North Carolina courthouse removes Confederate statue, saying it’s time ‘to move forward’

A Confederate statue that stood for more than 100 years was removed from a North Carolina courthouse early Wednesday, joining a handful of places around the state where such monuments have come down despite a law protecting them.

A crowd of several dozen gathered outside the historic Chatham County courthouse to watch workers carefully dismantle the 27-foot-high statue. Television news footage showed workers atop motorized lifts secure the statue, which was then taken away with the help of a crane.

Taking down Confederate statues in North Carolina is rare since the state enacted a law in 2015 that restricted the removal of public monuments.

County officials argued in court that the monument was private property owned by the United Daughters of the Confederacy. A judge hearing the group’s challenge declined to block the removal.

In past weeks, demonstrators for and against removal had gathered around the statue, leading to scuffles and some arrests.

“The last several months have been a painful time for Chatham County. We’ve experienced high emotions, division and even violence which have impacted residents, businesses and the overall feel of our community,” Chatham County Board of Commissioners Chair Mike Dasher said in a statement. “What’s clear now is that the overwhelming majority of our residents are eager to move forward.”

A state tally shows Confederate monuments are located at contemporary or historic courthouses in about half of the state’s counties.

Onlookers to the statue’s removal Wednesday had mixed opinions.

Robert Butler, a supporter of the monument, described the removal to Raleigh’s WRAL-TV as “heartbreaking.”

“A statue’s never hurt a soul, just like a grave memorial,” he said. “Do they hurt anybody?”

But Sandra Day of Moncure, who is black, told The News & Observer that she supported its removal. She said she got out of bed and put on a heavy coat to watch the statue come down.

“It’s an honor and a privilege to be standing here,” she said. “I wanted to see it for myself.”

Kin to Michael Brown, Marine deserter accused of killing mom’s boyfriend: ‘Please, turn yourself in’

The mother and grandmother of Michael Brown, a decorated U.S. Marine now on the run after allegedly killing his mother’s boyfriend in Virginia, pleaded with him Friday to turn himself in.

“Please trust us when we tell you to trust the authorities and turn yourself in,” his grandmother, Diane Hanson, told Roanoke’s WFXR-TV.

Brown, 22, allegedly deserted his post at Marine Corps Base Camp Lejeune in North Carolina last month after he was accused in the shooting death of Rodney Brown on Nov. 9.

On Friday, authorities in North Roanoke cleared a search area after investigating a report of a possible sighting of Brown walking along train tracks. But authorities said they could not confirm Brown was in the area, WSLS-TV of Roanoke reported.

Also on Friday, the U.S. Marine Corps confirmed that Brown was considered a deserter, WDBJ-TV of Roanoke reported. A Marine Corps spokesman told the station Brown did not show up for duties Oct. 24, was listed as AWOL the next day, and was declared a deserter Nov. 10, the day after Rodney Brown was killed.

“I don’t want you hurt, please,” his mother, Vanessa Hanson, said.  “Michael you’re my baby I love you please I can’t lose you. I’m scared for you.”

Brown’s car was found in South Carolina last week, authorities said Wednesday.

Several agencies in North Carolina and Virginia — in addition to the U.S. Marshals, FBI, and Naval Criminal Investigative Service (NCIS) have been conducting a massive manhunt for him.

His mother went on to say they would help him get a lawyer if he turned himself in.

“I can’t lose another person,” she added.

“Michael I know that you’re alone and afraid right now but there are people who want to help you,” his grandmother told WFXR. “We still care about you. Please turn yourself in. Nobody wants to see you die also.”

The Franklin County Sheriff’s Office in Virginia Monday issued a warrant for Brown’s arrest on second-degree murder charges.

Authorities were still working to determine a motive. Neighbors told WSLS the Marine recently learned Rodney Brown was not his biological father. He reportedly believed his mother’s boyfriend was his biological father for his entire life.

Authorities said Brown should be considered “armed and dangerous.”

North Carolina inmate sentenced to death in failed escape that killed four

A North Carolina prison inmate was sentenced to death Monday after being convicted of murdering four people during a failed escape attempt.

Mikel Brady, 30, remained quiet when the sentence was handed down. Jurors agreed on the sentencing after 35 minutes of deliberation, The Virginian-Pilot reported.

Brady had been charged with first-degree murder and other charges related to his failed Oct. 12, 2017, escape from Pasquotank Correctional Institution north of Elizabeth City.

He was the first of four inmates tried on charges of killing two prison guards and two prison workers. He was already serving time for wounding a North Carolina state trooper in 2013.

“I understand he’s got one life, but he took four,”  District Attorney Andrew Womble said.

Three other inmates — Jonathan Monk, Seth J. Frazier and Wisezah Buckman — are awaiting trial.

North Carolina judges toss GOP’s ‘gerrymandered’ districts, in major win for Eric Holder initiative

A panel of state judges in North Carolina blocked the state’s GOP-friendly congressional map from being used in the 2020 elections, ruling that voters had a strong likelihood of winning a lawsuit that argued Republicans unlawfully manipulated district lines for partisan gain beyond any reasonable doubt.

The lawsuit was brought by North Carolina voters backed by the National Redistricting Foundation, part of a comprehensive national operation led by former Attorney General Eric Holder intended to make district lines more friendly to Democrats before the 2020 elections and the pivotal 2021 redistricting.

The panel of three Superior Court judges issued a preliminary injunction preventing elections under the district lines, starting with the March 3 primary. The judges further indicated they would soon effectively make that preliminary injunction permanent by encouraging the plaintiffs to file for a motion for summary judgment.

The ruling came just months after the Supreme Court punted the partisan fight over gerrymandering to state courts this summer, saying it was not an issue for federal courts to decide regardless of the circumstances.

In September, after that go-ahead from the Supreme Court, North Carolina state judges quickly struck down state House and Senate districts. They found extreme political manipulation of the district lines, similar to what voters suing over the congressional map also said had occurred.

In the ruling Monday, the judges — Paul Ridgeway, Alma Hinton and Joseph Crosswhite — agreed that “there is a substantial likelihood that plaintiffs will prevail on the merits of this action by showing beyond a reasonable doubt that the 2016 congressional districts are extreme partisan gerrymanders” in violation of the North Carolina Constitution.

The judges gave no date by which a new map must be drawn, but they suggested lawmakers could redraw them on their own quickly to ensure that congressional primaries be held as scheduled.

The State Board of Elections has said lines needed to be finalized by Dec. 15.

“The court respectfully urges the General Assembly to adopt an expeditious process,” the judges wrote.

Republican state legislators made plain when they drew that map that the lines were designed to help the GOP retain 10 of the state’s 13 congressional seats, even though vote totals in the state were split roughly evenly along party lines.

But, the Republicans argued such strategies weren’t unlawful — an argument that, in the federal system, had succeeded in the Supreme Court. Republican defendants in the lawsuit and three sitting GOP U.S. House members opposed the injunction request.

Former Wisconsin Gov. Scott Walker told Fox News earlier this month that Holder was interested only in helping Democrats, and seemed conspicuously uninterested in gerrymandering that helped Democrats. Republicans, Walker said, needed to match Holder’s efforts in the courts.

“Eric Holder has been at this for years. They have this whole ‘sue until blue’ mentality,” Walker said. “So, even a state like North Carolina where Republicans are in charge of the Assembly and the Senate — the two Houses there — they’ve gone to court and over the years they’ve gotten involved in Supreme Court races. So now, the liberals — Eric Holder’s team — now [control] who is on the Supreme Court in North Carolina.”

“And, after the federal government, the U.S. Supreme Court said they weren’t going to get involved in this,” he told “Fox & Friends.” “It’s now in every one of the states.”

Walker asserted that “Holder’s not talking about redistricting in places like Maryland, where you have the third congressional district. It’s arguably the most gerrymandered district in the entire country. He’s not talking about Illinois or Massachusetts. Why? Because those places benefit Democrats.”

“Anywhere that Eric Holder’s at, we’re going to be at in the courts. We’re going to be involved in data. We’re in all 50 states,” Walker said. “We’ve got to push back against Eric Holder.”

SUPREME COURT RULES GERRYMANDER QUESTIONS ARE BEYOND THE SCOPE OF FEDERAL COURTS

The state judges’ ruling, which could be appealed, likely would lead to a map with more competitive districts for the November race — making it more difficult for national Republicans to retake control of the U.S. House.

Democrats and unaffiliated voters who sued Sept. 27 sought the injunction before any trial was held on their partisan gerrymandering claims. They said the case was extremely similar to a successful lawsuit over state legislative districts.

The same three judges hearing the congressional case ruled in that case just two months ago, finding Republicans performed extreme political manipulation in those maps to ensure they could hold majorities in almost any political environment. Republicans were ordered to redraw those lines.

Lawyers for North Carolina Republican legislators had argued there was no clear way for judges to know what kinds of map-making were unacceptable, since “redistricting is political because of what it is, not because of who does it.” Any complaints about how districts were drawn would vanish if Democrats could lead some Republican voters to change their minds and voted with them, GOP lawyers said.

Also Monday, the judges issued a separate ruling in that legislative case, upholding all of the changes that the General Assembly made to several dozen state House and Senate districts. The plaintiffs who sued there had requested a third-party expert step in and rework 19 House districts.

In the current congressional lawsuit, the plaintiffs’ attorneys convinced the judges that evidence already accumulated from separate federal litigation challenging the congressional lines showed they were likely to succeed in the state case.

The federal case went all the way to the Supreme Court, which decided 5-4 in June that federal courts would not get involved in partisan redistricting claims. But, the justices left the door open for state courts to intervene.

Opponents of the current congressional map have latched on to the comment made by state Rep. David Lewis during the 2016 remapping. Lewis said at the time he was proposing a 10-3 map “because I do not believe it’s possible to draw a map with 11 Republicans and two Democrats.” Lewis said later he was joking.

Attorneys for Lewis and other Republican lawmakers who were defendants in the state congressional lawsuit case rejected the plaintiffs’ partisan gerrymandering claims. They told the judges it was too late to make congressional map changes, since candidate filing would begin in early December and the facts in the case were not settled. Any further changes, the GOP’s lawyers said, would result in voter confusion and extremely low turnout should the primary have to be delayed.

North Carolina man gets prison time for accidentally killing fellow Marine

A man has been sentenced to prison for his roommate’s death when they were Marines stationed at Camp Lejeune in North Carolina.

The sentence of 14-to-26 months was delivered Friday to Tyler Prudden, 30, who had pleaded guilty to manslaughter in the 2013 death of 22-year-old Lance Cpl. LaNija Gilpatrick, according to reports.

He admitted shooting Gilpatrick accidentally after he’d told investigators at first that Gilpatrick accidentally shot himself, the Jacksonville Daily News reported.

“He hid the fact that he was the one who actually shot (Gilpatrick),” Prudden attorney Stuart Popkin told the paper. “It’s a difficult case in that there’s someone that died and your client is the one all the fingers are pointing at … He decided to accept responsibility and not go through a trial.”

Two years after the shooting, Nancy Patterson showed the Onslow County Sheriff’s Office a Facebook message she received that led them to reopen the case, the paper reported.

“Your son did not shoot himself. Tyler shot him,” the message said, according to the paper.

Patterson suspected it came from Prudden’s ex-wife who was a witness to the shooting but investigators have never said who sent it, WITN-TV reported.

Prosecutor Bob Roupe said Prudden later admitted pointing a gun he thought was unloaded and firing at Gilpatrick, the Daily News reported. The bullet struck Gilpatrick in the face.

By the time he was arrested, Prudden was no longer a Marine. Gilpatrick joined the Marines in 2010. Prudden was one of the pallbearers at his funeral.

The Daily News quoted Patterson as saying after the sentencing that Prudden got off “really, really easy.”

“I had to bury my oldest child,” she said.

North Carolina woman held in 2004 murder of ex-sister-in-law after Facebook tip

A North Carolina woman was arrested for a 15-year-old cold case Thursday after a detailed tip to a crime-fighting Facebook page led investigators to a shallow grave on the woman’s property in the small town of Spring Hope.

Kimberly Hancock, 49, was charged with first-degree murder in the death of her former sister-in-law, Deborah Elaine Deans, who went missing in 2004.

“Remains have been found consistent with the description of the wrapping and how the body was buried,” Sheriff Keith Stone said, according to Raleigh’s WRAL-TV.

The body has not yet been identified but Stone said there is a “strong possibility” it is Deans.

“It’s not a good outcome,” Stone said, according to WRAL, “but it puts families to rest to know at least where their loved ones are.”

Hancock was charged with manslaughter in 1989 for killing her father who was allegedly abusive but got a suspended sentence, WTVD reported.

Deans, who was 29 at the time she disappeared, was a mother of four.

Deans was last seen in the area where the body was found.

A family in North Carolina turned out to be “extremely lucky” after a utility pole smashed through their vehicle, just moments after a parent dropped their child off at school.

No one was hurt in the incident in Thomasville, a city roughly 70 miles northeast of Charlotte, which happened before 9 a.m. on Friday, according to authorities.

Forecasters are predicting that despite high winds, surging seas and heavy rain along the Gulf Coast, Tropical Storm Nester is not expected to morph into a hurricane, much to the relief of states in the storm’s path that were more than 75 percent devastated by Hurricane Michael just last year.

The National Hurricane Center predicted that conditions along the coast late Friday into early Saturday are expected to deteriorate as Nestor makes landfall around the coast of Mexico Beach on Saturday morning without strengthening into a hurricane.

WET WEEKEND: TROPICAL STORM WARNINGS FOR US GULF COAST

Florida officials said they activated the state’s emergency operations center at its lowest level and are not bracing for life-threatening or devastating damage. Even heavy rainfall — which is expected to be 2 to 4 inches from the central Gulf Coast to the eastern Carolinas, and up to 6 inches in some spots — will be a welcome change for areas suffering from a severe drought.

“We’ve done very little preparation only because there’s nothing really to prepare for,” Mexico City Beach Mayor Al Cathey said, according to reports by The Associated Press. “We haven’t seen any alarm at all.”

Forecasters said that as of 4 p.m. ET Friday, the storm was about 150 miles south-southeast of the mouth of the Mississippi River, or about 280 miles southwest of Panama City, Fla. It had top sustained winds of 60 mph and was moving to the northeast at 22 mph.

A tropical storm warning is in effect from Navarre, Fla., to Yankeetown, Fla. A storm surge warning is in effect for Indian Pass to Clearwater Beach in the state.

Conditions in parts of Alabama, Georgia and northern Florida, reaching into the Carolinas and Virginia, may include blustery winds and heavy rain through Sunday.

The Coast Guard predicted dangerous rip currents and sea levels that could rise to 20 feet around Panama City, a bustling tourist beach destination at this time of year.

Nester also impeded attempts by officials to use explosives to topple the damaged construction cranes that remain unstable after the Hard Rock Hotel in New Orleans partially collapsed last week, causing them to delay the efforts until after the storm.
