The latest smear perpetrated against Justice Brett Kavanaugh has finally begun to die down. As I shared over the past few days, the original piece in The New York Times was unverifiable trash, rehashing old, uncredible allegations and introducing a new one that was so laughable that even the alleged victim doesn’t remember it happening. Worse though, the Times also buried a bombshell revelation (first reported in Mollie Hemingway’s book last summer) that Christine Blasey Ford’s “witness” didn’t recall the incident, didn’t find it believable, and had been pressured to lie.

The wheels have come completely off this cart but that isn’t going to stop other outlets from continuing to smear feces on themselves and claim it’s moisturizer.

Per The Federalist, The Altantic is the latest to publish an article of based on excerprts of “The Education of Brett Kavanaugh,” a book so badly researched and biased that it’s actually enjoyable to read for it’s sheer comedic value.

A new Atlantic-published, adapted excerpt of the book attempts to resurrect Pogrebin and Kelly’s anti-Kavanaugh smears but once again has a major error. “We Spent 10 Months Investigating Kavanaugh. Here’s What We Found” was published in the Atlantic.

Their reporting must not have been thorough. In a section explaining why they believe the accusers despite the lack of any evidence, they write that their emotional reaction to the claims was that the claims rang true. But they get major facts wrong:

Using Martha’s common-sense test, the claims of Deborah Ramirez, while not proven by witnesses, also ring true to us. Ramirez, who was a Yale classmate of Kavanaugh’s, said he drunkenly thrust his penis at her during a party in their freshman-year dormitory, Lawrance Hall. The people who allegedly witnessed the event—Kavanaugh’s friends Kevin Genda, David Todd, and David White—have kept mum about it. Kavanaugh has denied it. If such an incident had occurred, Kavanaugh said, it would have been the “talk of campus.”

It is not true that the alleged witnesses kept mum. This is another major error by The New York Times reporters.

Notice in the excerpt above, you get the same ridiculous “ring true” standard that has no basis in fact or any semblance of journalistic process. Things don’t “ring true.” They either are true or they aren’t and if you can’t prove them to be so, they shouldn’t be spread as supposition.

Further, the writers of this new smear-laden book are lying. The people in question did not keep “mum about it.” Several of them questioned the accusations veracity and sided with Kavanaugh, providing their support for the idea that he wouldn’t have done something like that. Other’s outright denied witnessing anything at all.

So why would the Times “reporters” who wrote this book leave that out and then publish an article in The Atlantic also omitting yet more exculpatory evidence in Kavanaugh’s favor? I think we all know the answers to that.

Exactly. This isn’t omission by error. It’s purposefully smearing Brett Kavanaugh by leaving out key facts and witness testimony in his favor. This new anti-Kavanaugh book continues to be shown for the piece of trash that it is. It’s no surprise it came from two distinguished reporters at The New York Times. What’s that say about that publication?

Last Friday, California continued its intolerance of other states having politics different than its own.

Following Iowa’s failure to bill taxpayers for gender-transition surgeries under Medicaid, Attorney General Xavier Becerra made the “Land Where the Tall Corn Grows” the 11th state on California’s travel ban list.

I thought Democrats are against travel bans?

Anyway, state employees are now prohibited from traveling to nearly a quarter of the United States on the citizenry’s dime.

Actually, that doesn’t sound like a bad idea.

But — as pointed out by Ted Cruz — for 2020 Democrat hopeful Kamala Harris, it ain’t so good.

Ladies and gentleman, note the political footshot:

The Daily Wire observes that Iowa hosts “the first nominating contest in the Democratic Party presidential primaries.”

It’s interesting how the same legislation can be framed so differently. This was Iowa Gov. Kim Reynolds’s description of House File 766:

“This narrow provision simply clarifies that Iowa’s Civil Rights Act does not require taxpayer dollars to pay for sex reassignment and other similar surgeries. This returns us to what had been the state’s position for years.”

Contrast that with AG Xavier’s sum-up:

“The Iowa Legislature has reversed course on what was settled law under the Iowa Civil Rights Act, repealing protections for those seeking gender-affirming healthcare. California has taken an unambiguous stand against discrimination and government actions that would enable it. That’s why my office is adding Iowa to the list of states subject to state-funded or sponsored travel restrictions.”

Shouldn’t the Left Coast state help one of its own? Kamala could use it.

More from The Daily Wire:

Harris has enough troubles of her own without being banned from traveling to Iowa; her poll numbers plunged right after Rep. Tulsi Gabbard slammed her at a Democratic presidential debate and haven’t recovered; she’s hovering at a puny 6.2% in the RealClearPolitics average.

Oh, well.

As for the Medicaid regulation, at least one Twitter user gave Iowa’s governor a high-five, and she even provided her street cred:

Though the “bombshell” New York Times hit piece against Supreme Court Justice Brett Kavanaugh has collapsed under the weight of its own deliberate omissions, that hasn’t stopped some impeachment-happy Democrats from demanding a formal impeachment inquiry.

But while the discredited report hasn’t prevented opportunistic Squad members and Democratic presidential candidates like Sen. Kamala Harris from hitting the gas on the Impeach Kavanaugh bus, House Speaker Nancy Pelosi has a giant red “STOP” sign in hand – and is already using it:

House Democratic leaders and rank-and-file members are dismissing calls to impeach Supreme Court Justice Brett Kavanaugh, with some arguing the House has limited investigative resources and others saying it is a politically toxic issue.

Asked on Tuesday night if she sees the House spending any time on the Kavanaugh matter, House Speaker Nancy Pelosi responded with a simple “no.”

Pelosi didn’t elaborate, but other House Democrats boiled it down to fears a Kavanaugh impeachment show trial could hurt them in 2020:

Rep. Katie Hill, a California freshman, said she believes talk of impeachment could hurt Democrats on the campaign trail.
[…]
“… I know that this is not the issue that we want to be talking about just in terms of election,” she added. “I would like us to be able to just do what’s right, but I know that for many of my colleagues, it’s a really, really tough one.”

Pennsylvania Rep. Matt Cartwright also said his party should not prioritize the issue.

“Democrats are focused on the bread and butter, kitchen table issues facing ordinary Americans,” he told CNN.

Meanwhile, Politico reports on the “impeachment schism” that has grown between Pelosi and House Judiciary Committee Chairman Jerry Nadler over the committee’s slow Trump impeachment waltz:

In a closed-door meeting last week, Speaker Nancy Pelosi stunned lawmakers and aides with a swipe at Democratic staff on the House Judiciary Committee.

Pelosi criticized the panel’s handling of impeachment in harsh terms, complaining committee aides have advanced the push for ousting President Donald Trump far beyond where the House Democratic Caucus stands. Democrats simply don’t have the votes on the floor to impeach Trump, Pelosi said.

“And you can feel free to leak this,” Pelosi added, according to multiple people in the room. Pelosi’s office declined to comment on the meeting.

Politico Playbook reported this morning that Democrats are far short of the votes they would need in the House to be able to impeach Trump. According to Democratic insiders they’ve talked to, 175 Democrats would vote today to impeach Trump if the issue came before the floor. That’s 43 short of the 218 needed.

So Pelosi is right to be concerned about how it would look for members if they tried and failed to impeach Trump in the middle of a crucial election cycle after months of Democrats like Nadler and AOC screaming “IMPEACH!”

They don’t have the votes now. They won’t have the votes later. Not for a Kavanaugh impeachment nor a Trump impeachment. Pelosi knows it.

A lot of us have been more than a little uneasy over hints that President Trump may be succumbing to the “do something” impulse in response to recent shootings in El Paso, Dayton, and Odessa-Midland. This is always the worst reason to do anything. There is no conceivable gun regulation, short of mandatory confiscation, that would have prevented any to those shootings. The weakness of the background check and, by inference, red flag laws was demonstrated in Odessa-Midland where the shooter was barred from firearm ownership over mental health issues and was able to purchase one from a criminal. It would seem that the unifying theory of criminal behavior, that is, that criminals commit crimes, was in full force.

Nevertheless, Senate Democrats coming up with three new gun control proposals and Mitch McConnell dumping the decision on how to proceed directly in Trump’s lap gave me the queasy feeling that Trump was about to try to trade away sure base votes for the chimera of pleasing suburban women (we’ve been trying to do that since George H. W. Bush and “soccer moms” and how’s it working out for us?).

That seemed to be about to happen today.

The White House and Department of Justice (DOJ) have met with multiple Republican senators and congressmen to shop legislation on expanding background checks consistent with the Manchin-Toomey bill, sources familiar with the effort told the Daily Caller.

The Daily Caller obtained a copy of an idea sheet circulating among Republican members, which indicates that the legislation in question would expand background checks to include all commercially advertised unlicensed sales.

This bill seems to have effectively shut down all private, non-family sales of firearms unless a background check was accomplished…this is the Holy Grail of closing the “gun show loophole” the left has been caterwauling about for years. Despite the language of the underlying Manchin-Toomey bill, this clearly opens the way for a national gun registry and what that will ultimately mean.

When the White House was asked they disavowed that this was the plan

And, for whatever reason, it appears Manchin and Toomey aren’t on board with the White House talking paper

And the NRA is about to go nuts

What we’re looking at, it seems, is a trial balloon that didn’t go over all that well

For right now, this effort seems to be dead. I suspect that once the White House political operation gets a taste of just how negative the reaction among base voters is, that this idea will stay dead. Until the next time when we must DO SOMETHING.

The 2020 Democratic primary has devolved into insanity, or perhaps it started off that way? We’ve seen the delusional, dictatorial rantings of people like Beto O’Rourke on guns and Kamala Harris on plastic straws. There’s essentially no level of crazy these people aren’t willing to go to in order to pander to the radical left.

Of course, Bernie Sanders has been doing that his entire life, so it’s no surprise when he keeps the train rolling.

Enter the latest bright idea from a guy so intellectually worthless that he got fired from a commune.

While speaking before a left-wing Latino audience, Democratic presidential candidate Bernie Sanders pledged to end immigration raids and impose a “moratorium” on all deportations.

“We are going to end the ICE raids that are terrorizing communities all across this country,” Sanders said Saturday in Las Vegas, according to footage flagged by the Republican National Committee. “We are going to impose a moratorium on deportations. And we are going to, as I mentioned — and there are some things that a president can do with executive orders and some things you can’t.”

A moratorium on deportations, eh? Sounds legit. I mean, it’s not like ICE needs to ability to deport criminals who would otherwise remain here committing more crimes, right? This is a level of shark jumping levels not seen since the Fonz took the water that fateful day. It’s like saying let’s close all prisons or stop enforcing all non-violent penal statues (well, Joe Biden did kind of say that).

Even past the rule of law issues, which stand tall on their own, the impracticality of it all sticks out like a sore thumb. Our system is already overloaded. Now, Bernie wants to tell HHS that no one can be deported? Where will they live? Who will pay for them? Never mind that such an action would result in a massive influx of dangerous, un-vetted illegal immigration. The border has just now started to calm down and Bernie wants to fling the door open again and give away free cocktails on the way in. Think of how much that would benefit the cartels and how many women and children would lose their lives with such a policy.

Democrats are going to calling for seizing citizen’s homes to house illegal immigrants pretty soon. I mean, what’s the next logical escalation of their craziness? They already want to give out free healthcare and college. What about free cars? Free phones? It’s as if money has no finite value.

Let’s be real though. This is actually about simply releasing illegal immigrants into the general population with no accountability. Damage to them or others be damned. The Democrats are playing an incredibly dangerous and cynical game. In a saner political environment, they’d be mercilessly mocked for such ideas. Instead, they are lauded by our media. But these are the stakes in 2020 and why seeing that a Democrat isn’t elected is so important.

Everyone has a fantasy or two.

For an MSNBC panelist, it’s driving his car straight into Trump Plaza.

And that’s the news.

Here’s more about fantasies: Elie Mystal, executive editor of Above the Law, tweeted Wednesday morning about his dreamy would-be car crash, along with an article about an actual Trump Plaza auto accident that resulted in several people being injured Tuesday night.

It’s a fantasy, but the talk is real:

“Real talk: When you come out of the parking lot of this mall/movie theater, you have to sit a red light staring right into this lobby.
I’ve thought about driving my car through it EVERY TIME. Basic humanity keeps me from doing it, but JUST.”

Elie noted that the “the view in this picture is exactly the view you have from the stop light.”

And that light, according to the aspiring felon/potential vehicular manslaughterer, is “long.”

He also theorized that Tuesday’s crash — which was determined by police to be an accident — was intentional.

Or MAYBE that’s his own bias:

“Anyway, innocent until proven guilty but…’accident’ doesn’t seem likely to me. Maybe that’s my own bias.”

The guy ain’t your average schmo — he’s one of them people that knows a lot:

“Defense counsel should NOT put me on this guy’s jury, I know too much :).”

He knows so much that last October, he told America that Bret Kavanaugh’s confirmation may result in a Thousand-Year Reich.

I’ll say that once more: the confirmation of a conservative judge was possibly going to initialize a Thousand-Year Reich.

That, from the guy who knows stuff.

The guy who drives by Trump Tower every day.

The guy who’s dreaming of crashing his car into a building full of people.

The guy MSNBC believes is the right person to have on.

MSNBC guest Elie Mystal, who is the executive editor of AboveTheLaw.com, advocated for nonwhite voters to mobilize to defeat President Trump in the 2020 presidential election, saying “you do not negotiate with” with his white supporters.

Host Joy Reid had asked the panel on Sunday how someone talks to a person who is “drugged by” their support for Trump.

“You don’t communicate it to them — you beat them. You beat them,” Mystal said. “They are not a majority of this country. The majority of white people in this country are not a majority of the country. And all the people who are not fooled by this need to come together, go to the polls, go to the protests, do whatever you have to do. You do not negotiate with these people, you destroy them.”

And from RedState’s Elizabeth Vaughn:

In a Thursday night appearance on MSNBC’s “All In With Chris Hayes,” contributor and legal blog editor Elie Mystal had some fiery words for Equinox and SoulCycle chairman Stephen Ross.

Ross is hosting a fundraiser for President Trump at his home in Southampton, NY this weekend and Mystal has called for protestors to show up outside his home with “pitchforks and torches.”

Apparently, the recent boycotts of Ross’ businesses didn’t go far enough for Mystal. He said:

“People of color are already targets under this administration. I have no problem on shining the light back on the donors who fund this kind of racialized hate. I mean I go further. I want pitchforks and torches outside this man’s house in the Hamptons.

Nice job, Peacock.

When last we left you, New York Times reporters Robin Pogrebin and Kate Kelly were blaming the paper’s editorial staff for cutting out a crucial section of their weekend hit piece on Supreme Court Justice Brett Kavanaugh.

Pogrebin and Kelly have insisted that they included the exculpatory information which noted that the alleged victim of an alleged sexual assault by Kavanaugh has no recollection of it happening. The authors also allege that somehow during the editing process that information was was innocently removed.

Few people are buying it, which is quite possibly why Pogrebin shifted gears on the Twitter machine earlier today by pulling a tactic straight out of the leftist playbook: When all else fails, blame Fox News.

Here’s what Pogrebin tweeted:

Vox’s leading Democratic party shill Aaron Rupar asserted in the piece that Fox News has misleadingly “described changes the New York Times made to Robin Pogrebin and Kate Kelly’s story as a ‘correction’ at least a dozen times.”

Rupar then states that “there’s just one problem — the Times did not, in fact, ‘correct’ anything. To make a ‘correction’ to a story indicates something was factually wrong.”

The problem with Rupar’s piece and Pogrebin retweeting it is that Pogrebin herself has used the term “corrected” to describe the paper taking action to add the information to the story (h/t: Twitchy):

And as Jeryl Bier notes, by Vox’s own standards they label fixing the omission of relevant information from a news story as a … correction:

Regardless of how Pogrebin and Vox labeled the Times’ corrective actions, the whole debate is weak sauce, and a pathetic attempt at shifting the blame elsewhere for failures that can ultimately only be pinned on the two people who wrote the original piece and those who “proofed” it before it went to press:

Pogrebin and Kelly have shown no shame when it comes to the pretzels they twist themselves into to avoid blame for what happened. So their critics should, in turn, shown no mercy in their constructive criticisms. Fair is fair.

Trump Administration Revokes California’s Ability to Set Fuel Efficiency Standards For the Rest of the Nation

Since 1968, California has enjoyed a specific carve-out of regulatory authority under the Clean Air Act. According to the law, no state can set emissions standards in excess of federal standards except for California. This special authority was given in recognition of California’s role as a leader in limiting auto emissions and the unique smog problem facing Los Angeles at the time. (Read the history here even if the total argument is progressive nutbaggery.)

What has happened is that California is in the thrall of the climate change goober community and has set emission standards to, in their benighted view, deal with that problem. This is something not contemplated by the law. The practical effect is that California is able to set vehicle emissions standards for the entire nature by virtue of the size of the California auto market. Essentially, this lets California make law for the entire nation and it has reinforced its position by creating an unlawful interstate compact, the so-called “Section 177 states” of Connecticut, Delaware, Maine, Maryland, Massachusetts, New Jersey, New Mexico, New York, Oregon, Pennsylvania, Rhode Island, Vermont, Washington and the District of Columbia, who follow California’s lead on auto emissions.

There has been a lengthy negotiation period in which the Trump administration has attempted to negotiate with California a freeze on CAFE standards for cars and light trucks at 30 mpg rather than staying on a guide slope to require 54.5 mpg as the fleet standard. But it has gone nowhere:

There appears to have been very little movement in the negotiations since they began almost a year ago, and both sides on Thursday accused the other of negotiating in bad faith.

“Despite the administration’s best efforts to reach a common-sense solution, it is time to acknowledge that CARB has failed to put forward a productive alternative,” a White House statement said, referring to the California Air Resources Board, the state’s clean air regulator. “Accordingly, the administration is moving forward to finalize a rule later this year with the goal of promoting safer, cleaner and more affordable vehicles.”

Stanley Young, a spokesman for the air resources board, said meetings between the sides had been held but “were always at a superficial level, with no effort to engage in a conversation.”

Mandy Gunasekara, who served as principal deputy assistant administrator in the Environmental Protection Agency’s Office of Air and Radiation before leaving this month to start a private consulting business, and who was involved in the talks, said that California had put forward only one counterproposal: a plan to delay implementation of the fuel economy rules by one year. Trump officials saw that as a nonstarter.

“Looking at it now, it seems they were more interested in stalling the progress of the conversation than actually working to make a deal,” Ms. Gunasekara said.

Earlier today, President Trump announced that the administration would grant no further waivers.

This sets up a nasty and lengthy legal battle. The burden is on the EPA to show that:

  • California was arbitrary and capricious in its finding that its standards are, in the aggregate, at least as protective of public health and welfare as applicable federal standards;
  • California does not need such standards to meet compelling and extraordinary conditions; or
  • such standards and accompanying enforcement procedures are not consistent with Section202(a) of the Clean Air Act.

I don’t know how well the administration has done its homework here. It also is looking at an adverse Supreme Court ruling Massachusetts vs EPA where the EPA was required to regulate carbon dioxide as a greenhouse gas and opined that states have a greater role in making these decisions because they are sovereign entities (kind of funny watching Souter, Ginsberg, and Breyer agreeing that states were anything but federal fiefdoms). In that case, Roberts issued a major dissent, so that case may or may not be a factor.

My gut is that if Trump is reelected, the waiver revocation sticks. If he doesn’t win, the case will be dropped and some kind of consent decree tossed in to make it exponentially harder for the next Republican president to try it.

After a growing number of Democrats in recent days have criticized Beto O’Rourke’s gun confiscation plan as unhelpful and unrealistic, President Trump took his turn at the Twitter microphone this morning and delivered some inconvenient truths of his own to the struggling presidential candidate and his party.

Here’s what the President tweeted:

Trump was responding to remarks O’Rourke made at last Thursday’s Democratic presidential debate where he said “Hell yes” in response to ABC News debate moderator David Muir’s question about whether or not he was going to take away people’s guns if elected president:

MUIR: Some of the stage have suggested a voluntary buy-back for guns in this country. You have gone further. You said, quote, “Americans who own AR-15s and AK-47s will have to sell them to the government, all of them. You know that critics call this confiscation. Are you proposing taking away their guns and how would this work?

BETO O’ROURKE: I am, if it’s a weapon that was designed to kill people on a battlefield. If the high impact, high velocity, when it hits your body, shreds everything inside of your body because it was designed to do that so you would bleed to death on a battlefield and not be able to get up and kill one of our soldiers. When we see that being used against children and in Odessa, I met the mother of a 15-year-old girl who was shot by an AR-15 and that mother watched her bleed to death over the course of an hour because so many other people were shot by that AR-15 in Odessa, there weren’t enough ambulances to get to them in time. Hell, yes, we’re going to take your AR-15, your AK-47. We’re not going to allow it to be used against a fellow American anymore.

As of this writing “Dummy Beto” is still trending on Twitter:

The failed Senate candidate replied by doubling down on his call to “buy back” all “assault weapons”, and accusing Trump of “cowardice”:

Beto can say Trump is a “coward” on this issue all day long but it doesn’t change the fact that Trump is right.

What Beto declared at the debate confirms the worst fears of gun rights groups and other 2nd Amendment defenders who have warned for years that Democratic efforts at gun control were part of a “step-by-step process” to eventually take away guns. Sen. Ron Johnson (R-WI) explained this well on Thursday when asked about universal background checks:

“When you really understand what the endgame of the left is, it’s literally mandatory buybacks or as I call it: confiscation. This is a step-by-step process for them,” Sen. Ron Johnson (R-Wis.) told The Hill Thursday when asked about the debate over expanded background checks for firearms sales.

Sen. Chris Coons (D-DE), who has been working with Republican Senators on a compromise bill, said last Friday on CNN that O’Rourke’s statement at the debate “will be played for years at Second Amendment rallies with organizations that try to scare people by saying Democrats are coming for your guns.”

To make matters worse for Democrats, O’Rourke is not the only presidential candidate calling for mandatory gun confiscation. Sens. Kamala Harris (CA) and Cory Booker (NJ), whose campaigns are going nowhere but who have nevertheless both been floated as vice presidential possibilities, have endorsed his plan.

If Beto was a wise man he would have never jumped on board the gun grabbing train and instead offered up some constitutionally sound common sense solutions that most Americans (including his fellow Texans) could get behind. But after the horrific El Paso mass shooting, he has been operating solely on emotion and anger on this issue, which is precisely why he belongs nowhere near the White House.

Because as I’ve written before, no matter how passionate, emotional, and personal an issue may be to a candidate, an unconstitutional plan is still unconstitutional.
