#MeToo was an odd thing. It wasn’t so much a revolution as a frenzy. It was lathered onto the front page in a way that was overwhelming. It was the New Kids on the Block. For a moment in time, everyone was wearing the pins and watching the shows and going to the events and emoting all over themselves. It swept the nation, just like “You Got It (The Right Stuff).” For an ideologically-oriented movement, that’s the kiss of death. Because that level of mania can’t be sustained.

Therefore, this is how it seemed to me when it was at its peak: We’re in the throes of a heightened level; anything anyone does or is revealed to have done during this window of time is going to get ruined. Then the news cycle’s going to reset, and everyone thereafter will continue to get away with similar misdeeds because people are sick of hearing about it.

Now here we are, largely on the other side. And one man swept by the broom of yesterday’s headlines is now regretting his surrender to its custodial cleanup.

After resigning from his senate seat in 2017 amid allegations of forcibly kissing talk-show host Leeann Tweeden and the damnation of a 2006 pre-Congress photo of him mockingly groping her as she slept, left-winger Al Franken wishes he’d stayed and fought.

A Monday piece in The New Yorker profiled the disgraced politician’s plight.

Al told the outlet due process is a thing:

“The idea that anybody who accuses someone of something is always right ― that’s not the case. That isn’t reality.”

The former SNL writer wishes he’d gone before the Senate Ethics Committee rather than stepping down.

And he’s not the only one with regret. Jane Mayer reported:

A remarkable number of Franken’s Senate colleagues have regrets about their own roles in his fall. Seven current and former U.S. senators who demanded Franken’s resignation in 2017 told me that they’d been wrong to do so. Such admissions are unusual in an institution whose members rarely concede mistakes.

Indeed — Vermont Democratic Sen. Patrick Leahy said pressuring Al to quit is “one of the biggest mistakes [he has] made” in his 45 years in Congress.

Former North Dakota Democratic Sen. Heidi Heitkamp’s bummed, too:

“If there’s one decision I’ve made that I would take back, it’s the decision to call for his resignation. It was made in the heat of the moment, without concern for exactly what this was.”

Tammy Duckworth, the junior Democratic senator from Illinois, told me that the Senate Ethics Committee “should have been allowed to move forward.” She said it was important to acknowledge the trauma that Franken’s accusers had gone through, but added, “We needed more facts. That due process didn’t happen is not good for our democracy.

Maine Independent Sen. Angus King compared Franken’s takedown to an execution:

“There’s no excuse for sexual assault. But Al deserved more of a process. I don’t denigrate the allegations, but this was the political equivalent of capital punishment.”

Oregon Democratic Sen. Jeff Merkley admitted he acted without even examining the situation:

“This was a rush to judgment that didn’t allow any of us to fully explore what this was about. I took the judgment of my peers rather than independently examining the circumstances. In my heart, I’ve not felt right about it.”

How do we end up with such rash people in a position to make our laws??

Jane asked Al a direct question and got an unmistakable answer:

When I asked him if he truly regretted his decision to resign, he said, “Oh, yeah. Absolutely.”

So now the pendulum’s swung back toward the concepts of evidence and proof. Seems reasonable.

Is Bernie Sanders’ Campaign Violating Workplace Laws?

A Washington Post article last week exposed three areas where the Bernie Sanders campaign *may* be violating workplace laws. Since then, Sanders himself exposed another possible violation.

Last week, the Washington Post ran an article (in full here) about a labor dispute between management and unionized staff within the Bernie Sanders campaign.

The crux of the dispute stems from campaign field organizers’ assertion that they are being paid a salary of $36,000 but “working 60 hours per week at minimum, dropping their average hourly pay to less than $13.”

While many focused on the apparent hypocrisy of Sanders paying his own workers less than the $15 minimum wage he touts out on the campaign trail, Sanders quickly addressed the problem by reducing the staffers’ hours.

Although Sanders may have dodged the PR dilemma, there are several potentially-bigger issues (and questions) that the Washington Post article exposed.

They are:

1. Is the Sanders campaign misclassifying non-exempt employees as exempt?

Most employers (and their employees) in the United States are governed by federal laws (as well as individual state laws).

One of those federal laws is the Fair Labor Standards Act (FLSA) of 1938.

Among other things (like banning child labor), the FLSA mandates that employers pay employees the minimum wage, as well as overtime after 40 hours of work…unless they are classified as exempt from the FLSA.

It seems pretty clear from the Washington Post article that Sanders is treating his field organizers as exempt salaried employees. But, are they?

“Employees whose jobs are governed by the FLSA are either ‘exempt’ or ‘nonexempt,’” according to one legal summary. “Nonexempt employees are entitled to overtime pay. Exempt employees are not.”

With few exceptions, to be exempt an employee must (a) be paid at least $23,600 per year ($455 per week), and (b) be paid on a salary basis, and also (c) perform exempt job duties. These requirements are outlined in the FLSA Regulations (promulgated by the U.S. Department of Labor). Most employees must meet all three “tests” to be exempt.

It seems clear that the Sanders team is in compliance with part (a) and (b) as listed above, but what about part (c)?

Are the field organizers actually doing “outside sales” (exempt), or are they doing “inside sales” (non-exempt) in compliance with the Department of Labor’s salary test [see DOL fact sheet in PDF here]?

  • One side note: If a field organizer takes a few days off (e.g., to visit family or some other non-protected reason), does the Sanders campaign dock that employee’s pay? If so, that could also put the employee into a non-exempt category.

[If, in the off-chance, the Sanders campaign is classifying its employees as “independent contractors, that opens up a whole new set of hypocritical issues for the socialist senator.]


2. If employees are indeed misclassified, a) was it willful, and b) does the Sanders campaign owe back pay for overtime?

If Sanders has misclassified employees, his campaign may owe campaign workers a lot of money.

As noted here last week, “if the Sanders campaign workers are not exempt from the FLSA and are entitled to overtime, they should be making nearly $26 per hour for every hour worked over 40 instead of the $12 they’re averaging now.”

If, for example, the workers are entitled to overtime, worked 60 hours and were not paid for it, Sanders may owe each of them hundreds of dollars for each week they worked between 40 and 60 hours.

If there are willful violations, the Department of Labor has the ability to impose treble damages.

Ironically, Sanders (and other Democrats) have been outspoken in asking the Department of Labor to investigate employers they believe have misclassified employees under the FLSA.

Perhaps the same should be asked for the Sanders campaign?


3. Was Sanders’ campaign management direct dealing with unionized staff?

In May, Bernie Sanders proudly announced to the media that his campaign staffers had unionized with the United Food & Commercial Workers (UFCW), Local 400.

While it remains unclear whether Sanders and his campaign management encouraged unionization (which, itself, could be deemed coercive under the National Labor Relations Act), one passage in the Washington Post’s article bears some scrutiny:

The union and the Sanders campaign reached a collective bargaining agreement that went into effect on May 2 and expires on March 31, 2021.

If the Washington Post article is stating the facts correctly (a big ‘if’), Bernie Sanders’ campaign got a signed-union contract on May 2.

Then, after the contract went into effect, Sanders campaign manager Faiz Shakir called “an all-staff meeting, during which he recommended raising the pay for field organizers to $42,000 and changing the workweek specifications…”

If that description of events is accurate, that could be a potential violation of the National Labor Relations Act, as it infers that management [Shakir] was circumventing the union by “direct dealing” with employees.

Here is what the National Labor Relations Board states [in PDF]:

Once an employee representative has been designated by a majority of the employees in an appropriate unit, the Act makes that representative the exclusive bargaining agent for all employees in the unit….Once a collective-bargaining representative has been designated or selected by its employees, it is illegal for an employer to bargain with individual employees, with a group of employees, or with another employee representative.

While the actual facts of the meeting may differ from what was reported in the Washington Post, if they are indeed accurate and management met directly with unionized employees, either campaign staffers or their union (the UFCW), if they wanted to, could file unfair labor practice charges against campaign management with the National Labor Relations Board.


4. Are Sanders’ own statements violating employees’ rights?

Following the kerfuffle that the Washington Post article reported on, Bernie Sanders reportedly later commented that it was “really not acceptable” and that it was “improper” that “people are going out outside the process and going to the media.”

Here’s how it was reported in the Des Moines Register:

He [Sanders] also expressed frustration that staffers had taken their complaints to the media.

“It does bother me that people are going outside of the process and going to the media,” he said. “That is really not acceptable. It is really not what labor negotiations are about, and it’s improper.”

Sanders said, ahead of a weekend Iowa campaign swing: “We are disappointed that some individuals have decided to damage the integrity of these efforts. We are involved in negotiations. And some are individuals that have decided to damage the integrity of that process before they were concluded.”

Although the Senator may not realize it, employees are afforded many rights under Section Seven of the National Labor Relations Act.

Among those rights are the right to engaged in “protected, concerted activity” (with or without a union).

Prohibiting employees against talking to the press about their wages or working conditions could be deemed unlawful.

In fact, only recently, the NLRB issued further clarification on this point:

In a memo released on April 15, the agency evaluated a case where a company maintained a policy that prohibited employees from speaking to the media at any time. The NLRB found this rule to be unlawful and explained: “Employees have a statutory right to speak publically about their complaints or concerns with their terms and conditions of employment, including to the press, without employer authorization.”

Despite the fact that he is running a political campaign, Sanders is an employer–and like the CEO of his campaign.

If employees were to interpret his statements as potential threats that adverse action may be taken against them for speaking to the press, Sanders could have charges filed against him.

As stated above, beside the press accounts as reported, it is uncertain what the actual facts are. However, as described, the reporters’ accounts may, in fact, warrant a closer look into whether or not Bernie Sanders and his campaign are violating its workers’ rights.

Last week, I wrote on a story that was mostly overlooked, despite being pretty big news. Namely, that the Southern District of New York, which had been promoted for years as being Trump’s coming downfall, closed their case against Trump and his organization with no further charges coming.

Judge William H. Pauley III announced that prosecutors in the Southern District of New York revealed this development to the court in a status report, as media companies including The New York Times, Associated Press, CNN, and Dow Jones & Co. have pushed to unseal the search warrant materials related to the case. The end of the investigation likely means no additional charges will be filed against anyone, including the president.

And with that, a collective scream went out among the #resistance. Their last, great hope had crashed and burned, showing itself to be just another dud in the road to take down Donald Trump. The SDNY was supposed to do the job Robert Mueller didn’t do. This time it was supposed to be different. They were the “existential” threat to Trump’s presidency and his family. Lots of “really smart” people told me so on cable news and in editorials at The New York Times.

Alas, it wasn’t meant to be. In the end, the SDNY didn’t have the goods and closed up shop.

That’s no reason to let the media off the hook though. Here’s a killer montage of just how delusional they were in fluffing the SDNY as the coming deus ex machina to take out Trump.

In the montage, you can see foaming at the mouth predictions that Trump would be arrested leaving the White House, that his children would be hauled off the prison, and that there was noway the SDNY was going to let this go without getting “justice.” Will those people apologize or admit they were wrong? Nah, they’ll move onto the next conspiracy theory like they always do.

Adam Schiff was on the Sunday shows just this past weekend insisting that the DOJ may reopen the case after Trump leaves office. That’s not going to happen, but it does show the kind of sickness we are dealing with. These are not sane people.

But good job as always to our intrepid, virtuous media. I can’t imagine why they have absolutely no credibility at this point.

Rep. Dan Crenshaw (R-TX) has emerged as a leading voice among House Republicans on the issue of illegal immigration, and in recent weeks has emphasized the point that the Democratic position is that there be nothing short of open borders.

In an interview with Fox News this morning, Crenshaw responded to claims from Democrats about what’s happening at the border and the course of action some on the left are demanding be taken.

But first, some recent history: Earlier this month Crenshaw pointed out how the Democratic position on the current border crisis had evolved over the last few months from accusing Republicans of “manufacturing a crisis” to finally admitting there is a crisis at the border – and then blaming Trump.

In particular, the freshman Congressman took issue with the claims of Rep. Alexandria Ocasio-Cortez (D-NY), who has been among the loudest voices of opposition to the Trump administration’s border policies, and who said she was harassed during her visit to a detention center in early July:

“Now she is saying that border patrol agents harassed her and forced migrants to drink out of toilets? This is insanity. This is not true. There is no one else corroborating these kinds of reports.

“Yet, she is using it to try and make her case that we shouldn’t have any enforcement and that we should have open borders. This is really dishonest behavior from a member of Congress and I honestly can’t believe it.”

In his interview this morning, Crenshaw responded to a question from Fox and Friends‘s Brian Kilmeade about AOC calling for a 9/11-style commission to investigate how conditions on the southern border have deteriorated:

“Notice that they never come up with a solution,” Crenshaw told “Fox & Friends” Monday morning. “They talk about the over-crowded facilities. They never have a solution. They don’t have a solution for our immigration system. They say it shouldn’t be defined by the administration — well, we do have laws right now…that says you can’t illegally cross the border. That’s immigration policy set by Congress. It’s a law in place. We need to enforce it.”

He said Democrats aren’t proposing ways to fix the issue.

“What they really want is more commissions like this, more investigations they can point to, to call the president evil,” he said. “That’s what they want.”

[…]

“I’m worried that the Democrats like this crisis too much,” Crenshaw added. “I’m worried as I’ve seen them fight against every single, even the smallest measures to help fix our immigration problem, they fight against. They don’t want walls. They don’t want a fix to the asylum loopholes. They’re talking about decriminalizing illegal border crossings.”

In other words, what they want is one thing: Open borders.

Crenshaw also recently pushed for an amendment that would allow for crime data collection in sanctuary cities, which Democrats blocked. Watch below as he discussed the bill during a committee hearing:

“I do honestly fear that we have gotten to a point where we are actually debating between open borders and managed borders,” he said in the clip. “I hope we’re not there. I honestly do not hope we’re there.”

Unfortunately, we are most definitely there.

This Week’s Dem Polling in Arrested Development Gifs

Another week, another poll- this one by CBS News/YouGov. We’ve turned to Taylor Swift and Archer for help remembering which candidate is which in the past and, this week, we’re looking to Arrested Development for help.

How’s the field looking in general? Most voters seem downright delighted with the options they have going into 2020.

These are supposed to be the things they hate about Donald Trump, so it’s going to be hard to run a candidate with the same attributes.

Maybe they’ll find better luck in their second place candidate (who is 5 points behind)- Elizabeth Warren. She is, umm, also white. And doing surprisingly well considering the whole thing where she lied about that.

Kamala Harris brings in 16% of the vote in this poll and, with it, takes third place. With her record on criminal justice, it’s truly incredible she’s in the double digits.

Bernie Sanders is just one point behind Ms. Harris with 15%. Here he is explaining his economic theories to anyone who understands math.

The gap between 4th and 5th place is huge. Pete Buttigieg has less than half the votes of Bernie in this poll with only 6%. Maybe don’t brand yourself as “Mayor Pete” when you were mayor of a failing crime-ridden city. Doesn’t send a great message to viewers.

Trump took aim at the Squad again this morning, tweeting:

The “Squad” is a very Racist group of troublemakers who are young, inexperienced, and not very smart. They are pulling the once great Democrat Party far left, and were against humanitarian aid at the Border…And are now against ICE and Homeland Security. So bad for our Country!

This comment was prefaced on Sunday by the following tweet:

I don’t believe the four Congresswomen are capable of loving our Country. They should apologize to America (and Israel) for the horrible (hateful) things they have said. They are destroying the Democrat Party, but are weak & insecure people who can never destroy our great Nation!

No one cares to talk about the reasons for Trump’s criticism of these Congresswomen.

First, these women are racists and bigots. They constantly remind us that they are “people of color” as if that renders them immune to being tagged as racists. But, racism isn’t a one way street. It’s not a label reserved only for whites or Jewish people.

How would one characterize the following statements by Ilhan Omar? She once said that “Israel has hypnotised the world.” On another occasion, she called upon Allah to “awaken the people and help them see the evil doings of Israel.” No one can forget the anti-Semitic remarks she made in February for which she was widely criticized. First, while explaining the reason U.S. politicians supported Israel, she said, “It’s all about the Benjamins, baby.”  The following month, after still more anti-Semitic tweets from Omar, House leadership considered introducing a resolution to condemn her. After much disagreement within the Democratic caucus, the resolution was watered down to condemn  “anti-Semitism, Islamophobia, racism and other forms of bigotry,” a bow to Omar’s progressive allies.

How about Ayanna Pressley’s remarks last week at the Netroots Nation conference a couple of weekends ago? Sounds a little racist to me. How about you?

I don’t want to bring a chair to an old table. This is the time to shake the table. This is the time to redefine that table. Because if you’re going to come to this table, all of you who have aspirations of running for office. If you’re not prepared to come to that table and represent that voice, don’t come, because we don’t need any more brown faces that don’t want to be a brown voice. We don’t need black faces that don’t want to be a black voice. We don’t need Muslims that don’t want to be a Muslim voice. We don’t need queers that don’t want to be a queer voice. If you’re worried about being marginalized and stereotyped, please don’t even show up because we need you to represent that voice.

They are also young and inexperienced. They’ve spent seven months in Congress. A reasonable person might want to familiarize themselves with the lay of the land, learn how things work in Washington, before trying to transform the country into a socialist republic. But not these four.

In February, one month into her first term in Congress, AOC started a revolution when she unveiled her Green New Deal, which is said to be the brainchild of her Chief of Staff, Saikat Chakrabarti. Presented as a climate change bill, it was a bid to take over the U.S. economy.

Surprisingly, the left piled on to this bold new proposal. Most of the candidates support some version of the GND. Against all odds, this 29-year-old former bartender has managed to pull the party to the left.

Anyone who dares criticize the Squad is labeled as a racist. Trump is a racist and so is anyone who voted for him. When pressed for a reasonable explanation, they point to the children in cages, the squalid conditions inside the border facilities, and separation of families at the border, all of which were the same during the Obama administration.

It’s always interesting to hear stories about college students who are read a statement which they are told was made by Trump. Here is an excerpt from a 2014 Obama White House address.

We are a nation of laws. Undocumented workers broke our immigration laws, and I believe that they must be held accountable, especially those who may be dangerous. That’s why over the past six years deportations of criminals are up 80 percent, and that’s why we’re going to keep focusing on threats to our security.

The students tore it apart, then were told Obama had said the words. And they were silent.

No matter. These ladies want to abolish ICE. According to them, our border control agents are Nazis and the detention centers are “concentration camps.” Oh, and Trump is a fascist.

AOC is seen crying at the border. Tlaib puts on an emotional performance in a House committee hearing. Is a detention center supposed to be a hotel? These migrants are trying to enter the country illegally. They’ve been told not to come. They know what to expect before they arrive. Furthermore, if the Squad is so concerned about conditions in these facilities, why were they the only four members of Congress to vote against an aid package to improve them?

Why is it considered racist to criticize these four women? As I see it, they deserve to be criticized. Not because, as they constantly remind us, they are people of color, but because of their anti-Semitism, their overreach, their own roles in stoking racial division and more.

They are headstrong, much like teenagers. Put another way, they don’t know what they don’t know. They’re in a hurry and don’t want to take the time to learn how things are done. As a result, they are making mistakes.

You would think liberals would like them. But their popularity is surprisingly low. Except for those on the far left, most Democrats find these women and their ideas too extreme.

Trump adds “and they’re not too smart.” Here’s an example. In a speech this morning to the NAACP Convention, Rashida Tlaib spoke about her “Boost Act.” In the video below, she tells the audience, “I’m going to take money from the rich and “give it back to the people, those who earned it.” Um…wait a minute.

And the best part of all is that Trump has managed to make them the face of the Democratic Party.

Who could have possibly foreseen this?

Over the past week, we’ve had an all out political food fight involving Ilhan Omar (among others) and Donald Trump. That fight expanded outside of just Trump’s comments when Omar, just days after accusing the President of racism, introduced a House resolution in support of the anti-Semitic Boycott, Divestment, and Sanction movement, which seeks the destruction of Israel. She also managed to compare Israel to Nazi Germany because that’s just the kind of person she is.

To this point, not a single intrepid reporter has asked Omar about her sponsoring of such a resolution. Nancy Pelosi, who just a month ago called BDS anti-Semitic from the stage of AIPAC, has always escaped any questioning over how that squares with Omar’s actions. It must be nice to be a Democrat.

Despite the media’s best efforts though, America is learning who Ilhan Omar is and they aren’t fans.

I recently wrote on an internal Democrat party poll showing that Omar had just a 9% (not a typo) approval rating among non-college educated whites in swing states. That’s important because it’s that group that decides which direction states like Wisconsin and Michigan will go in 2020. In the grand scheme of things though, it was easy for partisans to dismiss. Of course those working class white people don’t like Omar. They are just racists after all, right?

Well, we’ve finally got some more in depth numbers and they are equally as brutal for Ilhan Omar, and by extension the Democratic party.

The first thing to note is that over 50% of people have an opinion on her. That may not seem like a lot, but for a single Congressional member, that shows she has pretty massive exposure. It’s illogical to assume that her numbers would improve any with greater name recognition. You’d expect the same trend to continue if the original sample is properly done.

Being 17 points underwater in favorability is simply awful. That’s levels that would make Hillary Clinton laugh. She’s seen as more unfavorable than favorable by every single demographic group except black Americans. But perhaps the most relevant number is her favorability with independents. Those encompass the suburban voters the Republican party lost in 2018 and need to win back. She’s at a full 30 points underwater with them.

What this shows is that Trump’s strategy of making Omar and company the face of the party is actually very smart politically. If Pelosi were still in control, she’d put a damper on it, but the lunatics are running the asylum at this point.

By the way, I’d love to meet the 5% of Republicans who have a favorable view of Ilhan Omar. That’d be a pretty fascinating conversation.

It used to be “believe all women” and their charges are serious; when a Democrat is caught the standards change.

It is with laughable moxie that Jane Mayer, she of The New Yorker, today is attempting to rewrite the history of Al Franken’s downfall. The former Minnesota Senator was chased out of his seat when charges of sexual harassment were delivered by actress Leanne Tweeden. She detailed lengthy occurrences when Franken would have approached her with inappropriate behavior when they were both conducting a USO Tour for the troops overseas.

There was even a widely circulated picture of Franken appearing to be in mid-grope of a sleeping Tweeden. Hers was an accusation with an amount of credibility so strong that numerous fellow Democrats lobbied for Franken to step away. Now Jane Mayer goes to work to forensically pick apart the Tweeden claims in The New Yorker, all because the disgraced politician is saying he regrets stepping down.

This is a staggering turnabout by Mayer for a number of reasons. The first being the obvious: What happened to the leftist mantra of believing all women? How is it possible the term “all” comes with a qualifier, though it seems that it is in fact the case when it comes to which party the accused represents.

Secondly, how is Al Franken today denying his responsibility in the matter? There is a lengthy testimonial from Tweeden that has not been questioned, until today. Then there is the photographic corroboration, a picture with the same players that follows the narrative. Now roll in the biggest detail needing to be overlooked: Franken admitted to the behavior when this broke out. Now, after saying he previously crossed a line with many women, he today is claiming his innocence.

“Tweeden may well have felt harassed, and even violated, by Franken, but he insisted to me that her version of events is “just not true.”

But the worst of it involves not the two parties, but Jane Mayer. Last October Mayer, along with one time respected journalist Ronan Farrow, released a lengthy article they worked together attempting to draw up a list of potential witnesses attesting to Supreme Court Nominee Brett Kavanaugh being a serial lecher. The article came out as an eleventh-hour bid to derail the confirmation process. Her list of “witnesses” were little more than people who had heard things, and could not confirm solid evidence, let alone place Kavanaugh directly on the scene of any wrong-doing.

The primary witness Mayer offered up had to be qualified with the phrase “if true” regarding her claims. Those claims never did come to anything approaching verification, and the hit-job Jane Mayer attempted became blatantly revealed for what it was. She promoted a series of allegations that were not rooted in anything approaching verifiable testimony, yet sold that as a valid story that should have motivated a Senate investigation.

Today she is claiming to have done the extensive journalistic work, in a case that has been closed for some time and with details which have not been questioned. She does this in an attempt to rehabilitate a fallen Democrat Senator, one who already took responsibility. Clearly when you are a Democrat you are granted the benefit of the doubt, even well after an incident has been established. Conservatives, meanwhile, have to bear the guilt of any accuser, evidence and proof of wrongdoing not required.

Fail: CNN Caught in Remarkable Self-Own After Saying Trump “Falsely Accused” AOC of Calling America “Garbage”

In October 2017, CNN launched what they called a “Facts First” campaign to counter Trump’s narrative that the cable news outlet was a non-stop source of “fake news.” The move was met with much praise and fanfare, including from Variety, which published this report:

In what may be one of the most distinctive and unorthodox promotional campaigns from the Time Warner cable-news outlet since Ted Turner launched it in 1980, CNN will push back against the portrayal by critics and members of the Trump administration that it dispenses made-up stories to the public in deliberate fashion. A new branding campaign gives the network a new slogan: “Facts First.”

One of the promos, which start appearing on CNN today, shows a stark picture of an apple on the screen, while music plays. “This is an apple,” says a narrator. “Some people might try to tell you that it’s a banana. They might scream ‘Banana. Banana. Banana.’ over and over and over again. They might put ‘banana’ in all caps. You might even start to believe that this is a banana. But it’s not,” counsels the voice. “This is an apple.”

Remember this?

Since that time, CNN has continuously tried without much success to push back on claims from Republicans including Trump that it leans left, that it more often than not only gives you one side of the story, and/or that it frequently gives you the wrong side of the story.

Their “Facts First” campaign has done little in the way of convincing their critics that the network is on the up and up, especially when you consider how they routinely hold Democrats to different standards than they do Republicans.

But though their duplicity has been well-documented, a pretty remarkable thing happened this past weekend on their website. They fact checked claims President Trump made about Squad leader Rep. Alexandria Ocasio-Cortez (D-NY), and ended up owning … themselves.

Here’s how their resident fact checker Daniel Dale set it up – the bolded emphasis is added by me:

During an exchange with reporters as he left the White House on Friday afternoon, President Donald Trump made false accusations against both Rep. Alexandria Ocasio-Cortez and Rep. Ilhan Omar, two of the four Democratic members of Congress against whom he launched a racist “go back” attack earlier in the week.

“The first lady thinks that it’s horrible what they’ve said about Israel and horrible what they’ve said about our country, these congresswomen. They can’t call our country and our people ‘garbage.’ They can’t be anti-Semitic. They can’t talk about evil Jews, which is what they say. ‘Evil Jews,’ ” Trump said Friday.

In both cases, he was twisting a quote to bolster his allegation that “they hate our country.”

Facts First: Ocasio-Cortez did not call Americans “garbage”; she said in March that the country has gone so far in the wrong direction that people shouldn’t be satisfied with moderate policies that are merely “10% better from garbage.” None of the congresswomen have uttered the phrase “evil Jews”; Omar tweeted in 2012 that Israel had committed “evil doings.”

Here’s where the self-own comes in: Trump didn’t just say that AOC called the American people “garbage” – he also said she called our country “garbage”, which is true once you read the context of the AOC quote, which Dale helpfully provides:

Ocasio-Cortez, a New York congresswoman, did not call any person “garbage,” much less Americans as a group.

Ocasio-Cortez was asked at an event at the South by Southwest festival why it has taken so long for there to be Democratic candidates who run on bold progressive policies like Medicare for All and the Green New Deal.

Ocasio-Cortez said the country has drifted so far in the wrong direction, away from helping average working people, that ambitious initiatives are necessary. Given that society has “strayed so far away from what has really made us powerful and just and good and equitable and productive,” she said, “moderate” policies are insufficient.

“I think all of these things sound radical compared to where we are. But where we are is not a good thing. This idea of 10% better from garbage shouldn’t be what we settle for. It feels like moderate is not a stance, it’s just an attitude toward life of like, ‘meh,’ ” she told her interviewer from The Intercept.

Her remark can be interpreted as her saying that the current state of the country is “garbage.” But it is false to say, as Trump did, that she called “our people” garbage.

Trump was briefly closer to accurate in his rally speech in North Carolina on Wednesday, in which he said, “She described contemporary America” as garbage. But he then added, “That’s you, that’s me, that’s all of us — as garbage.” That’s just not true.

Notice how Dale continuously ignores the part of the quote from Trump he gave in the first part of the fact check, where Trump said AOC had called the country “garbage”? Here’s the full quote again:

“They can’t call our country and our people ‘garbage.’”

It’s almost like Dale didn’t even notice the “country” part of Trump’s quote. I guess he was so eager to white knight for AOC that he conveniently overlooked the part of his quote that was an accurate representation of what Ocasio-Cortez has said about America.

A Washington Post video editor posted a video clip of what AOC said so it could be viewed in context. He thinks it exonerates her, but it doesn’t:

If the media firefighters at CNN, the WaPo, and elsewhere wanted to say that Trump was only half correct in his assessment on what AOC has said about America and its people, that would be one thing. In the AOC quote in question, she didn’t say the American people were garbage, but the context made it clear that she was saying the country is garbage.

The transcript backs that up and so does the video – both of which were, rather ironically, provided by newsies trying to disprove Trump’s insinuation that AOC hates America. News outlets that suggest otherwise are doing the whole apple=banana thing, and in the process are taking part in the same type of “fake news” stories they say they don’t push.

The struggle for Democrats to nail President Donald Trump with anything that they could generated no shortage of conspiracies and suspicions. One in particular is that FBI Director James Comey was trying his level best to bring Trump down from the inside.

Now it would appear that these suspicions are true as a report is going to be filed quite shortly showing that Comey was attempting to get dirt on Trump by planting an agent inside the White House to collect information against Trump, according to Real Clear Politics. Comey was apparently doing this while assuring Trump that there was no action being taken against him by the FBI:

Sources tell RealClearInvestigations that Justice Department Inspector General Michael Horowitz will soon file a report with evidence indicating that Comey was misleading the president. Even as he repeatedly assured Trump that he was not a target, the former director was secretly trying to build a conspiracy case against the president, while at times acting as an investigative agent.

Two U.S. officials briefed on the inspector general’s investigation of possible FBI misconduct said Comey was essentially “running a covert operation against” the president, starting with a private “defensive briefing” he gave Trump just weeks before his inauguration. They said Horowitz has examined high-level FBI text messages and other communications indicating Comey was actually conducting a “counterintelligence assessment” of Trump during that January 2017 meeting in New York.

In addition to adding notes of his meetings and phone calls with Trump to the official FBI case file, Comey had an agent inside the White House who reported back to FBI headquarters about Trump and his aides, according to other officials familiar with the matter.

Real Clear noted that the motivations aren’t completely out in the open as to why Comey would do this yet, but Republicans are positive that this was another way that some were attempting to stop the Trump presidency for the same reasons that Peter Strzok was; political motivation.

How deep this rabbit hole goes is anyone’s guess. It’s doubtful Comey was doing this of his own accord and likely would have had co-conspirators in their mission to bring down an entire presidency from the inside. Rest assured that this investigation is going to turn up a lot more in the future.
