Sean Hannity said in his Tuesday monologue that moderate Republican senators who waffle and consider allowing Democrats “special treatment” in regard to President Trump’s impeachment risk becoming part of the opposition party’s “charade.”

If the Trump impeachment case was such a “slam-dunk” as claimed, Hannity explained, Democratic impeachment managers like Reps. Hakeem Jeffries, D-N.Y., Adam Schiff, D-Calif., and Val Demings, D-Fla., shouldn’t be able to impose new roles and responsibilities upon the Senate regarding impeachment.

Hannity noted the Constitution delineates that the House shall “have the sole power of impeachment” while the Senate has the power to “try” the aforesaid impeachment.

In that regard, the House should have already formulated an impeachment case against Trump and it is not the Senate’s responsibility to finish that work.

“They said it’s a slam dunk. Now the House managers, they got their impeachment, they have their trial, everyone is sworn in, dressed up and ready to go. Present your slam dunk case,” Hannity challenged Schiff, Jeffries and the others … They didn’t call the witnesses that they now are demanding to be called. They have the sole power to impeach, [but] they think the U.S. Senate now should spend months doing their constitutional job.”

“The beady-eyed lunatic you’ve been watching on your screen all day is perhaps the worst liar in all of politics,” the host added of Schiff — reminding viewers how much of the evidence the lawmaker he claimed to have incriminating Trump has never been presented.

Addressing the American people directly, Hannity challenged them to observe their state’s Republican senator or senators and watch how they handle the impeachment trial.

“Some of them [the Republican senators] I would argue are pretty weak and some of them are willing to lend credibility to this unconstitutional role that the House is trying to impose on them because they didn’t do their job,” he warned.

“If you give the House Democrats, if your representatives allow the House Democrats the special treatment they don’t deserve, that’s unconstitutional. You are literally a part of what is a charade that will live in perpetuity that is ripping this country apart. You, your representatives, your senators will be adding legitimacy to this unconstitutional corruption.”

CNN political analyst Joe Lockhart was the butt of the joke on Twitter for sounding the alarms on Sen. Ted Cruz, R-Texas., for tweeting during the Senate impeachment trial of President Trump.

As the impeachment trial was underway, Cruz shared a video of himself knocking House Speaker Nancy Pelosi, D-Calif., and House Intelligence Committee chairman and House manager Adam Schiff, D-Calif., for suggesting that Trump invoking executive privilege is “obstruction of Congress.”

“If it were, nearly every president would have committed impeachable conduct,” Cruz added.

Lockhart, however, cried foul because the senators are forbidden to bring their cellphones to the impeachment trial. Not only did the CNN analyst question if Cruz was “willing to go to prison,” he called on Twitter CEO Jack Dorsey to look into the matter.

“Senators on the floor are sworn to silence and have no electronic devices. So how is this Senator tweeting? Did he sneak a phone in[?] Is he willing to go to prison? Or is the tweet from someone other than Cruz. @jack you should investigate,” Lockhart wrote.

Critics quickly went after the former Clinton aide for suggesting the Texas lawmaker was breaking the law.

“This person is paid to provide analysis on @CNN,” Daily Caller White House correspondent Amber Athey reacted.

“Congrats! You’ve said the dumbest thing ever!” Club for Growth senior analyst Andrew Follett exclaimed.

National Republican Senatorial Committee senior advisor Matt Whitlock pointed out that Cruz’s colleague and 2020 candidate, Sen. Elizabeth Warren, D-Mass., as well as. Sen. Ed Markey, D-Mass., also tweeted during the impeachment trial.

“If you’re going to be the enforcer on this I think you’ll end up staying pretty busy,” Whitlock told Lockhart.

Even Cruz piled on the CNN analyst, daring him to “come and take” his cellphone.

CNN chief legal analyst Jeffrey Toobin showered House Intelligence Committee Chairman Adam Schiff, D-Calif, and other Democrats with praise over their handling of the impeachment trial, declaring they’re “so much better” than President Trump‘s defense team.

During the network’s coverage of the launch of the impeachment trial on Tuesday, CNN anchor Wolf Blitzer asked Toobin to compare the “presentations” from the House managers and the president’s counsel. However, Toobin insisted there wasn’t even a “close comparison.”

“You know, I don’t want to sound like a partisan, but the Democrats have been so much better, it’s not even a close comparison as far as I can tell,” Toobin began.

The CNN analyst then complimented Schiff, who is serving as the lead House manager during the impeachment trial.

“Adam Schiff knows the facts. That is something that you can’t fake,” Toobin told the panel. “A lot of what he’s doing is off the cuff. It’s responding to the arguments. Most of the lawyers have just been reading, reading presentations.”

While he offered similar praise for Trump lawyer Jay Sekulow, Toobin wasn’t nearly as kind to others from the president’s legal team, saying Pat Cipollone is “less” effective and that Patrick Philbin is “not ready for primetime.”

He quickly pivoted back to the Democrats.

“I think Adam Schiff is just in charge — he’s acting like a lead prosecutor,” Toobin continued. “And I think Congresswoman Lofgren, while not as theatrical of a performer, she had a very good argument to make and I thought she made it very effectively.”

The Daily Briefing” host and “The Five” co-host Dana Perino said Tuesday that Senate Minority Leader Charles Schumer, D-N.Y. risks losing the public’s — and the U.S. Senate’s — attention if he continues to offer “amendments” to the parameters of the Trump impeachment trial.

During Fox News Channel’s special coverage of the trial, Perino said that Schumer needs to understand that most observers have a “limited amount of attention span.”

“Not just in the [Senate] room … but for America,” she added. “Who is paying attention?”

Perino said Schumer likely understands many of his proposals will fail in the Republican-majority Senate. Other observers have noted that a few moderate Republican senators — including Lisa Murkowski of Alaska, Mitt Romney of Utah, Cory Gardner of Colorado and Susan Collins of Maine — are being watched closely for their votes on certain matters.

However, Perino said that it is unlikely that any Republican will “break” with the majority.

“He has to make a decision,” Perino said of Schumer. “Does he want to go through all of these or tell [Senate Majority Leader Mitch] McConnell: ‘Put these amendments in the record. Table them all at once. Get to the substance right away.'”

Earlier in her analysis, Perino said Rep. Zoe Lofgren, D-Calif., one of the Democrats’ “impeachment managers,” had been given the unenviable “job” of trying to convince senators to approve a Schumer amendment subpoenaing White House documents by “telling the Senate that they need to do their [the House managers’] job.”

“Even some of the moderate senators on the GOP side have said that the House handed them incomplete homework,” Perino noted.

Former Secretary of State Hillary Clinton was asked about her ties to disgraced film mogul Harvey Weinstein and implied that she and other Democrats who’ve been associated with the accused predator did not know about his history of sexual misconduct, but reporting from “Catch and Kill” author Ronan Farrow suggested otherwise.

Clinton is making more headlines ahead of the release of a four-part Hulu series about her life and career and was asked during an interview with The Hollywood Reporter about her past relationship with Weinstein, who was previously one of the biggest Democratic donors and fundraisers in the entertainment industry.

“With his trial in the news right now, do you have regrets about your lengthy association with Harvey Weinstein?” THR TV editor Lacey Rose asked.

“How could we have known?” Clinton responded. “He raised money for me, for the Obamas, for Democrats in general. And that at the time was something that everybody thought made sense. And of course, if all of us had known what we know now, it would have affected our behavior.”

Farrow, the Pulitzer Prize-winning journalist who helped expose the Weinstein scandal, reported last fall in his book that Clinton’s staff attempted to discourage him from looking into the former Secretary of State’s longtime political ally while discussing a scheduled interview he was supposed to have with Clinton for another book he was writing about foreign policy.

“A call came in from Nick Merrill, Clinton’s flack,” Farrow said of the Clinton spokesperson. “We discussed the book briefly, and then he said, ‘By the way, we know about the big story you’re on.'”

“Well, you know, it’s a concern for us,” Merrill reportedly told Farrow.

When the New Yorker journalist pressed the spokesperson on where he heard it from, Merrill, according to Farrow, responded by saying, “Let’s just say people are talking.”

During an interview on Fox News, Farrow explained how Clinton attempted to back out of an interview she had previously committed to granting him for a separate project.

“She attempted to withdraw from an interview that she had committed to for a foreign policy book that I was working on, for which I interviewed every other living secretary of state,” he told Special Report anchor Brett Baier.

“And, before doing so, her staff raised concerns about the fact that I was working on this story about one of her most significant donors– a big bundler of Hollywood money.”

That bundler was Harvey Weinstein.

Back in 2017, actress Lena Dunham said she warned Clinton’s campaign about Weinstein’s alleged predation during the 2016 election.

“I just want you to let you know that Harvey’s a rapist and this is going to come out at some point,” Dunham said she told the campaign. “I think it’s a really bad idea for him to host fund-raisers and be involved because it’s an open secret in Hollywood that he has a problem with sexual assault.”

Dunham, who has professed “an incredible allegiance to Hillary,” claimed Clinton campaign deputy communications manager Kristina Schake told her she’d relay the message to campaign manager Robby Mook, but that she was surprised at the warning.

When the Weinstein scandal emerged in October 2017, Clinton issued a statement saying the was “shocked and appalled” by the allegations.

Both sides in the Senate impeachment trial of President Trump are undermining their cases with their lofty rhetoric, former federal prosecutor Andrew McCarthy said Tuesday.

McCarthy, a Fox News contributor and former Assistant U.S. Attorney for Manhattan, said that the political and legal declarations coming from both Rep. Adam Schiff, D-Calif., and White House Counsel Pat Cipollone are not helping their prospective sides.

In Schiff’s case, McCarthy said the House Intelligence Committee chairman has continued to argue that the White House must provide more evidence and witnesses, which he was referred to as “key,” “vital” or “crucial.”

At the same time, Mccarthy noted, the impeachment managers argue that the evidence against Trump is “overwhelming.”

McCarthy wondered aloud how it is possible for a case against Trump to be “overwhelming” if it is also lacking “vital” evidence and “key” witnesses.

“I think his rhetoric is running into his position,” McCarthy said.

Meanwhile, Cipollone’s team has argued what McCarthy called “the constitutional infirmity” of the Democrats’ two impeachment charges.

“The president wants to contest the facts of the case. Some of that has seeped into the rhetoric of his lawyers,” said McCarthy, who added that such rhetoric does not help any case to dismiss the charges outright.

That rhetoric, he said, also concerns moderate Republican senators like Cory Gardner of Colorado, Thom Tillis of North Carolina and Susan Collins of Maine, who are up for reelection this year and who are being closely watched as the trial drags on.

“The president is taking the position that the facts need to be contested — that whether there was a quid pro quo and whether he did anything wrong needs to be contested,” McCarthy said. “That actually supports the argument for why you should hear from witnesses who haven’t been heard from yet and who may have things to say that are relevant on those different subjects.

“Now, [Republicans] can make the argument that the House should have called those witnesses or made a better effort to get them. The fact is that the rhetoric of contesting the facts is supporting the arguments of the people who say that more witnesses are necessary.”

Alan Dershowitz: Trump impeachment is a ‘motion-to-dismiss’ case, save for ‘political’ considerations

Harvard Law professor emeritus Alan Dershowitz, a constitutional representative for President Trump in his Senate impeachment trial, said that in a normal court of law, the case would be subject to a “motion to dismiss.”

Dershowitz said Monday on “The Ingraham Angle” that in a court of law, Trump’s attorneys would be wise to petition for a motion to dismiss on the grounds that the charges against him do not amount to a crime, whether or not he acted as he was accused.

Dershowitz said that in the case of an impeachment trial, such a motion would become a “political issue.”

“This is a motion-to-dismiss case, in which, if it were a criminal case and he was charged with dishonesty … the first thing you do is make a motion to dismiss because dishonesty isn’t a crime,” he said, using “dishonesty” as an example not necessarily germane to the current impeachment case.

“Obstruction of Congress is not an impeachable offense. Abuse of power is not an impeachable offense. A motion to dismiss and a perfect world would be ideal, but do the American public want to see an end to the trial so quickly? I think that becomes a political issue.”

Dershowitz underlined that he does not believe the president committed either of those acts, adding that the Trump team’s legal brief lays out that case.

“The position is he didn’t do any of these things, that he is innocent as a matter of fact,” Dershowitz said.

“As every criminal trial lawyer knows when you have disputes over facts and disputes over law, you always argue in the alternative. You always argue that the facts are not proved, but hypothetically, even if the facts were to be proved, they wouldn’t rise to the level of a crime or in this case an impeachable offense. So, it is not an acknowledgment in any way by anyone on the legal team that the president did anything wrong, that is just not how that brief could possibly be read.”

Regarding his title of “constitutional representative” rather than formally a legal team member or lawyer, Dershowitz told Ingraham his role is similar to the capacity in which he served during the O.J. Simpson case.

“My role is to present the constitutional argument — I am not meeting with the team on strategic issues. I am not involved in whether witnesses should be called, or whether facts should be alleged,” he said. “My argument is limited.”

Former New York City Mayor Rudy Giuliani said Monday he is “heartbroken” by what he called lies being told by his former associate, Ukrainian-born businessman Lev Parnas.

Giuliani, President Trump’s personal attorney, said Monday on “The Ingraham Angle” that he used to be close to Parnas and was even the godfather to his child.

“Obviously, I was misled by him,” he said, after host Laura Ingraham played a portion of Parnas’ interview with MSNBC host Rachel Maddow. “I still feel sorry for him.”

Parnas told Maddow that while he was in contact with officials in Ukraine, he would “not do anything without the consent of Rudy Giuliani or [President Trump].”

“I have no intent, I have no reason to speak to any of these officials. It’s all about Joe Biden, Hunter Biden — also Rudy had a personal thing with the [Paul] Manafort stuff.”

On “The Ingraham Angle,” Giuliani said Parnas committed several “misrepresentations” during his lengthy MSNBC interview. He said that he did not want to go into too much detail, but would earnestly welcome the opportunity to testify before Congress on the matter.

“I wouldn’t mind being called as a witness for a lot of reasons, including being able to reveal the unbelievable amount of corruption that went on between the Democratic Party and Ukraine all throughout the Obama Administration. I think people will be astounded to know the hundreds of millions of dollars that illegally passed hands between Americans and Ukrainians.” the former mayor said.

“I will tell you — that [Parnas], in very large part, did not tell the truth,” Giuliani continued.

He said Parnas had claimed to have been part of a meeting during a White House Hanukkah party in which Trump “deputized” him as a “representative.”

“Four people in that meeting — myself, [Parnas’] former partner Igor Fruman, and two others say that’s absolutely untrue — and the meeting never took place.”

Ingraham said that, if true, it would likely show that Parnas was not being directed by-proxy through Giuliani.

“It indicates he lied, misrepresented,” the ex-mayor responded. “Like Michael Cohen did.”

Giuliani added that Parnas reportedly “put out” the story that claimed Rep. Devin Nunes, R-Calif., met with Ukrainian prosecutor Viktor Shokin in Austria in 2018. Nunes has previously claimed on Fox News that he was never in Vienna at the time, and Giuliani made similar remarks to that extent in his interview. The lawmaker also sued CNN in December for defamation, relating to their reporting of the story.

Shokin was the prosecutor whose firing was referenced on videotape by former Vice President Joe Biden.

“Lev Parnas once again lied,” said Giuliani. “Devin Nunes was not in Vienna at that time, his passport demonstrates that.”

“The man is a demonstrated liar. … He didn’t just lie, he lied stupidly — a stupid lie is when your partner Igor Fruman can contradict you. A stupid lie is when there is a tape recording that can contradict you. A stupid lie is when there is a passport that can contradict you.”

When asked by Ingraham about Parnas’ motivation for allegedly lying, Giuliani again claimed that the motivation is “not to go to prison — the same thing as Michael Cohen.”

Cohen, formerly an attorney for then-businessman Trump, testified before Congress about issues related to Trump and the 2016 election.

Giuliani later shook his head when he listened to another clip of the Parnas-Maddow interview, in which Parnas claimed the ex-mayor was in contact with Attorney General William Barr about Ukraine.

Laura Ingraham didn’t mince words Monday, calling on the “moderate” Republican senators who are open to hearing witnesses in the Senate impeachment trial to change course, saying the “entire presidency is on the line.”

“Now, in the Senate, [Sen. Mitt] Romney feels that he can play the people for Utah for suckers,” Ingraham said on “The Ingraham Angle.” “Now let’s waste millions of taxpayer money, weeks of legislative time to force the Senate to call witnesses that [Jerrold] Nadler and [Adam] Schiff didn’t even bother pursuing.”

WHO IS LEV PARNAS AND WHY MIGHT DEMS WANT TO CALL HIM AS A WITNESS?

Ingraham asked aloud why any Republican would bother to consider witnesses.

“Well, remember, [House Speaker Nancy] Pelosi and Schiff want witnesses only to scuff up the president before the next election period. It’s not about fact-finding. So why on earth would any Republican agree to this?” Ingraham asked. “There has to be a political price to be paid for engaging in these types of charades.”

Ingraham called on voters to let these senators know how they feel on the topic of witnesses.

“And the voters of Utah need to let Mitt Romney know their feelings on this. Loud and clear,” Ingraham said. “Ditto for all Republican voters, by the way. These senators have to stop trying to burnish their moderate bona fides by hemming and hawing on whether there’s any impeachable offense here. There is not any impeachable offense here.”

“Murkowski has to understand that with the entire presidency on the line, this is no time now to show off her independent streak. And Collins needs to hear that it’s about to get a lot colder for her in Maine if she plays footsie with Pelosi and Schiff,” Ingraham said. “And Lamar Alexander, God bless him, he needs to know that his legacy will be forever tarred if he’s part of creating a precedent for this type of political impeachment.”

The host once again warned Republicans there was a price to pay with their decision.

“Good luck protecting them from the voters if they make the wrong decisions,” Ingraham said. “Any Republicans who appear to have taken these bogus articles of impeachment seriously will only be remembered as craven fools and puppets of the New York Times.”

Sean Hannity warned Republican senators Monday night that it is their job only to “render a verdict” in President Trump’s impeachment trial and nothing more.

“For those Republicans, the people you’ve elected, want to prove their own moral superiority and sense of extra special fairness,” Hannity said on his television program. “You need to focus on your constitutional role. Period. Which is why the voters hired you.”

Hannity spoke directly to his viewers in explaining what he expects.

“Now you, the American people, you need to know this. It is not your Republican senator’s job to bolster what are pathetically weak articles of impeachment from the House,” Hannity said. “It is not your senator’s duty to call witnesses that the House didn’t even subpoena. It is not your representative’s responsibility to investigate evidence the House neglected to examine. There are no do-overs. The Senate doesn’t get to take on the constitutional role of the House.

“Senators review the articles of impeachment. That’s it. As delivered by the House. They now have House managers. They will present their case. And your Republican senators need to render a verdict. That’s it,” Hannity added.

The host warned of the impact the articles of impeachment could have on the future of the executive branch.

“These articles are an affront to our entire constitutional system,” Hannity said. “The ramifications would transcend and alter the presidency, the executive branch of our government.”

Hannity said Republican senators must not “lend legitimacy” to the Democrats’ impeachment push.

“Your elected senators must not capitulate, lend legitimacy to the demands of a compromised, in this specific case, congenital liar whose been lying to us for three years, [Rep.] Adam Schiff [D-Calif.,] and the rest of his malignant house managers,” Hannity said. “That’s because this is a baseless impeachment. It has been a politically motivated witch hunt from the very beginning.”
