Illegal Alien Who Confessed to Murder Of Mollie Tibbets, Says His Constitutional Rights Were Violated

On July 18, 2018, University of Iowa student, Mollie Tibbets, age 20, went out for a jog in Brooklyn, Iowa and disappeared.

Following an exhaustive search, Tibbett’s body was found over a month later in a Poweshiek County cornfield. Police had been led there by illegal alien Cristhian Bahena Rivera, then 24, who had confessed to the murder. Surveillance camera footage had shown Rivera’s car following Tibbetts. Rivera was charged with first-degree murder and is being held on a $5 million bond.

According to Breitbart News:

Rivera told police that Tibbetts was jogging when he saw her, according to prosecutors. That is when he said he approached Tibbetts and started talking to her. After Tibbetts told Bahena Rivera that she would call the police if he did not stop following her, the illegal alien allegedly chased her and says he “blacked out” after this.

Rivera lived in the county, an area which is surrounded by sanctuary cities, and with a “stolen ID and social security card,” he had found work at a local dairy farm.

Rivera is being represented by two tax-payer funded attorneys, Chad and Jennifer Frese.

They have just filed a 29-page motion which was obtained by the Des Moines Register. They claim that Rivera’s constitutional rights were violated because the local Iowa police who questioned him failed to make it “clear that he could have contacted the Mexican consulate before speaking to law enforcement.”

The filing states:

Providing this information to Bahena Rivera — a confused, exhausted and vulnerable Mexican national was seeking trustworthy help — would have triggered an invocation of consular notification and a decision to await the consulate’s assistance before making any other statements.

They also claim that Rivera was not read his Miranda Rights “until hours into a 12-hour interview — a violation of his constitutional rights that they claim should nullify his alleged murder confession.”

The attorneys wrote that he has “very limited Mexican education” and is “wholly unfamiliar with the U.S. criminal justice system.”

The case is due to go to trial on November 12 and has already been postponed once as Rivera’s attorneys try to have his confession thrown out of the case. They have already managed to “move the trial to a less white, more Hispanic-populated county in the state.”

Should Rivera’s confession be thrown out because he wasn’t read his Miranda rights until several hours into his interview? Should he escape punishment because police forgot to read them for a few hours?

I am not a lawyer, but it’s possible the police did not arrest Rivera until several hours into questioning because that is when they determined he was the killer.

The law states (and I’m sure that exceptions apply) if an individual is not read their Miranda rights, the evidence gathered cannot be used to establish guilt in court.

What happens then in the Rivera case, when the rights were read several hours into the confession? The court filing indicates that, at some point during the interview, he was read his Miranda rights.

Rivera then continued speaking to police for several more hours, signed his confession and then led police to Tibet’s body. The fact that he murdered her is not in question.

This case opens up the hot debate between liberals and conservatives over just which constitutional rights people who enter the U.S. illegally are entitled to. Certain basic human rights apply to citizens and non-citizens alike, but should undocumented immigrants receive the full constitutional rights an American citizen would?

Should American taxpayers be forced to pay for Rivera’s legal representation?

Finally, and most importantly, what about Mollie Tibbetts’ constitutional rights?

Grace Anna Rodgers is amazing.

The 9-year-old entered the world with “spine-crushing dwarfism.”

When she was born, doctors said the cherubic child would likely be deaf, and that her scoliosis — part of a condition called Conradi Hunermann syndrome — could impair her ability to breathe.

How’s that deaf prediction looking now? And you can’t carry a tune without a breath.

She’s been singing since she was 16 months old, and let me tell ya — the girl is good.

In 2013, she became a YouTube sensation thanks to her rendition of “The Star Spangled Banner.”

She was 3.

Ever seen a bunch of little kids stand in front of people and sing? At a school program? A church commencement? Most of them stare at their shoes. Or mumble through.

Not Grace.

She let’s it go.

But there were forces at work to see that she never made it onto a stage: Her mother, Angie, writes on the little entertainer’s official website, “Doctors tried to get us to abort her over five different times. It never was an ‘option’ for us.”

And it hasn’t always been easy:

“She has overcome many obstacles including being born blind due to cataracts, severe kyphosis and scoliosis of the spine, and other health issues. She has many other health issues she deals with daily. We almost lost her in 2012 due to complications after surgery. We travel to other states for her health care as far as Maryland as well as in our home state of Kentucky.”

But this little girl is special:

“[S]he is never in a bad mood. She is always singing and happy. She is super smart and loves to entertain. She is a blessing each and every day. God truly gave us a little girl that touches our souls.”

We’re living in a world where some in power are endorsing the abject murder of babies, seconds before birth or even afterward. What has become of the human heart?

To see it beating boldly, watch Grace.

Some people were put on this earth to move us. To teach us. To remind us of things we might otherwise forget. Or never learn. Some people were placed here to do something no one else can do. To inspire us in a way only they can.

Some people were born to sing.

Show them who you are, sweetheart.

Some people can’t understand the concept of defending oneself against deadly attacks.

On Sunday, actress-turned-ill-informed-political-bullhorner Alyssa Milano tweeted the following:

“BREAKING: UNFATHOMABLE! The NRA is seeking MORE constitutional protection for guns. While McConnell is doing nothing to protect us from gun violence, Dem Senators are filing an amicus brief tomorrow in the Supreme Court to stop them.”

“Unfathomable.”

Odd; it’s unfathomable that she thinks it’s unfathomable.

The outspoken tweeter notes the need to “protect us from gun violence.”

Ultimately, there’s only one thing that can protect us from gun violence: gun violence.

That’s the whole point of being able to own a firearm for self-defense.

That’s why the police carry them — there’s no other way to adequately protect themselves from bad guys who have guns and won’t obey the murder laws.

Shouldn’t the fact that there’s a black thing with a handle and trigger on the hip of every cop clue people into what’s the best defense against gun violence?

It’s like Ice-T said: “I’ll give up my guns when everyone else [gives up theirs].”

The reason we have mass murder is that some people won’t obey the law against it.

And that leaves us with a significant question: How do you protect yourself against people who don’t obey the law?

Some on the Left have an answer: Make a law.

I’ll say that again, because the nonsensical nature of it bears repeating: Some on the Left believe the way to trip up and score over those who don’t obey the law is to snare them with…a law.

BOOM!

Mission accomplished.

How is it possible someone could think that?

They’re not listening to the question.

The answer is “the right to defend oneself.” With equal or greater armament.

You cannot be protected by a law from those who don’t obey laws.

Can someone get this on a T-shirt, and fast? Or write it in the sky? How can the message be delivered to those who believe the very thing someone won’t do is the very thing they will always do?

You can’t defend yourself against an attacker with garlic unless they’re Dracula. You can’t protect yourself against an assaulter with Kryptonite unless they’re Superman. You can’t fight back against an assailant with water unless they’re the aliens from Signs or the Wicked Witch of the West.

And you can’t defend against an attacker with a law unless they’re a law-abiding citizen.

To not understand this is…unfathomable.

The staff and security for Democratic socialist Sen. Bernie Sanders got a little overzealous in their jobs while the Vermont 2020 candidate attended the Iowa state fair over the weekend.

According to the Washington Examiner, members of the press were doing what the press does and jockeying for position to get the best picture or spot to ask the Senator a question. In reaction, his security and staff began manhandling the press, shoving and grabbing them as they went:

The confrontation erupted after members of the campaign relentlessly pushed the local journalists to make room for Sanders as he made his way to various attractions at the fair on Sunday.

The press pool erupted in chaos as Sanders left the campaign event, which was hosted by the Des Moines Register.

“Do not put your hands on me. You keep pushing me,” the female photographer yelled at the staffer.

Another journalist asked if a different female reporter was okay after she was pushed by Sanders’ campaign workers many times.

Security for the event, as well as members of Sanders’ campaign, repeatedly grabbed and shoved members of the press. One staffer for the Des Moines Register pushed a gate into a reporter for the Washington Examiner after telling him that “not all press” would be allowed to follow Sanders around.

While I can understand that the press can be aggressive themselves, especially to the point of being dangerous, two wrongs don’t make a right, especially when it comes to shoving around female members of the press.

According to the Daily Wire, despite the fact that the physicality was great enough to warrant complaints within the press office, the Des Moines Register, the outlet covering the event, didn’t mention the dust-up between staffers and reporters. In fact, few mainstream press outlets appear to be doing so, at least at the time of this writing.

Texas Rep. Dan Crenshaw caused a bit of an uproar when he revealed that he’d be in support of a red flag law, or in other words, a state action whereby your guns are confiscated by the government if you’re deemed a risk to society in some way.

The Republican, conservative, and Libertarian members of society came down hard on Crenshaw and Trump when the idea of a red flag law was brought to the forefront.

However, Crenshaw noted in a video posted to Twitter that what he would consider a viable red flag law doesn’t look like something Democrats would propose.

“Earlier this week, President Trump indicated his support for something called red flag laws. I stated on Twitter that maybe we should consider them at the state level, maybe we should have a conversation about it, and it should be a conversation,” said Crenshaw.

“Unfortunately, that’s not what happened,” he continued. “What came out of it instead was hate-filled comments, a lot of emotion, a lot of anger, a lot of memes – a lot of memes that could be improved.”

Crenshaw continued by noting that even mentioning the term sent right-leaning Americans into the idea that they had been betrayed and shutting out any conversation about it.

“Clearly even the words ‘red flag law’ just emotionally triggered a lot of people, made you guys really mad at me. It seemed that no amount of explanation was able to quell your fears or convince you otherwise, convince you that somehow the president and I had not betrayed you,” Crenshaw said. “That is not true, of course, and it’s sad that many of you think that, it really is.”

“When we say ‘red flag laws,’ you guys stop listening,” he continued. “You can’t hear what we’re suggesting because, understandably, you automatically assume that we’re just agreeing with the left’s version of that law and we all know that the left’s version would not be good, it would not protect due process. But as it turns out, that isn’t what we’re talking about at all.”

Crenshaw noted the importance of due process when crafting anything like a red flag law.

“Making sure that due process could not be abused is at the heart of any conservative solution to the supposed red flag laws. In our version of what those would look like, I’ve laid out specific safeguards that would have to be in place for us to support any type of red flag law,” Crenshaw said.

Crenshaw was careful to note that his looking into red flag laws does not mean he was currently crafting any legislation as of yet, and made sure to tell his listeners that he understands the right’s fears of red flag laws.

“Here’s the thing, I understand your fears about bad red flag laws. Red flag law is a general concept,” he explained. “There could be good ones and there can be bad ones. You should be against the bad ones, as I am.”

The tricky part about red flag laws is that they’re easily corruptable or expanded once they’re put in place. Should a shooting occur in a state that has a red flag law in place, calls for expansions on it with inevitably rise and that state would be put in danger of having oppressive and abusive rules put on it in the name of “gun safety.”

Crenshaw urged that nothing can change unless we have an actual conversation about it, instead of resorting to emotional reactions.

“The whole purpose of what the president did, and what I am doing, in trying to start a conversation about this is so that we take control of the narrative and propose solutions that actually do protect due process rights,” Crenshaw said. “[Let’s] ensure that we aren’t on the sidelines when Democrats are proposing blatantly unconstitutional laws that would not protect your due process.”

“It’s a conversation that conservatives have actually been having for a very long time. It’s not new at all and it definitely does not deserve the emotional reaction that it has gotten,” he added. “We are better than that. Let’s be better than that.”

Yesterday, the Washington Post ran a stunt feature trying to shape the gun control debate.

As my colleague, Brad Slager, describes it:

It is a jarring visual, one that makes you pause. It is also doing another job; serving as agitprop. To go along with this tabulation it mentions how one third of these names occurred since the Sandy Hook school shooting, declaring a massive rise in these events. What it does not do is show how gun deaths have been on the decline for decades, just as the supposed violence-inducing weapons have been rising in popularity and in numbers.

Read it slowly and out loud. 1196 victims over 54 years. To me, the takeaway from the article is that we are supposed to get exercised over 22 deaths per year in so-called mass shootings–I should say “mass shootings of white people” to really encapsulize what the Washington Post is talking about because what they studiously avoid are shootings carried out to further some criminal enterprise or endeavor:

To put this in perspective, somewhere in the neighborhood of 25 people are killed each year by lightning strikes which should give you an idea of the odds of you or a loved one being the victim of a mass shooting that would gain the interest of the Washington Post.

Cattle kill approximately 22 Americans per year nationwide, and the animals deliberately attack their victims in 75 percent of those cases, according to a 2009 study. About one-third of bovine killers have a history of aggressive behavior. Swine likely kill fewer people than cattle do, but there are no reliable data on this question. The CDC’s mortality statistics group together all mammal attacks apart from those perpetrated by rodents, dogs, and humans. The death count in the mammal-attack category averages about 73 per year, including cattle-related mortalities.

I’m not trying to be flippant about these deaths but let’s not lose sight of the fact that the sole reason the Washington Post is pushing this story is because is believes that by focusing on an extraordinarily infrequent event that it can create an emotional appeal that will, in turn, generate legislation to make gun ownership much more onerous. And make no mistake about it, it is the quest to eliminate your ability to own a firearm that is the objective of the Washington Post and its fellow travelers. Absolutely none of the solutions they are proposing would have done anything at all to prevent the shootings in El Paso or Dayton or nearly every other place.

If the Washington Post really cared about mass shootings, it would have weekend box scores from West Baltimore, Southside Chicago, East LA, and the like. The post realizes that if it does this, then mass shootings will become associated with criminal enterprises and their impact and their ability to shape public policy will be limited.

In a nation of 330 million there is a lot of tragedy every day. Very little of it is actually preventable.  Sorry. I’m not interested in finding “common sense” solutions to a non-problem. I’m not going to participate in negotiating away my rights in search of the good opinion of the left because of a manufactured national crisis. I’m not going to fall for the “do something” bullsh**. Unless and until you can show me how your proposals will only effect people who are definitely going to become mass shooters and not scoop of a hundredfold inoffensive people for every one, then we’re done.

Our media betters pretend to care about the condition of the news without looking into any of their own mirrors.

When the death of Jeffery Epstein was announced late on Friday it took no time at all for the talk on social media to speculate on how the announced sucide was anything but that. What was telling was how people from both sides of the political spectrum were forwarding their impressions on how Epstein was more likely to have been dispatched, rather than have taken his own life.

This was displayed on Twitter in rather blatant fashion early Saturday morning. As the announcement was spreading across the platform there was a complete storyline taking place about how Epstein’s death fits in with a number of others surrounding Bill and Hillary Clinton. I say this not to give the story any veracity, but to show how this was in fact a very common narrative on the platform. As the Epstein news was flashing across Twitter the man’s name was actually trending BELOW that of another hashtag — #ClintonBodyCount. Another reared up – #Arkancide – in just as quick of a fashion.

That is the level in which the speculation was being tossed around. However once Donald Trump joined in the game late the media lost its collective minds. Suddenly the topic that so many had been bandying about was an explosive and shameful thing to be mentioned. The press, still unable to recognize when the President is provoking them, reacted in exactly the imbalanced fashion Trump intended. He poked a stick into their cage, and they growled right on cue.

CNN’s Oliver Darcy (filling in for Brian Stelter, out on maternity leave) wrote the outlet’s latest Reliable Sources newsletter. It was filled with hand-wringing and head-shaking over the deplorable condition of the news landscape, with so many repeating or reporting on the “vile” conspiracy narrative. Darcy had plenty to say in a cautionary fashion about how the press should behave in this climate.

“And, while I hate to be the bearer of bad news, it needs to be said: With the 2020 campaign approaching, and with bad actors continuing to pollute our information ecosystem, things are going to get worse.”

However in his words of warning one thing Darcy does not do is acknowledge his own network’s role in the “polluting”. For him to pretend that he and his network have not been tossing garbage theories over the transom and tossing false narratives out the windows of their driving news cycle is utter hilarity. I guess he expects us to pretend that for two and a half years they did not attempt to sell the Russian collusion narrative, absent anything approaching solid evidence.

But Darcy himself exposes his own contribution to the littered media landscape. He recently sent out a tweet referencing a New York Times article that attempts to claim the El Paso shooter was reliant upon conservative media, using similar words such as “invasion” in his manifesto.

This is Darcy polluting in the highest order. For him to attempt to sell this garbage theory he has to ignore the fact thee shooter began his opinions on the matter years before Donald Trump’s rise — that is, during the Obama administration. Darcy also bypasses the numerous leftist positions he held. He also completely pretends the Dayton shooter – with his support of Bernie Sanders and Elizabeth Warren — no longer exists.

It is just more of the same from this media complex. They have strewn their biased garbage all around the political lands, and then step back and point fingers at others over all of the “pollution” they witness. In a word, the accusations are pure garbage.

On Sunday, noted left-wing Harvard Constitutional law professor Laurence Tribe ventured off into the fever swamps on the issue of abortion, positing what he thought was a solid reason why white supremacists “opposed” it:

It’s both sad and yet unsurprising that someone with such a distinguished educational pedigree like Tribe could be so wildly off the mark. Several conservatives were quick to point this out to the professor:

The most notable conservative to school Tribe was his former student – Sen. Ted Cruz (R-TX), who posted a series of tweets setting the record straight:

For what it’s worth, Tribe tried to, ahem, clarify his Sunday tweet by posting another one on the same issue Monday morning:

Tribe can try to clarify all he wants to, but the insinuation in his original tweet was clear. Liberals including Tribe have spent the entirety of Trump’s presidency trying to paint all Trump supporters as racists and white supremacists, and his initial abortion tweet was one example of many.

What he didn’t realize he was doing, as Cruz and others have astutely pointed out, is accidentally demonstrating that actual white supremacists and the pro-abortion left have a lot in common.

Oops.

Citing “a person familiar with the matter” who wished to remain anonymous, the Washington Post reported that the cellmate of accused sex trafficker Jeffrey Epstein was transferred out on Friday, hours before his death. Investigators are looking into why he was not replaced.

Additionally, the source said the guard had not checked on Epstein for several hours before he was found unresponsive on Saturday morning. Guards are expected to check on inmates in the “high-security Special Housing Unit, in which high-profile or dangerous detainees are kept separate from the general population” every 30 minutes. (Those who are on suicide watch are supposed to be checked every 15 minutes, but it’s been confirmed that he had been removed from the watch list.)

Serena Gregg, president of the American Federation of Government Employees Local 3148, blames the failure on understaffing.

She noted that “the Metropolitan Correctional Center is functioning with less than 70 percent of the needed correctional officers, forcing many to work mandatory overtime and 60- or 70-hour workweeks.”

Gregg said that, on the night of Epstein’s death, the two guards on duty “were working overtime — one forced to do so by management, the other for his fourth or fifth consecutive day.” She added that, “one of the individuals assigned to watch Epstein’s unit did not normally work as a correctional officer but, like others in roles such as counselors and teachers, was able to do so.” She said:

If it wasn’t Mr. Epstein, it would have been somebody else, because of the conditions at that institution. It wasn’t a matter of how it happened or it happening, but it was only a matter of time for it to happen. It was inevitable. Our staff is severely overworked.

It’s daunting — mentally, physically. I would feel confident in saying that some of that contributed to the unfortunate death of inmate Epstein.

On July 23rd, Epstein had been found unconscious in his cell with injuries to his neck and was immediately placed on suicide watch. A week later, he was moved to the special housing unit, “where there was a higher level of security, but not constant monitoring,” and taken off suicide watch.

According to the Washington Post:

Before the incident, Epstein had a cellmate: Nicholas Tartaglione, a former police officer in custody on murder and narcotics charges. But Young, the national union president, said Epstein was in a cell alone immediately before his death.

Young said he was not certain why Epstein was in the cell alone, as the Federal Bureau of Prisons has moved recently to make sure fewer inmates are housed on their own. He said there was some speculation after the July 23 incident that Epstein was trying to get away from Tartaglione, whom he feared, and he believed that, at least for a time, Epstein had another cellmate after coming off suicide watch.

Young asserted that in the jail’s general population, Epstein also probably would have been a target and that there was only so much officers could do to prevent him from harming himself.

Young told the reporter, “We can’t ever stop anyone who is persistent on killing themselves. The only thing the bureau can do is delay that.”

And here comes the Trump bashing. Young said, “All this was caused by the administration” which “had imposed a hiring freeze and budget cuts on the Federal Bureau of Prisons.”

Young pointed out that, during a Congressional hearing, Attorney General William P. Barr “conceded the bureau was short about 4,000 or 5,000 employees and said he had lifted the hiring freeze and was trying to ensure a steady pipeline of new officers to replace those who leave.”

Brace yourselves for the copious amounts of finger pointing to come.

One would assume, especially in the Special Housing Unit, that cameras would have captured what took place in or around Epstein’s cell in the early hours on Saturday morning. I would expect cameras to be focused directly on inmates’ cells and the surrounding areas.

Former U.S. attorney, Preet Bharara tweeted, “There should be – and almost certainly is – video of Epstein’s suicide at MCC. One hopes it is complete, conclusive, and secured.”

E.O. Young, the national president of the Council of Prison Locals C-33, disagrees. He said, “It was not clear how much, if any, of the incident or authorities’ check-ins was captured on camera.” Young also told the reporter that, “while cameras are prevalent in the facility, he did not believe they generally captured inmates’ cells.”

News of Epstein’s apparent suicide while in federal custody immediately triggered both an FBI and a Department of Justice Inspector General investigation. It also sparked outrage among his victims who were waiting for Epstein to face justice.

The city’s chief medical examiner, Barbara Sampson, announced that an autopsy had been performed on Sunday, but said they would not be releasing their immediate findings. “At the request of Epstein’s representatives,” private pathologist Michael Baden was allowed to attend the autopsy.

Still, I imagine we’ll be hearing quite a bit from “sources who are willing to speak on the condition of anonymity.”

In the tweet below, Tech tycoon and current presidential candidate John McAfee adds a bit of levity to the buzz around Epstein’s death.

Jerry Nadler’s race to impeachment has been off the front pages for a few weeks, mostly because Robert Mueller failed to do anything but harm the case for removing Donald Trump from office. Trump may be a bull in a china shop, but there’s just very little there in the vein of actual impeachable offenses. Some Democrats, including Nancy Pelosi, realize this and have sought to tamp down expectations. Nadler and what appears to be about half the Democrat caucus are choosing a different path.

Namely, they are trying to stealth impeach Trump by having formal impeachment proceedings without actually having articles of impeachment pass. This has been hinted at for a while and Nadler is now proclaiming he’s doing it.

House Judiciary Committee Chairman Jerry Nadler told CNN this week his panel is conducting “formal impeachment proceedings” against President Trump and could be ready to file articles of impeachment this fall.

The New York Democrat’s announcement blew up social media and thrilled the Democratic base, which has been clamoring for the House to take formal steps to oust the president.

The problem is that this clearly violates House rules.

The top Republican on the Judiciary Committee, Rep. Doug Collins of Georgia, called out Nadler’s CNN claim almost as soon as he uttered it on the CNN set.

“Chairman Nadler is either uninformed about what a formal impeachment inquiry is or he is deliberately misleading the American public to score cheap political points,” Collins tweeted Thursday. “Which is it, Chairman?”

Any function of impeachment under Article 1 requires a majority vote in the House approving such measures. Without that fail safe, any committee could abuse the impeachment process and the court system by simply declaring they’ve started impeachment proceedings. It’s unconstitutional.

Nadler, however, doesn’t appear to have the authority to launch a formal impeachment inquiry regardless of the case he makes to the court, Republicans said.

That power rests with the House, which must approve a formal Judiciary Committee impeachment probe by simple majority.

Collins, a GOP aide told the Washington Examiner, “does dispute Nadler’s assertion that the committee is currently conducting “formal impeachment proceedings. The House rules do require a formal vote in order for the committee to begin conducting a formal impeachment inquiry.”

Furthermore, it defies history, which has also given us the precedent that a formal vote and passage is required. In 1998, before Republicans could investigate Clinton, they were made to pass authorization for the Judiciary committee to begin an impeachment investigation. That’s happened in every previous impeachment attempt as well. Nadler wants to skip that step because he knows he doesn’t have enough support, even among Democrats, to win such a vote.

The courts should laugh at this nonsense and Republicans should oppose it unconditionally. A future precedent where a President can be investigated via the powers of impeachment without Congress actually authorizing such would be incredibly dangerous. It would essentially shut down governance, as every new President would end up having every inch of their private affairs invaded by partisans. The Republican Congress under Obama did not play such games and Democrats under Trump can’t be allowed to do so now.

This matter is simple. If Democrats want to use the powers of impeachment, then pass authorization to do so and bare the political consequences. They don’t get to have their cake and eat it too, demanding courts give them documents they aren’t entitled to while getting to skip the backlash from moderate voters.
