Yesterday was a day of drama in the prosecution of former Mike Flynn business partner, Bijan Rafiekian, for a chickensh** violation of the Foreign Agents Registration Act. I posted on the decision by Flynn’s counsel, Sidney Powell, to tell the court that Flynn could not truthfully testify the way Justice wanted because Justice wanted him to lie. Justice, for its part, attempted to, without evidence, change Flynn’s status from cooperating witness to unindicted co-conspirator so they could still use the testimony he’s  now saying is untrue without having to call Flynn as a witness.

What followed was a series of decisions by the trial judge that calls into question the ability of the federal government to pursue its case and left a great deal of questions about whether Flynn had breached his plea agreement and even the value of the agreement itself.

Phase One. The Feds get their ass handed to them.

The court ruled that Flynn could not be a co-conspirator because there was no claim that a conspiracy exists:

Part of that may be because when federal prosecutors said they were using Flynn, they also told the court that there was no conspiracy:

There will also be no conspiracy charges made against Rafiekian:

The court also said the government can’t argue that the contract at the center of the case was paid for by the Turkish government because there is no evidence that is the case.

There is a decision outstanding on whether the government can even use  some of the information from partnership attorneys that Flynn provided to the government because Rafiekian shared the costs of the attorneys and it may violate his attorney-client privilege.

On the whole, this was ugly. Flynn will not be called by the government. There will be no conspiracy allegations. The government can’t argue as a fact that the contract was on behalf of the Turkish government, only that someone told Rafiekian that it was. That, alone, seems to torpedo the FARA charge. Some of the evidence the government is planning on using may be illegal.It is hard to see how this is even prosecutable unless your objective is to make the expense of the trial punishment for a guy you know you can’t convict.

Phase Two. Is Mike Flynn in deep do-do?

It is hard to tell.

There is a hearing today on this subject before Judge Emmett Sullivan who famously accused Flynn of treason in  a previous hearing.

While he’s probably interested in Flynn’s more nuanced approach to the guilty plea that has evolved with change of counsel:

He is also going to be interested in how Mueller’s team protrayed Flynn’s involvment to the court and how the prosecutors in the Rafiekian case have described it.

Neither government nor Flynn is in for a pleasant day. Sullivan is not a government toady, like a lot of judges. He also doesn’t like to be f***ed with. Flynn, at least, can hide behind his counsel’s claim that previous counsel screwed the pooch in their plea negotiations. I’m not sure what the government plans on using as an excuse.

I know tampering with the dead is taboo, but I’ll make an exception here for Beto O’Rourke.

As I said a few weeks ago, his campaign is nothing but a smoking crater at this point. He has no base of support anymore now that he’s not running against Ted Cruz and the media aren’t relentlessly fluffing him.

Instead of standing for anything, Beto has spent his entire presidential campaign apologizing for being privileged and doing whatever he can to show off his inter-sectional credentials. That’s a losing strategy when Joe Biden is sucking up the moderate support and everyone else is already more woke than you.

In what is probably his most pathetic show of pandering to date, Beto decided it’d be a good idea to rant to immigrants about how awful and racist the United States is.

I mean, if that’s true, then why would these people want to be here?

It’s not true though. America was not founded on “white supremacy.” It was founded on an incredible set of ideals which have allowed us to develop into the most free, prosperous country on earth. There’s a reason the immigrants and refugees in that picture are in Nashville, TN and not Mexico City.

This entire message isn’t unique to Beto though. We’ve heard similar trashing of America from other candidates and it appears to have become a pretty solid plank in the Democratic party platform. We’ll see how that works out for them outside of blue urban areas in the coming election.

Denigrating the United States with ridiculous hyperbole just makes Beto look desperate. He’s a man with nowhere go and he’s flailing about (figuratively and literally) trying to make people notice him. Mission accomplished I guess, but it’ll do nothing for his campaign.

Someone tell this dude to just quit already. The sheer cringe of all this is getting harder and harder to watch.

It’s not easy to come across as an ultimate everyman and an exceptionally smart guy at the same time. But somehow, Mike Rowe pulls it off.

He drops bombs of profundity via the simplest of language in a way I may not have ever before observed.

With his inimitable style, Mike took to Facebook on the 4th to answer a Nike/Kaepernick question from one Karen Murphy, who inquired the following:

“Why would anyone in their right mind support Nike after this latest round of nonsense? Why would any public company with an image to protect take advice from an athlete? How can our attention be sucked up by people with nothing better to do than complain about fireworks and tanks on the fourth of July? Our country seems be losing its mind, or at the very least, its sense of history and perspective. As a man who has always seemed comfortable with our country’s flag, I was hoping you might have some insight to share on this, especially today.”

If you’re unaware of the situation at the Swoosh, the iconic athletic company pulled from stores a sneaker featuring Betsy Ross’s U.S. flag following former football player Colin Kaepernick’s suggestion that it may offend some due to America’s history of slavery (here and here).

Ready to get Rowed?

Here we go…

Mike replied:

“I think Nike has the right to decorate their shoes with whatever flag they desire. I think Kaepernick has the right to offer marketing advice to any company that’ll take it. And I think you and I have the right to purchase whatever brand of tennis shoes we choose. The reason these rights exist, is because we live in the United States, and the reason the states are united, is because we decided, two and a half centuries ago, to be free of our British masters. So, we fought a war. Happily, the results of that war made us a free country.”

But we didn’t stay the way we were:

“Then, four score and seven years later, we decided we could not call ourselves a free country, as long as slavery existed. So, we fought another war. Happily, the results of that war made us freer still. Had either conflict gone the other way, our county would not exist – not as we know it, anyway. And the flag we fly today would look nothing like the one I’m proud to stand for.”

Mike went on to note that there’s nothing dangerous about Nike listening to Colin, or with complaining about patriotic military displays (please see more on that absurdity here).

He also, however, cited Ronald Reagan’s warning of the country perpetually being only one generation away from losing our liberty:

“Along with the siren song of socialism, the persistent promise of “free” stuff, and the breathtaking level of censorship on our college campuses, I worry about the growing belief among many that we can somehow improve our present by erasing our past; by toppling statues, outlawing “problematic” symbols, or rewriting specific pieces of our history in ways that leave us feeling less offended. George Orwell said it best… ‘The most effective way to destroy a people is to deny and obliterate their understanding of history.’”

You got that right!

The former Dirty Work host observed that we shouldn’t overlook Colin’s mistake.

He’s windin’ up, folks:

[Colin] has argued that the Betsy Ross flag is ‘racist,’ because it flew at a time when slavery was legal in America. By that definition, aren’t crosses are also racist? Weren’t they on churches attended by slave-owning congregants? Why not demand their removal? What about the Bald Eagle? Wasn’t our national bird flying around when slaves were held? Why not protest it as well? What about the Great Seal? E Pluribus Unum? The Liberty Bell? It rang countless times while slavery was still the law of the land. Why not demand its removal? Kaepernick’s argument is unpersuasive, not because it’s unpopular, or unpatriotic. It’s unpersuasive because it’s completely void of logic.”

The man knows how to make a concrete point.

Mike closed with a statement patriotism, again quoting Orwell:

“People sleep peaceably in their beds at night only because rough men stand ready to do violence on their behalf.”

Mike Rowe has a gift. Not only is he able to make powerful points in the most efficient, understandable way possible, but — in my opinion — he does so in a manner poised to compel even those who might otherwise want to oppose him.

He’s a living ode to yet another Orwell quote which he cited in his response to Karen:

“If liberty means anything at all, it means the right to tell people what they do not want to hear.”

But more than most, he makes people want to hear it.

When it comes to the embarrassing dust-up between House Speaker Nancy Pelosi (D-CA) and the Queenie Quartet, only the leader of the pack Rep. Alexandria Ocasio-Cortez (D-NY) is allowed to define the terms of the debate, and no one else.

Or so she wants you to think.

The latest instance of AOC throwing a temper tantrum because of hurt feelings comes in response to remarks made by Kellyanne Conway, counselor to the President, regarding the ongoing public spat between Pelosi and Ocasio-Cortez, Reps. Ilhan Omar (D-MN), Rashida Tlaib (D-MI), and Ayanna Pressley (D-MA).

Here’s what Conway said:

White House counselor Kellyanne Conway on Tuesday mocked the dispute over border spending between House Speaker Nancy Pelosi and four female freshman Democratic lawmakers as a “major meow moment” and “huge catfight.”

Conway gloated that Pelosi had put Reps. Alexandria Ocasio-Cortez of New York, Ilhan Omar of Minnesota, Ayanna Pressley of Massachusetts and Rashida Tlaib of Michigan — who call themselves “The Squad” — in their place after they opposed an emergency spending bill because they believed it did not go far enough to protect migrant children.

“Those four female Democrats that Nancy Pelosi is brushing back, I think they are all freshman members,” she said on Fox News.

“A major ‘meow moment’ — brushing back in a huge catfight, really ridiculing them — and they voted against the Democratic aid package.”

In response to Conway’s remarks, AOC accused her of … sexism:

When it was pointed out to Ocasio-Cortez that women being sexist towards each other was not actually a thing, the freshman Congresswoman dug a deeper hole by trying to redefine the term “patriarchy”:

But those pesky facts just kept coming back to haunt her:

Plus, so-called “progressive” women can and do try to keep other women down in ways the “patriarchy” couldn’t get away with, as Daily Caller‘s Virginia Kruta astutely noted here:

In a follow-up, AOC asserted that:

“Being a woman does not mean you’re immune from being bad to women” – totally agree there, especially when it comes to tearing other women down based on their looks – like AOC has done, and then utterly lacking in self-awareness when complaining about how others use a woman’s looks to tear other women down – which AOC has also done.

The arguments of Alexandria Ocasio-Cortez and the rest of the Queenie Quartet have the consistency of a wet paper bag. As I’ve said before, the Freshman Four want to have it both ways. On one hand, they want to be able to insult and vilify their political opposition with impunity, yet they turn around and whine like babies when they get a taste of their own medicine.

In a nutshell, these are the same women who tell you they “don’t flinch” and that they will “raise hell” but then turn around and play the “sexism” or “woman of color” card to try and shut their opposition down for raising hell and not flinching.

“Feminist” frauds. All of them.

During an interview with reporters on Tuesday, President Donald Trump revealed that he had a “falling out” with billionaire financier recently charged with child sex trafficking, Jeffrey Epstein.

“I knew him like everybody in Palm Beach knew him. He was a fixture in Palm Beach. I had a falling out with him a long time ago,” Trump told reporters. “I don’t think I’ve spoken to him for 15 years. I wasn’t a fan. I was not a fan of his, that I can tell you. I was not a fan of his.”

Author of  “Filthy Rich: The Billionaire’s Sex Scandal–The Shocking True Story of Jeffrey Epstein,” James Patterson, revealed to Dana Perino exactly what Trump meant by that during an interview on “The Daily Briefing.”

“President Trump said earlier that he had a falling-out with Epstein about 15 years ago. Do you know what that was about?” asked Perino.

“Well, I know that there were some complaints about Epstein at Mar-a-Lago and also I spoke to the head of the spa there,” said Patterson. “I said ‘did you ever meet Epstein?’ She said, ‘oh yes… he was inappropriate with some of the younger women there.”

“She said she went to Trump and he threw him out of the club,” he added.

Patterson went on to tell Fox News that he “knows” Trump wasn’t aware of Epstein’s illegal activities, and also made it clear that he “believes” Clinton didn’t know either.

A raid on Epstein’s home found pictures of nude, underage girls. The impact of Epstein’s trouble with the law has swung many into a political tug-of-war between Republicans and Democrats and trying to connect Epstein to the opposite party. Earlier this week, users on Wikipedia were quietly trying to edit out any connection Epstein had to Democrats like Bill Clinton and Kevin Spacey, both of whom have been accused of sexual assault.

Amazingly a company has stood up to the tolerant hordes that are demanding a movie be banned from theaters.

There had been a time in the not so distant past that the concept of censorship had been a flashpoint cause for those on the left. The mere mention of limiting any amount of content in a motion picture, let’s say, would bring out the loud rebukes. If religious groups were outraged at their depiction in a film scorn would rain down at the appearance of wanting to silence artists.

Even Harvey Weinstein years back would invoke the threat when it came to mundane acts like how his movies were rated by the MPAA.

These days those leftists are not only more comfortable with censoring activities, but they are also applauding them. We are in an era where journalists are encouraging other journalistic outlets to be silenced and removed from social platforms. It is without hyperbole that comparing some things we are seeing to George Orwell’s “1984” takes place. Policing how we think is actually being attempted.

The recent anti-abortion drama “Unplanned” endured some of the silencing tactics when it was released into theaters last April, yet it still managed to become a modest hit on its own terms. Most major cable television networks refused to run commercials for the film, and the Motion Picture Association gave the movie an “R-rating”, which limited its audience reach. This also delivered a crude irony: girls under the age of 18 were prevented from seeing a film about abortion, yet they are able to get an actual abortion procedure in many states.

It is now being released into Canadian theatres and some on the left are incensed about that. The opposition has been so virulent that there have been threats of violence called in to theaters that were scheduling the film. And there have been calls for the film to be banned outright.

In a refreshing dose of sanity and sober thinking the theater chain in Canada, Cineplex, has issued a statement defending its decision. Ellis Jacob, the President and CEO of the theater chain, issued a statement letter declaring they would not be backing down from exhibiting “Unplanned”. The irony that it is members of the left calling for the suppression of art is actually lost on those from the liberal wing.

I understand and can appreciate the concerns about the film,” Jacob said in his letter, “but it is up to each of us to decide whether or not we want to see it.” In other words, he says that he trusts adults to be able to make a decision for themselves. Imagine that kind of thinking, from a corporate head. “In Canada we have the option, and I think it is an important thing to remember.

This outrage is both revealing, and it is imbalanced. The revealing aspect is that it seems a number of leftists feel threatened that a film that offers content in opposition to their own cherished political views. That they feel a need to restrict the title is indicative of a perceived threat. The imbalance comes from the very small platform the film is receiving in that country. Cineplex has 1,700 screens across Canada — “Unplanned” is being shown on just 14 screens. The leftists still regard this small rollout as a threat.

There have been reports of select theaters canceling scheduled viewings as a result of threats. This tactic has become more normalized from the militants on the left. It is a healthy thing to see a company actually standing up in the face of this type of imbalanced activist reaction.

This sure differs from the common reaction we have been witnessing from companies lately. The norm has been for companies to see a social media manufactured maelstrom taking place and then cowing to the digital hordes. It has to be pointed out that it is liberal activists who are at the front lines of the calls for censorship and the banning of artistic content. This is a wide departure from their positions on such matters just a generation ago. Nowadays those who are on the creative side of the culture are more than willing to engage in stifling select creative works they deem unfit.

You don’t go to a practicing drug addict to seek advice on how to stay clean or ask a corrupt mechanic on what kind of work your car needs, but Austin Mayor Steve Adler is going to do just that, or at least something similar.

Austin’s homeless problem has taken a turn for the worst, especially after the Texas capitol passed ordinance that allowed homeless people to set up camp on city streets so long as they’re not blocking walkways. The problem proceeded to spiral out of control, even managing to anger Texas Governor Greg Abbott, who has expressed his intention to bring the power of Texas against Adler’s office in order to kill the ordinance.

In the meantime, Adler is giving interviews that attempt to put his new homeless laws in a positive light. To say these interviews are unconvincing is an understatement, especially with all the problems he has to admit it’s bringing with it.

According to Fox 7, the mayor is looking to get some insight on the problem and planning a trip to California in order to seek advice from city leaders in that state on how to handle the homeless problem currently plaguing his city.

If I went to a prostitute to seek guidance on abstinence, I’m not sure you’d be able to label it as “wise.”

It should be noted that Los Angeles is one of the examples of how to handle a homeless problem in the country. As the LA Times reported in February of last year, the homeless problem in that city has shot up 75 percent in the last six years, and even acknowledges that the problem became worse when Democrats took over leadership with a super-majority.

“The problem has only gotten worse since Mayor Eric Garcetti took office in 2013 and a liberal Democratic supermajority emerged in 2016 on the county Board of Supervisors,” reported the LA Times.

The Times noted just how bad the numbers are:

Tent cities stretch from the Antelope Valley desert to the Santa Monica coast, with stopovers in unlikely communities — even Bel-Air, where a homeless cooking fire was implicated in December’s Skirball fire.

During an October hygiene survey, county public health officials identified 222 encampments, including 50 with 30 or more people living in them. These ragtag outposts have altered the basic terms of urban life.

People in Koreatown step outside their fancy condos to find tents, rotting food and human feces at their doorsteps. Buses and trains have become de facto shelters, and thousands of people sleep in fear and degradation.

Officials and philanthropic groups have been housing more homeless people than ever before — 26,000 between 2014 and 2017. But L.A. has a severe housing shortage, and city and county homeless programs have been slow to start and too limited to absorb the waves of people forced into the streets.

The problem is so horrible in cities controlled by Democrats that it got President Donald Trump’s attention at the beginning of July. During an interview with Fox News’s Tucker Carlson, the problem came up.

“It’s a phenomenon that started two years ago,” Trump noted. “It’s disgraceful. I’m going to maybe – I am looking at it very seriously.”

Disease, drugs, and trash continue to mount, yet Democrat leaders continue to try to downplay the problem, and even blame it on something other than their policies that encourage homelessness much like the kind being passed in Austin and San Francisco.

Yet, this is where Mayor Adler wants to go to get advice on how to deal with the problem currently spiraling out of control in the heart of one of the most successful states in the nation. This is backward thinking, and hopefully Abbott will step in to stop Democrats from allowing this to rage out of control soon.

If you go to various cities in California, one of the first things you’ll notice is the shocking amount of homeless people that are camped out on the streets. I wish I could say these were people just down on their luck, but where homeless camps pop up, an inordinate amount of drug use does as well.

And for some reason, Austin, Texas, wants to be just like them.

Austin’s Mayor Steve Adler made it legal for homeless people to set up tents on city streets so long as they aren’t blocking pathways. In an interview, Adler said he doesn’t think that this will cause problems like it does in Los Angeles or San Francisco, but Austin residents, especially women, are worried about safety concerns.

Texas Governor Greg Abbott warned back in June that if Austin does go through with it, then he’ll be forced to bring the power of Texas down on the city.

“If Austin— or any other Texas city—permits camping on city streets it will be yet another local ordinance the State of Texas will override,” tweeted Abbott. “At some point cities must start putting public safety & common sense first.”

Fast forward to July, and the ordinance is already causing major problems. Needless to say, Abbott is not happy. Abbott took to Twitter once again to show people what kind of dangers the policies Austin enacted are bringing on. Quote tweeting a Texas resident who caught an accident caused by homeless people darting into traffic caused a major accident near downtown Austin.

“Look at this insanity caused by Austin’s reckless homeless policy. All state-imposed solutions are on the table including eliminating local sovereign immunity for damages and injuries like this caused by a city’s homeless policy,” tweeted Abbott.

“The horror stories are piling up,” he added.

Adler seems to be willing to stand his ground, however. He noted that Abbott was “misled” in a tweet and blamed the outrage around homeless camps on people trying to scare and lie to others.

Austin residents fired back.

It’s likely that Abbott is currently cooking up something in the legislature with the help of Republicans, though if this continues to spiral out of control, Austin may end up just like San Francisco, which has become a dangerous place to be with all the homeless and hard drugs that literally litter the streets.

The New York Times Rushes to Whitewash News That IG Horowitz Interviewed Christopher Steele

After a bit of a lull, more Russia investigation news is making its way into view as the IG report on the original investigation itself nears.

Earlier today I posted on one of Mueller’s two major pillars proving Russian interference falling apart. Sometimes, evidence can lead where you don’t want to go and a decision has to be made. Do you take one on the chin or keep pressing? Throughout this entire ordeal, from the FBI investigation to the Mueller investigation, we’ve seen the latter choice made in order to push the right narrative.

Perhaps the biggest example of that was the treatment of Christopher Steele’s dossier. Whether talking about the FBI or Robert Mueller, the evidence went somewhere contrary to the conclusion they wanted to reach. That meant the FBI ignoring red flag after red flag and continuing to push the document anyway. For Mueller, it meant inexplicably ignoring it’s existence, despite it being central to the entire case.

Apparently that hasn’t been lost on IG Horowitz, who is finalizing his report on possible FBI and DOJ corruption during the Russia investigation. He, unlike Robert Mueller, felt that Christopher Steele was actually worth talking about and this culminated in a 15 hour interview. News of that broke today and as per usual, the report came via a liberal media outlet desperately seeking to get out ahead of the story.

The New York Times, obviously working with leakers friendly to Steele, ran to try to whitewash the whole matter.

The “much broader” investigation excuse has always been a farce. The FBI were not concerned with stopping Russian interference before the 2016 election and their lack of action through election day is fairly strong evidence of that. Instead, they continually sought to try to tie the Trump campaign to some kind of Russian conspiracy. That was clearly their main goal and anyone pretending otherwise is just being disingenuous.

Mueller’s conclusion that the campaign “welcomed and expected” to benefit from Russian interference still has precious little evidence to back it up as well. Any politician would welcome the dropping of damaging information on their opponent. That’s far from nefarious and the Clinton campaign were certainly open to help from Russian sources via Steele’s work. Robert Mueller never found that worth pursing though. Odd, right?

Every step of the way, the Times seeks to downplay behavior that would immediately be red-flagged if they were the actions of a Republican administration. The number of wiretaps given over the course of a year is not a excuse for malfeasance and to trot that out there is transparent at best. The FBI knew Steele’s main source was unreliable and had lied, yet they kept using Steele’s work anyway. That doesn’t just happen. Someone consciously made the decision that the narrative was more important than the evidence.

Things get even stupider in the the article though.

The Times clearly has sources who directly worked on this investigation. They are the same sources who feed them leaks, like those in this article, in order to get out ahead of stories and sanitize them for those implicated. But the same New York Times can’t figure out something as simple as who the main source in the Page warrant was? That’s implausible and the much more logical explanation is that the answer isn’t flattering for the FBI.

Steele’s answer on whether the bureau was relying too heavily on outsiders says a lot. On one hand, we are told the FBI are the best in the world and would never screw things up. Yet, here’s Steele basically saying they were too stupid to handle and judge his intelligence on their own.

Jule Kelly also laid down some critiques of the reporting.

Bruce and Nellie Ohr have been at the heart of this since the beginning, yet the media continually brush them aside and accept nonsensical, inconsistent excuses for their behavior. Nellie was working for Fusion GPS and feeding information to the DOJ through her husband long before September. The idea that the FBI was unaware of Steele’s work until then is a laughable premise. In fact, Bruce Ohr would later admit in his Congressional testimony that he discussed Steele’s work with Glenn Simpson in August of 2016. Even more damning, Bruce and Nellie Ohr met with Steele personally in July of 2016.

In all of these numerous puff pieces by The New York Times and The Washington Post on this topic, Steele is painted as a reliable guy just doing his job. His pervasive connections to the Russians are never explored. His motives never analyzed. The obvious questions about how he could have gotten it so wrong are never asked. Even when the Times admitted that the dossier may have been a Russian disinformation operation, they never bothered to ask whether Steele was part of that, you know, given that he wrote the thing.

To cap it all off, Robert Mueller, who we were assured was going to leave no stone unturned in search of the virtuous truth, didn’t even bother to look into any of this. Does that make sense?

This entire thing is just a mess. Hopefully, the coming IG report can shed some light on this, but even then, I don’t expect any real justice.

Every day, YouTube pushes a list of news videos into my feed that they term “Top News.”

As you can see from the screenshot I took, they are nothing but mainstream and cable channels from different countries. Tim Pool’s latest videos far and away outclass any of these videos by miles, and some of this stuff is hard hitting news. Pool’s coverage of the border crisis and politicians involved with it has been majorly watched videos.

Despite these channels consistently discussing news, it’s not considered good enough to be “Top News” according to YouTube. A dancing cockatoo, however, is.

Pakman posted a video discussing this push of YouTube’s for more mainstream news to take center stage, where in he discusses just how bad it’s become. In the video he points to a graph that shows the recommendations from YouTube toward independent news, and you can see for yourself the recommendations generated from the YouTube algorithm push mainstream news channels far more than independent news channels.

Pakman notes that he spent the weekend researching this and attempted to see who was gaining the recommendations that would have otherwise gone to these independent channels. Pakman shows us a graph generated by monitoring YouTube’s algorithm that shows the recommendations “dive off a cliff” at May 1st, where as CNN, Fox News, and other corporate news channels skyrocketed.

Pakman wanted to stress that this wasn’t just affecting conservative news channels, but news channels across the ideological spectrum. In other words, if you’re not a corporate entity, YouTube probably won’t recommend you.

Pool also posted a graph that shows what Pakman is talking about.

YouTube is likely abandoning creators and personalities that base themselves on their platform due to the fact that it’s become too “dangerous” for it to do otherwise.
