Earlier this week, media and Democrats were pushing that the testimony of William Taylor, the chargé d’affaires in Ukraine since June 2019, was the “smoking gun” showing quid pro quo in the Ukraine matter.

But just as with the Mueller report where the same folks trumpeted “smoking guns” multiple times, it isn’t exactly what it appears to be.

“During that phone call, Ambassador Sondland told me that President Trump had told him that he wants President Zelensky to state publicly that Ukraine will investigate Burisma and alleged Ukrainian interference in the 2016 U.S. election,” Taylor said in his prepared statement that was conveniently leaked, according to Fox News.

“By mid-July it was becoming clear to me that the meeting President Zelensky wanted was conditioned on the investigations of Burisma and alleged Ukrainian interference in the 2016 U.S. elections,” Taylor wrote.

But if you read that and think it sounds like multiple hearsay, you’d be right. It’s basically multiple hearsay, “he said that he said that he said.”

Plus that isn’t what the transcript of the July 25 Ukraine call reflected at all. The transcript of the call showed no discussion of quid pro quo. Indeed, Ukrainian President Zelensky said there was no quid pro quo, that he didn’t feel pressured in any way. So whatever Taylor thought, it wasn’t what Zelensky thought. Additionally Volker said that no one knew that any aid hold up was even in question until late August, long after the July 25 call.

As Republicans who heard his testimony noted when he was questioned, Taylor’s testimony didn’t really support the claim of a quid pro quo. Rep. John Ratcliffe (R-TX) said that the claim didn’t hold water.

“At the end of the day, this was about quid pro quo and whether or not the Ukrainians were aware that military aid was being withheld and on that most important issue. Neither this witness or any other witness has provided any evidence that there was a quid pro quo, or any evidence that the Ukrainians were aware that military aid was being withheld on July 25,” Ratcliffe said on “The Story” Tuesday night, claiming that absent testimony speaking to that point, “a quid pro quo is legally impossible.” ….

“The mainstream media reporting that he provided evidence of a quid pro quo involving military aid is false — I questioned him directly on that,” Ratcliffe said Tuesday. “I can’t tell you what he said … but I can tell you what he didn’t say — neither he nor any other witness has provided testimony that the Ukrainians were aware that military aid was being withheld.”

He added: “You can’t have a quid pro quo with no quo.”

House Minority Leader Kevin McCarthy said Ratcliffe’s questioning blew apart Taylor’s version and Rep. Mark Meadows (R-NC) said media and Democratic reports didn’t tell the story, calling for the full testimony to be released.

But now there’s some more interesting information about that may have bearing on the matter.

Ivan Pentchoukov of The Epoch Times points out that Thomas Eager, a staffer for the House Intel Committee run by Rep. Adam Schiff (D-CA) met with Taylor on August 25 in Ukraine and they discussed Ukraine’s interactions with both past administrations and the current, Trump, administration.

Then Politico published a story about the possible withholding of aid a few days later on August 28 based on a leak from a “senior administration official.”

The senior administration official, who asked to remain anonymous in order to discuss internal matters, said the president wants to ensure U.S. interests are being prioritized when it comes to foreign assistance, and is seeking assurances that other countries are “paying their fair share.”

Pentchoukov also pointed out some other interesting coincidences.

Just interesting coincidences. Perhaps Republicans want to ask Taylor, Schiff and Eager about some of these coincidences?

Newsweek gleefully reported yesterday about comments Fox News senior judicial analyst Andrew Napolitano made on Fox and Friends Thursday morning in the aftermath of the storming that took place on Wednesday by dozens of frustrated House GOP members into House Intel Chief Adam Schiff’s secret hearings.

During the segment, Napolitano told the hosts that the GOP had no one to blame themselves for how the current impeachment inquiry was being conducted. Why? According to him, the impeachment inquiry rules were written in 2015 by the GOP and signed by then-House Speaker John Boehner:

“As frustrating as it may be to have these hearings going on behind closed doors…they are consistent with the rules,” Napolitano, who previously served as a New Jersey Superior Court judge, explained during a segment of the Fox News morning show Fox & Friends.

“When were the rules written last?” the legal expert asked. “In January of 2015. And who signed them? John Boehner [the Republican speaker of the House]. And who enacted them? A Republican majority,” he asserted.

A video of the clip was tweeted out by Media Matters’ Bobby Lewis, who apparently is their designated monitor for Fox and Friends. The clip went viral, and as of this writing has over 29,000 retweets and nearly 80,000 likes:

In the next tweet, Lewis asserted – without evidence – that Napolitano “demolishe[d] Fox’s talking point that Dems need transparency.” Similarly, the Daily Beast ran a piece on the Judge’s comments, and uncritically passed them off as factual. “Napolitano … effectively dismantl[ed] the primary talking point of both Fox News and the Trump White House,” senior writer Matt Wilstein stated.

There’s just one problem: Boehner himself called BS on Judge Napolitano’s comments, as Brit Hume noted in a couple of tweets responding to the reports:

Boehner later confirmed that that’s what he said:

I assume Judge Nap is talking about a rule that was/is supposedly in the House Rules and Manual, an updated one of which is distributed every two years to the new Congress. Here’s how the process works:

Printed as a “House Document,” the Manual is usually authorized by House resolution at the end of a Congress for printing at the beginning of the following Congress. As such, the House document number reflects the Congress that authorized the printing although the cover page identifies the applicable Congress for the contents.

Let’s assume for grins and giggles that Napolitano is correct here. Even if he was, the book changes for each new Congress. 2015 was when the 114th Congress convened. We’re now in the 116th Congress. And as Rep. Dan Crenshaw (TX) pointed out Wednesday, the rulebook for this Congress clearly states on page 568 all House members should have access to the documents/transcripts, etc that Schiff is keeping under wraps:

Indeed. Too bad our intellectual betters in the mainstream media aren’t interested in finding out why that’s the case.

Things are definitely heating up in the investigation of the Russia probe.

Multiple reports confirmed yesterday that U.S. Attorney John Durham’s investigation was now officially a criminal investigation which gives him the power to subpoena witnesses, call a grand jury and file charges.

Reports have also indicated that this expanding of the investigation changed after information which Attorney General William Barr and Durham found in Rome during their investigation and that Durham was very interested in questioning former Director of National Intelligence James Clapper and former CIA Director John Brennan.

Now new texts are also added more fire to the inferno. According to Fox, Republicans are demanding answers from the ICIG Michael Atkinson if he’s been investigating leaks and released previously unpublished texts and emails from Peter Strzok. They highlighted various texts showing the involvement or knowledge of leaks reflected by Stzok’s texts. On Dec. 15, 2016, he wrote, “Think our sisters have begun leaking like mad. Scorned and worried and political, they’re kicking in to overdrive.” “Think there will be a crescendo of leaks/articles leading up to Thurs,” he tweeted on June 6, 2017 and

Johnson and Grassley emphasized in their letter that the Trump administration “has faced 125 leaked stories — one leak a day — containing information that was potentially damaging to national security,” according to standards laid out during the Obama administration.

The Republicans have sought answers formally from the ICIG concerning those leaks since May. But, they wrote Wednesday, the ICIG has been nonresponsive — and even claimed that it cannot comment because Atkinson gave closed-door congressional testimony on Capitol Hill and the transcript of his remarks is not yet public.

But there were even more bombshells from the new texts and a filing by Sidney Powell, the attorney for Gen. Michael Flynn.

Powell has moved to dismiss the case against Flynn and asked the court to hold the government in contempt for suppressing texts between Lisa Page and Peter Strozk. The motion is a stunning look into the effort to target Flynn to get at the president.

Powell alleges a set-up of Flynn including that the FBI 302s related to Flynn were edited. A 302 is the form the FBI uses to reflect what a witness says during an interview. Powell’s filing also suggests that Office of Net Assessment’s James Baker illegally leaked the transcripts of Flynn’s calls to David Ignatius of the Washington Post. And Powell is specifically looking for the phone records of James Clapper to see about his contacts with Ignatius, includes that he essentially told Ignatius to “take the kill shot on Flynn.”

The new texts released confirm the editing, showing multiple references to editing the 302s by multiple parties, as Techno Fog breaks down in these tweets.

This is troubling in the extreme.

Democrats have been shellshocked by the allegations concerned Rep. Katie Hill (D-CA) that were broken exclusively by RedState about Hill being involved in a “throuple” with a campaign aide and her husband. Hill also allegedly had an affair with a staffer, her legislative director, Graham Kelly.

Hill has now admitted to having an “inappropriate relationship” with the campaign aide, but is still denying having a sexual relationship with her congressional staffer.

House Rules forbid having sexual relationships with staffers.

The House announced on Wednesday that they had launched an investigation into Hill based on the report by RedState.

From Fox News:

“The committee is aware of public allegations that Representative Katie Hill may have engaged in a sexual relationship with an individual on her congressional staff, in violation of House Rule XXIII, Clause 18(a),” Committee Chairman Ted Deutch, D-Fla., and Ranking Member Kenny Marchant, R-Texas, wrote. They added that the panel had launched “an investigation and will gather additional information regarding the allegations.”

But now it turns out that Katie Hill is not the only person they’re investigating.

Turns out there’s another Democrat who allegedly had an inappropriate relationship with a staffer.

The House Ethics Committee announced that they were also investigating Delegate Michael F.Q. San Nicolas (D-Guam) over allegations that he had a sexual relationship with a staffer & campaign finance abuses. They are looking into allegations that he converted campaign funds to personal use and accepted improper or excessive campaign contributions.

According to the Washington Times, legal counsel for San Nicolas said, “The congressman welcomes the opportunity for due process.”

Territories of the United States, like Guam, have non-voting delegates instead of representatives. San Nicolas has represented Guam’s at large district since January. He was elected to serve as the Vice Chair of the House Committee on Financial Services by fellow committee members.

Kuam News reported that in San Nicolas’ former chief of staff John Paul Manuel had filed a complaint with the Guam Election Commission about his former boss’ actions.

Here’s what Manuel said in September before the House announcement and he didn’t hold back.

Manuel told KUAM News, “How can you truly be supporting our troops when he is engaging in sexual relations with their wives while they are away? There is never a convenient time to reveal a friend’s wrong-doings. But the truth needed to be said. How is it responsible to have your chakmak on government payroll for $85,000? Powerful men need to realize the era of using political office as their own personal sexual playground is over. Government budgets don’t have any more room for chakmaks.”

Kuam News also reported San Nicolas has a pretty poor voting record, according to Roll Call, observing that:

[I]n the Committee of the Whole, Congressman San Nicolas “voted just 47% of the time he has been eligible through October. 23rd”. Roll Call reports “overall he’s missed 138 or 259 votes so far”.

After complaints from LGBTQ groups that their Always line of feminine products weren’t “inclusive” enough, Proctor and Gamble has decided to phase out the use of the female symbol on their packaging … because not everyone who goes through their, ahem, monthly cycle is a woman or something.

Fox News reports:

“For over 35 years Always has championed girls and women, and we will continue to do so,” the company said in a statement Tuesday, according to The Independent. “We’re also committed to diversity & inclusion and are on a continual journey to understand the needs of all of our consumers.”

Company officials added that they realize not everyone who needs feminine hygiene products “identif[ies] as female.” Procter & Gamble did not immediately respond to an after-hours email from Fox News.

The decision was lauded by trans activists but faced criticism online.

“Women are quite literally being erased from sanitary products now. Is there anywhere we are allowed to be visible!?” one woman wrote on Twitter, according to The Independent.

Progressive trans activists applauded the move, of course. But in a show of a complete lack of self awareness, they actually mansplained accused women who complained about the removal of the symbol of fragility, which I let them know was a bit of a strange comment for them to to make, all things considered:

In any event, the Babylon Bee had an alternative suggestion earlier this week for P&G that might actually work better than the removal of the symbol:

CINCINNATI, OH—Always is appealing to the company’s male customers with its new “Always Macho” series of menstrual products.

The pads and tampons’ packaging will feature pictures of monster trucks crushing each other, AR-15s, and John Cena dropkicking people.

“We want to welcome all people who menstruate, whether you are a cisgender woman, a transgender man, or a dude who really likes monster trucks,” said a Procter & Gamble representative.

No matter where 2020 Democratic presidential candidate Sen. Kamala Harris goes, she faces an uphill battle.

Nationally, she’s polling in a distant 5th place. In Iowa, where she vowed to “f**king move” in order to win over Democrats in the crucial caucus state, her campaign is cratering.

She’s not doing any better in South Carolina, which has a large percentage of black Democratic voters, nor in New Hampshire.

But it’s her home state of California that perhaps more than any other state is showing her the writing on the wall.

Over a month ago an Emerson University survey showed her in 5th place in California behind Andrew Yang.

Unfortunately for Harris, her numbers in there among Democratic primary voters have not gotten any better over time:

Less than five months before Californians vote in the 2020 presidential primary, a new Change Research poll for KQED shows U.S. Sen. Kamala Harris losing ground to the front-runners, Sens. Elizabeth Warren from Massachusetts and Vermont’s Bernie Sanders.

The poll, taken after last week’s Democratic candidate debate, finds Warren is the top choice of 28% of primary voters, followed by Sanders at 24% and former Vice President Joe Biden at 19%.

South Bend, Indiana Mayor Pete Buttigieg is fourth with 9% followed by Harris at 8%. The October survey puts Harris 20 percentage points behind Sen. Warren, compared with a 14 percentage point gap in our September poll.

The poll also shows Harris trailing badly among female voters and Hispanic voters:

By gender, Warren is the top choice of female voters with 31% support, followed by Sanders with 23% and Biden at 21%. Buttigieg and Harris are the choice of 8% and 7% of women respectively.

Sen. Sanders is the favorite of Latino voters with 28% support, followed by Warren and Biden (22% each), Harris (7%) and Buttigieg (6%). The only Latino candidate, former HUD Secretary Julian Castro, is the choice of just 1% of Latino voters in California.

Harris is in decent shape with black Democrats according to the poll (16%), but she still lags behind Biden (30%) and Sen. Bernie Sanders (20%).

As I’ve said before, I believe she’s sticking around at this point as an audition of sorts for vice presidential consideration, but considering she’s in bad shape across all key demographics, I’m not sure how much good she’d do in terms of the female/black vote for Biden or Sanders should they become the nominee. And the possibility of Warren picking another woman as her running mate is very low.

Of course, general elections are much different than primaries so there’s still a chance she could end up as the eventual nominee’s running mate. But as far as her chances go for the nomination itself, it’s all over but the crying at this point, especially when you consider the fact that no recent candidate for president has gone on to be their party’s nominee without winning their home state.

After weeks of getting nowhere with Schiff and Co. when it comes to being given full access to impeachment inquiry documents and transcripts from the secretive hearings and witness testimonies, dozens of House Republicans finally organized as a group this week to stop talking and start taking action.

They organized a sit-in Wednesday (complete with lunch served) in the SCIF where the witnesses have been questioned, but ultimately did not get what they wanted from Schiff.

Another Republican who took action but in a different way yesterday was Rep. Dan Crenshaw (TX), who tweeted out a video talking about the rules Schiff has made up regarding how this inquiry will be conducted. Here’s how he started out:

“Chairman Adam Schiff says that non-committee members can’t have access to all the hearings and depositions that have been happening with respect to the impeachment inquiry. Is that true?” he wondered.

Crenshaw then pointed to the House Rules and Manual for the current Congress. “Let’s check the House rules,” he stated, opening the book up to page 568 of this document.

Reading the text, Crenshaw said that “Such records shall be the property of the House and each member, meaning we can actually go look at them.”

At that point, he noted he was going to go downstairs to where the records were kept to see if he would be given access to them.

He wasn’t allowed to film what was going on inside the secure committee room, but when he came out he stated they would’t let him see anything, saying they repeated the Schiff rule to him about non-committee members and records access.

But Crenshaw said he has spoken to committee members who have also sent letters requesting to see impeachment inquiry documents as well but have also been told no. “Where is the transparency?” Crenshaw asked rhetorically. “There’s none.”

The Democratic clown show continues.

Democratic 2020 presidential candidate Joe Biden has demonstrated his propensity for gaffes and being behind the times.

As my colleague Streiff noted on Wednesday, this “behind the times” problem left them open to a great troll from the Trump team when the Biden folks neglected to register the web address for their Latino coalition outreach.

Now, Biden’s latest ad just adds to that “behind the times” perception.

When you look at it, your immediate thought may be: who told him this was a good idea?

We open to what looks like one of those old commercials where an actor who hasn’t worked in years in a dated outfit is selling insurance to the elderly. Cue Uncle Joe.

Gack. What is that?

Now we have no idea what he’s talking about, Vladimir Putin coming after him. But then, neither does he, it’s just a money pitch and word is he’s desperate. This surely shows it.

And let’s stop with this “Russia interfered in our elections” terminology. Russia was behind Facebook pages for and against Trump. And the FBI alleges they were behind the DNC server hack and John Podesta’s email phishing. But because people in media and people like Biden use that terminology, a majority of Democrats reportedly believe that votes were changed or machines were hacked by Russians. If you want to say they tried to influence people’s opinions, that would be more accurate. Should we still be condemning that and trying to prevent it? Yes. But no one except the voters “decided who the president was going to be.” And to suggest that Putin did is a dishonest fiction, pushing this “illegitimate president” theme again.

Let’s also look back to the Obama administration where Biden was the Vice-President, that administration that he has embraced as a big part of his record. The administration that was known for its “flexibility” when it came to Russia. That administration that, knowing everything that Russia was, presented them with a “reset” button (with the wrong word). That administration that allowed Russia to walk into Eastern Europe and steal Crimea from Ukraine, doing nothing in response. That administration who drew red line after red line with Russia-backed Syria and then did nothing as they continued to drop chemical weapons on their people. Indeed there may be no administration in recent history who has bent over more or been so accommodating for Putin than the Obama administration.

Can we ever forget these golden video moments?

Let’s look at the Trump administration, by contrast, since that’s the comparison Joe raised. Let’s disabuse people of this fiction that the present administration has been favorable to Russia.

The Trump administration came in and put more sanctions on Russia on top of the ones already in place, going further than Obama ever had. Here’s a great list of the dozens of Russians people and businesses subject to sanctions and actions. Trump also booted Russian diplomats out. When Syria continued to use chemical weapons, he bombed them. He gave Ukraine lethal weapons to be able to defend themselves, something the Obama administration refused to do. The administration also said they were giving Ukraine $10 million to help build their naval defense against Russia. After the Russians attacked a US base in Syria in Feb. 2018, the Trump administration didn’t set a red line, they dropped bombs on the heads of the Russians, killing hundreds. And let’s not even get into the many ways that Trump, by building up the American economy and the energy industry, stomps all over the Russian agenda. Where Obama stalled the Keystone XL pipeline (there he is being flexible again!), Trump signed executive orders fast-tracking it, for example.

We’d tell Joe to get better ad advice. But then, we’d miss out on laughing at silly things like this.

Republicans have finally had enough.

On Wednesday, dozens of House Republicans made their anger known and protested the closed door impeachment proceeding Democrats were conducting, holding a press conference and delaying the proceeding until they were allowed in.

Now, on Thursday, the Senate is backing up the GOP in the House.

Senate Judiciary Chair Lindsey Graham and Senate Majority Leader Mitch McConnell announced that they would be introducing a resolution today to condemn the House Democrats “illegitimate impeachment inquiry.”

Like their fellows in the House, they are condemning the lack of transparency and the closed door proceedings, in addition to questioning the validity of the inquiry to begin with given that there has been no formal vote of the House in favor of such a proceeding.

From Politico:

“This is a kangaroo court and it will not stand,” Graham said this week. “I’ve got a resolution saying if you’re going to impeach the president give him the same rights that Richard Nixon had and that Bill Clinton had…what’s going on now is disgusting.” …

McConnell said he “obviously” supported the effort. His support is key because he would control whether any impeachment is basically rejected if it reaches the Senate.

Republicans and the GOP base have been very unhappy with the way the Democrats have been proceeding. Democrats have been trying to play both ends against the middle, appeasing their base by claiming they’re having an impeachment inquiry despite having no vote, while not having to put the issue or their vulnerable members in pro-Trump districts on the record in such a vote.

But in doing so, Democrats are deviating from precedent that there’s a vote before proceeding with an inquiry. If the House has the power of impeachment, as the Constitution says, then the House and only the House has that power. And the power of the House can only be shown by a formal vote, not by the pronouncement of the House Speaker or any single member of the House.

In the case of Bill Clinton, not only did you have a formal House vote for the inquiry, you had a finding by Ken Starr of 11 grounds, including perjury, obstruction of justice, witness-tampering and abuse of power which preceded it. Now you have none of that.

On Tuesday, Graham called the process Democrats had taken unconstitutional, according to the Daily Caller.

“Here’s the point of this resolution. Any impeachment vote based on this process, to me, is illegitimate, is unconstitutional, and should be dismissed in Senate without a trial,” Graham told Fox News’ “Hannity.”

The chairman of the Senate Judiciary Committee said the resolution “puts the Senate on record condemning the house for the future of the presidency. We cannot allow future presidents and this president to be impeached based on an inquiry in the House that’s never been voted upon that does not allow the president to confront the witness against him, to call witnesses on his behalf and cross-examine people who are accusing him of misdeeds,” Graham told Sean Hannity.

He said the process denied the president basic legal rights.

“All I’m asking is give Donald Trump the same rights as Richard Nixon and Bill Clinton had when it comes to impeachment. I’m insisting that Donald Trump be given the same rights that any American has at when you’re giving a parking ticket to confront the witnesses against you, can’t be based on hearsay … ”

This is a big signal to Democrats that their efforts are going to be dead on arrival in the Senate.

And their efforts wouldn’t just be dead there, but in the 2020 election as well unless they stop the madness.

Nick wrote yesterday about how House Republicans who are frustrated by the secretive nature of the so-called “impeachment inquiry” process decided to stop talking about it and took action, storming the SCIF room where Schiff was conducting his show trial witness tampering witness questioning.

High drama, of course, ensued, with Schiff and Co. scurrying away with the witness while the fed up Republicans staged a sit-in, hoping to negotiate with Schiff for full access to witnesses and transcripts. Unfortunately they weren’t successful, but they did eat pretty good while in the midst of the stand-off.

One of the biggest “concerns” for Democrats and reporters who were present for the goings-on yesterday was whether or not any Republicans/Republican staffers who stormed the highly-secured area had taken any audio or video, which would be a no-no since cell phones are not allowed in the room:

One former CBS journalist in particular was enraged, and demanded serious action be take against the Republican “invaders”, including questioning them for possible foreign allegiances:

Leavitt, an “award-winning multimedia journalist” according to his Twitter bio and whose credits include CBS (though he was never an employee), got read the riot act by Twitter users:

CNN national security/legal analyst Susan Hennessey, who is no fan of Republicans, wrote a Twitter thread noting that in the scheme of things, Republicans bringing their phones into the SCIF was not really much of a “security compromise.” That probably won’t be enough for the David Leavitt types, but then again really nothing would be.
