Alan Dershowitz: Some Democrats channeling Soviet minister’s ‘Show me the man, I’ll show you the crime’ maxim

Some Democrats pursuing the impeachment of President Trump are trying their hardest to pin an impeachable crime on the commander in chief, according to law professor Alan Dershowitz.

In an interview airing Sunday at 8 p.m. ET, Dershowitz tells Mark Levin on “Life, Liberty & Levin” that Trump’s phone call with Ukraine does not rise to the level of bribery as defined in common law.

“[I]t can’t operate when you’re the president of the United States and you’re conditioning or withholding money in order to make sure that a country isn’t corrupt and you’re asking them to investigate [something],” he said.

“That just doesn’t fit any definition of bribery — common law definition of bribery, statutory definition of bribery — however you define the constitutional word ‘bribery.’ It just doesn’t fit,” he said.

MARK LEVIN: EX-DNC CONSULTANT CHALUPA SHOULD HAVE BEEN CALLED AT IMPEACHMENT HEARINGS

Dershowitz claimed some Democrats appear to be trying to find a crime to accuse Trump of, rather than going through the impeachment process after evidence of a specific high crime has been established.

He recalled the mantra of a former Soviet Union official who would customarily dismiss any presumption of innocence against the accused.

“What they’re trying to do is what the KGB under Lavrentiy Beria said to Stalin, the dictator — I’m not comparing our country to the Soviet Union — I just want to make sure it never becomes anything like that,” he said.

Beria, once the Soviet deputy premier and interior minister, famously would reassure Stalin, “Show me the man and I’ll find you the crime.”

“And that’s what some of the Democrats are doing,” Dershowitz claimed. “They have Trump in their sights. They want to figure out a way of impeaching him and they’re searching for a crime.”

Dershowitz said Democrats settled on the charge of bribery after previous allegations either did not stick or rise to the level of an impeachable offense.

“First, they came up with abuse of power — not a crime — it’s not in the Constitution. So now they’re saying ‘bribery,’ but they’re making it up,” he said. “There is no case for bribery based on, even if all the allegations against the president were to be proved, which they haven’t been.”

Dershowitz said that former Treasury Secretary Alexander Hamilton also famously warned against impeaching a president for partisan ends.

“Alexander Hamilton said in Federalist Paper Number 65: The greatest danger would be if impeachment turned on the number of people each party had,” he said.

Impeaching Trump, Dershowitz said, would be a “complete abuse” of the Founding Fathers’ intentions.

For that reason, Dershowitz said he opposed former President Bill Clinton’s impeachment just as he does that of Trump. Clinton’s affair with intern Monica Lewinsky and the ensuing perjury charge did not amount to a “high crime,” the professor claimed.

“What Bill Clinton committed was a low crime, a crime to protect his personal life,” he said, adding that, at the time, Rep. Jerrold Nadler, D-N.Y. — who is helping lead the Trump impeachment proceedings — made the exact case in defense of the 42nd president.

Former Miami detective claims Jeffrey Epstein’s copilot disclosed details of his flights

Private investigator Mike Fisten claimed one Jeffrey Epstein’s former copilots disclosed to him alleged details about trips on the disgraced money man and sex offender’s private jet.

Mike Fisten, a former police detective in Miami-Dade, Fla., said in an exclusive interview with Jesse Watters on “Watters’ World” on Saturday that the copilot was not allowed to leave the cockpit during flights but noticed some peculiar things.

“His first pilot, who’s his most dedicated pilot, wouldn’t talk to us,” the investigator said. “But we were able to find [Epstein’s] copilots.”

Fisten said he was able to meet with a copilot at the man’s home. The copilot, Fisten said, lived in an upscale Florida community.

“I’ll never forget sitting in this guy’s living room up in this really nice area of Wellington, Florida, and talking to him,” he told Watters. “And he’s telling me, ‘I can’t tell you anything. I really want to, but I can’t.’” Fisten said that at that point he noticed a photo of the man with his daughters.

“I said, ‘Look at your daughters. They could have been victims.’ And the guy started tearing up and he started talking,” Fisten said.

The copilot claimed he flew “all over the world” with Epstein, and alleged that the financier employed very young stewardesses and had “bedrooms” in the back of the plane, according to Fisten. The copilot described the stewardesses as appearing to be minors dressed in outfits as that of “candy stripers,” he said.

The copilot also told Fisten that former President Bill Clinton flew on the plane “numerous times,” he said.

“Twenty-six times, I believe,” Fisten claimed.

“Hillary [Clinton] never flew on the plane — that we knew of,” he added, recalling what the copilot claimed to him during the visit. “She was never recorded going on the plane and no one’s ever seen her on the plane. [Chelsea Clinton] was never with him.”

Fisten had been hired by Epstein victims’ attorney Brad Edwards in 2009 to investigate the New York City native, who was found dead this past August in his prison cell while awaiting trial on federal sex-trafficking charges.

The billionaire Epstein had owned an island near St. Thomas in the Virgin Islands called Little St. James.

Clinton said through a spokesman earlier this year that he “knows nothing” about Epstein’s “terrible crimes,” insisting that he took “a total of four trips on Jeffrey Epstein’s airplane” in 2002 and 2003 —  while his Secret Service detail traveled with him at all times — and that he only had brief meetings with Epstein.

“[Clinton] had one meeting with Epstein in his Harlem office in 2002, and around the same time made one brief visit to Epstein’s New York apartment with a staff member and his security detail,” the former president’s press secretary, Angel Ureña, tweeted in July.

“He’s not spoken to Epstein in well over a decade and has never been to Little St. James Island, Epstein’s ranch in New Mexico or his residence in Florida,” the statement added.

Martha MacCallum presses former Schumer aide about Trump quid pro quo claim

A former aide to Sen. Charles Schumer, D-N.Y., maintained that President Trump was trying to hold up defense aid to Ukraine in exchange for an investigation into political rival Joe Biden. However, “The Story” host Martha MacCallum on Friday said the text of the transcript, as cited by guest Christopher Hahn, reflected nothing of the sort.

“The president was so convinced by that theory [that Ukraine meddled in the 2016 election] that he withheld aid from Ukraine so they would chase down that theory,” Hahn, now a liberal radio host, claimed.

“I direct your attention to the bottom of page three and the top of page four of the transcript where the president of the United States was holding up aid for an investigation into Joe Biden — and Crowdstrike, which is a company based in California owned by a former Russian who is an American now, who the RNC [Republican National Committee] uses,” he added, referring to the phone call between Trump and Ukraine’s president, Volodymyr Zelensky.

However, MacCallum said the transcript reflects nothing that ties the U.S. aid to an investigation into Biden, the former vice president and 2020 Democratic presidential candidate.

Hahn responded by citing a passage in the transcript that references “a favor.”

“I can’t believe we are about to go through this again,” MacCallum responded. “Right after that [passage] comes ‘you know we went through a lot in 2016.'”

Hahn said another purported problem for Trump is that he allegedly is “trusting Russian misinformation over his own National Security Council.”

The former Democratic aide claimed the entire exchange portrays the president as “completely incompetent.”

Former Trump campaign manager Corey Lewandowski responded to Hahn’s remarks and claimed House Speaker Nancy Pelosi, D-Calif., would be the politician, if any, who would be friendly to Russia because she has not passed a federal budget that he said would provide further aid to Ukraine.

Hahn fired back that Lewandowski should instead prepare to potentially “testify in the Senate” — an apparent reference to a potential Trump impeachment trial in that chamber.

Melissa Francis presses White House spokesman on claim some Senate Republicans could support impeachment

Fox News Channel host Melissa Francis pressed a White House spokesman on a Democratic senator’s claim there are some Republicans in the chamber who are considering supporting the impeachment of President Trump.

On Friday’s “Outnumbered Overtime,” Francis played a CNN clip in which Sen. Christopher Coons of Delaware claimed Senate Democrats will be counting on a handful of Republicans to support their cause.

“We will be relying on a small number of Republicans who are pushing back against this idea — who recognize that impeachment is a serious, significant constitutional moment,” he said.

“There are, I believe, a few Republicans who recognize that what President Trump did here was demonstrably impeachable,” the former New Castle County executive continued.

Democrats will need some Republicans to vote with them in order to convict or remove the president from office if the impeachment process makes it to the Senate.

In turn, Francis asked Deputy White House Press Secretary Hogan Gidley if it was true that some Republicans may be waffling on the issue.

“We’ve already had a vote in the House,” Gidley responded.

Francis then asked if he is confident the Senate will act similarly.

“If it goes there, [Trump] wants a trial,” Gidley said.

In response, Francis pressed further: “But, are there Republican senators who are wavering?”

“Democrats want this fight — it’s something the president is willing to have,” the aide responded. “Not to my knowledge,” he later said, in regard to Coons’ claim.

Gidley said Trump has met with “hundreds” of congressional representatives and many Senate Republicans — asserting that they are all on board with opposing impeachment.

“This process is a sham,” he said, adding that it is Democrats who should be concerned because of the numerous freshmen lawmakers in that party who won seats in Trump-friendly districts in 2018.

He also criticized House Speaker Nancy Pelosi, D-Calif., for ignoring the USMCA trade deal currently languishing on her desk, as well as legislation that he said would help all Americans — like infrastructure funding and prescription pharmaceutical reform.

Pelosi, he claimed, is only interested in concentrating her power and taking back the White House.

Newt Gingrich urges Pelosi to re-read Starr report on Bill Clinton, note how many times word ‘guilty’ appears

Former House Speaker Newt Gingrich, R-Ga., responded Thursday to comments current House Speaker Nancy Pelosi, D-Calif., made deriding the Republican impeachment of ex-President Bill Clinton.

Clinton was impeached by the House but acquitted by the Senate in 1999 after independent counsels looked into the Whitewater scandal, and subsequently examined Clinton’s statements regarding Arkansas state employee Paula Jones and White House intern Monica Lewinsky.

DOES PELOSI HAVE THE VOTES FOR IMPEACHMENT?

At a CNN town hall event earlier in the evening, Pelosi rejected Republicans’ claims that President Trump’s alleged indiscretions with Ukraine fail to rise to the level of impeachable offenses.

She said some Republicans in Congress recall Clinton’s impeachment yet defend Trump in the current inquiry.

Several lawmakers remain in office from that time in 1998-99, including Sens. Charles Grassley of Iowa and Mitch McConnell of Kentucky, Rep. James Sensenbrenner of Wisconsin, and then-Rep. Lindsey Graham of South Carolina, who now serves in the Senate.

Republicans, Pelosi said, investigated Bill Clinton “for personal indiscretion and [for] misrepresenting about it — impeached him. Some of these same people are saying, ‘Oh, this doesn’t rise to impeachment.’ They were right there impeaching Bill Clinton for being stupid in terms of something like that.”

To those remarks, Gingrich responded that Clinton was served with perjury charges.

“Democrats have a compulsion to lie because the truth kills them,” he claimed. “The fact is, there were 11 counts of guilty in the independent counsel’s report, including perjury, which as Nancy knows is, in fact, a felony. Clinton lost his license to practice law in Arkansas.”

Gingrich said Pelosi should re-read former Special Counsel Robert Mueller’s report on the Russia investigation, saying there is no mention of the word “guilty” as there was in former Special Counsel Kenneth Starr’s report on Clinton.

Gingrich said it would have been a “dereliction of duty” if the House did not take Starr’s report seriously.

Rep. Doug Collins claims Jerry Nadler hung up on him during Trump impeachment discussion

House Judiciary Committee ranking member Doug Collins, R-Ga., says he has tried in vain to get an idea of how the panel will proceed in the impeachment process — but claims the committee’s Democratic chairman won’t keep him informed.

In fact, Collins told Laura Ingraham Thursday on “The Ingraham Angle” that Chairman Jerrold Nadler, D-N.Y., even hung up on him when he called Nadler to get information.

“He never gets back to me,” Collins said. “I’m trying to get a definition of what’s going on — ‘Don’t worry Doug, we’ll talk to you.’ Just the other day as I was trying to get information from him, he just gets tired of talking to me and just hangs up.”

MAN WHO CONFRONTED BIDEN OVER UKRAINE REBUFFS HECKLER: ‘STICK IT UP YOUR A–‘

The North Georgia lawmaker said Nadler’s alleged action is a symptom of the larger issue in the committee.

“They are so lost and so scared that they are going to lose this moment to get at this president,” he said, calling the legislative panel a “farce.”

Collins said one of the other senior Republicans on the committee, Rep. James Sensenbrenner of Wisconsin, has requested per committee rules a hearing for the GOP minority to call their own witnesses.

The response from Nadler or his fellow Democrats has thus far been unclear, Collins said.

“They don’t want the truth to come out,” he remarked, adding that House Speaker Nancy Pelosi reportedly questioned Republicans’ understanding of their oaths of office in regard to impeaching President Trump.

“It’s not [used] to persecute a president that started in November 2016 in Brooklyn with tears flowing down your face because your candidate lost,” he said, referring to Hillary Clinton’s supporters at the candidate’s New York City headquarters.

“The American people deserve better than this.”

He added that when the results of the House Intelligence Committee’s part of the impeachment investigation are presented next week, it will be an example of Nadler “trying to make chicken salad out of chicken Schiff.”

Tucker Carlson: Pelosi deployed meaningless ‘cliches’ to defend Democrats’ ‘somber approach’ to impeachment

Tucker Carlson said Thursday that House Speaker Nancy Pelosi’s continued support for impeaching President Trump has been a political disaster for her party, to the point Pelosi has turned to “cliches” to make her case.

Carlson referenced Pelosi’s comments, in which she invoked Founding Fathers James Madison, Gouveneur Morris and Benjamin Franklin. The “Tucker Carlson Tonight” host said that the House Speaker implied that the fourth president of the United States had put his “personal seal of approval” on the Democrats’ impeachment process.

“For a brief moment, the founders of our country are useful to the left, so they are being presented as heroes,” Carlson remarked, noting that in the past, Democratic-leaning groups and Democratic politicians have rallied in support of removing statuary and other representations of figures like Thomas Jefferson and George Washington.

“Enjoy it while it lasts,” said Carlson, who added that Pelosi’s historical references were complemented by a “dense cluster of familiar phrases.”

RAND PAUL: SCHIFF’S RELEASE OF PHONE RECORDS IS ABSOLUTELY OUTRAGEOUS

“It’s not so much an ‘argument’, as it is a ‘cliche-bomb’.”

During her afternoon remarks, Pelosi claimed America’s “democracy is what is at stake,” adding, “The president leaves us no choice but to act. He is trying to corrupt, once again, the election for his own benefit.”

Carlson said Pelosi is essentially saying that going forward with impeachment is vital to our democracy — “In order to honor the spirit of Benjamin Franklin, we must suspend our democracy in order to preserve it.”

He added that Pelosi would’ve been “laughed off the stage” for her remarks had she made them to Democrats in the 1970s. However, Carlson said that at some point, Democrats stopped trying to win elections through persuasion and put their faith in demographics, claiming that former President Barack Obama had helped usher in an era in which Democrats supported open borders in the hope that new citizens would vote them into power perpetually.

“And then, out of nowhere, Donald Trump proved them wrong,” Carlson said. “He leaped off the front page of the New York Post and beat them in a presidential election.”

The host added that Trump’s victory had left Democrats “shattered” and scrambling for a way to undermine the system that made his election possible.

He also rejected Pelosi’s claim that Reps. Adam Schiff, D-Calif., and Jerrold Nadler, D-N.Y., have taken a “somber approach” in their capacity as House committee chairmen to the process of impeachment.

“That is what Nancy Pelosi would like you to recall from the past couple weeks, and appreciate the ‘dignity’ that that bug-eyed lunatic from Burbank [Schiff] brought to this process,” he added.

Carlson also played a clip of Nadler appearing to doze off while witnesses were being questioned Wednesday. by House Judiciary Committee member Steve Chabot, R-Ohio.

Mark Levin: ‘Precious’ to watch ‘radical’, anti-Constitutional professors claim to know about impeachment

Constitutional law attorney and radio host Mark Levin panned Wednesday’s House Judiciary Committee impeachment hearing as a display of four academic witnesses “who witnessed nothing.”

Levin, host of Fox News Channel’s “Life, Liberty & Levin,” said on “The Mark Levin Show” on Westwood One that three of the witnesses were “progressive,” “left-wing” scholars who by definition, he claimed, are opposed to the classic Constitutional order heralded by America’s Founding Fathers.

“Three of the witnesses, who have been consistently hostile to President Trump are progressives — left-wing progressives,” he said. “If you are a radical progressive … you don’t even believe in the Constitution to begin with.”

“The progressives are at war with our Constitutional order. They are at war with our Declaration of Independence and the principles that undergird it. They reject them. They’ve rejected them since the late 1800s. Woodrow Wilson, Franklin Roosevelt, Barack Obama, and so many others.”

He claimed three of the professors called to testify — Noah Feldman, Pamela Karlan and Michael Gerhardt — are the type of scholar who, if nominated to the federal bench, would become “radical activists — like [Supreme Court Justice] Ruth Bader Ginsburg, if you will.”

“The purpose of progressivism is to get around Constitutionalism,” he said, adding that impeachment, by definition, is a Constitutionally prescribed action.

“So, it is precious indeed to watch these radical progressive law professors — three of them — tell us what the Framers intended when they read [former President James] Madison’s notes or the Federalist Papers,” Levin said.

He claimed that people like three of the four professors do not want to interpret the Constitution under the auspices of the law, but instead use it as a “tool to advance their ideology.”

In regard to President Trump’s prospective impeachment under the Constitution, he said that has amounted to the mantra of “the ends justify the means.”

“Academia is one of the last safe harbors for the Soviet, Maoist, Leninist left — where they are tenured,” he claimed.

Of the fourth academic witness, George Washington University Law Professor Jonathan Turley, called by Republicans — though a liberal who said he voted against Trump in 2016 — Levin said he did a “terrific job.”

But, he lamented the fact Turley made a point to reiterate that he did not support Trump when giving his testimony.

John Solomon: DOJ watchdog’s FISA report will have ‘6 to 12 findings of wrongdoing’

Westlake Legal Group ENC3_132199865585880000 John Solomon: DOJ watchdog's FISA report will have '6 to 12 findings of wrongdoing' fox-news/shows/hannity fox-news/politics/trump-impeachment-inquiry fox-news/politics/house-of-representatives fox-news/politics/elections/senate fox-news/person/donald-trump fox-news/news-events/russia-investigation fox-news/media/fox-news-flash fox-news/media fox news fnc/media fnc e7e85f7b-9543-5e34-a9ae-bd2c9b47d8e7 Charles Creitz article

Investigative reporter and Fox News contributor John Solomon claimed Wednesday that the Justice Department Office of Inspector General’s forthcoming report on alleged FISA (Foreign Intelligence Surveillance Act) abuse during the 2016 election will be a “road map” for potential prosecutions, reflection on what went wrong and fixing problems with current law.

Solomon said on “Hannity” that the American people should ignore media leaks and pundits’ conjecture about the report from Michael Horowitz, which is due out Monday.

“I think everybody that is reporting on it now is just conjecturing or getting fragments from people who have a motive to get ahead of the story,” he said. “There’s going to be six to twelve findings of wrongdoing, malfeasance [and] mistakes that were made in the FISA process.”

Solomon also predicted there will be “sweeping recommendations” on what should be changed in the FISA warrant process.

“This is going to be a very, very powerful road map, and it’s going to lead to months of debate and additional action, including discipline and possible prosecutions.”

Solomon added that the report may contain an entry about the alleged omission of “derogatory evidence” about former MI6 spy Christopher Steele — the man who compiled the now-infamous Trump-Russia dossier.

That information, he claimed, will be a “red flag” and will likely consist of one of Steele’s “sub-sources” disowning what the ex-British agent reported in his dossier.

“I think you’re going to see all of the things that we’ve been talking about on your show,” Solomon told host Sean Hannity.

On Monday, Rep. Mark Meadows, R-N.C., downplayed published reports that the probe had determined that there was enough information to justify the agency’s investigation of members of the Trump campaign.

Meadows was asked about a story in The Washington Post that said Horowitz’s report justified the FBI’s action at the time. The New York Times, citing two unnamed sources, reported that the findings are expected to contradict some theories put forward by President Trump himself.

Meadows, the former chairman of the House Freedom Caucus, said that the reports are “based on speculation on information which has been leaked.”

Fox News’ Edmund DeMarche contributed to this report.

Tucker Carlson: Judiciary Committee Democrats treating impeachment like a college faculty meeting

Tucker Carlson reacted strongly to Wednesday’s House Judiciary Committee impeachment hearing, characterizing it as a college faculty meeting.

During the opening monologue on “Tucker Carlson Tonight,” the host said Judiciary Committee Chairman Jerrold Nadler, D-N.Y., took a different tack than House Intelligence Committee Chairman Adam Schiff’s, D-Calif., had in prior hearings.

Schiff’s proceedings, said Carlson, consisted of a “whole cavalcade of intel and foreign policy professionals and having them explain how their feelings had been hurt by the ‘Bad Orange Man’.”

Nadler, by contrast, styled his hearing as more academic, calling three law professors to join Republican-solicited witness Jonathan Turley, himself a Democrat.

He said Nadler’s committee is “treat[ing] impeachment like a faculty meeting at Wesleyan.”

“So, produce a long line of academics with impressive-sounding credentials, [and] have them condemn the president as a ‘very bad man’.”

He said the so-called “star” of the hearing was Stanford law professor Pamela Karlan.

“She’s the quote ‘Kenneth and Harle Montgomery Professor of Public Interest Law at Stanford’ — whoa, stand back, ladies and gentlemen,” he remarked.

Carlson noted that Karlan has multiple degrees from Yale, clerked for the Nixon-appointed former Supreme Court Justice Harry Blackmun, and has authored textbooks on constitutional law. However, the host said Karlan is also a partisan, highlighting a tense exchange between the professor and Rep. Matt Gaetz, R-Fla., about her donations to Hillary Clinton, Sen. Elizabeth Warren, D-Mass., and former President Barack Obama.

“This is a subtheme of the impeachment drama that we’d like to highlight,” Carlson later said. “The more you know about the people you’re supposed to consider impressive the more you find out they’re not impressive at all — they’re not very smart, they have no wisdom, their personal lives are a disaster… In this specific case, they’re not even unbiased arbiters.”

“So, does donating to Democrats prove that Karlan is wrong?” Carlson said. “No … She proved that herself. She made it very clear that she was incapable of clear thinking or wise judgments.”
