Charges against Massachusetts judge shows ‘immigration laws aren’t optional:’ ICE agent

A former ICE special agent told Fox News that he hopes the case of the Massachusetts judge accused of helping an illegal immigrant flee federal authorities will “send a message to other activist judges that immigration laws aren’t optional.”

Jim Hayes made the comments Friday on ‘Fox & Friends’ a day after Newton District Court Judge Shelley M. Richmond Joseph and court officer Wesley MacGregor were indicted by a federal grand jury for obstruction of justice and three other counts. The pair allegedly helped Jose Medina-Perez get out of the Massachusetts courthouse in 2018 through a back door in order to elude the ICE agent who sought him.

“I think that the judge certainly faces the criminal charges that are pending. I think certainly that bar card is up for grabs at this point, depending on the outcome of that case,” Hayes told ‘Fox & Friends’.

“I think that, hopefully, these charges will send a message to other activist judges that immigration laws aren’t optional,” he added.

Medina-Perez, a twice-deported illegal immigrant with a fugitive warrant for drunken driving in Pennsylvania, had been in Joseph’s courtroom in order to be arraigned on drug charges, the Boston Globe previously reported.

Joseph, who has been suspended without pay, and MacGregor appeared in court Thursday and pleaded not guilty to all counts. No date has been set for their next court appearance.

“People who serve in the criminal justice system have to have honesty and integrity in order for the system to work and for our system and our justice system to continue,” Hayes said.

Fox News correspondent Geraldo Rivera has warned that if Democratic 2020 presidential candidates don’t take the crisis at the border seriously, they’ll do so at their own risk.

Speaking with “Fox & Friends” hosts on Friday morning, Rivera discussed the influx of candidates entering the race, including former Vice President Joe Biden, and gave an update on the newest developments at the border.

“If [Democrats] don’t take it seriously they ignore it at their peril,” Rivera said.

He went on to discuss the fact that Mexico is experiencing the same problems dealing with volumes of people at the border as the United States is. Processing facilities, as many have argued, are understaffed and underresourced, resulting in conditions that have been controversial.

“It is very, very difficult when hundreds and hundreds become thousands and thousands ultimately become tens of it is very difficult to have an orderly system,” he said.

Rivera asserted his opinion that the United States could lessen the influx of migrants coming into the country by investing in the development of Central American countries, where many are fleeing from violence and economic instability.

“I believe, as I have said before on this program, that we have to stop the source of the migrant explosion, by a comprehensive system of political and economic reform in Central America where people have the incentive to stay home,” Rivera said.

“I think we have help Mexico with its infrastructure. Mexico has a moral burden, as the president made very clear, not to let unchecked herds of desperate people flow through 2,000 miles of Mexican territory to get our southern border.”

Rivera also brought up President Trump’s controversial comments about Mexican immigrants during his campaign in 2016.

The Fox News correspondent said that having been so excited about Trump’s campaign, the comments made him feel “deflated” as a Hispanic American.

However, as the crisis at the border has accelerated over the last few years, Rivera argued that ultimately, the president’s comments weren’t incorrect.

“He is now in a position where he can justly say I was right, that the that the anarchy at the border doesn’t serve anybody,” Rivera said. “Maybe he said it in a language I felt was a little rough and insensitive, but there is no doubt.”

“Outdated laws” need fixing to deal with the surge in illegal immigrant families crossing the U.S. border with Mexico, a top Border Patrol official said Friday.

Migrant families face no consequences if apprehended trying to cross the border illegally under present law, Border Patrol chief of Operations Brian Hastings claimed during an appearance on “Fox & Friends.”

“We need a change in the current outdated laws that we’re dealing with for this current demographic and this crisis that we have,” he said.

Hastings said as of Thursday there have been 440,000 apprehensions along the southwest border. There were 396,000 apprehensions all of last year.

SOUTHERN BORDER AT ‘BREAKING POINT’ AFTER MORE THAN 76,000 ILLEGAL IMMIGRANTS TRIED CROSSING IN FEBRUARY, OFFICIALS SAY

And those numbers continue to rise, he said.

Historically 70 to 90 percent of apprehensions at the border were quickly returned to Mexico, Hastings said.

Now, 83 percent of those apprehended have come from the Central American northern triangle which includes Guatemala, El Salvador, and Honduras, and of those 63 percent are “family units” and children who cannot be returned, he said.

“There are no consequences that we can apply to this group currently,” Hastings said. “We’re overwhelmed. If you look at agents there doing a tremendous job trying to deal with the flow.”

The law dictates children have to be released after 20 days of detention.

Sen. Lindsey Graham, R-S.C., says that has forced immigration officials to release entire families because “you don’t want to separate families.”

Recently, he said he is drafting legislation that would allow children to be detained for more than 20 days.

Hastings said agents are frustrated with the situation but are doing the best they can with the resources they have.

“Up to 40 percent of our agents are processing at any given time,” he said. “That should say that in and of itself is pulling from those border security resources.”

Conservative columnist Mark Steyn on Thursday outlined the difference between Democratic presidential frontrunners Joe Biden and Bernie Sanders, saying that Biden is being forced to run a “dishonest” race while Sanders has been ‘romanticized’ by the “new” Democratic Party.

“I don’t think it’s his skin color or his age,” Steyn said of Biden on Fox News’ “Tucker Carlson Tonight,” “because as much as I enjoy hearing all these people beat up on a 76-year-old white man, his principal rival in the Democratic primary is a 77-year-old white man.

JOE BIDEN OFFICIALLY LAUNCHES 2020 PRESIDENTIAL BID

“And the difference between them,” Steyn told host Tucker Carlson, “I think is that Bernie is a romance for his supporters. He is a romantic figure, a romantic, insane figure, but he is a romantic.”

Biden formally announced his candidacy with a video posted Thursday morning.

“The core values of this nation, our standing in the world, our very democracy, everything that has made America — America — is at stake. That’s why today I’m announcing my candidacy for president of the United States,” Biden added in a Twitter message.

Steyn said Biden has been “disowned” by his own party and seems like he’s now trying to be someone other than the politician he has been his entire career.

“Biden is tired and in the awful position of being unable to run as himself, because the Democrats have basically disowned 90 percent of what Joe Biden has been doing in Washington the last 45 years,” Steyn said.

“So that’s a terrible problem for a guy, when you have to run in an essentially dishonest way, which is why he gave this a tortured and weird rationale as to why he has decided to get into the race in this video.

“Bernie has it way easier,” Steyn added. “Bernie just gets to be Bernie, and Biden is trying to be something other than Biden.”

President Trump in a phone interview on “Hannity” Thursday talked about a handful of Democratic contenders for the 2020 presidential election, disparaging some of them including former Vice President Joe Biden.

“I think we are calling him ‘Sleepy Joe’ ’cause I’ve known him for a while. Is he a pretty sleepy guy. He won’t be able to deal with [Chinese] President Xi, I will tell you. That’s a different level of energy and, frankly, intelligence. So I sort refer to him as ‘Sleepy Joe.’ A lot of people wanted me to change the word ‘sleepy’ to something else that rhymes with it,” Trump told host Sean Hannity. “I thought it was too nasty.

“He’s not going to able to do the job,” Trump added.

Biden officially announced his candidacy in a video Thursday morning, going directly after Trump.

“If we give Donald Trump eight years in the White House, he will forever and fundamentally alter the character of this nation, who we are, and I cannot stand by and watch that happen,” Biden says in the video.

When asked about frontrunner Sen. Bernie Sanders, I-Vt., Trump criticized his record, said Sanders had “misguided energy” and asserting that Sanders “talks a lot” but hasn’t accomplished anything.

The president didn’t seem to think too much of the rest of the field, referring to former U.S. Rep. Beto O’Rourke of Texas as “a fluke” and mentioning the lack of attention the former media darling has received recently.

“He is fading very fast, he is fading very, very fast. It looks like he will be a thing of the past very soon. He was a hot item,” Trump said.

Trump outright dismissed Sen. Kamala Harris, D-Calif., and South Bend, Ind., Mayor Pete Buttigieg, although he said he was “rooting” for Buttigieg.

“I don’t see either of them. I think she has got a little bit of a nasty wit but that might be it. And mayor Pete is not going to make it. I would hope he would. I’m rooting for him but he is not going to make it,” Trump said.

President Trump told Fox News’ “Hannity” in a wide-ranging interview Thursday night that Attorney General Bill Barr is handling the “incredible” new revelations that Ukrainian actors apparently leaked damaging information about then-campaign chairman Paul Manafort to help Hillary Clinton‘s campaign.

Last month, Ukraine Prosecutor General Yurii Lutsenko opened a probe into the so-called black ledger files that led to Manafort’s departure from the Trump campaign, after an unearthed audio recording apparently revealed that a senior Ukrainian anticorruption official admitted to disclosing Manafort’s information to benefit Clinton.

Asked by host Sean Hannity whether Americans need to see the results of Ukraine’s ongoing investigation into whether officials in that country worked with the Clinton team, Trump replied: “I think they do.”

With that remark, Trump echoed his personal attorney Rudy Giuliani, who wrote on Twitter on Wednesday: “Keep your eye on Ukraine.”

Separately, a 2017 investigation by Politico found that Ukrainian officials not only publicly sought to undermine Trump by questioning his fitness for office, but also worked behind the scenes to secure a Clinton victory.

Among other initiatives, Politico found, the Ukrainian government worked with a DNC consultant to conduct opposition research against Trump, including going after former Trump campaign chairman Paul Manafort for Russian ties, helping lead to his resignation.

FOX NEWS EXCLUSIVE: INTERNAL FBI TEXTS MESSAGES SUGGEST FBI WANTED TO MONITOR TRUMP TEAM DURING INTEL BRIEFINGS

“I defer to the attorney general, and we’ll see what he says about it,” Trump told Hannity.

Trump also unloaded on former FBI officials Peter Strzok and Lisa Page, following a Fox News report earlier in the day concerning newly revealed internal text messages between the two.

The messages indicated they discussed using briefings to the Trump team after the 2016 election to identify people they could “develop for potential relationships,” track lines of questioning and “assess” changes in “demeanor” – language one GOP lawmaker called “more evidence” of irregular conduct in the original Russia probe.

“They were trying to infiltrate the administration,” Trump told host Sean Hannity. “Really, it’s a coup. It’s spying. It’s hard to believe in this country we would have had that.”

Trump called the news “very disconcerting” and emphasized that Strzok and Page used their government-issued phones not only to exchange numerous anti-Trump text messages but also to hide their extramarital affair from their spouses.

“They were going hog wild to find something about the administration, which obviously wasn’t there,” Trump charged, referring to Strzok and Page as “two beauties,” “lovers,” and “sick, sick people” who are “like children, when you look at them.”

“They’re trying to infiltrate the White House, long after the election,” Trump said. “This is a disgrace. Hopefully the attorney general will do what’s right, and I believe he will. … It’s possibly the greatest scandal in the history of this country.”

As for his widely mocked tweet that the Obama intelligence community had wiretapped Trump Tower — which was followed months later by the revelation that the FBI had, in fact, monitored one of his former aides — Trump said his remarks were the product of a “little bit of a hunch” and a “little bit of wisdom.”

STRZOK’S PHONE FROM MUELLER PROBE TOTALLY WIPED. FBI BLAMES SOFTWARE GLITCH FOR OTHER DELETIONS

Trump additionally voiced little confidence in Robert Mueller, saying the special counsel was perhaps “best friends” with former FBI Director James Comey — whose termination led to Mueller’s appointment.

Trump also faulted Mueller for, in his view, needlessly wrecking the careers of many members of his team.

Trump asserted he had “turned down” Mueller to head the FBI, and that Mueller was “conflicted” not only “because of the fact that Comey and him are best friends,” but also because Trump “had a nasty business transaction” with Mueller.

Without taking questions from reporters about the Mueller report, President Donald Trump and first lady Melania Trump walk to board Marine One for the short trip to Joint Base Andrews then on to his estate in Palm Beach, Fla., at the White House in Washington, Thursday, April 18, 2019. (Associated Press)

That was an apparent reference to an episode, referenced in Mueller’s report, in which Mueller sought a refund — apparently unsuccessfully — from Trump after withdrawing from membership in his golf club.

But Trump said it was a “very good” sign that the New York Times acknowledged in a recent article that there were credibility problems in the discredited dossier that the FBI used to justify surveilling one of his campaign aides.

The Times finally joined a chorus of publications that have long cast doubt on the dossier’s veracity, writing that the document “financed by Hillary Clinton’s campaign and the Democratic National Committee” was “likely to face new, possibly harsh scrutiny from multiple inquiries.”

The article noted that British ex-spy Christopher Steele relied in part on Russian sources and that, ironically, the document could have been part of a “Russian disinformation” effort to smear Trump even as Moscow was going after Clinton.

The article, Trump said, suggested that dossier skepticism, once panned as denialism, has entered the mainstream, as Mueller’s report found “some of the most sensational claims in the dossier appeared to be false, and others were impossible to prove.”

As he did in his previous interview on “Hannity,” Trump vowed to declassify and release not only the documents related to the surveillance warrants to surveil his campaign, and even more.

“Everything’s going to be declassified, and more,” Trump said. “It’ll all be declassified.”

“Everything’s going to be declassified, and more. It’ll all be declassified.”

— President Trump

Responding to the entrance of Joe Biden in the 2020 presidential race, Trump emphasized the economic growth and health care successes for veterans under his administration, who “don’t have to die waiting in line” anymore.

Biden attracted mockery on Thursday for insisting that he told former President Barack Obama not to endorse his run.

“I’ve known Joe over the years. He’s not the brightest lightbulb in the group,” Trump said. “But he has a name they know.”

Contrary to some public statements, President Trump and his campaign staff are likely “pretty concerned” about having former Vice President Joe Biden as a potential opponent in 2020, the Federalist publisher Ben Domenech said Thursday.

“I actually think they are pretty concerned about him,” Domenech said during an appearance on Fox News’ “Special Report with Bret Baier.”

Domenech noted that part of the concern may stem from the fact that Trump and Biden — a Democrat who made his White House bid official Thursday morning — appeal to some of the same types of voters.

STEVE FORBES: BIDEN’S RUN ‘FOUR YEARS TOO LATE’

“I think part of that has to do with the fact that Joe Biden has clearly proven in the past to appeal to the same states that were key to President Trump in deciding the 2016 election,” Domenech said. For example, Biden — a longtime U.S. senator from Delaware, often speaks of his childhood in Pennsylvania, a state that Trump won over Hillary Clinton in 2016.

In his campaign kickoff video Thursday, Biden argued that “if we give Donald Trump eight years in the White House, he will forever and fundamentally alter the character of this nation, who we are, and I cannot stand by and watch that happen.”

Nevertheless, Trump welcomed Biden to the race, calling him “Sleepy Joe” in a tweet and warning Biden to prepare for a “nasty” primary fight against a large field of other Democrats seeking the party’s presidential nomination.

Domenech said Biden is a much stronger candidate than others believe he is, in particular with African-Americans.

“Personally I think the elite opinion is wrong about Joe Biden, that he actually is a much stronger candidate that they are giving credit for,” Domenech said. “I think a large part of that is that he has an enormous wellspring of support among African-American voters that you do not see for a lot of the other candidates in this race. Where they might be appealing to the more ‘woke’ white progressive vote that I think is the loudest and shouting about a lot of different issues right now.”

The Federalist publisher also said Biden will need to deal with issues from earlier in his career that his Democratic rivals will almost certainly raise.

“The problem here for him is how does he deal with all the hits that are going to come against him from his past?” Domenech said.

“We’ve seen them used in lot of different ways and I think they will be deployed against him. He will have to come up with different ways to respond to the different aspects of that.”

The panelists on “The Five” were fired up Thursday about presidential candidate Sen. Bernie Sanders, I-Vt., saying felons in prison, including the Boston Marathon bomber, should be able to vote.

On Wednesday, Sanders doubled down on his remarks made at a CNN town hall earlier in the week.

“That is a right we must protect because we know the history of this country. We know that women didn’t have the right to vote. We know that African-Americans didn’t have the right to vote,” Sanders said at a rally in Houston.

5 THINGS TO KNOW ABOUT SEN. BERNIE SANDERS

Co-host Juan Williams gave credit to Sanders for casting light on the issue.

“Bernie Sanders is moving this conversation incrementally. You don’t want to hear it,” Williams said.

Co-host Dana Perino argued that Sanders was shifting the conversation to restoring felons’ rights after prison because he was scrutinized for saying felons behind bars should be permitted to vote.

“That’s not true. I’m not going to take a backseat on felon voting rights,” Perino said, saying the topics were separate.

“But, that’s not what Bernie Sanders is talking about. That wasn’t the initial thing the other day, and him moving the conversation incrementally is to try to save face,” Perino argued.

“Let’s give Bernie a round of applause. Let the Boston bomber vote. Good job, Bernie,” co-host Jesse Watters interjected sarcastically.

Williams defended his point, saying, “You act as if America isn’t having this conversation.”

“America isn’t!” co-host Greg Gutfeld exclaimed.

Gutfeld then jokingly argued that prisoners should be given guns while locked up.

“I should be able to have my gun too, right. If I want my voting rights, I should have my gun rights,” Gutfeld said, laughing.

Former Republican presidential candidate Steve Forbes said Thursday that former Vice President Joe Biden is running for president “four years too late.”

“I think Biden made a huge mistake.  I think it’s a classic case, Neil, he’s running four years too late like Elizabeth Warren. If they ran in 2016, both would have had a shot not only winning the nomination but certainly Biden winning the general election,” Forbes said on “Your World with Neil Cavuto.”

Biden, in an online video Thursday, officially declared his candidacy for president in 2020 after weeks of speculation.

PROGRESSIVE GROUP TAKES AIM AT BIDEN SOON AFTER LAUNCH

President Trump welcomed Biden into the presidential race through Twitter but warmed him the primary will be “nasty.”

“Welcome to the race Sleepy Joe,” Trump tweeted. “I only hope you have the intelligence, long in doubt, to wage a successful primary campaign. It will be nasty – you will be dealing with people who truly have some very sick & demented ideas. But if you make it, I will see you at the Starting Gate!”

Neil Cavuto and his panel of experts were discussing the tone of the video announcement in which the former vice president pointed to the violence in Charlottesville, Va., at a “Unite the Right” rally in August 2017.

Biden took aim at Trump’s response that “there were some very fine people on both sides.”

The chairman of Forbes Media said Biden wasn’t giving the message of a senior candidate.

“People want to hope for the future. They know things are bad now, a lot of people feel the president is not up to the office, and all that kind of thing, but Biden is being the senior candidate, when the senior candidate in there should say, ‘I’ve seen a lot, we’re going to come out of it. Here’s how,'” Forbes said.

Fox News contributor Kat Timpf added that Biden was taking a tone similar to Hillary Clinton in 2016 — and that didn’t work out for her.

“Obama had a message of, imagine what could happen in the future we could have if I were president. This is him saying, there won’t be a future if me or a Democrat is not president,” Timpf said.

“That is interesting to me because in 2016, the Democrats, Hillary Clinton and her campaign made things about attacking Trump and the doom and gloom situation if Trump were to be elected and they didn’t win. It seems like Joe Biden’s announcement was doing the same thing.”
