12.

The Federalist explains why this failure is such a problem:

The complainant’s failure to disclose his interactions with Schiff or his staff could put him in legal hot water, as the whistleblower form he submitted requires individuals to disclose “other actions you are taking on your disclosure” under penalty of perjury. An entire page of the whistleblower form is dedicated to collecting information about previous disclosures so the ICIG can take appropriate action in response to the complaint.

“I have previously disclosed (or am disclosing) the violations alleged here to (complete all that apply),” the form requires the complainant to attest. The form includes checkboxes for disclosures to other inspectors general, other agencies, the Department of Justice, the Government Accountability Office, the Office of Special Counsel, other executive branch departments, Congress and its respective committees, and media. It also includes a separate question asking the complainant to detail those previous disclosures to the ICIG.

The bottom of the form requires the complainant to swear to the truth of everything asserted or the person could face prosecution for a false statement, a felony that could earn one five years in prison.

The Federalist confirmed with an official that the box about notifying Congress was left empty.

It is not clear exactly when the contact with the aide was made or whether there were potentially other contacts. But the contact with the aide, who told the whistleblower to go the ICIG obviously preceded filling out the form for the ICIG, hence the problem.

In addition to trying to strong-arm cable news outlets into suppressing the Hunter Biden angle of the Ukraine story, Joe Biden is now refusing to answer certain questions about it during press conferences.

The embattled 2020 Democratic candidate was in Los Angeles today for a labor union summit and while there took some questions from reporters about his campaign and, of course, Trump and the Ukraine issue.

One exchange he had with a reporter was particularly intense, and it was in regards to his role during the Obama administration overseeing United States policy towards Ukraine while his son Hunter was a board member for a Ukrainian gas company.

The reporter got straight to the point. “How was your role as vice president in charge of policy in Ukraine and your son’s job in Ukraine – how is that not a conflict of interest?”

“It’s not a conflict of interest,” Biden emphatically responded. “There’s been no indication of any conflict of interest from Ukraine or anywhere else. Period.”

As the reporter attempted to interject and ask about even the appearance of a conflict of interest, Biden shut him down.

“I’m not going to respond to that,” Biden yelled. “Let’s focus on the problem. Focus on this man, what he’s doing, that no president has ever done. No president,” Biden loudly continued while aggressively pointing his finger at the questioner.

During the same press conference, Biden was asked about the golf photo of himself, his son, and a Ukrainian gas company executive shown in the now-deleted Nickelback video Trump shared on Twitter earlier this week, and whether he stood by the statement that he never discussed his son’s business dealings overseas. He says he stands by it:

So how’s the recently-released book on much-hated/much-loved Brett Kavanaugh doing?

Firstly, there appears to be some missing information, as observed by Fox News:

The…book, titled The Education of Brett Kavanaugh: An Investigation, faced a bumpy road at the outset as its authors faced criticism for not including what many saw as critical information about a sexual misconduct allegation they relayed in an excerpt published by The New York Times.

As for the sales report, well, it ain’t so good:

(NYT) writers Robin Pogrebin and Kate Kelly saw just over 2,000 copies sold in the week it debuted mid-September, market research data revealed. The data came from the NPD Group’s BookScan tracker, which covers about 80 percent to 85 percent of print sales.

The slump might certainly be attributed to the public’s hopes to never, ever hear about the hubbub again, given the climax of madness during Brett’s confirmation hearings (here and here).

Somehow, certain groups reached the fever pitch of insisting that all women should always be believed in all circumstances about all things. The hysteria even came with nonsensical phrases such as “Believe All Victims”: Of course, victims should be believed; but you first must determine whether they’re victims. Therefore, investigation must precede surety.

But not in that moment of madness.

So are the no-good numbers due to disinterest? Not if another book is any indication — one that was, incidentally, written by Fox News contributor Mollie Hemingway and Judicial Crisis Network Chief Counsel Carrie Severino.

Justice on Trial has trounced the other Brettfest:

In the first week after publishing Justice on Trial, the book saw more than 17,000 book sales and it eventually reached multiple bestseller lists. Justice on Trial sales slowly declined to roughly 1,700  around the time The Education of Brett Kavanaugh: An Investigation was released. But by the second week of publication for that book, it had already fallen behind Justice on Trial in weekly sales.

As of the week of Sept. 22 – 28, Hemingway and Severino sold more than 55,000 copies and enjoyed 15 weeks ranked among Amazon’s top 10 selling books. That included two weeks as No. 1 and four weeks as No. 2. By contrast, The Education of Brett Kavanaugh ranked 68th on Amazon after its release and quickly dropped to 168th in the following week.

Regnery Publishing, which released Justice on Trial, told Fox News that it sold over 100,000 copies in ebook, print and audio formats.

Looks like Donald Trump has an opinion as to why the new book’s done so poorly:

“I call for the Resignation of everybody at The New York Times involved in the Kavanaugh SMEAR story, and while you’re at it, the Russian Witch Hunt Hoax, which is just as phony! They’ve taken the Old Grey Lady and broken her down, destroyed her virtue and ruined her reputation… She can never recover, and will never return to Greatness, under current Management. The Times is DEAD, long live The New York Times!”

He’s a man with an opinion, folks.

Will The Education of Brett Kavanaugh rally? It remains to be seen.

For more on the aforementioned missing info, here’s Fox once more:

The initial excerpt contained allegations that Kavanaugh’s genitalia was thrust in a woman’s face during his college years. When The Times published the excerpt in its opinion section, it omitted the fact that the alleged victim herself had no memory of that happening. According to the reporters, that omission was an “oversight” by the paper’s editors.

Joe Biden might think he can tightly control his campaign messaging, but Fox News just let him know today that he has another thing coming.

Last night, I wrote about a threatening letter sent to the cable news outlet from Biden’s campaign warning them not to run a new ad from the Trump campaign on the Ukraine issue that will soon be airing in key early voting states as part of a massive ad blitz.

To recap, here’s what Biden’s team said in the letter:

In a letter to Fox News and Fox Business general counsel Lily Claffee, Biden campaign manager Greg Schultz wrote that the ad “falsely states” that “Biden offered Ukraine $1 billion to fire the prosecutor investigating a company affiliated with his son.”
[…]
“Though the Trump campaign is prepared to fabricate outright lies, your station’s airwaves should not be used to disseminate them,” Schultz wrote. “We are putting you on notice about the absolute falsity of the advertisement’s claims, and we expect that you will reject it. Please consider this letter a standing request that you reject any advertisement containing similar claims, regardless whether the Trump campaign or a third-party group seeks to place it.”

For those of you who haven’t seen it, here’s the ad:

CNN announced earlier this week they would not be running the ad, in deference to the Biden campaign in part because it disparages several of their news personalities, including Chris Cuomo, Don Lemon, and Jim Acosta.

Fox News has since issued a statement in response to the Biden campaign letting them know they will not bow to threats:

“We are not in the business of censoring ads from candidates on either side of the aisle. Vice President Joe Biden has a standing invitation to appear on any of our platforms.”

This isn’t the first time in recent weeks that Joe Biden has attempted to flex some muscle with cable news outlets in hopes of suppressing the Ukraine story.

Last week, Red State’s streiff wrote about how the Biden campaign was attempting to intimidate cable news networks into keeping President Trump’s personal attorney Rudy Giuliani off their airwaves, alleging he we was “spread[ing] false, debunked conspiracy theories on behalf of Donald Trump.”

Even if Biden happened to be successful in shutting down Giuliani from the airwaves and the Trump ad from Fox News, the fact remains that Trump himself will not be quiet about it and will continue to raise the issue into the general election campaign season, assuming Biden ends up being the nominee.

The Volker testimony has now been released and once again, we find that the Democrats’ version of the facts is false.

That fact explains why Republicans yesterday said there was no case after hearing his testimony and why Rep. Adam Schiff (D-CA) ran scurrying away from reporters refusing to comment.

The full transcript pretty much blows their theory of the case for impeachment out of the water.

Kurt Volker was a U.S. diplomatic envoy to Ukraine for two years. He said that contrary to the whistleblower complaint there was never any effort to get Ukraine to dig up dirt on Hunter or Joe Biden.

From The Federalist:

“As you will see from the extensive text messages I am providing, which convey a sense of real-time dialogue with several different actors, Vice President Biden was never a topic of discussion,” he said.

Volker testified that he never even mentioned a delay on U.S. military assistance to Ukrainian officials until late August, when news reports indicated that funding had been put on hold. Volker’s statement directly undercuts claims that the funding was part of a deliberate quid pro quo meant to force the Ukrainians to take certain actions in order for the military aids to be released.

Volker’s testimony also reflected badly on Democrats. Volker said that Trump didn’t have the best view of the Ukraine because of their involvement in allegedly helping the Democrats undermine him during the 2016 election and Trump was not happy with corruption in the country.

Volker testified that he believed the allegations of Ukrainian meddling in the 2016 U.S. presidential elections on behalf of the Democrats were “plausible.”

He said on the other hand that no one on the Trump team was trying to do that in the 2020 election. “The point about Ukraine avoiding anything that could play into U.S. elections in 2020 is a message that I know our Chargé in Ukraine, Amb. Bill Taylor, reinforced in other meetings,” Volker asserted.

He said that he was not on the Ukraine phone call being looked at, but that overall it was a “good” call and in no way was there any quid pro quo or linkage of aid related to the Bidens.

“All said it was a good, congratulatory call, that they discussed the importance of fighting corruption and promoting reform in Ukraine, and that President Trump reiterated his invitation to President Zelensky to visit the White House,” he testified. “I was not made aware of any reference to Vice President Biden or his son, which I only learned about when the transcript of the call was released on September 25, 2019.”

So if he didn’t even know Biden was mentioned he couldn’t really be helping to push for an investigation, blowing another whistleblower claim the Volker helped demands to look into Hunter Biden. The testimony also kills the whistleblower claim that aid was held up because they didn’t even know about it, so it couldn’t be any pressure. It wasn’t public until August.

Looks like Schiff and the other Democrats are flailing desperately, because their case is going down in flames.

New fundraising numbers have been posted by the Democrat primary candidates and they show some interesting shifts in the field.

Decrepit and bedridden Bernie Sanders led the pack with $25.3 million. Enough to buy a nice mausoleum.
Elizabeth Warren was second with $24.6 million.
Pete Buttigieg raised $19.1 million.
Joe Biden pulled in $15.2 million.
Kamala Harris finished the Third Quarter with $11.6 million.

If you ignore the silliness of Yang and Williamson, the real story is that Joe Biden is in a death spiral. His fundraising is down by 30%. He’s slipping in the polls, especially Iowa and New Hampshire. His South Carolina “firewall” looks very flimsy. The news swirling around about Hunter Biden’s financial shenanigans is not going to get better and you can bet President Trump is not going to let up so long as the Ukraine phone call bullsh** is being propped up as grounds for impeachment. Beyond that, Biden’s campaign staff is as sclerotic as Biden so by the time it responds to Charge A we’ve already moved on to Charge F (see my post Donald Trump, Impeachment, And John Boyd’s OODA Loop). Beyond the slowness of his campaign’s reaction time, Biden is not a fighter. He’s simply not temperamentally suited to engaging in the bare-knuckle brawl that Trump seems to relish as is shown by his response to the corruption allegations against his son. You’ll also notice that Biden has been abandoned by his fellow Democrats and is left to fight this out with just the help of his media friends and fluffers.

As a footnote, Harris is also toast…I find this sort of shocking as I would have bet good money that she’d be one of the top three candidates going into Iowa.

Everything is going Warren’s way. Biden is fading. Harris and Buttigieg have been revealed to be insubstantial lightweights. Bernie Sanders is unlikely to go back on the trail. Right now, if you were forced to make a prediction you’d say that she is the nominee. We’ll see how she does when President Trump and his team drop the twitching, tattered corpse of Joe Biden’s campaign and turn their gimlet eyes of Pocahontas.

Actor Robert De Niro doesn’t like President Donald Trump. He’s made that clear again and again.

But he’s done it, not by disagreeing with policies, but by being crude and obnoxious, cursing the president out on live television, infamously saying “F**k Trump” live on the Academy Awards last year. Two years before that he even threatened to punch Trump in the face.

He claims to be upset with the actions of the president.

But now he’s facing a federal lawsuit from someone who’s very upset with his actions.

Graham Chase Robinson, a woman who used to work for De Niro has brought a claim of gender discrimination and fostering an abusive working environment against him.

According to Fox Business, her attorney Jeremy Heisler said, “Ms. [Graham Chase] Robinson has no choice but … to send him a message: the Harvey Weinsteins of this world should realize their approach is extinct. You can no longer intimidate women. You can no longer threaten them.”

Variety details some of the allegations in the suit.

De Niro purportedly used sexist language, calling female employees “c—s” and “bitches,” and referred to Robinson, who was his executive assistant, as his “office wife.”

“Robert De Niro is someone who has clung to old mores,” the lawsuit reads. “He does not accept the idea that men should treat women as equals. He does not care that gender discrimination in the workplace violates the law. Ms. Robinson is a casualty of this attitude.” ….

In her suit, Robinson says she was underpaid compared to male colleagues and given “female duties like housework.” De Niro allegedly joked to Robinson about his Viagra prescription, asked her to imagine him on the toilet and suggested she could get pregnant using sperm from a married male co-worker.

Fox Business also notes that the suit claims De Niro allegedly gave her “unwanted physical contact” in addition to unwanted “sexually charged” comments.

Now an audio has been released in which De Niro goes on a profanity-laden rant against Robinson.

“You’re living in Spain, and you’re f***ing upset with me because you tell me how nice you have it and you f***ing don’t answer my calls? How dare you. You’re about to be fired. You’re f***ing history,” the “Goodfellas” actor can be heard shouting into the phone. “How dare you. With all the good things you do. This is f***ing bad. How dare you f***ing disrespect me how much you did. Don’t be angry with me ’cause I’m pissed off ’cause I didn’t get a simple thing that I need right now here in California, where I’m here less than 24 hours, you gotta be f***ing kidding me, you spoilt brat!”

Robinson’s team said that De Niro’s people knew they were going to sue and so they sued her first, accusing her of not doing her job, charging for personal expenses and misappropriating frequently flyer miles. She reportedly made an astonishing $300,000, according to Variety.

Her attorneys are now arguing that those comments have wrongly damaged her reputation.

A De Niro spokesperson said that De Niro denies all the allegations.

Donald Trump is a different kind of president. He’s certainly not afraid to call people by name and call out their shenanigans.

And on Friday, the Commander-in-Chief accused House Speaker Nancy Pelosi of being a scaredy cat.

Who’s Nancy shakin’ in her boots over? Seemingly, it’s the Quad Squad. Trump said House Democrats are following Alexandria Ocasio-Cortez and her compadres, not the Speaker. Is that why Pelosi moved forward with impeachment, despite being unable to name a “high crime or misdemeanor” that would warrant it? When asked about impeachment in the House, here’s what he had to say:

“They all vote with AOC and plus three; Nancy Pelosi is petrified of them.”

The Donald believes she has good reason to fear: Republicans are coming to oust her.

“I mean, she’s afraid that she is going to lose her position. Nancy Pelosi will lose her speakership right after the election when the Republicans take over the House.”

As for impeachment, the President insisted it’s a witch hunt, just like Russian collusion:

“Should’ve never happened. Just like Russia collusion should’ve never happened. That was a witch hunt. … Should’ve never happened.”

But Trump’s not worried about it, because he’ll be fine in the Senate:

“It think this: We have a great relationship in the Senate. I have a 95% approval rating in the Republican Party. I believe the senators look at this as a hoax, it’s a witch hunt, it’s a disgrace.”

Despite his allegation of Nancy knockin’ at the knees, Pelosi appears to think the same of Trump. On Wednesday, CNN reported the Speaker claiming he’s afraid of House Democrats and the probe that’s coming:

“I think the President knows the argument that can be made against him and he’s scared, and so he’s trying to divert attention from that to where (he’s) standing in the way of legislation.”

That’s all fine and good, but the Dems look to be in a real pickle. Despite their talk, in addition to the reasons I covered here, many congressional Dems may not want to be associated with something as pointed as an actual impeachment.

The Daily Wire stated it aptly:

Democrats have been sidestepping the requirement to bring impeachment proceedings to a full vote on the House floor. More than 30 members of the House Democratic caucus represent congressional districts that voted for Trump during the 2016 election cycle. The Democratic Party largely gained its House majority after a wave of the party’s moderate candidates were elected in those purple districts during the 2018 election cycle.

Nonetheless, putting aside the ravings of AOC, it seems to me the more seasoned Dems in the House may be interested in impeachment because they already know 2020’s a no-go. They have no candidate on deck who can possibly defeat The Donald, and they appear to have given up arguing the superiority of their policies a long time ago.

I miss those days — the Idea days.

The recent spike in gas prices after the Saudi Arabia oil field attack is an important reminder of how foreign oil can have a big impact here in the U.S.  Just days after the attack on the other side of the globe, Americans saw gas prices spike across most the country. That’s why it’s critical for the U.S. to strengthen our energy resources and prioritize our energy infrastructure to reduce our dependency on oil in the Middle East and enable greater economic stability here at home.

Pipelines are a critical part of that energy infrastructure, providing us the energy necessary to fuel most of our daily lives, whether it’s to heat our homes, drive to work, or generate electricity. Pipelines are also one of the safest and cost-effective ways to transport crude oil, natural gas, and petroleum, and the reason the United States has the largest network of energy pipelines world-wide.

Each year, over 2.5 million miles of pipelines in the U.S. safely deliver trillions of cubic feet of natural gas and hundreds of billions of ton/miles of liquid petroleum products. Several of those pipelines are located in the Midwest with nearly 30% of our nation’s crude oil running through Minnesota by pipeline and 20% in Wisconsin.

That’s why the recent Minnesota Supreme Court’s ruling in favor of allowing the Line 3 pipeline project to continue is so important. It puts additional pressure on Minnesota Gov. Tim Walz to give the green light to regulators to allow pipeline construction to build. And it denies a petition from opposition groups to further review an Environmental Impact Statement, an already rigorous safety review process that the company must go through to ensure a project is safe for the environment and surrounding community.

The non-profit environmental groups like Honor the Earth and Mille Lacs Band of Ojibwe are protesting the replacement of an aging pipeline that currently runs through North Dakota, Minnesota, and Wisconsin. This is another classic case of outside groups strategically attempting to further their agenda by holding up projects in litigation. While they present themselves as environmental groups, many of them are funded by billionaires with competing interests like transporting crude by railway.

In addition to bolstering our energy infrastructure, there are economic benefits that result from pipelines – a fact that’s ignored by these outside groups. Pipeline companies contribute millions, sometimes even billions to a state’s economy during construction and many years after in tax revenue. Pipeline construction creates jobs and income which results in increased demand in consumer goods and services.

Opposing the pipeline is also out of step with Minnesota itself and the many other groups and communities who support this pipeline being rebuilt. The Laborers’ International Union of North America and Iron Range labor union members in Minnesota, for example, are vocal proponents of the pipeline’s construction because it will create more union jobs and enrich the local economy.

The bottom line is that the recent Minnesota Supreme Court decision is a positive step for bolstering U.S. energy resources. Without pipelines like Line 3, we are undermining our energy infrastructure and the ability to safely, affordably deliver the energy resources that are needed to power our everyday life. This, in turn, helps the U.S. reduce our dependence on oil in the Middle East and strengthens American energy leadership. That’s something every American should get behind.
