For extra drama, maybe Bolton will finally reveal in that same issue that he’s the “Anonymous” who was working for the Resistance inside Trump’s administration the whole time.

I kid, but the prospect of a deposition is real. And as noted last night, Bolton figures to be a potentially important witness.

As House members who serve on the Intelligence, Oversight and Foreign Affairs committees have been interviewing witnesses in private, some of the committees’ Democrats have said they believe there’s a need for Bolton to testify.

As a Twitter pal said yesterday, I can’t believe he’s going to get Trump impeached just because Trump wouldn’t let him start a war.

There’s news today about another potentially important witness. The figure who came up most often in Bill Taylor’s testimony earlier this week was Tim Morrison, an expert on Russia and Europe who served under Bolton on the National Security Council and who was on the call between Trump and Zelensky on July 25. Morrison is already set to testify. The newsy part, per CNN, is that he’s supposedly going to corroborate Taylor’s bombshell testimony about a quid pro quo — but with a key caveat.

[T]wo sources also tell CNN that Morrison will contend that he didn’t see anything wrong with what the Trump administration did, while one of the sources said there will be “nuance” over what Morrison intends to say.

Taylor testified that he was “alarmed” to learn from Morrison that the Trump administration “conditioned” not only a Trump-Zelensky White House meeting but also the military assistance on the investigations.

Taylor said that Morrison told him about a conversation between Gordon Sondland, the American ambassador to the European Union, and Andriy Yermak, a Zelensky aide. Sondland told Yermak in September that the aid “would not come” until Zelensky “committed to pursue the Burisma investigation,” according to Taylor’s testimony.

I’m not sure it’ll work to Trump’s benefit if Morrison confirms that everything Taylor said is true, up to and including Sondland warning the Ukrainians that they needed to do something on Biden to get their aid, but subjectively he just didn’t see what the big deal was. I guess it depends on why Morrison didn’t think it was a big deal. Does he have reason to believe that Trump wasn’t looped in on what Sondland was doing, in which case he’d be helpful to Trump’s defense? Or is he just sort of “meh” on the president using taxpayer funds to squeeze foreign powers on corruption probes that just so happen to focus on the frontrunner in the other party’s presidential primaries?

Either way, Morrison is notable because of his firsthand knowledge of some of the key events, like the call. It’s fair to knock the whistleblower complaint for hearsay, relaying little more than second-hand information, but that’s what the inquiry was for. To haul in the people who were actually there as the Ukraine business was carried out and hear it from them directly. The whistleblower probably won’t testify at Trump’s trial but Sondland, Taylor, and Morrison will.

In lieu of an exit question, read this other CNN piece addressing one of the mysteries of the Ukraine case: After blocking Ukraine’s military aid throughout the month of August, why did Trump finally relent and hand it over on September 11? In the abstract, that undercuts the idea of a quid pro quo. After all, Ukraine never did publicly commit to reopening the Burisma and CrowdStrike probes until later, after they had the money in hand. Trump forking over the cash in advance is potential evidence that he wasn’t using it for leverage after all. The CNN story argues, though, that all sorts of political grenades about a quid pro quo were starting to go off around the president just before he coughed up the money, which may have spooked him into doing it. Members of Congress were demanding to know why it hadn’t been turned over, with Democrats ready to block Pentagon funding over it; people at OMB were allegedly worried they’d be in legal trouble if the money didn’t go out before September 30; and just two days before, on September 9, the House Oversight Committee opened an investigation into what Trump and Rudy were doing with Ukraine. Whispers about irregularities had also leaked into the press, with WaPo running an editorial about a possible quid pro quo on September 5 under the eye-popping headline, “Trump tries to force Ukraine to meddle in the 2020 election.”

Here’s a bit from the CNN piece that I hadn’t heard before, though: “That same week, Mulvaney and other top White House officials first learned about the whistleblower complaint. While White House lawyers had known about the complaint for weeks, news of its existence was starting to spread within the West Wing.” Either Trump first discovered that week that people in the intel bureaucracy were scrutinizing his dealings with Ukraine or he realized that the rest of the world was about to discover it. And so, perhaps, he decided to just get rid of the hot potato by finally handing the aid over. If he was about to be accused of a quid pro quo, best not to have the quid still in hand while awaiting the quo.

As I reported yesterday, the Barr-Durham probe into the origins of the Russia investigation has now transitioned into a full blown criminal investigation. What this means is the ability to compel testimony, empanel a grand jury, and subpoena documents. Before this change, cooperation was essentially voluntary.

There are some dots to connect here, which while still speculative, are becoming clearer as the days pass. This change to a criminal investigation came at exactly the same time the Inspector General announced his report was nearly ready for release. It’s fair to assume that it likely contains some criminal referrals. There’s also the news that broke earlier today that Lisa Page helped edit and retroactively date Flynn’s interview 302s. Was something illegal done with that? To the layman, it certainly seems improper and it’s a trail that will likely be followed.

Aside from the details, much of which have been reported by RedState over the past few days, one of the more humorous aspects of all this is seeing Democrats begin to soil themselves at the thought of possible corruption dealing with the Trump-Russia investigation.

Let’s start with the committee chairs at the forefront right now.

Yes, that’s Jerry Nadler and Adam Schiff, who are currently leading highly partisan investigations of the President complaining that Bill Barr is somehow a partisan. Keep in mind as well that John Durham is Barr’s top guy here and that he was appointed by Eric Holder to prosecute torture cases. He’s also got a history of mob busting. In other words, Durham is as far from a partisan as you’ll find at the DOJ. Democrats are purposely not attacking him directly, instead going after Barr, but the fact is that Durham is the one running this investigation on the ground.

Mark Warner, also known as Republican Sen. Burr’s boss, chimed in.

Notice the indication here that corruption should be brushed aside because it may somehow jeopardize “key international intelligence partnership.” He doesn’t expound of course, but his complaint seems rather hollow. If those partnerships include foul behavior, then they need to be jeopardized and if they are so weak that they can’t simply answer questions, then they weren’t worth much to begin with.

Barr has been before Congress many times. I’m sure he’d be happy to go again and embarrass those questioning him.

Here’s Dick Blumenthal, famous for lying about his service in Vietnam, ranting a bit.

Are you starting to see the trend? These people are nervous and their responses actually may be changing my mind a bit about whether something is going to come from this. People are starting to lawyer up and the political ramifications are obviously not good for Democrats. I do not think Durham would have moved to a criminal investigation if he didn’t have evidence in hand.

I’m old enough to remember when Democrats loved investigations until they suddenly didn’t. Many are on record asserting that if someone has nothing to hide, they should welcome being investigated. That was a very common theme throughout the Mueller ordeal. Now that the Obama administration is the target, including figures like Brennan, Clapper, and Comey, the flailing and consternation has begun.

The media are obviously losing it as well, doing their level best to the lay the groundwork for an “improper bias” narrative involving Barr’s work. You could see that in the Times report on this change last night. It’s all nonsense and should be ignored. While the left are going to do everything they can to muddy the waters, a lot of people are sleeping a little worse tonight.

CNN sent correspondent Martin Savidge to my beloved state of North Carolina this week to ask voters their thoughts on the impeachment inquiry drama currently playing out in Washington, D.C.

As House Intel Chair Adam Schiff’s show trial inquiry has been described by Republicans like Rep. Lee Zeldin (NY) as nothing more than a “clown show” process, it would seem fitting that the choice of venue for the interviews was … the state fair.

Before we get started on what the voters said, let’s take a quick look at the beauty of it all – from the ferris wheel at sunset to the bacon stand where, of course, the bacon options are plentiful:

Most of the voters Savidge talked to were either against impeaching Trump or ambivalent about it. One of the voters talked about how he did not like the secrecy of it all. Here’s a partial transcript:

SAVIDGE: Here, you can satisfy your wildest deep-fried dreams. We’ve come to measure voter appetite for impeachment.

UNIDENTIFIED MALE: I think it’s a waste of the taxpayer’s money.

SAVIDGE: Do you think the president did anything wrong?

JENNIFER WALL, NORTH CAROLINA VOTER: Absolutely, absolutely.

JIM UZZLE, NORTH CAROLINA VOTER: I don’t think he’s broken the law and I wish they would do right for America versus wasting their money, our money on a lost cause.

SAVIDGE: Most of the Trump supporters we talked to were unmoved by days of explosive testimony and revelations against the president.

Do you think it changes the minds of Trump supporters?

JEFF MASON, NORTH CAROLINA VOTER: I do not. The ones of us who support him will continue to support him. If you look at the economy, there’s no way to design that weir doing pretty amazing.

RICH BLEWITT, NORTH CAROLINA VOTER: If it was out in the open and everything was discussed and he did something wrong, impeach the guy. I just don’t like the secrecy. It just sounds wrong the way they’re going about it, that’s all.

It was the last voter, a Trump supporter, who stole the segment. When Savidge asked him if he followed the impeachment news closely, here’s how the voter answered:

SAVIDGE: Joe Miller did vote for Trump. Do you follow this?

JOE MILLER, NORTH CAROLINA VOTER: Not much. I try not to, actually.

SAVIDGE: How do you avoid it? It seems to be everywhere.

MILLER: I watch a lot of ESPN.

Now my critics will complain that I’m saying voters should stay in the dark on what’s going on in the world by avoiding watching the news. Not so. I just know that as someone who covers this stuff every day, sometimes it’s nice to be able to avoid all the drama and spin, even if just for a few hours. Especially when we’re talking about watching the type of “news” programming that comes from national media outlets like CNN.

And it’s not even so much by watching ESPN as an alternative, either, because even they get political sometimes. Maybe watch some ID channel. Or HGTV, or some YouTube organizing videos, or …

Federal judge: Secret Mueller grand jury material must be shared with House Dems — because their impeachment inquiry is legally valid

Expecting some solid rage-tweeting from POTUS over this later today, especially since the judge is an Obama appointee.

One of the core Republican critiques of the impeachment inquiry is that it hasn’t been authorized via a floor vote, as has traditionally happened in the House when an impeachment investigation begins. That’s not just a political complaint either. It was the very first legal claim made in the letter sent to Pelosi a few weeks ago by White House counsel Pat Cipollone:

That issue was before a federal district court this week in connection with Democrats’ demand for access to the redacted grand jury material in the Mueller report. The law says that grand jury material must be provided when it’s relevant to a “judicial proceeding.” But that’s Cipolline’s, and the DOJ’s, point — there’s no “judicial proceeding” in the House because they’ve never gotten around to formally initiating one. That forced Judge Beryl Howell to take up the question of whether an impeachment inquiry that hasn’t officially commenced with a House vote can be said to exist.

Answer: Yes. The key section runs from pages 49 to 62 of the opinion. Howell notes that the House has in fact impeached *judges* before without formally opening an impeachment inquiry with a floor vote, but the thrust of her argument is simply deference to the House on a matter where the Constitution gives it exclusive power. That deference isn’t unlimited — the court can and will scrutinize whether the House, in demanding grand jury material, really does want that material for an investigation whose “primary purpose” is judicial, i.e. impeachment. But if the House clears that bar, which it did in this case, the court isn’t going to tell it how to run its shop by voting on an official resolution to open an impeachment probe. Especially not based on something as gassy as tradition:

Howell emphasizes deference to the legislature again later:

The ruling can be and will be appealed, of course, but I’m skeptical that a 5-4 conservative majority led by John Roberts will start dictating procedural steps to Pelosi on a matter as glaringly political as impeachment. The other four conservatives might be willing to, but there are two ultra-high-profile examples in Roberts’s past of him allegedly changing his vote to side with the liberals in cases that had drawn intense political interest. Roberts reportedly is anxious that the Court not come to be seen as just another partisan operation; the Trump era, with POTUS complaining about “Obama judges” vis-a-vis “Trump judges,” must have only intensified that anxiety. It’s all but impossible to imagine Roberts casting a decisive vote for the Republican in a showdown over whether the Democratic impeachment process is constitutional or not, knowing that that decision will be demagogued as Republican justices covering for Trump. I’d bet on Howell’s ruling to stand, at least in its bottom-line holding that the House gets wide latitude on how to conduct impeachment.

I might even bet that the vote will be more lopsided than 5-4.

Exit question: What sort of bombshell would need to be lurking in the Mueller grand jury material for Democrats to add something related to Russiagate to the articles of impeachment? Pelosi has reportedly been adamant behind closed doors that impeachment should focus laser-like on the Ukraine matter. The further it strays from that subject, the more the public will lose sight of what Trump is accused of and the easier it’ll be for Republicans to accuse Dems of kitchen-sinking all of their grievances with the president via impeachment. I think they’re going to stay away from Russia stuff unless there’s something truly explosive in the Mueller stuff — explosive enough that it’s actually more incriminating than the Ukraine matter.

Radio host Sebastian Gorka spotted something very unusual about former CIA Director John Brennan’s twitter account today. Gorka tweeted, “Why hasn’t @BarackObama’s chief bagman @JohnBrennan not appeared on Social Media for 9 days now?”

Brennan typically posts at least every day or two, usually to take a jab at Trump or one of his associates. But he’s gone quiet.

I know what might explain it. It’s been a week since NBC reported that Attorney General William Barr and U.S. Attorney John Durham planned to expand their investigation and were said to be interested in interviewing Brennan and his colleague, former Director of National Intelligence James Clapper.

That had to be a blow and I’ll bet social media is just about the last thing on his mind.

I guess that’s what happens when you interfere in a U.S. election. Then, when you don’t get quite the result you were shooting for, you decide to do whatever it takes to overturn it. Not good for the soul John.

Oooh! I’m looking back at some of his previous tweets. Most of them are directed toward President Trump.

He does include several positive comments. Actually, he praises Mitt “Pierre Delecto” Romney for his courage and integrity! He writes, “How many other Republican Senators are ready to show the courage, integrity, & principled position of Senator Romney?”

Hopefully none.

He concludes with, “Thank you, Senator, for putting our Nation & our Constitution above party politics & the corrupt behavior of Donald Trump.”

In another tweet, he congratulates former National Security Advisor Susan Rice on her new book and commends her for her values. Did he catch what Susan said this week about Sen. Graham? Classy lady.

I bet Brennan was really rocked last night when he heard that Durham’s administrative review had shifted into a criminal investigation. At least he didn’t go on television to explain it all to us like his buddy, Andrew McCabe.

We may not be hearing much from Brennan in the near future. After all, finding just the right lawyer has got to be a very time consuming process. Poor Johnny.

Apparently, the one person who can shame Adam Schiff more than Adam Schiff in 2019, is Adam Schiff in 2015.

During this “whistleblower” sham of a witchhunt, Schiff has done a number of ridiculous things, such as quoting Trump as saying things he never said to another world leader…

…and gotten caught orchestrating this entire drama with the “whistleblower” before the complaint against Trump was even filed…

Not surprising anyone, this kind of behavior used to abhor Schiff according to statements he made in 2015 about the way Republicans were handling investigations.

The GOP managed to cobble together quite a few of these moments where Schiff lambasted the GOP as being a dishonorable and shady party for doing things such as allowing a set of rules for the impeachment to be set and established, and claiming that the GOP won’t even establish the scope of the investigation.

All of these things that Schiff was supposedly horrified by then are things that Schiff is unabashedly doing now.

Schiff acts as a moral beacon for the rest of Washington, even going so far as to pretend as if impeachment is something he didn’t want to do in the first place, but this video makes it pretty clear just how much weasel DNA Schiff has.

The hypocrisy of Schiff proves that this is a partisan witch hunt — partisanship horrified Schiff in 2015 — and the only thing keeping this going is the Democrat’s desperation and the media’s advanced case of Trump Derangement Syndrom.

Republican nominee John James gave Michigan’s senior Democratic Sen. Debbie Stabenow a run for her money in 2018 in a closely-watched Senate race, but fell short.

But James, a West Point grad and U.S. Army veteran who served in Iraq, is not someone who gives up easily. This time around he wants to take on Michigan’s junior Sen. Gary Peters, and two new polls show James’ hard work is paying off:

That “oh, oh” you hear from the Democratic camp of U.S. Senator Gary Peters is that, in one week, two polls are out showing his race against Republican challenger John James is a statistical dead heat and for an incumbent to be in that spot one year before the election is hardly good news.

In the Vanguard, Dennis, Pubic Sector Consultant poll last May it was Mr. Peters 42% and a generic Republican 36%. It is now 39.5% for Mr. Peters and 39.3% for Mr. James.

The race today is a toss-up.

And then there was this poll from earlier this month:

The poll, conducted by the Michigan-based Marketing Resource Group, a firm with ties to Republicans, shows Peters leading businessman and Iraq War veteran John James (R) by a slim 43 percent to 40 percent margin.

James may have a better chance against Peters, who is seeking his second term in office. Peters is less well-known among Michiganders than his senior colleague; while 75 percent of state voters polled said they were aware of Peters, only 35 percent knew enough about him to say whether they felt positively, 20 percent, or negatively, 15 percent

The poll shows a tighter race than a Target Insyght survey last month, which showed Peters leading by a 53 percent to 37 percent margin.

His third quarter fundraising haul was pretty impressive, too:

We still have a little over a year between now and election time so obviously a lot of things can change, but the fact that James has a strong showing and is doing well in the fundraising department at this stage in the game is a good sign that the inroads he made with voters during the last campaign cycle are paying off.

His only primary opponent as of right now is a man named Bob Carr, and he dropped out of the 2018 Senate race before the primary. He’s also a former Democrat. The Michigan primary is August 4, 2020.

Even with all that encouraging news, James or whoever the Republican nominee ends up being will still end up having a major uphill battle to clear the final hurdle:

Beyond that, beating the professorial Peters will require doing something no one has done in Michigan in 67 years: defeating a sitting Democratic U.S. senator. The last was Blair Moody in 1952, who had been appointed to serve out a term the previous year and lost an election bid to Charles Potter.

Also, though President Trump won Michigan in 2016, his approval numbers there right now are not good according to the Michigan state chart from Morning Consult (make sure to scroll down and click the Michigan tab). This could carry over in down ballot races if that sentiment doesn’t change between now and November 2020.

In any event, put this one on your list of races to watch next year. The Michigan Senate race in 2018 was closer than people thought it would be and that’s just one of many reasons why Republicans feel like James has a real shot at an upset the second time around.

Now Bloomberg, the news outlet most famous for misrepresenting the Facebook messages of a Trump Administration official in an attempt to get him fired, is reporting that the White House knew in advance of the theater on The Hill.

A group of Republicans disrupted a hearing of the Democrats’ impeachment inquiry Wednesday by storming into a secure room at the Capitol in a protest carried out with the blessing of President Donald Trump.

The two dozen or so GOP House members are among some of Trump’s staunchest defenders in Congress, and at least some of them met with the president Tuesday where they outlined a plan to crash the hearing, according to several people familiar with the matter. Trump supported the action, saying he wanted the transcripts of the hearings released because they will exonerate him, the people said.

Why this is considered news is anyone’s guess. The only explanation that I can come up with is that, at some level, the media and Democrats a) don’t believe that Republicans are capable of planning anything and b) they are convinced deep down in what passes for their souls that any action by the GOP is illegitimate and a scandal.

Of course, the White House knew. Of course, Trump knew. Why, in the name of heaven, would House members want to do this and not tell the White House so it could energize its PR apparatus? You’re going to see more of this and you’re going to see more and more White House involvement. The House Democrats have already decided that they will not follow the model used during the Nixon and Clinton impeachment episodes. Fine. They can do that. The House, unambiguously, has the right to create its own rules. If a House majority decided that Nancy Pelosi could “deem” impeachment, they could do that. None of that means that either the President or the House GOP caucus or the Senate GOP caucus has to treat those rules as legitimate.

The best path for President Trump, now that it seems like a decision has been made to impeach without a House vote, is to make the process look ridiculous and clown-like. Thankfully, as Schiff and Nadler are involved, that is not difficult. By making the process a parody, he can delegitimize it in its entirety and make even such weak sisters in the Senate as Romney and Murkowski and Collins queasy about voting to convict.

As Matt Gaetz said, you don’t fight a pack of rabid hyenas using Marquis of Queensbury rules.

On Thursday, Republican Florida Rep. Matt Gaetz appeared on MSNBC and told host Hallie Jackson to stop the misrepresentation of facts.

Actually, that’s a great message for a whole lot of people.

Hallie was pinching Matt on the testimony of William Taylor, acting ambassador to Ukraine. Only some of Bill’s impeachment-related reveal’s been made public, and Hallie wanted to know more:

“[A]bout the substance of this, Congressman — because I haven’t heard you say anything since Bill Taylor testified — yes or no, is it okay for any politician to trade military aid for political favors?”

But Matt wasn’t there for the hearing, so he was all clammed up:

“Look, I’m not going to get into the specifics of the Taylor deposition because I wasn’t present for it. The lead-in to your question was, ‘I want to talk about Bill Taylor’s deposition.’”



Hallie pressed, “Do you think it’s appropriate?”

Matt made it clear — he doesn’t believe President Trump tried to strong-arm Ukraine into investigating Joe Biden by withholding military aid:

“I do not believe it would be appropriate for any politician to link military aid to assistance in a future election. No. And I also don’t think that’s what the President did.”

The congressman wanted to point out — the one thing we do know is Ukraine meddled in 2016 (and if so, it wasn’t  in Trump’s favor):

“It was a Ukrainian court that ruled that the Ukraine impermissibly interfered in the (2016) U.S. election, and that is a sufficient basis for the President to ask for cooperation with the Attorney General on that matter.”

But Katie didn’t wanna talk about that, ’cause it isn’t proven. Trump aggressing Biden, however…

“[W]hat you are saying is significant — not about the piece about Ukraine in 2016, because that is not a proven theory –“

Matt interrupted:

“Well, wait — it was a court order in Ukraine. But you just keep blowing through these things like they’re facts, but they’re not.”

Then he made a T-shirt:

“[S]top mischaracterizing stuff.”

He told Hallie he was having to work extra hard to have the conversation:

“I have to fact-check you in real time.”

The MSNBC host is a fast talker, and the whole exchange was riddled with words, words, words, cranked out as from a gatlin gun with hair.

But Matt told her it’s all foolishness:

“You’re playing the game here, Hallie. You’re playing the game where they selectively leak stuff that is not subject to cross examination, rigorous review, check against documents and timelines. And by the way, when they had to do this in open, in the Russian investigation, with Mueller, with Lewindowski, Democrats looked terrible. And now they’re trying to do things in secret so we can have interviews like this, so that you can cherry-pick elements of leaked testimony, and then ask me about them when I wasn’t in there, you didn’t see the testimony, and more importantly, we’re unable to see how those statements hold up against cross examination.”

The representative laid out what he believes to be the Dems’ MO. Basically, they’re playing Prison Rules, and it’s all a lunge for redemption after the humiliating defeat of goofy Russia Mania:

“[W]hen the Speaker of the House won’t adopt rules, then it creates an environment where the Democrats just sort of make it up as they go along — kick some committees out, let some committees in, and it’s all because they wanna reshuffle the legislative deck, because they’re humiliated that they lost the Russia investigation unequivocally with the American people. Adam Schiff lied to the American people when he said he had more than circumstantial evidence that President Trump was engaged in a criminal conspiracy with Russia…”

Matt said something similar to Tucker Carlson Thursday — there are no rules (here).

But I like Matt’s, and I propose its incorporation into Washington and the media. And the mirror — so what if I ate an entire dozen of Krispy Kreme?

Stop mischaracterizing stuff.
