Retired Army captain: Eddie Gallagher’s trial is a ‘disgrace,’ ‘clearly, he did not murder anyone’

The trial of Navy SEAL Edward Gallagher — who is accused of killing an injured ISIS prisoner of war in Iraq – is a “disgrace,” according to a fellow service member.

Speaking Thursday after a medic stunningly claimed he killed the combatant by suffocating him, retired U.S. Army Capt. Tyler Merritt told Sandra Smith on “The Story” the testimony proves Gallagher’s innocent.

“Blatantly – clearly, he did not murder anyone,” he said. “If there is another individual who said they asphyxiated a wounded combatant, then it’s kind of hard for Eddie to be guilty of murder.”

MEDIC TESTIFIES THAT HE, NOT NAVY SEAL EDDIE GALLAGHER, WAS RESPONSIBLE FOR ISIS FIGHTER’S DEATH

Merritt was alluding to testimony from Special Operator 1st Class Corey Scott, who revealed during cross-examination he killed the ISIS fighter.

“Why did you kill him?” Gallagher attorney Timothy Parlatore asked Scott during the trial Thursday in San Diego.

“Because I knew he was going to die anyway,” Scott answered. “I wanted to save him from what was going to happen next to him.”

Merritt – who served with Gallagher – slammed the charges against the officer.

“You are asking Navy SEALs to go to foreign countries and do bad things to bad people and this is a bad person … that is a military-aged male,” he told Smith.

“Regardless of all of that, Eddie did not murder this individual. He is an honorable man and what’s happened here is an absolute travesty.”

Gallagher, 40, has pleaded not guilty to premeditated murder and aggravated assault charges stemming from the alleged killing and alleged instances of firing sniper rounds at civilians in Iraq.

Fox News’ Greg Norman and Dan Gallo contributed to this report.

Marc Thiessen: ‘Appalled’ to see people blaming Trump for Iran situation

While many on the left are blaming President Trump for the escalating tension between the U.S. and Iran, Marc Thiessen believes the president is deescalating the situation.

Thiessen made the assessment during an appearance on “The Story” on Thursday night and added he was “appalled” over the accusations that president was responsible for the situation.

“I think the president is deescalating it if you look at what he said. He said that it could have been a mistake and could have been somebody who was not coming from the top. And so he’s taking a very, very measured approach to this,” Thiessen said.

Iran blasted a Navy high-altitude drone out of the sky over the Strait of Hormuz, with U.S. Central Command leaders on Thursday slamming the “unprovoked” strike and Tehran’s subsequent “false” justifications for it.

Thiessen blasted Trump’s critics for blaming Trump for the actions of Iran.

“But what I’m really appalled by quite frankly Sandra is all the people in Washington who are spending so much time trying to blame Donald Trump for this escalation of tensions,” Thiessen said.

SITUATION ROOM BRIEFING ON IRAN CRISIS CONCLUDES, AS MCCONNELL SAYS ‘MEASURED’ RESPONSE IS COMING

Thiessen also went after Democratic presidential frontrunner Joe Biden who he said should “look into a mirror,” saying the Obama administration’s nuclear deal with Iran is responsible for Iran’s actions.

“You had Joe Biden go out today and say that this is a completely self-inflicted wound. I mean Donald Trump didn’t put a mine on a on a Japanese oil tanker. Donald Trump didn’t shoot down a U.S. drone. Iran did those things. And the fact is the reason why Donald Trump has had to impose these sanctions is because of the Obama administration’s nuclear deal.”

The former speechwriter for President George W. Bush lauded Trump’s dealing s with Iran over the past two years.

“They have never been more irresponsible and they had been in the last two years until Trump came in and cut off their funding,” Thiessen said.

10-year-old girl is youngest to climb El Capitan: ‘I did it to have fun’

The 10-year-old girl who just became the youngest person to conquer one of the world’s most challenging mountain climbs said Thursday, “I did it to have fun.”

Selah Schneiter of Colorado appeared on “Shepard Smith Reporting” on Thursday to talk about her climb on the “Nose Route” of El Capitan in Yosemite National Park. She made the bold ascent over five days in early June.

10-YEAR-OLD GIRL BECOMES YOUNGEST PERSON TO CLIMB EL CAPITAN

“I feel like everybody is thinking it’s really crazy that I did it because I’m the youngest person, but I did it to have fun,” she told Smith.

El Capitan, a vertical rock formation in California’s Sierra Nevada mountains, is about 3,000 feet from base to summit along its tallest face.

For perspective, imagine climbing something twice the height of the World Trade Center. Rock climbers consider it one for their ultimate challenges.

Selah made it to the top with the help of her father, a climbing guide and a family friend.

Her mother, Joy, who also appeared on “Shepard Smith Reporting,” said her daughter “practiced a ton.” Still she had some worries, given that Selah weighs a bit less than 60 pounds.

Her parents are both rock climbers, though, and they said she has been climbing since she was a baby.

Smith reported that Selah considers herself “just a normal girl.”

How does she feel about her achievement? “Exciting and really overwhelming.”

She added that reaching the top “was really emotional.”

“It was really something that I have been thinking about for a long time,” she added.

Said Joy: “She’s a precocious little kid.”

So precocious, in fact, that she told Smith she’s already contemplating her next climb.

AOC’s ‘concentration camps’ rhetoric is ‘demoralizing’ agents, acting ICE chief says

Recent remarks by U.S. Rep. Alexandria Ocasio-Cortez, D-N.Y., comparing U.S. detention facilities for migrants to “concentration camps” are hurting the agents who care for the children at the border, the acting ICE director claimed.

Agents for U.S. Immigration and Customs Enforcement often donate from their own homes to provide food, toys and other comforts to the children of illegal immigrants and asylum seekers being held at the border, Mark Morgan told host Laura Ingraham on Fox News’ “The Ingraham Angle” on Wednesday night.

LESLIE MARSHALL: AOC AND TRUMP SHOULD BOTH TONE DOWN FIERY IMMIGRATION RHETORIC

“The hardworking men and women of the Border Patrol and ICE are working every day to safeguard this country,” he said. “And, what is this kind of rhetoric doing? It’s demoralizing them.”

Morgan, who also served in the Obama administration, said he has observed agents taking time to engage with the children and make them feel comfortable.

“I was there 2014, 2016, and I’m here now,” he said. “I’ve watched it, I’ve been there, as well.

“I saw Border Patrol agents — they care for these kids as if they were their own, bringing in soccer balls to play soccer with them — and this kind of rhetoric, it is irresponsible, reckless, and it’s flat-out wrong.”

“We want to get the kids out of those facilities because we are overcrowded and get them to better conditions. We’ve been asking for $4.5 million to make that happen. If Congress wants to fix this, pass that [legislative] supplement.”

On Monday, Ocasio-Cortez — whose district includes parts of the Bronx and Queens in New York City — told her Instagram followers the U.S. government is “running concentration camps on our southern border.”

“That is exactly what they are. They are concentration camps,” Ocasio-Cortez said during a live-stream that was viewed by Fox News.

Fox News’ Sean Hannity unloaded on the mainstream media Wednesday night for their coverage of President Trump’s Florida campaign rally warning them that they are underestimating the concerns of the president’s supporters.

“The Americans who showed up last night in flip-flops and cargo shorts, they will be the people who choose the next president, they are the ones who were right in 2016 and all of you were wrong,” Hannity said.

He was reacting to a montage of media clips from CNN and MSNBC that showed hosts and their guests mocking those who attended the Orlando rally.

Hannity accused the media of ignoring the impact of the Obama administration’s policies and noted that the president’s supporters did not “buy into” the Russia investigation.

“The forgotten men and women in this country, the one that suffered the most under Biden-Obama, the people who make this country great every day. They didn’t buy into your lies, your conspiracy theories,” Hannity said.

Hannity also blasted CNN’s Don Lemon for comparing Trump and Adolf Hitler Tuesday night while arguing that such “bad people” shouldn’t be given a platform.

“You let your ‘journalist’ Don Lemon say this on your network last night? You should be ashamed of yourself,” Hannity told CNN boss Jeff Zucker.

The Fox News’ host accused CNN of being unable to take the criticism responding to Lemon’s comments.

“What really happened was this. When the president was 6 minutes into the speech last night, said all of those fake news people in the back and the crowd started… telling the truth about fake news CNN, that CNN sucks, CNN couldn’t take the criticism and they turned it off,” Hannity said.

Alan Dershowitz: Trump ‘perfectly entitled to invoke executive privilege’

Westlake Legal Group Ingraham-Dershowitz_FOX Alan Dershowitz: Trump 'perfectly entitled to invoke executive privilege' fox-news/topic/fox-news-flash fox-news/shows/ingraham-angle fox-news/politics/house-of-representatives/democrats fox-news/politics/executive/white-house fox-news/politics/executive fox-news/person/donald-trump fox-news/entertainment/media fox news fnc/politics fnc Charles Creitz article 588dd48d-17b9-513a-b8a6-8a9f957819c4

President Trump is within his rights to invoke executive privilege, including when it comes to former White House communications director Hope Hicks, according to Alan Dershowitz.

Congressional lawmakers often claim presidents are not “above the law” in many of these cases, but Congress itself is also not “above the law,” Dershowitz told host Laura Ingraham on Fox News’ “The Ingraham Angle.”

“Each branch of the government has a form of executive privilege,” Dershowitz said Wednesday night. “The president is perfectly entitled to invoke executive privilege. If they think it goes too far … let the courts decide.

“The president is perfectly entitled to invoke executive privilege. If they think it goes too far … let the courts decide.”

— Alan Dershowitz

HOPE HICKS QUESTIONED BEHIND CLOSED DOORS ON CAPITOL HILL, AS POLS BICKER OVER INTERVIEW

“As far as the current issue is concerned, all three branches of government have privilege,” he continued. “You can’t call a law clerk at the Supreme Court and ask the law clerk, ‘What did you discuss with the justice?’ Imagine if they tried to call legislative assistants of senators or congressmen, the same congressmen who are demanding that [Hicks] speak would be up in arms.”

Dershowitz claimed there is a risk of weakening privilege power throughout the three branches of government in cases where such powers are challenged.

“The danger is you can diminish executive privilege and legislative privilege and judicial privilege, not only for this administration but for future administrations,” he said.

“That would have a big structural impact on government and on civil liberties.”

Hicks was questioned behind closed doors Wednesday by members of the House Judiciary Committee as part of the panel’s review of obstruction allegations and Special Counsel Robert Mueller‘s report on the Russia investigation.

Some Democrats complained that Hicks – who is now the chief communications officer at Fox Corp. – was ordered by the White House to stay quiet about her time as an aide to Trump.

“She’s objecting to stuff that’s already in the public record,” Rep. Karen Bass, D-Calif., said. “It’s pretty ridiculous.”

Earlier Wednesday, House Judiciary Committee Chairman Jerrold Nadler, D-N.Y., declined to comment on the substance of the interview: “All I’ll say is Ms. Hicks is answering questions put to her and the interview continues.”

CLICK HERE TO GET THE FOX NEWS APP

In a letter Tuesday to Nadler, White House Counsel Pat Cipollone wrote that Trump had directed Hicks not to answer questions “relating to the time of her service as a senior adviser to the president.”

Cipollone said Hicks was “absolutely immune” from compelled testimony with respect to her service to the president because of the separation of powers between the executive and legislative branches. The White House similarly has cited broad executive privilege with respect to many of the Democrats’ investigative demands, using the president’s power to withhold information to protect the confidentiality of the Oval Office decision-making process.

Fox News’ Andrew O’Reilly contributed to this report.

Fox News’ Jesse Watters criticized a critic of Parkland shooting survivor Kyle Kashuv who compared the student to the very shooter who killed his classmates. But he defended Harvard’s choice to drop Kashuv, saying the young man must “face the consequences.”

“You don’t kick a kid like that when he’s down. He is an adult and it’s irresponsible for him to smear him that way,” Watters said Wednesday on “The Story with Martha MacCallum” calling MSNBC contributor David Jolly “a joke.”

Jolly on Tuesday said that social media messages written by Kashuv sounded like ones of a mass shooter, while the teen “deserves a closer look” as to whether the pro-Second Amendment advocate should be able to purchase a firearm.

Kashuv said Monday on Twitter that Harvard rescinded his admission after the recent resurfacing of racist and offensive remarks he described as “offensive,” “idiotic” and “inflammatory.”

The student said he made the comments before the mass shooting — which he says made him a different person, and he apologized Monday in an interview with Fox News’ Ed Henry.

Watters backed Harvard’s choice not to admit the teen, and said accepting Kashuv does “no good” for the university.

President Trump offers a challenge to the media because the collective political bent of his platforms is “right down the middle,” according to Greg Gutfeld.

Trump’s penchant for drawing crowds was on display Tuesday at his Orlando re-election campaign kickoff, Gutfeld added Wednesday on “The Five.”

“The Democrats have a big challenge here because there are so many of them. He just makes them seem so small by his outsized personality,” he said.

HILLARY CLINTON AGAIN TAKES AIM AT TRUMP AFTER PRESIDENT’S 2020 CAMPAIGN LAUNCH

“The unspoken truth when you go through the achievements – I wish the media would understand – is that Trump is a centrist.”

The “Greg Gutfeld Show” host listed several of Trump’s platforms, claiming they don’t add up to anything right-wing or simplistic.

“Strong military – center right. Prison reform – center left. Cut taxes – center right. Trade wars – center left. Rejection of military actions – Libertarian. Pro-free speech – Libertarian. ‘Don’t burn the flag’ – center right.”

“Conclusion: He is right down the middle,” Gutfeld claimed. “That confounds the media because they don’t know how to handle that – he is exactly what America wants.”

Gutfeld criticized MSNBC host Joe Scarborough and others who he claimed are “reacting emotionally” when critiquing Trump and his campaign event.

Fox News contributor Katie Pavlich pointed out Wednesday that President Trump’s re-election campaign is far different in terms of organization than his first presidential campaign.

Trump’s campaign operation raised a whopping $24.8 million in less than 24 hours amid his 2020 re-election launch in Florida on Tuesday — a figure that blows past what any of the Democratic candidates raised in the entire first quarter.

Republican National Committee Chairwoman Ronna McDaniel tweeted early Wednesday about the fundraising haul, with President Trump tweeting  “THANK YOU!” in response.

Going into Trump’s rally on Tuesday, the re-election campaign had $40.8 million in cash-on-hand at the start of second-quarter fundraising on April 1. Combined with the RNC’s joint fundraising committees, they have a combined $82 million cash-on-hand for the second quarter.

Responding on “Outnumbered,” Pavlich noted the enthusiasm in Florida for Trump’s election kick-off event, with 100,000 people requesting tickets to attend.

“This is different this time in terms of the apparatus the president has for his campaign,” she said, adding the campaign and the RNC have held 250 events to train more than 400,000 volunteers.

Democrat Capri Cafaro agreed that the “ground game is important” and Trump will enjoy the “value of incumbency.”

“Donald Trump does have some things he can point to as victories and as accomplishments. He’s not just candidate Trump, he’s President Trump,” said Cafaro.

However, a new Fox News Poll suggests a cause for concern for the president’s re-election chances.

The poll found former Vice President Joe Biden holding a sizable lead on the Democratic field, with a 10-point lead on Trump in a hypothetical head-to-head matchup.

Family and friends of woman who died in Dominican Republic claim authorities are lying about past ‘several heart attacks’

Relatives and the former supervisor of a New York woman who died suddenly on June 10 at a luxury resort in Punta Cana are disputing the Dominican Republic Minister of Public Health’s claim that she had several past heart attacks.

On Monday, Public Health Minister Rafael Sanchez Cardenas said at a press conference that Leyla Cox, a New York hospital MRI technician who died suddenly on June 10 in her room at the Excellence resort, had an enlarged heart, high blood pressure and that she had suffered “several past heart attacks.”

But on Wednesday, her supervisor where she worked at the Richmond University Medical Center in Staten Island said that in the roughly 10 years she knew Cox, who was 53, she had not had a heart attack or had any serious medical conditions.

“She seemed to be in good health, she had medical tests here and all were good,” said Kathy Giovinazzo, the assistant vice president of clinical services at the hospital, in an interview with Fox News. “In all the years I knew her, I never knew her to have a heart attack.”

Dominican authorities have told the family that Cox died of a heart attack, but the family has expressed skepticism, saying that she had been healthy and had shown no signs of illness leading up to her trip to the island to celebrate her 53rd birthday. Prompted by doubts, her son, William Cox, successfully fought to get Dominican authorities to send a vial of her blood to the U.S. for toxicological testing.

Cox’s son accuses Dominican authorities of lying to avoid accountability.

“In the 25 years I’ve been alive, my mother did not have a heart attack,” he said, adding that others in the family said the Sanchez Cardenas characterization of Leyla Cox’s health were untrue.

“They’re lying,” Cox said. “It’s been like this from the beginning since she died. They give misinformation. They’re trying to cover up.”

The spokesman for the Ministry of Public Health told Fox News on Wednesday that Sanchez Cardenas was “stating facts that came directly from forensic and pathological tests.”

“Those tests tell you a person’s cause of death and any past medical conditions,” said Carlos Suero, the spokesman. “People come to the Dominican Republic with medical conditions and if they die here, they want to blame it on the Dominican Republic.”

Leyla Cox’s death was one of a rash of deaths of U.S. tourists in the Dominican Republic since last year that have been made public by their loved ones. The relatives of most of the nine U.S. tourists — whose deaths occurred under seemingly similar circumstances –have raised doubts about the accounts they’ve been given by Dominican authorities.

DOMINICAN REPUBLIC RESORT DEATHS MYSTERY: TIMELINE

Several are planning to conduct their own tests in the United States. Since Dominican authorities have declared nearly all the deaths to have occurred because of natural causes, they have declined to conduct toxicological tests, leading to complaints from the relatives.

“Once a death is declared to be from natural causes, they have a different process,” Cox said. “They can just declare any death to be of natural causes because then they’re not held accountable.”

On Tuesday afternoon, the Dominican attorney general approved Will Cox’s request that a blood sample from his mother be sent to the U.S. for toxicological tests. The hospital where she worked agreed to conduct the tests at no charge to her family.

Cox had wanted toxicological tests to be done in the Dominican Republic but was told that the machines were not working. He is trying to get her ashes sent to the U.S.

Cox said it has been nothing short of an ordeal to extract information from the resort and Dominican authorities about the details of his mother’s death. He said that while a U.S. embassy staff member was in touch with him every day, and was helpful in some instances, in others he gave incomplete or erroneous information.

Speaking on “America’s Newsroom” Wednesday, Cox credited an official at the U.S. Embassy for helping him obtain blood and urine samples for a separate toxicology report in the United States. He said he initially received an incomplete police report, while the resort’s first statement on his mother’s death was incorrect.

“I felt like I was pushed up against the wall and didn’t have any options and they almost forced me to cremate the body within 24 hours,” said Cox, expressing fear that he’ll never get a clear answer on how his mother died.
