After a turbulent tenure, Director of National Intelligence Dan Coats looks to be resigning as early as the beginning of this week.

This report via Fox News.

Dan Coats is expected to step down in the coming days as the director of national intelligence (DNI), according to multiple reports, following months of speculation and public spats between President Trump and the intelligence community.

Coats was typical of the earlier appointments of Donald Trump’s administration, coming on board in March of 2017. The President simply did not have the contacts nor the preparation in place to weed out many of the people being shoved in front of him as the “best” nominees for certain positions. Trump certainly bares the blame that, as the buck stops with him, but what it meant in a practical sense is that a lot of people who ultimately did not support the President or his policy goals ended up in positions of power.

Coats always seemed more interested in the status quo and remaining part of the club than bringing any real reform to an intelligence apparatus that’s had a checkered history at best. While he couldn’t be counted on to cooperate with various investigations into misconduct, he was always available to yuck it up with MSNBC’s Andrew Mitchell or to publicly undermine the administration’s policy on North Korea.

Just this past January, Coats chose to testify that Iran was not resuming it’s nuclear activities. We now know that wasn’t true and that Iran is in fact moving forward to break stockpile limits. Either the intel agencies and Coats were too incompetent to see that coming or they felt contradicting the President so The New York Times could squee was more important.

As I noted just yesterday, Coats was behind efforts to stonewall the DOJ from reviewing a recording between George Papadopoulos and what most speculate is Steven Halper. There is of course no logical reason to protect Halper at this point, but Coats has always seemingly seen it as his duty to protect the intel agencies from themselves, transparency and justice be damned.

Now, the person likely being nominated to replace Coats has the right people sweating.

President Trump is expected to nominate Rep. John Ratcliffe (R-Texas) to replace Dan Coats as director of national intelligence, according to three sources familiar with the president’s deliberations.

Behind the scenes: Trump was thrilled by Ratcliffe’s admonishment of former special counsel Robert Mueller in last week’s House Judiciary Committee hearing. “The special counsel’s job, nowhere does it say that you were to conclusively determine Donald Trump’s innocence or that the special counsel report should determine whether or not to exonerate him,” Ratcliffe, a former prosecutor, said to Mueller.

Trump should be thrilled with Ratcliffe’s performance last week. It showed a man who wasn’t going to be bullied by the demands of the entrenched bureaucratic establishment. Robert Mueller did violate DOJ policy and basic American decency by publishing a report full of slander and suppositions without actually backing it up with recommendations for charges. Donald Trump may be the President but he’s still a citizen who deserved the presumption of innocence from prosecutors. He didn’t get that.

Ratcliffe is also on record fulling supporting AG Bill Barr and his investigation into how all this Russia mess got started in the first place.

And while Ratcliffe said he does not want to prematurely accuse any specific person of a crime — as Democrats have done with President Trump — he stressed that it is clear crimes were committed by people during the Obama administration, including government officials.

“I think the first thing we need to do is make sure we don’t do what the Democrats have done,” the Texas Republican told host Maria Bartiromo on Sunday Morning Futures. “They accused Donald Trump of a crime and then they try and reverse engineer a process to justify that accusation. So I’m not going to accuse any specific person of any specific crime, I just want there to be a fair process to get there. What I do know as a former federal prosecutor is that it does appear that there were crimes committed during the Obama administration.”

That means it’s time for the press to unleash the snark.

Graff’s description is of course nonsense. Ratcliffe’s resume includes far more than that, including being on the House intel committee, being a federal attorney, and serving in several roles interacting with the intel agencies. But this will be the line now because it’s always the line when an outsider looks to shake up the status quo of an organization.

The only problem with Dan Coats’ resignation is that Trump didn’t demand it well over a year ago. This was long overdue.

Big Conservatism vs Trump: the Brawler

I came across two very interesting articles this weekend that do a great job of explaining the phenomenon of President Donald J. Trump. The first, by Dr. Jack Kerwick decries the apparent lack of testicular fortitude amongst those who claim the most conservative of credentials, but can’t seem to understand that were are in a knock down, drag ‘em out war.

Bearing this in mind, it should be painfully obvious that Big Conservatives, i.e. those in the so-called mainstream “conservative” media, or “the Big Con,” who are forever imploring the members of their audiences to “fight” the left so as to prevail in the “cultural wars,” or this “second Civil War,” are either dishonest or profoundly inept.

Big Conservatives at least speak as if they conceive of our contemporary politics as war by other means. We know that the left sees matters this way. Yet Big Conservatives, though they possess the ability—the resources in money and influence—to fight the left, their will for doing so is sorely lacking.

We all know who the “Big Conservatives” are…Krystal, Goldberg and that perfect example of political pusillanimity, George Will, among so many others. They bring moral preening and high dudgeon to an art form.

Dr. Kerwick concludes thusly,

The “ruthless intention” to which Master Al [his martial arts instructor] speaks is a matter of being in it to win it, so to speak. Big Conservatives, inasmuch as they do nothing but essentially whine that the left dislikes them and favors itself by way of its “double standards”—all of the while accusing leftists of being the snowflakes—give no indication that they are interested in doing anything other than enriching themselves.

Big Conservatism has the ability to genuinely fight the left.  It lacks the will.

Thus, the left will continue to win the war as long as it is the only side that is intent upon fighting.

Kerwick is right. As long as Krystal, Will, et al continue to be the so called “leaders” of conservative thought, we will remain on the road to perdition. However, there is some room for cautious optimism: President Donald J. Trump. In a Wall Street Journal piece called, Trump: A Brawler For Democracy, Holman W. Jenkins Jr. (that’s a mouthful) sets us up with,

Politicians, by the time they’ve asked millions for their money, their time, their support and their votes, are obliged to do just about anything to win. Once elected, they have an even bigger responsibility to defend their power and ability to govern. Ask any president: This, and not governing, is what they spend much of their time doing. And one thing you can say about President Trump: This most unlikely and in some ways weakest of presidents has brawled his way to victory over the most concerted delegitimization campaign any president has ever faced.

Jenkins is right. President Trump isn’t a dilettante like George Will. He understands that you cannot govern if you don’t win. When he gets hit, he hits back and with great effect, as I’ve indicated here here and here. Once in office, you can’t let your enemies control the message. Over the past few months, where has all the attention been, on President Trump’s Twitter feed, or the policy positions of the 13,497 declared Democrat Presidential contenders?

Instead of allowing her the room to promote the policies of a cohesive Democrat platform, President Trump has gotten Speaker Nancy Pelosi, titular head of the “mainline Democrats,” to publicly embrace four radical House members whose public statements and policy positions are in direct opposition to the interests of the Obama Blue Collar Democrats; Those same Obama voters who took a chance on Donald J. Trump in 2016.

President Trump’s deft use of his Twitter as a laser pointer teasing the Democrat herd (actually the term is “clowder” or “glaring” Thanks, “Big Bang Theory”) of cats, keeps him on the offense. Those 2016 Trump Democrats aren’t going back. Come 2020, they are going to low crawl to the polls to flip the lever for Trump. And they are going to bring some buddies with them. Why? Because President Trump doesn’t act like the weak chinned, mewling members of Big Conservative. He understands that is is a war. So he fights…on all fronts.

I’m not much for dramatic descriptions in the Russia investigation because I’m generally cynical anyone will be held accountable, but “game changer” are Trey Gowdy’s words, not mine.

At this point, it’s getting hard to keep track of all the different informants the government ran against George Papadopoulos, but one in particular made a recording that is getting renewed scrutiny by the DOJ. It involves possibly “exculpatory” evidence that was purposely not presented to the FISA court in subsequent renewals against Carter Page.

The Justice Department is intent on reviewing transcripts of recordings that at least one government informant made of conversations with former Trump campaign associate George Papadopoulos.

Little is known about these classified transcripts, including who is the source, other than the growing hype about them in conservative circles. Former Rep. Trey Gowdy called them a “game changer” in a Fox News interview in May.

Here are some of the scant details revealed so far.

Investigators looking at why certain “exculpatory” material from these transcripts was not presented in subsequent applications for surveillance warrants against another Trump campaign aide, Carter Page.

“I think it’s the smoking gun,” one source said.

Without Trump’s declassification order, one source said Director of National Intelligence Dan Coats would not have allowed anyone to have access to these mysterious records. But another source stressed that Coats as well as FBI Director Christopher Wray and CIA Director Gina Haspel are cooperating with DOJ’s investigation.

It should shock no one that Dan Coats was trying to stonewall this until the president stepped in.

It never ceases to amaze me how pervasive the scheme to protect each other is within our federal bureaucracies. They hide behind claims of “sources and methods,” but if a law (or even department policy) was broken, how is it proper to hide behind secrecy? Without transparency in the face of malfeasance there can be no accountability, and that’s apparently exactly how the FBI likes it.

So who is on the recordings? The best guess is that it’s Steven Halper and Azra Turk. Turk is known for having asked Papadopoulus if Trump was working for the Russians. At this point, it’s essentially been confirmed that she was an FBI informant, with even The New York Times reporting on it. This of course all leads back to Joseph Mifsud, the mysterious man who first told Papadopoulus the Russians had dirt on Hillary Clinton. That was the beginning of the investigation dubbed Crossfire Hurricane. The lack of prosecution against Mifsud, despite the fact that he lied to the FBI and Mueller’s team at least three times, points to the fact that he was also working for U.S. intelligence, otherwise there would be no reason to continue protecting him.

When you put all this together, you get Papadopoulus as nothing more than a poor sucker who was baited by the U.S. government and used as a pretext to start an investigation against the Trump campaign.

If this recording turns out to show that Papadopoulus actually rebuffed Halper or even that his interest was mostly innocent, it’s going to be another black eye against the FBI’s conduct. I say FBI because if the CIA is involved, then things really get bad for the government from a legal standpoint. Hopefully, AG Barr and the Durham investigation are getting to the bottom of this. The fact that they are going after these recordings does give me hope that they are pulling on every thread.

Time is of the essence though. This can’t drag out into the 2020 election. Things need to start going public sooner rather than later.

Objectively, the angst in political Washington right now over “foreign meddling” in our elections is nothing more significant than mildly deranged monkeys rubbing feces on themselves to get attention. In 2016, not a single vote was changed anywhere by Russian hands because absolutely none of the votes cast in the presidential election were done so by systems that could be compromised by “hacking.” The fact is that the systems that are vulnerable to hacking really don’t mean a whole lot in terms of election results. If voter registration records are altered to add imaginary voters, then someone has to show up and cast a vote. This could be foiled by the simple precaution of requiring a government-issued REAL ID compliant identification. If you can’t be bothered to get one, it isn’t a sign of The Man keeping you down, it is a sign that you are too f***ing apathetic or stupid to be allowed to vote. If voter information is deleted or altered, then the affected voters, by federal law, have the right to cast a provisional ballot. This ballot, accompanied by a sworn affidavit by the voter attesting to its truthfulness, is reviewed by a county or city board of election by comparing it to hard copy voter registration data. Voting machines are not hooked to the internet. Memory cards from voting machines are removed and hand carried to the board of elections (or equivalent) by election officials. Fraud did occur, but it took place the old fashioned way in Democrat-run sh**holes where more votes were cast than there were registered voters.

But, where the big thing for the Democrats after 2000 was arguing about voter intent and “hanging chads,” as a way of delegitimizing President Bush, post-2016 Democrats have been harping on “foreign interference” to delegitimize President Trump…they even conconcted a bullsh** investigation to reinforce that narrative.

Anyway, House Democrats passed two so-called election protection bills. One requires any campaign that is contacted by a foreign national offering assistance to report the contact to the FBI. This is not only patently un-Constitutional on its face but it is so overbroad that it would require reporting contacts with green card holders and places the onus on the campaign, including people with only a tangential relationship such as campaign surrogates, to ensure that the people they are talking to are only US citizens. It should be called the “Special Counsel Perpetual Employment Act.” The other bill in question would provide some grants to modernize processes and infrastructure but would also impose mandates upon election officials that are not covered by the grants.

Senate Democrats tried to force both bills through by unanimous consent and McConnell refused to allow that to happen. Now some of them are trying to hang the “Moscow Mitch” name on him insinuating that because he stopped their cheap little power grab that he’s somehow beholden to the Kremlin.

Foreign interference in our electoral politics is real. It has been since, at least, the XYZ Affair. Laws can mitigate it but it isn’t going to stop. We just need to pull out big boy undies on and stop defecating on ourselves and act like we are a freakin superpower not some Third World banana republic. Because we aren’t and we should publicly shame the Democrats who think that we are.

In a predawn twitterstorm, President Trump had harsh words for House Oversight Committee Chairman Elijah Cummings (D-MD). Trump tweeted: “Rep. Elijah Cummings has been a brutal bully, shouting and screaming at the great men & women of Border Patrol about conditions at the Southern Border, when actually his Baltimore district is FAR WORSE and more dangerous.”

In the next tweet, Trump wrote: “His district is considered the Worst in the USA. As proven last week during a Congressional tour, the Border is clean, efficient & well run, just very crowded. Cummings’ District is a disgusting, rat and rodent infested mess. If he spent more time in Baltimore, maybe he could help clean up this very dangerous & filthy place.”

Finally, he wrote: “Why is so much money sent to the Elijah Cummings district when it is considered the worst run and most dangerous anywhere in the United States. No human being would want to live there. Where is all this money going? How much is stolen? Investigate this corrupt mess immediately!”

Cummings is known for his frequent criticism of the President. Recently, Cummings said the treatment of migrant children at the border facilities “is government-sponsored child abuse…on a grand scale…We have seen cases where the administration has deported parents without their children and still, to this day, have not reunited those families.”

A recent DHS Inspector General’s report told of “dangerous overcrowding” and “prolonged detention of children and adults” at some of these facilities.

At a committee hearing last week, Cummings discussed these findings with Homeland Security Secretary Kevin McAleenan. Cummings said, “You feel like you’re doing a great job, right? What does that mean? What does that mean? When a child is sitting in their own feces, can’t take a shower? Come on, man. What’s that about? None of us would have our children in that position. They are human beings.”

McAleenan defended the work DHS has done and invited Cummings to see for himself that conditions were improving.

Cummings fired back at Trump. He tweeted, “Mr. President, I go home to my district daily. Each morning, I wake up, and I go and fight for my neighbors. It is my constitutional duty to conduct oversight of the Executive Branch. But, it is my moral duty to fight for my constituents.”

House Speaker Nancy Pelosi and other House Democrats defended Cummings by tweet.

Trump was also angry about the House Oversight Committee’s vote to subpoena records of White House officials (including those of Ivanka Trump and Jared Kushner) and aide’s use of social media for government business use. In a committee hearing on Thursday, Cummings said, “There are serious questions about this White House’s use of personal email and text accounts. We must issue these subpoenas to get our answers.”

I posted about Republican committee member Chip Roy’s angry outburst after the vote had been taken at that meeting. He berated committee Democrats for their “fishing expedition” and for neglecting their responsibility to the American people as they try to bring President Trump down, then stormed out of the room.

Following the debacle of Wednesday’s Mueller hearings, which was really a watershed moment for the impeachment movement, President Trump has decided to go on the offense.

Democrats, beware.

It’s impossible to argue that former special counsel Robert Mueller’s testimony before Congress last week was not a turning point in the Democrats’ endless fight to impeach President Trump. What they believed to be their ace in the hole turned out to be their worst nightmare.

Their hero turned out to be a frail old man who had only cursory knowledge of the investigation which bore his name. He asked for many questions to be repeated and declared the most relevant topics to be off-limits before questioning even began. The formidable Robert S. Mueller III who for two years held the future of Trump’s presidency in his hands, was unmasked before the eyes of stunned lawmakers and the American people.

Following Wednesday’s debacle, many Democrats have admitted that the case which began as an FBI counter-intelligence investigation in July 2016 against President Trump is over. Even rabid anti-Trumper Rep. Adam Schiff (D-CA) threw in the towel this week. But, there are some who continue to fight, one of whom is House Judiciary Committee chairman Rep. Jerry Nadler (D-NY).

Radio host and conservative commentator Mark Levin discussed the deluded Congressman on his show.

Levin was fired up, as he often is, and said Nadler was “drunk on power,” and called him a “coward,” a “pompous ass” and a “miscreant.” Here’s what Levin told his listeners.

We need to take on these bastards. We need to take them on politically. We need to engage them on a constitutional basis, on a factual basis, on every basis whatsoever. They have declared war today. Mr. Nadler has declared war on the American people. Mr. Nadler has declared war on the office of the presidency and the president of the United States. Mr. Nadler is hellbent on reversing the election results of 2016 and disenfranchising nearly 63 million of you. Mr. Nadler is a throwback. He’s a reprobate from one congressional district out of 435 congressional districts – a dark blue district filled with reds.”

He doesn’t get to run this country. I’ve had enough of this guy. I’ve had enough of his efforts to cripple this president and his agenda. And make no mistake about it, that’s what this is about. They want their third term for Obama. They’ve never accepted this election. They don’t accept a peaceful transition of power.

He called for the American people to fight back against Nadler and his sycophants.

Nadler has “squeezed the last drop out of the impeachment lemon,” yet he persists.

As the committee’s chairman, he was the first to question Mueller. He tried and succeeded in getting Mueller to say that, if it hadn’t been for the DOJ’s Office of Legal Counsel guidelines which advise against charging a sitting president with a crime, they would have recommended obstruction of justice charges for President Trump.

All along Mueller and his team have tried to use this excuse. During a March phone call with William Barr, Mueller was asked three times (and there were DOJ officials in the room who witnessed the conversation), if the reason his team did not recommend charges against Trump was because of OLC guidelines. And Mueller stated three times that it was not the reason.

Following his nine minute sneak attack on May 29, Mueller tried again to resurrect the excuse. He even introduced a new standard telling reporters that they could not “exonerate” the President. He was forced to walk back that comment in a joint statement with the DOJ hours later.

Exoneration or the inability to exonerate are not legal standards in the United States. A defendant is found to be either “guilty” or “not guilty.” If there is insufficient evidence to charge a suspect, the case is closed. Mueller knows that.

American Greatness’ Conrad Black explains:

Mueller tried to turn an inability to exonerate—a standard that he admitted has never been asked or expected of any kind of American prosecutor—into something the Democratic congressional allies of his investigative team could use to continue their malicious and illegal harassment of the president.

Unfortunately for Nadler, someone set Mueller straight over the lunch break and before taking questions in the afternoon session, he announced that he needed to make a correction. He told lawmakers that they didn’t recommend charges against the President because they had insufficient evidence.

Nadler’s heart must have sunk.

But that didn’t stop him from continuing to repeat the narrative.

During a Democratic press conference on Friday, Nadler once again reiterated the claim, citing Mueller’s response to a question from Rep. Ted Lieu (D-CA).  Nadler told reporters:

He [Mueller] told us in a remarkable exchange with Mr. Lieu that, but for the Department of Justice policy prohibiting [him] from doing so, he would have indicted President Trump. Indeed it is clear that any other citizen of this country who has behaved as this president has would have been charged with multiple crimes.

Radio host Buck Sexton appeared on Tucker Carlson’ show on Friday night and the two were discussing the role of the media in throughout the last few years. He suggested that “some commentators may have gone too far to retract their claims.”

He added, “I don’t think that the hosts on these networks could say, ‘Maybe we got this mostly, if not entirely, wrong all along, so they have to double down.’”

It may be the same way for Nadler. He just can’t help himself.

What Is It About the Left That Never Gets Tired Of Finding Stupid Wars For Us To Fight

One would think that after the nation being at war for nearly two decades, the last thing that any responsible person would be advocating for would be another military adventure. You would be wrong.

I stumbled across this yesterday on Twitter.

Imagine. A left wing talking head interviewing a left wing journalist about how easy it would be for US military forces to just do something.

Josh Rogin, who has blocked me on twitter after I started busting on him over his craptacular record of posting #FakeNews. Here are some examples

This is the hobby horse that Rogin has been riding for a few months:

About 10 miles from a U.S. military outpost in southern Syria, some 30,000 civilians are in crisis — with almost no food, water or medicine — and, for complicated reasons, the U.S. government refuses to feed them. These innocent people are living under the protection of the United States, fearing the Bashar al-Assad regime, Iranian militias and the Islamic State. But the U.S. government, which bears primary responsibility for their fate because of its control over the area, is standing by and watching them needlessly starve to death.

Let’s review the bidding. Right now we have less than 1,000 troops in Syria. Most of those are concentrated in the North. The American troops in the nearest the refugee camp Rogin talks about are few in number, they don’t “control” any area, the are mostly Special Forces trainers, and they are surrounded by enemies of many different varieties: ISIS, Iranian militias, Assad’s loyalists.

For more than eight years, the United States has failed to lead a strategy that puts the Syrian people’s interests first, and the world has failed to stop the Assad regime’s brutal slaughter of civilians — aided by Russia and Iran. But these 30,000 people are still alive and depending on the United States for survival.

One tweet, one snap of the finger by Trump could allow the U.S. military to do what it does for people suffering all over the world — save their lives. We can feed them, or we can transport them to areas of Syria not controlled by the Assad regime. But we can’t stand by and watch them starve needlessly in the shadow of a U.S. military outpost.

If we don’t act now, our neglect will make us complicit in whatever horror they suffer next.

F*** that noise.

I’m not a Ron Paul isolationist type. I think military intervention, or the viable threat thereof, is a critical piece of American foreign policy. If a national interest is at stake–and I say interest, not national survival–I have no objection to killing as many foreigners as it takes to protect that interest. But while the military has the ability to execute nation-building missions–in fact, it is no accident that the elite of the US Military Academy have until recently gone into the Corps of Engineers, or that coastal forts, harbors, and post roads in the early republic were build by the US Army–that has to be part of something that is important. What we’re doing in Syria is not only not important, it is arguably counterproductive. Do we really think ISIS was any more evil than Iran? Are we better off with Iran calling the shots from Tehran to the Mediterranean?

What Rogin is advocating is a replay of Somalia in 1992-93. He wants us to get involved in trying to resolve a humanitarian crisis in an environment where there is little infrastructure and no security. I’m not a huge fan of the Powell Doctrine but, arguendo, let’s use it as an analytical tool:

  1. Is a vital national security interest threatened?
  2. Do we have a clear attainable objective?
  3. Have the risks and costs been fully and frankly analyzed?
  4. Have all other non-violent policy means been fully exhausted?
  5. Is there a plausible exit strategy to avoid endless entanglement?/li>
  6. Have the consequences of our action been fully considered?
  7. Is the action supported by the American people?
  8. Do we have genuine broad international support?

Here are my answers:

  1. Nope. Not even a minor one.
  2. Are you sh***ing me?
  3. Yes, and the US Representative for Syria says there is no upside to getting involved.
  4. Absolutely not. There are NGOs. There is the UN. There are other governments. The image at the top of the page indicates the UN an Red Crescent are active there.
  5. Are you sh***ing me?
  6. No. And just because this isn’t starting out kinetic doesn’t mean it won’t go that way. See Mogadishu.
  7. No.
  8. No.

How many American troops is Rogin willing to kill so that he can feel good about himself? A hundred? Fifty? Surely, he must have a number in mind.

Trying to provide relief to these people would require the infusion of several thousand troops to a) deliver supplies, b) guard the supply dumps, c) secure the convoys delivering the supplies. This would inevitably serve as a magnet for both more refugees and for people wishing to carry out attacks on US military forces. While it sucks to be those refugees, there is little we can really do about it without creating a larger mess than exists.

The sad fact is that this civil war is over. Bashar Assad has won. The war that Barack Obama and Hillary Clinton kicked off thinking the could quickly dispose of a guy who really needed killing mutated into a war that has lasted seven years, engendered genocide and ethnic cleansing, displaced millions of people, and, inadvertently, change the dynamics of European politics perhaps forever as countries, like Italy, will find their own people a minority in their own country within 50 years. There is no US national interest in getting involved in this mess and once we are there, we own it.

What I don’t understand about the left is their opposition to military actions that actually make sense (like keeping Central America from going communist) and the way they drool at the idea of getting young Americans killed for a warm fuzzy feeling and cocktail party banter (Somalia).

This misadventure should serve as an object lesson at the futility of letting failed novelists and narcissistic bloviators get us into wars. It should not be a catalyst to sending more American troops to do nothing worthwhile and great cost of time, treasure, and blood.

As has been signaled for a while, the Democrats in the House want to have their cake and eat it to on impeachment.

They don’t want to actually impeach Donald Trump because that’s wildly unpopular. Instead, they want to wink and nod while demanding judges give them access to information as if impeachment had happened so they can drag this out until 2020.

That’s the plan Jerry Nadler and company are moving forward with now and this was laid out in a bizarre press conference yesterday.

The technical absurdity of “filing an application” aside, here’s what Nadler is trying to do.

As a major next step, Chairman Jerrold Nadler, D-N.Y., and the committee filed a petition in D.C. federal court on Friday to obtain grand jury materials from the former special counsel’s investigation. The petition claims the panel needs the information in order to determine whether to recommend articles of impeachment, in an attempt to give the request more weight in the eyes of the court.

“To meaningfully consider whether to exercise this authority — as well as to exercise its other pressing legislative and oversight responsibilities — the Committee must obtain evidence and testimony in a timely manner,” the filing reads.

Fresh off the disaster that was Robert Mueller’s testimony, Nadler has now decided to take the next step in this ridiculous game. Namely, he’s going to ask the court to make an exception in the laws dealing with grand jury testimony. Keep in mind that such exceptions are granted at such a low volume as to be almost non-existent historically. There are almost no legitimate reasons to expose people who gave grand jury testimony and political food fighting is certainly not one of those reasons.

The law protects grand jury testimony for a very important reason. If the guarantees of confidentiality are no longer there, the grand jury system becomes pointless and it encourages a lack of cooperation. This is especially true given that the mere presence of a person testifying can be used to smear them, even if they’ve technically done nothing wrong.

What Nadler is trying to do sets an awful precedent.

This is exactly right. The access Nadler seeks is reserved for actual impeachment proceedings (and even then, maybe not). There is no precedent, nor logic to opening an “impeachment inquiry” within a committee and then suddenly being given access to everything as if articles of impeachment had passed. You either pass articles of impeachment or you don’t.

If a judge rubber stamps this, it opens the door for massive abuse, not just that which will take place under Nadler, but also in future administrations. Don’t like who was elected president? Just open an impeachment “inquiry” in a committee and demand all their personal information. There’s got to be something there, right? And we just need to be sure of course.

That’s essentially what Democrats are doing. They have no real evidence of high crimes and misdemeanors. If they did, they’d have passed articles of impeachment already and we’d be halfway through a trial in the Senate by now. They can’t though, so they want to subvert the system entirely, impeaching while not actually impeaching so as to not rile public opinion against them.

Republicans are already speculating this gambit won’t work.

This description, though, prompted confusion on Capitol Hill. Republicans on the same committee insisted that the House has not entered a formal impeachment inquiry, meaning Democrats aren’t entitled to the grand jury material they seek.

“The House is either formally in impeachment proceedings, which involve both an impeachment inquiry and consideration of articles of impeachment, or we are not. It’s a binary issue,” a GOP aide said in an email.

House Judiciary Committee Ranking Member Doug Collins, R-Ga., blasted Nadler’s move to “sue for grand jury material to which they have no right.”

“Chairman Nadler’s legal action here is sure to fail, weakening Congress’s ability to conduct oversight now and into the future. If my colleagues want grand jury information, they should propose legislation allowing Congress to access it,” he said in a statement. “Democrats want to convince their base they’re still wedded to impeachment even after this week’s hearing, but a baseless legal claim is an odd way to show that.”

Whatever judge gets this, regardless of who appointed him or her, needs to put politics aside and slap this down hard. Ruling in favor of Democrats here would open a Pandora’s box of corruption. If Democrats want special access to materials, they need to impeach the President. Period. If they can’t do that, tough luck. They don’t get to change the rules just because they are scared of public opinion. The case law does not support them getting their way here and it shouldn’t be ignored just because Trump is president. That has become all too common and it’s a blight on our judicial system.

Hopefully, cooler heads prevail here in court, even if it means the Supreme Court having to step in eventually. The left hating Donald Trump is not a valid reason to destroy all constitutional and legal norms.

President Trump Has Whacked 13 Regulations For Each New One Enacted
In and amongst all the daily sturm und drang of the Trump Presidency, sometimes we just might need to step away from all the reality show stuff and have a deeper look at just how surprisingly and strategically effective President Trump actually is. Over at Legal Insurrection, they talk about something that is almost as important as Supreme Court Nominations—Regulatory Reform. One of President Donald Trump’s campaign promises was to roll back Obama-era regulations and to lift a variety of restrictions put in place by the mammoth bureaucracy that is our federal government.

He stated in the lead-up to the 2016 election that he intended to eliminate two regulations for every new one.  To date, the Trump administration is far exceeding that goal, eliminating 13 regulations for every new one.

Thirteen for One! Six times better than he promised! That’s huge. According to Steve Forbes, quoted in the same article (emphasis mine) regulatory relief is just as important as tax cuts to unburden a moribund economy.

Two big things have been propelling the U.S. economy forward in impressive fashion: the 2017 Trump tax cuts and the president’s relentless drive to reduce unnecessary regulations, which are another form of taxation.

As most of us know, bureaucracies and their evil spawn, regulations, once born are well nigh impossible to kill. What’s more egregious, is that by pretty much a stroke of a pen and with very little oversight, nameless bureaucrats can reduce your take home pay or increase your cost of purchasing a common commodity. This news isn’t as good as hearing that Ruth Bader Ginsberg & John Roberts have retired, but it’s still pretty good. Drain. The. Swamp.

Kentucky Senator Rand Paul has also been listening to Rep. Ilhan Omar complain about and denigrate America and he’s got a solution that will likely get him called “racist” by anyone on the left who hears it.

Paul was being interviewed by Breitbart about Omar’s disrespect and Paul told the story of immigrants he’s met who have escaped to America from places that were living hells under dictatorial regimes.

“Most of them are thankful, I’ve met people who have come here from behind the iron curtain that got away from Communism – they’re some of the best Americans we have because they really appreciate how great our country is,” said Paul.

“And then I hear Representative Omar say ‘oh America’s terrible. I’d love there to be justice and there’s no justice here’ and it’s like she came here and we fed her we clothed her – she got welfare, she got school, she got healthcare and then she has the honor of actually winning a seat in Congress and she says we’re a terrible country. I think that’s about as ungrateful as you can get,” continued Paul.

Paul took the position that, while Omar shouldn’t be forcefully sent anywhere, he’d be happy to buy her a ticket to Somalia so she could see for herself just how great she has it here in the states.

“I think she could look and learn a little bit about the disaster that is Somalia that has no capitalism, has no God-given rights guaranteed in a constitution and has about seven different tribes that have been fighting each other for the last 40 years,” continued Paul. “And then maybe after she’s visited Somalia for a while she might come back and appreciate America more.”

I have to agree with Paul on this one, and have written that if Omar is that down on America, then maybe she should indeed go to the place she escaped as a child to see just how amazing it is to be an American.
