Senate Judiciary Committee Chairman Lindsey Graham said Monday that critics who calling for Attorney General William Barr to resign have a political agenda separate from upholding the rule of law they claim to cherish.

Graham, R-S.C., told “Hannity” that Barr was doing his job when his office stepped in to soften a sentencing recommendation from four now-resigned federal prosecutors in the case of Republican consultant Roger Stone.

Stone has been convicted of witness tampering and lying to Congress in relation to the Russia investigation. The prosecutors recommended up to nine years in prison — but Barr balked at the suggestion.

“Bill Barr stepped in and stopped what I thought was an unjust sentence enhancement – and to the people who want Barr to resign, we know your agenda,” he said.

“You are not trying to uphold the rule of law. You’re trying to take a good man down because you hate” President Trump.

Graham added that the counterintelligence investigation into potential links between Trump campaign figures and Russia — dubbed “Crossfire Hurricane” — was a “danger to democracy.”

“I think it should never happen again. I think it was set up to destroy the Trump campaign, not protect it from Russian influence,” he said.

“I think [former Mueller team prosecutor] Andrew Weissmann needs to tell the country why it took two years to do the Mueller investigation when he should’ve figured it out in the first week there was nothing there.”

Regarding Barr’s action, which came around the same time as a tweet from President Trump slamming the initial Stone recommendation, several Democrats had expressed outrage.

Sen. Richard Blumenthal, D-Conn., said Barr “ought to be ashamed and embarrassed and resign as a result of this action directly interfering in the independent prosecution of Roger Stone.” He also said the controversy served as yet another example of “political interference by the president to alter the independent decisions of the Department of Justice.”

Rep. Jerrold Nadler, D-N.Y., didn’t answer a question on whether Barr should resign, but said: “I think the behavior is extremely egregious.”

Barr, speaking to ABC News last Thursday, pushed back on Trump’s tweet while also defending his handling of the Stone case.

“I’m gonna do what I think is right,” he said, “and you know, I cannot do my job here at the department with a constant background commentary that undercuts me.”

Sen. Lindsey Graham, R-S.C., claimed on “America’s Newsroom” Tuesday that “the demise of the Democratic Party” is underway, as voters headed to the polls in New Hampshire’s first-in-the-nation primary.

“The president’s in a spot where he really can’t lose as this plays out,” Graham said on Tuesday. “[Former Vice President Joe] Biden’s going to win South Carolina, you’re going to have three different winners in the first three states.”

“On Super Tuesday, I think [billionaire and former New York City mayor Mike] Bloomberg is going to make a real dent. He’s going to make a real presence,” he continued. “You’re going to go to this convention with Biden basically collapsed. Somebody’s going to fill that lane, it’s not going to be [Democratic Sen.] Amy Klobuchar, it’s going to be Bloomberg.”

He went on to say that if the 2020 Democratic National Convention in July comes around and “if you can’t find a nomination on the first round of voting, the Democratic Party as we know it is going to completely implode.”

Graham said if a nomination isn’t determined after the first round of voting, “It’s going to help President Trump get reelected.”

He then noted, “You’re seeing the demise of the Democratic Party that your grandfather and grandmother knew and we’ll see how that affects America.”

Bernie Sanders, I-Vt., the populist senator who’s making his second straight White House run, is in the driver’s seat – sitting atop the final public opinion polls, drawing large and energetic crowds in the closing days,  and sporting arguably the largest grassroots get-out-the-vote operation in New Hampshire.

After getting out of Iowa’s caucuses with essentially a tie with 2020 nomination rival former South Bend, Ind., Mayor Pete Buttigieg, expectations are high for self-described democratic socialist Sanders in a state where he shares home-field advantage with fellow progressive standard-bearer Sen. Elizabeth Warren of Massachusetts.  

When host Sandra Smith asked Graham why he doesn’t think Klobuchar, D-Minn., can fill Biden’s spot he said, “She doesn’t have the juice.”

“This is socialism versus liberalism,” he continued. “Amy is a nice person, but at the end of the day she’s not going to be able to compete with Bloomberg. He’s got just too much money.”

Sen. Lindsey Graham, R-S.C., Tuesday called on former national security adviser John Bolton to hold a press conference to expand on a New York Times bombshell report that claimed Bolton wrote in his upcoming book that President Trump explicitly tied $391 million in Ukrainian military aid to investigating the Bidens.

“John, you’ve kind of thrown the country into a ditch here,” Graham told Fox News’ Martha MacCallum. “Just come forward and say what’s on your mind, hold a news conference and we’ll consider what you’ve got to say if you think it’s that important.”

Graham said from his point of view, he believes he has all the evidence he needs in Trump’s impeachment trial, which he said he was optimistic would wrap up with an acquittal before the State of the Union next Tuesday.

He added that even if what Bolton said Trump did was true it wouldn’t be an impeachable offense.

MCCONNELL SAYS GOP DOESN’T HAVE VOTES YET TO BLOCK IMPEACHMENT WITNESSES, AS BOLTON BOOK DISRUPTS TRIAL SCRIPT

The White House’s plans for a speedy trial without witnesses were thrown into doubt this week after the Times’ report, which renewed calls from Democrats to subpoena Bolton who has said he is willing to be a witness.

Some moderate Republicans have said they might be open to hearing his testimony in the wake of the report and House Speaker Mitch McConnell reportedly said he didn’t have the votes as of Tuesday to dismiss calling witnesses.

Graham said he blames House Democrats for not pursuing a Bolton subpoena in the courts.

Lead House impeachment manager Rep. Adam Schiff explained Democrats decided not to go through the courts to compel Bolton’s testimony because he believes it would be used as a stall tactic.

“If you argue that, well, the House needed to go through endless months or even years of litigation before bringing about an impeachment, you effectively nullify the impeachment clause,” Schiff said earlier this month. “You allow the president of the United States — by delay, by playing rope-a-dope in the courts — to defeat the power of the impeachment clause.”

Graham added that he would be open to calling Joe and Hunter Biden and the whistleblower as witnesses.

“It’s a partisan, political exercise,” he said of Trump’s impeachment, “that needs to die this week.”

Sen. Lindsey Graham, R-S.C., announced that his initial plan of a pre-trial dismissal of the impeachment case against President Trump is now unlikely to happen, but he is pushing for the trial to begin and end as quickly as possible.

The Senate trial is set to begin Tuesday. Graham had previously floated the idea that the GOP majority could immediately vote to dismiss the case before hearing any arguments, but now he states that this does not appear to be a possibility given the lack of sufficient Republican support for such action.

TRUMP LAWYERS RESPOND TO ARTICLES OF IMPEACHMENT: ‘CONSTITUTIONALLY INVALID’

“Yeah that’s dead for practical purposes,” Graham told “Fox News Sunday,” explaining, “the idea of dismissing the case early on is not going to happen; we don’t have the votes for that.”

Graham remains confident that Republicans are still united enough to acquit Trump at the conclusion of the trial. How long the trial goes is still up in the air. Graham would neither confirm nor deny reports that Senate Majority Leader Mitch McConnell plans on keeping the Senate in session for 12 hours a day so that House Democrats would be done presenting their arguments Wednesday.

In addition to presenting their arguments, House Democrats want to call witnesses such as former National Security Adviser John Bolton, who did not testify during the House’s impeachment inquiry due to Trump’s claim of executive privilege. Bolton indicated he would comply with a Senate subpoena.

Senators Ted Cruz, R-Texas; Lisa Murkowski, R-Alaska; and Susan Collins, R-Maine, are among a small group of Republicans who have yet to completely shut the door on new witnesses, wanting to hear arguments first. Democrats would need them and at least one more in order to be able to call witnesses, but Graham warned that if they get their wish, the GOP will look to call defense witnesses such as Hunter Biden.

“If we call one witness, we’re going to call all the witnesses,” Graham said.

HOUSE DEMOCRATS URGE SENATE TO ‘ELIMINATE THE THREAT’ OF TRUMP, IN OPENING IMPEACHMENT TRIAL SALVO

Personally, Graham said he would rather look into Hunter Biden’s dealings with Ukrainian energy company Burisma Holdings outside of the context of the impeachment trial, and would rather not have any witnesses called during the trial from either side.

“The sooner this is over the better,” he said.

While the trial itself will first begin on Tuesday, both sides have already filed documents presenting arguments.

The Democratic House impeachment managers filed a lengthy brief Saturday night arguing that Trump abused the power of the presidency by using military aid as leverage to pressure Ukraine into announcing investigations into former Vice President Joe Biden and his son Hunter, as well as whether Democrats used Ukraine to interfere in the 2016 election.

They also claim that the president obstructed Congress by blocking key witnesses from testifying during the House’s impeachment inquiry.

In his answer to the impeachment articles — also filed Saturday — Trump and his attorneys argued that he committed no wrongdoing when it comes to his dealings with Ukraine, claiming that he did not pressure Ukrainian President Volodydmyr Zelensky into conducting investigations into political rivals, and that the military aid was released without any investigations being announced.

Additionally, Trump argues that the obstruction of Congress charge is meritless because his instructions for witnesses like Bolton not to testify were done under executive privilege, and House Democrats who claimed this was improper never allowed the courts to make a ruling on the matter because they either withdrew subpoenas or opted not to issue them.

President Trump will emerge from the Senate impeachment trial “the strongest he has been politically,” Sen. Lindsey Graham, R-S.C. told Sean Hannity Wednesday.

“The best thing for the American people is to end this as soon as possible,” Graham said. “On February the fourth when the president comes into the house chamber to deliver the state of the union, he will have been acquitted by the Senate, [he will be] the strongest he has been politically.”

“When it comes to Donald Trump, the best is yet to come,” Graham added.

Graham’s comments came hours after House Speaker Nancy Pelosi, D-Calif., put her signature on the articles of impeachment against Trump–  one month after the House impeached Trump alleging he abused his presidential power by pressuring Ukraine to investigate Democratic rival Joe Biden, using military aid to the country as leverage.

“The House will be able to make their case for 24 hours. Hopefully, we do this in a couple of days. Then the defense team of the president will make their case based on the record established in the house,” Graham said.

“I hope this is done in about a week and I predict a bipartisan acquittal of President Trump,” he added.

Graham also responded to Pelosi’s announcement naming Senate Minority Leader Chuck Schumer among the impeachment managers who will prosecute the case against the president in the Senate.

“I tell my colleagues on the Republican side, Chuck Schumer is not seeking the truth,” Graham said. “If you think that Chuck Schumer is trying to find out what happened here you’re missing a lot. Chuck Schumer is trying to take back the Senate,” he added.

Graham also warned the Democrats heading into November, saying Americans have the right to “pick their own leaders” and will hold it against politicians trying to take that away.”

“By the time the trial is over and we have an election in November, there will be a backlash…I will tell you why,” Graham said. “Most Americans zealously guard the right to pick their own leaders. I think they will hold it against politicians trying to take that away.”

“We will get the House back,” Graham concluded, “the Senate majority…and President Trump will be reelected.”

Sen. Lindsey Graham, R-S.C., called the War Powers Act “unconstitutional” during an interview Saturday on “Justice with Judge Jeanine,” and claimed Sens. Mike Lee, R-Utah, and Rand Paul, R-Ky., are wrong to support curbing President Trump‘s military authority.

“Congress has the power to declare war. That doesn’t mean the commander in chief can’t use military force to protect the country without Congress,” Graham told Jeanine Pirro. “We’ve had military engagements hundreds of times. What the president did is he took out [Gen. Qassem] Soleimani who was planning another attack against American forces in Iraq who were lawfully present. He has all the authority he needs to protect troops in the field.”

“The War Powers Act is blatantly unconstitutional,” he added. “You cannot have 535 commanders in chief. Can you imagine what our nation would look like if Bernie Sanders, Elizabeth Warren and Rand Paul, and AOC [Alexandria Ocasio-Cortez]… that we couldn’t defend the nation unless they all agree? That would be impossible.”

HOUSE PASSES WAR POWERS RESOLUTION IN REBUKE OF TRUMP’S ACTIONS AGAINST IRAN

The House of Representatives voted in favor of the War Powers Resolution, also known as the War Powers Act, on Thursday, in an attempt to limit President Trump’s military action toward Iran.

The resolution passed, 224-194, mostly along party lines, but both parties had some defectors: eight Democrats voted against the measure and three Republicans voted in favor of it. Independent Rep. Justin Amash, who left the Republican Party last year, also voted in favor of the measure.

Graham on Saturday also criticized Paul and Lee for opposing the drone strike that killed the Iranian earlier this month and said they are out of their depth on the issue.

“I like them both and if I had an eye problem I would call Rand Paul. He’s a great eye doctor but I would not ask him for commander in chief advice,” he said. “Mike Lee’s a great guy. But all I can tell you is that they’re so wrong. Their foreign policy is more like Bernie Sanders — less like Ronald Reagan, less like Donald Trump.”

“A commander in chief can use force to protect the nation, without 535 people signing on to it,” Graham added. “I said this when [Barack] Obama was president. I said it when [Bill] Clinton was president. If you don’t like what the commander in chief is doing, as a member of Congress, cut off funding. We have the power of the purse but we cannot make military decisions.”

Sen. Rand Paul, R-Ky., accused Sen. Lindsey Graham, R-S.C., of cloaking himself in a fake “drape of patriotism” Wednesday after Graham alleged that Paul and Sen. Mike Lee, R-Utah., “were empowering the enemy” by trying to limit President Trump’s ability to further escalate tensions with Iran.

Paul and Lee both announced after a closed-door meeting with Trump administration officials that they would support the “War Powers Resolution” introduced by Sen. Tim Kaine, a Virginia Democrati and member of the Senate Foreign Relations and Armed Services committees who also served as Hillary Clinton’s running mate in 2016.

The resolution seeks to limit Trump’s power to further escalate tensions with Iran, without first obtaining congressional approval, after Trump ordered the U.S. airstrike that killed top Iranian Quds Force Gen. Qassem Soleimani last week in Baghdad.

“They’re libertarians. I think they’re overreacting, quite frankly,” Graham told reporters of Paul and Lee after their news conference. “Go debate all you want to. I’m going to debate you. Trust me, I’m going to let people know that at this moment in time to play this game with the War Powers Act … whether you mean to or not, you’re empowering the enemy.”

Later, Paul called Graham’s remarks a “gutter type of response” and recommended that Graham re-read what the Constitution says regarding war powers divided between the commander-in-chief and the Legislative Branch, in an interview on CNN.

“I think it’s sad when people have this fake sort of drape of patriotism and anybody that disagrees with them is not a patriot,” Paul told CNN’s Wolf Blitzer. “I love my country. I have many family members that serve in the military and continue to serve. I love my country as much as the next guy.

“For him to insult and say we’re not as patriotic as he is — he hasn’t read the Constitution … he insults the Constitution, our Founding Fathers, and what we do stand for in this republic by making light of it and accusing people of lacking patriotism. I think that’s a low, gutter type of response.”

Paul also responded to remarks made by Lee who claimed in their joint news conference that defense and intelligence officials told GOP members of Congress to be “good little boys and girls” when it comes to Trump’s foreign policy decisions with Iran.

“To me, this is much bigger than the Trump administration,” Paul continued. “This question we have about who has the war-making power, this goes back to Truman in 1950. We fought war after war, the Korean War, the Vietnam war, without having them authorized by Congress.

“It’s been a tug-of-war. Many people have written that Congress and senators have abdicated their role in declaring war. That’s true. What Senator Lee and I are doing is standing up and saying the power resides in Congress and we’re going to fight for it.”

Defense Secretary Mark Esper, Secretary of State Mike Pompeo, CIA Director Gina Haspel and Joint Chiefs of Staff Chairman Gen. Mark Milley briefed members of both the House and Senate in a closed-door meeting Wednesday after days of heightened tensions with Iran stemming from the U.S. drone strike that killed Soleimani and other Iranian officials at Baghdad International Airport last week.

Then early Wednesday, Iran fired more than a dozen ballistic missiles at two bases in Iraq housing U.S. service members in a failed retaliatory attack thwarted by the U.S. military’s Early Warning Systems.

“They had to leave after 75 minutes, while they’re in the process of telling us that we need to be good little boys and girls and run along and not debate this in public. I find that absolutely insane. I think it’s unacceptable,” Lee said in a news conference after the meeting.

“I went in there hoping to get more specifics as far as the factual, legal, moral obligation for what they did,” Lee continued. “I’m still undecided on that issue because in part they never got to the details. Every time they got close they’d say ‘well, we can’t discuss that here because it’s really sensitive. … We’re in a secure underground bunker where all electronic devices have to be checked at the door, and they still refuse to tell us. I find that really upsetting.”

Sen. Lindsey Graham, R-S.C., told Fox News in an interview Wednesday that the Senate will take up President Trump’s impeachment trial next week shortly after he crafted a resolution that called on House Speaker Nancy Pelosi to deliver the articles of impeachment to the Senate.

Graham, the Republican chairman of the Senate Judiciary Committee, told Sean Hannity that Pelosi’s “dam is about to crack,” and cited recent reports that show emerging fissures in her own party. Several Democratic senators have publically called on the articles to be delivered.

“You said it was urgent,” Graham said. “If you believe it to be urgent, send it to the Senate for disposition.”

Sen. Dianne Feinstein of California is one Democrat apparently growing impatient.

“The longer it goes on the less urgent it becomes,” she said. “So if it’s serious and urgent, send them over. If it isn’t, don’t send it over.”

Graham said he plans to introduce the resolution Thursday. In it, he writes that Pelosi lacks “the power to effectively veto a resolution passed by a duly elected majority of the House of Representatives by refusing to transmit such a resolution to the Senate.” Graham argued that hanging onto the articles “is a flagrant violation of the separation of powers expressly outlined in the bicameral impeachment process under the Constitution of the United States.”

The House impeached Trump last month on charges that he abused the power of his office by pressuring Ukraine’s president to investigate Democrats, using as leverage $400 million in military assistance for U.S. ally as it counters Russia at its border. The funding for Ukraine was eventually released but only after Congress intervened.

Trump was also charged witn obstruction of Congress. The Senate trial will determine if the president is guilty and should be removed from office — but the GOP majority in the Senate makes that outcome unlikely.

Pelosi has voiced her concerns that Senate Majority Leader Mitch McConnell was coordinating with the White House to tilt the playing field.

Democrats sought assurances that the Senate would call certain witnesses, but McConnell made no such promise and said Tuesday that he has the votes needed to start the impeachment trial without an agreement.

“Hats off to Mitch McConnell for playing this very well,” Graham said on “Hannity.” “We’ll take the trial up next week.”

The question for the Trump administration is how far the United States wants to take the escalating conflict with the Iranian regime, “Fox News Sunday” host Chris Wallace said Friday.

Appearing on “America’s Newsroom” with host Sandra Smith, Wallace said that while nobody would “shed a tear” about the death of Iranian General Qassem Soleimani — the Ayatollah’s righthand man — what comes next “concerns some people.”

Wallace told Smith that both President Barack Obama and President George W. Bush had the options, at various points, to “take out” Soleimani and that “they decided — as much as they hated him — not to do so because they were worried how the Iranians would respond to that.

“And, that’s the concern,” Wallace explained. “They talked about harsh retaliation: what form will that take?”

“Will there be military strikes? Will there be terror attacks? Iran has a very sophisticated cyber capability. Could there be cyber-attacks on the U.S. homeland?” he continued further.

“So, if this is the kind of strike that finally gets Tehran’s attention, and they pulled back, well then that’s a great masterstroke for the U.S. On the other hand, if they simply escalate — respond to our escalation with another one of their own — then people are going to have to decide how far we want to take this.”

Officials told Fox News on Friday that 3,000 more U.S. troops would be deploying to the Middle East in the wake of Iranian President Hassan Rouhani’s threat to respond to the airstrike with “harsh retaliation.”

The 82nd Airborne Division’s brigade — put on alert Friday — will be deploying to Kuwait and a battalion of some 750 paratroops were deployed this week.

Meanwhile, members of Congress remain divided on the issue — with Republicans cheering the airstrike and Democrats rebuking the president’s actions, saying they were unauthorized.

“All steps must now be taken to protect our forces against the almost inevitable escalation and increased risk,” Rep. Adam Schiff. D-Calif., tweeted Thursday.

Republican South Carolina Sen. Lindsey Graham said on “Fox & Friends” Friday that the attack was justified.

“This was a pre-emptive attack to let everyone know from North Korea, just anyone else, that if you come after Americans on President Trump’s watch — you do so at your peril,” Graham said.

But, at least one Republican, Sen. Rand Paul, R-Ky., sympathized with some of the concerns expressed by Democrats.

“If we are to go to war w/ Iran the Constitution dictates that we declare war. A war without a Congressional declaration is a recipe for feckless intermittent eruptions of violence w/ no clear mission for our soldiers,” he wrote. “Our young men and women in the armed services deserve better.”

Senate Judiciary Committee Chairman Lindsey Graham, R-S.C., said the impeachment of President Trump is proof that a left-wing “mob” has taken over the House of Representatives.

Graham told “Hannity” that House Speaker Nancy Pelosi, D-Calif., claimed earlier this year that impeachment should be thoughtful and “bipartisan.”

“What happened between March and now?” he asked. “What happened [is] the mob took over the House. The mob is running the Democratic Party. If she did not move to impeach this president, she would not be Speaker.”

Graham told host Sean Hannity that Pelosi effectively chose to preserve her position over the good of the country and added that he hopes Democrats will pay electorally next year.

He said Democrats are intent on destroying President Trump and his administration but predicted that the hurried, partisan impeachment proceedings will all but ensure his reelection.

“[T]he political consequences to this will be felt in the next election,” he said. “Play this tape on election night [2020]. I will make a prediction here: the impeachment of this president by Nancy Pelosi, [Adam] Schiff, and [Jerry] Nadler will do as much to get Donald Trump reelected as that [Trump’s] litany of accomplishments.”

During the interview, Hannity asked how the South Carolina lawmaker believed moderate Republican senators will vote during the impeachment trial.

He mentioned Sen. Mitt Romney, R-Utah — an occasional foil of the president — as well as centrists Susan Collins of Maine and Lisa Murkowski of Alaska.

Graham said he predicts those Republicans, along with many others, will see the House proceedings as illegitimate and erroneous

“I think Republicans are going to be very reluctant to legitimize what the House did,” he said, “because if you care about the presidency as an institution, what they did in the House is really a threat to the presidency.”
