This broke late last night. It was so late that getting any real information or reaction to go on was nearly impossible, as most people were a sleep. It seems the story is still in the same place this morning.

What this centers on is Kurt Volker’s testimony, which I shared initial reactions to yesterday. The demeanor after the testimony and Adam Schiff’s behavior during it left the impression that he was scrambling. Apparently he was, as he and the other Democrat chairs decided to cherry pick some text messages to release last night in order to try to regain the upper hand.

Let’s take a look at them and talk about what they may or may not mean.

There’s a ton of editorializing going on here by Vogel, who is supposed to be a reporter. What deal is he talking about? There’s no actual deal spelled out here in this purposely curated text exchange (it was obviously longer than two messages). Pay attention to the dates because they are important. This one happened on August 10th, before Ukraine even knew about aid being held up, i.e. that’s not a factor here. The goal posts have now moved to Ukraine getting a White House visit, which seems like quit the walk down by Democrats. But there’s actually no direct mention of reciprocity at all here.

But, I want to be fair, so lets say that the Trump administration did ask them to look into corruption (which they have already admitted). What was the implication of the ask here in this text exchange? It was to look into Burisma, a known corrupt company, and to look into 2016 election meddling, which we know happened in Ukraine with the Hillary campaign. I’ve been assured for years that election meddling is of the utmost importance to get to the bottom of so why is that suddenly bad?

And to be clear, there’s no mention of Joe Biden in any of the text messages. Investigating Burisma is not off limits just because Democrats say it is.

Here’s another one people are really pushing this morning.

The first text there is actually good news for Trump. It shows (as we’ve reported) that the Ukrainians did not even know aid was being withheld, therefore there can’t be a quid pro quo involving it. That takes a major, major part of the Democrat narrative off the table.

But it’s the second text some are latching onto. Bill Taylor, as we’ll see in one more text coming up, is the lightening rod in this. Here, he seems to suggest there were conditions placed on the aid, even though we know from the previous exchange that’s not true. All Sondland says in response is “Call me.” This led to all kinds of assumptions being made. One of the common ones I saw last night is that if Sondland wasn’t hiding something, he’d have just said no in the text. I think that’s citing facts not in evidence. Perhaps he just wanted to better explain everything over the phone instead of writing a 500 word text message? The point being, there’s nothing here at all except pure supposition.

Finally, there was this text, which is probably the one that will end up pushed the most by both sides.

The mention of a political campaign here is the eye catcher, but we are again left wondering where Taylor is getting his assumptions from. Further, Sondland goes on to completely disabuse him of his notion there was any quid pro quo. Many on the left are trying to discount the last message, asserting it was written purposely to push back on what Taylor said and get that on record. The problem with that is that Democrats are now wanting you to interpret the “true meaning” of a text by asserting it means the opposite of what it actually says. Does that sound dispositive to anyone? The message says what it is says, and it says there is no quid pro quo.

Here’s the biggest thing here though. All of these text messages lack context.

Yet, the Democrats are refusing to release Volker’s testimony and instead chose to roll out cherry-picked text messaged. Does that sound suspicious to anyone? It’s almost like we’ve seen this game played before and that everyone should probably wait before freaking out.

I got into a bit of a back and forth last night with The Reagan Battalion over this. I never got an answer to my last question, but it’s pretty relevant in my opinion.

Adam Schiff and company could relieve me of my suspicions by simply releasing the full transcript of Volker’s testimony. Let’s see how he addressed these messages. Republican Congressional members are out there saying that there is a lot of context missing here and that what we are seeing right now is painting a false picture. If they are lying, then Democrats should have no problem calling their bluff, right? The fact that they haven’t done so is telling.

Here’s what I’m not going to do. I’m not going to take text messages personally chosen by Adam Schiff as proof of anything, especially when he’s clearly trying to hide the full context of the situation. Some conservative outlets may choose to rush and make early judgements here (again), but I’m not playing this game because it’s too obvious at this point. Let’s get every piece of information out there, and then we’ll talk about what’s damning or not.

I know I keep saying this but local government is just as odd and even corrupt as anything we see on the state or local level. In fact, it might even be worse and it is definitely where corrupt people begin to move up the ladder of corruption and bad behavior.

I have written previously here at Red State about what is going on in my local town. My latest was about how people who accuse each other of crimes can later support one another to run for office. Something Smells Fishy In Fraser, Michigan.

Pretty novel right? Almost like the Harry Reid and Mitt Romney love fest we are seeing now nationally.

Now we move into the next phase of WTF that can happen anywhere but seems to happen a bit too much in this small sleepy town of just under 15,000 people. ( Which will not go over 15k after the 2020 census, sorry Doug.)

How exciting!!

The person I referenced in the story listed above who is now running for office, Richard Haberman, was once the city manager of this quaint Lil Hamlet. As referenced in the story above he was here for over 5 years and when he left the city was in a bit of a financial predicament. I will be following up on that part of the story this coming Monday.

Haberman, however, claims in campaign literature that his experience of over 25 years is one of the reasons the people of the city should elect him and help guide the city he once was paid handsomely lead.

There is just one small problem.

His inaction as city manager according to a lawsuit that was just settled by the city of Fraser with three female employees of the city, claims he looked the other way and allowed elected officials to harass and intimidate those three female employees. The situation was so bad that the council voted to remove the two people accused after Haberman was let go of his position as C.M. according to the Detroit Free Press.

Fraser City Council voted Monday night to remove Mayor Joe Nichols and Councilman Matt Hemelberg from office after a two-hour tribunal hearing over accusations that the pair sexually harassed female city workers.

City employee Leah Brown testified that Nichols looked her up and down, and she said he said that not everyone can wear leggings like she could. She said Hemelberg told her supervisor “that’s a nice view over there. I was the only thing in his direction.”

She testified that the former officials had a conversation at City Hall about photos they had taken with half-dressed women. She said Councilwoman Yvette Foster was present.

Councilwoman Patrice Schornak said that the prior city manager knew what was going on and told staff to hire an attorney.

“We are here to defend individuals who work for this city,” she said

Being this a family-friendly site I won’t go into what was said about what some of the ladies’ body parts looked like according to these fellas that were removed.

However, for those of you following along at home, the previous city manager was Haberman.

According to multiple people I have talked to the city settled for 75,000 apiece for each of the ladies plus all the other incidentals of deductibles and what this will cost the city in increased premiums for insurance coverage. We are looking at 250,000 to 300,000 dollars for looking the other way while employees were being harassed.

According to the depositions taken in Leah Brown vs The City of Fraser, the environment was not pretty.

Kelly Doland who is the city clerk for Fraser said this on page 80 of her deposition…

Q. When you raised the issue of the alleged harassment at the dept head meeting, was there any response by Mr. Haberman?

A. Yes

Q. What did he say?

A. He said, I would advise you to get an attorney.

Q. Was that his sole response?

A. That’s’ the best I can recall.

From Michelle Kwiatkowski, who is the Systems Admistrator/ IT director for the city of Fraser said this from page 42 of her deposition…

Q. Did you make anybody aware that you thought this was inappropriate and hostile in 2015?

A. Mr. Haberman.

Q. What did you tell Mr. Haberman specifically in 2015 as it related to Mr. Nichols?

A. At that time we were still going back and forth because they wanted access to public safety. I told them there was no way they were getting access to public safety. He told me that– I specifically said– especially the way they come in and the way they treat women, there is no way they’re going over to public safety. I won’t sign off on it. I had to sign off on it in order to meet the LEIN requirements. he said he would talk to them about not coming in so much and he never did.

The semi amusing part of this is that Nichols wanted to roam around the public safety side of City Hall after being arrested by the same dept in 2007 for larceny according to the Macomb Daily. He plead guilty on that charge to ripping off a change purse.

Now, the city has just settled a lawsuit in the era of #MeToo where city employees say they went to their boss, Mr. Haberman, and complained about feeling intimated and harassed by elected officials. The city manager, who also in this town happens to the defacto Human Resources guy shrugs his shoulders and either ignores those pleas or says “Get a Lawyer.”

Maybe that is the 2019 definition of leadership. Would you want someone who did that elected as a council person?

The inaction in this case though is not the only example of money flying out the door under the leadership of Mr. Haberman. That story will be covered Monday when I go over how much money was blown with the finance director Haberman picked and than left a mess of the cities books.

Investigative reporter Paul Sperry reported on Thursday night that the whistleblower whose complaint triggered the House of Representatives to open an impeachment inquiry against President Trump, was “himself helping dig up dirt in Ukraine against Trump (and Manafort) while working in the Obama White House during 2016 campaign.” In an earlier tweet, Sperry wrote, “BREAKING: The whistleblower is a registered Democrat & CIA analyst who was detailed before the 2016 election to the Obama White House, where he worked on the NSC’s Ukraine desk & met w anti-Trump Ukrainian officials before being sent packing by the Trump NSC & becoming disgruntled.”

If these allegations are proven, and Paul Sperry is a very credible journalist, it blows up the Democrats’ case against Trump.

If this story is true, it offers further evidence that Rep. Adam Schiff (D-CA), who currently chairs the House Intelligence Committee, is an unscrupulous, deceitful manipulator who has caused great harm to our country. He should immediately be stripped of his chairmanship and thrown off the Intelligence Committee. It’s time for this liar to face justice.

The Democrats’ latest scheme to take out the President has been unraveling by the day. The fact that they chose such a weak narrative speaks to their great desperation.

I’ll keep an eye on this story and will post any updates I find.

Watchdog group Judicial Watch released 145 pages of former Deputy Attorney General Rod Rosenstein’s communications on Thursday. No one will be surprised to learn that he was indeed a creature of the deep state.

Over a year ago, Judicial Watch filed a Freedom of Information Act (FOIA) request seeking, “Any and all e-mails, text messages, or other records of communication addressed to or received by Deputy Attorney General Rod Rosenstein between May 8, 2017, and May 22, 2017.”

Here is a timeline of events from that period:

May 8, 2017: Rosenstein wrote the memo in which he made the case for then-FBI Director James Comey to be fired.

May 9, 2017: President Trump fired Comey.

May 12, 2017: Rosenstein sent an email to then future Special Counsel Robert Mueller telling him, “The boss and his staff do not know about our discussions.” This email tells us all we need to know, and had long suspected, about their relationship.

May 16, 2017: Rosenstein  emailed former Bush administration Deputy Attorney General and current Kirkland & Ellis Partner, Mark Filip writing, “I am with Mueller. He shares my views. Duty Calls. Sometimes the moment chooses us.

May 17, 2017: Rosenstein appointed former FBI Director Robert Mueller to the Special Counsel.

During this time, Rosenstein was “in direct communication with reporters from 60 Minutes, The New York Times and The Washington Post. In an email exchange dated May 2017, Rosenstein communicated with New York Times reporter Rebecca Ruiz to provide background for this article about himself. Ruiz emailed Rosenstein a draft of the article, and he responded with off-the-record comments and clarifications.” Judicial Watch reports:

In an email exchange on May 17, 2017, the day of Mueller’s appointment, Rosenstein exchanged emails with 60 Minutes producer Katherine Davis in which he answered off-the-record questions about Mueller’s scope of authority and chain of command:

Rosenstein: “Off the record: This special counsel is a DOJ employee. His status is similar to a US Attorney.”

Davis: “Good call on Mueller. Although I obviously thought you’d be great at leading the investigation too.”

On May 17, 2017, in an email exchange with Washington Post journalist Sari Horwitz and the subject line “Special Counsel” Rosenstein and Horwitz exchanged:

Rosenstein: “At some point, I owe you a long story. But this is not the right time for me to talk to anybody.”

Horwitz: “Now, I see why you couldn’t talk today! Obviously, we’re writing a big story about this. Is there any chance I could talk to you on background about your decision?”

Judicial Watch President Tom Fitton said, “These astonishing emails further confirm the corruption behind Rosenstein’s appointment of Robert Mueller. The emails also show a shockingly cozy relationship between Mr. Rosenstein and anti-Trump media reporters.”

Last month, Judicial Watch obtained a copy of a two-page memo written by then acting FBI Director Andrew McCabe on May 16, 2017. This memo was McCabe’s “contemporaneous recollection” of the infamous meeting held in then-Deputy Attorney General Rod Rosenstein’s office during which Rosenstein had allegedly proposed wearing a wire to record the President. McCabe wrote:

As our conversation continued the DAG proposed that he could potentially wear a recording device into the Oval Office to collect additional evidence on the President’s true intentions. He said he thought this might be possible because he was not searched when he entered the White House. I told him that I would discuss the opportunity with my investigative team and get back to him.

In September 2018, The New York Times reported on this meeting. Their article said this group had allegedly discussed the possibility of invoking the 25th Amendment to remove Trump from office. In addition, Rosenstein said he knew of one or two members of Trump’s cabinet who might be on board with such a plan.

Rosenstein has publicly maintained that he was being sarcastic when he made this comment. But nothing in McCabe’s memo suggests this to be true. Rather, McCabe wrote he told Rosenstein that he would “discuss the opportunity with my investigative team and get back to him.”

I’ve never understood why Rod Rosenstein, who has played such a pivotal role in the investigation of President Trump has received so little scrutiny. The matter of whether or not he volunteered to wear a wire is only part of what he must answer for. He needs to be asked why he appointed a Special Counsel when the FBI had no evidence that Trump had colluded with Russia in May 2017. We know this for a fact because, during her Congressional testimony last summer, FBI attorney Lisa Page admitted it.

So, why did Rosenstein do it? He needs to be questioned under oath.

Why did he allow Mueller to expand the scope of the investigation? What, if any, evidence did Rosenstein require from Mueller to expand the scope? Was there ever a Mueller request that Rosenstein said no to?

It was Rosenstein’s role to supervise the activities of the Special Counsel, and his apparent submission to Mueller suggests that Mueller was actually driving the bus.

Think about this. For over two years, we’ve been learning information about the activities of the deep state and all of it has corroborated the theory that this group has deliberately sought to destroy first candidate Donald Trump and following his surprise victory, President Donald Trump. No contradictory evidence has been presented. As hard as they’ve tried to cover up their complicity, somehow, albeit painfully slowly, the truth has come out.

It is a true aphorism in that it delivers the goods in a pithy fashion. In describing the level of targeting President Trump has received a person has said, ‘’They are not targeting him, they are targeting us. He’s just standing in the way.’’ Sure, it’s an oversimplification, but that last sentence explains much of the behavior we have been seeing out of Washington in regards to the President of late.

Beyond the easy explanation of chalking it up to Trump Derangement Syndrome what we are seeing playing out is a combination of frustration and desperation out of the Democrats, and by extension many members of the media. Consider the level of political attacks, and how they have been pervasive since Trump was sworn into office. Any normal politician would have been rendered in some capacity and that is exactly the point, and it is also the reason.

Trump, to put it quite simply is not a politician, and that reality has stymied the politicians and those who cover politics.

The Ukrainian controversy and its attached hopes for impeachment have exposed a certain high level of flailing by Democrats. Many members of that party have been insistent on bringing up impeachment hearings, for years now. The Russian collusion certainty has been as successful as an Atlantean fireworks display. The assured scandal that would fell the President at the hands of Stormy Daniels has instead seen her losing a judgment, and her lawyer on the verge of losing a career. The Dems have been so desperate that they explored impeachment hearings this summer on the basis that Trump had said some mean things to select House members

So now it is a supposed impropriety on a phone call that will bring him down. The Democrats feel as if their insistence alone that wrongdoing took place will be enough, with the reliable aid arriving from a consistently hysterical media. You can see the generated outrage in the faces of the talking heads; look at the flummoxed expressions on the face of Rep. Adam Schiff — this stuff is supposed to work. And there has been no effect on Trump after nearly three years.

This is because Trump, by not being a politician, is not at all swayed by political brinkmanship. Recall during the election when he appeared disinterested at times in the process. Look at the ways his field teams appeared disorganized, and the ways he had pledged to upend not just the Democrats but also the GOP, and even the electoral process. Trump was a reluctant winner, and his vocal pledges to ‘’Drain the swamp’’ was a signal. He harbors disdain for them, and their process.

The main commodity in D.C. is power. It is what drives every person in that town, and it is what is leveraged to get things done. You get your way by assuring someone they can acquire more, or you threaten by removing what they have. Trump has no more to gain, and quite possibly is not all too concerned if he has it removed. Career politicians like Adam Schiff are using tactics they are accustomed to, but they are impotent against an apathetic target. They are drawing up a complex play on a whiteboard to assure the winning 3-point shot, and Trump is telling them he thinks basketball is a waste of time. Yet this is all they know.

You knew the push back from the White House on the impeachment thing was going to happen and it looks like in the wake of the Kurt Volker testimony today on the hill falling flat ( My colleague Bonchie covered that here Kurt Volker’s Testimony Appears To Have Left Adam Schiff Scrambling) the White House is ready to launch in classic Trump style.

Axios   is now reporting that the White House will release a letter daring San Fran Nan to take a vote and get this party started.

The White House is planning to send Speaker Nancy Pelosi a letter as soon as Friday arguing that President Trump and his team can ignore lawmakers’ demands until she holds a full House vote formally approving an impeachment inquiry, 2 sources familiar with the letter tell Axios.

*Republicans also say the minority party can exert more influence over hearings and other aspects of an inquiry once it is formalized with a vote.

*By calling this an inquiry without holding a vote, Pelosi and the Democratic committee chairmen are having it both ways, one official said. “They want to be a little bit pregnant.”

Pelosi is clearly betting now that without a vote this will end up in the courts and bog this process down. She can then claim to the “Squad” and their supporters that she did all she could and the Democrats will need to beat Trump at the ballot box in 2020. Otherwise, she should hold the vote which historically has been done and limits what the executive branch can do but ALSO gives the minority in the House some more power than they have now.

This is actually a shrewd move by Nancy.

However, Trump and his team once again are going to seize the P.R high ground with this letter. Even poor Jim Acosta over at CNN will be sputtering about why arent the Democrats taking a vote to squash this Presidency.

If the Speaker of the House is so confident in the bill of goods that Adam Schiff sold her than she should follow precedent and open an impeachment inquiry with a vote of the full house and roll the dice as they say.

Unless of course, she doesn’t want to take the Trump triple dog dare challenge.

The way the Russian collusion thing fell apart you can’t really blame her if she doesn’t.

The Ukraine whistleblower story has been disintegrating all week. It really took a dive yesterday when it was revealed that Rep. Adam Schiff (D-CA) had prior knowledge of the complaint while publicly he was professing otherwise.

But the Washington Post dropped a story tonight that suggests Democrats may have an even more flawed story lined up in the box.

The WaPo claims:

An Internal Revenue Service official has filed a whistleblower complaint reporting that he was told at least one Treasury Department political appointee attempted to improperly interfere with the annual audit of the president or vice president’s tax returns, according to multiple people familiar with the document.

The problem? Once again, this is anonymous hearsay complaint, not even firsthand but a thirdhand claim of what allegedly occurred.

With the sudden and convenient whistleblower rule change, are we now to expect a flood of hearsay complaints based on “someone told me something.” How ridiculous is this?

Then while such information is supposed to be confidential after it is filed, once again we see an obviously convenient leak to the WaPo who is then all too happy to publish anonymous hearsay if it helps to serve the Democratic narrative. Democrats need to be called on the carpet for this.

It’s unclear who the “political appointee” in question is or even if it’s a pro or anti-Trump person. It’s not even clear if it refers to the president or the vice president’s returns.

But that isn’t stopping the Democrats from getting geared up, according to the WaPo, who said congressional Democrats are now circulating on Capitol Hill and have flagged it to a federal judge. Rep. Richard Neal told Bloomberg he is consulting with legal counsel about whether to release the whistleblower complaint. Democrats are calling it “deeply significant allegation” “if true,” the WaPo says.

Ah, the “if true” standard strikes again. If true, unicorns can fly. Thirdhand hearsay. Journalism at its finest.

Meanwhile, the WaPo admits that they themselves have not been able to confirm that anything wrong happened.

“The Post has been unable to verify the allegation in the whistleblower’s complaint of improper communication between Treasury and IRS on the tax audit program.”

But hey, it’s cool, we’ll run with it anyway.

James Jackson, a deputy inspector general at the Treasury Department, said in September when asked about the whistleblower complaint at a congressional hearing: “We can’t confirm or deny that we may or may not be doing anything. I can tell you, though, that anytime we get any kind of allegation in this world, in this realm, we investigate it aggressively.”

Jackson added: “We are not aware of any misconduct.”

In his interview with The Post, the whistleblower dismissed the contention of critics that the complaint was uncorroborated.

“That’s what investigations are for,” he said.

No, investigations apparently are now witch hunts without actual evidence of wrongdoing at the start to serve the Democrats’ desire to somehow go after the president. Because 2020 is coming and Orange Man Bad and we, the Democrats, have to throw what we can against the wall.

For shame.

House Minority Leader Kevin McCarthy (R-CA) went after Speaker Nancy Pelosi (D-CA) today, calling on her to suspend the “impeachment inquiry” and criticizing her for proceeding without following any of the rules required to conduct one.

McCarthy also called out Democratic committee chairs for proceeding without any bipartisanship and not allowing the participation of the Republicans.

From Fox News:

“Unfortunately, you have given no clear indication as to how your impeachment inquiry will proceed – including whether key historical precedents or basic standards of due process will be observed,” McCarthy said in his letter. “In addition, the swiftness and recklessness with which you have proceeded has already resulted in committee chairs attempting to limit minority participation in scheduled interviews, calling into question the integrity of such an inquiry.” ….

In his letter to Pelosi, McCarthy asked a number of questions, including whether Pelosi plans to hold a full House vote on authorizing the impeachment inquiry, whether she plans to grant subpoena powers to both the committee chairs and the ranking members, and whether she’ll allow Trump’s lawyers to attend the hearings.

After concerns were first raised about an “equal playing field” during the Volker session, Fox News is told Democrats made concessions and agreed to equal representation from Democratic and Republican counsels in the room. However, even though there are representatives from the Intelligence, Oversight and Foreign Affairs Committees, only the Intelligence Committee can ask questions.

Pelosi’s response? Who has to pay attention to the rules? She claimed “existing rules of the House provide House Committees with full authority to conduct investigations for all matters under their jurisdiction.” Forget about bipartisanship.

She also claimed there was no requirement to take a vote to start an impeachment inquiry.

Unreal.

Sen. Lindsay Graham (R-SC) blasted that and said media should be pushing back on the falsehood.

The leading Republican on the House Foreign Affairs Committee, Michael McCaul, sent a formal letter to the Democratic Chair of his Committee Eliot Engel (D-NY) yesterday that Pelosi was flouting House Rules X and XI.

Citing House Rules X and XI, McCaul said that until Congress members from both parties vote to create a special impeachment task force to carry out proceedings, “Intelligence Chairman Adam Schiff lacks the jurisdiction to investigate the Department of State’s conduct of United States foreign policy toward Ukraine. That prerogative belongs to our Members.”

“Official impeachment inquiries are initiated by the adoption of a House resolution empowering or creating a committee or task force to undertake such activities,” McCaul continued. “In both the Nixon and Clinton cases, the Judiciary Committee debated and reported a resolution authorizing the Judiciary Committee to investigate whether there were sufficient grounds to impeach the President, which was then debated and voted on by the full House of Representatives. There have been no such debates or votes in this Congress.”

MSNBC’s Rachel Maddow joined the ladies on “The View” today. The panel had been discussing Adam Schiff’s parody reading of President Trump’s  telephone call with Ukrainian President Volodymyr Zelensky. Co-host Abby Huntsman said she felt it was extremely partisan and that it had made her feel uncomfortable.

She said, “My frustration is that there has been a crying wolf for so long. This is it, this is the smoking gun. He’s out for two years now from Democrats, from some members of the media, that now you have people in this country that are, like, we don’t believe anything anymore. They’re shutting it off. They are not taking it as seriously as they should, and I ask you, (turning to Maddow) do you think you’re part of that problem? Do you think that you have?”

“Rachel?” Joy Behar interjected. The ladies shared a laugh over the question.

Then Maddow told the group:

I think it’s a very good point. It’s a consequence of having a really scandal-ridden presidency with all sorts of stuff happening all the time, that in any other presidency, would have already led to impeachment.

Just before you guys got on the air today, the President went out on the South Lawn and he was asked, “What did you want the Ukrainians to do?”

He said, “I want them to investigate Biden. And I want the Chinese to do it too.”

The ladies found that very amusing.

She added, “We can put all that aside. He’s just admitted to it on the South Lawn. So, you don’t need an inquiry.”

Why is that funny? I find it reasonable.

This woman has no clue why her ratings have cratered, especially since the release of the Mueller report put to the lie over two years of her Russian collusion hysteria. Her lack of self-awareness is breathtaking.

It will be delightful to tune into Maddow’s show after President Trump wins reelection next year.

In Virginia Tuesday, Fairfax Count Police Chief Edwin Roessler Jr. publicly rebuked one of his officers.

What’d the cop do wrong? During a routine traffic stop September 21st, they discovered the driver had no license and no legal status in the country.

Therefore, the officer contacted Immigration and Customs Enforcement.

In a press release, Chief Edwin lambasted the act as “unacceptable,” further claiming it had “damaged” the department’s reputation.

The incident was described in detail:

The officer found that one driver did not have a Virginia Operator’s license and obtained the driver’s information to conduct a check to verify the DMV record. During the query of the driver’s information, the officer received notification from the Immigration and Customs Enforcement Agency (ICE), that the driver was wanted by ICE for an administrative violation warrant on file for the failure to appear for a deportation hearing. The officer then contacted the ICE agent that was listed as the point of contact on the confirmation of the warrant. The ICE agent advised the officer that they were close by and responding to the location of the traffic crash. The FCPD officer then issued a uniform summons to the driver for not having an operator’s license. The driver signed the summons.  However, the officer then decided to detain the driver through a custodial detention and turned over custody to the ICE agent.

And Edwin said that was crappy:

If the response reads “OUTSTANDING ADMINISTRATIVE WARRANT OF REMOVAL” and the individual is not in custody or being taken into custody for any other violation of law, officers shall not confirm the hit through LESC and shall not take the individual into custody based solely upon the IVF hit. The majority of such administrative warrants represent civil violations of immigration law.

Then he bore down on the offending cop:

As a matter of full transparency to our community — our police officer violated our longstanding policy and deprived a person of their freedom, which is unacceptable. We have been informed by ICE that the driver was released after three hours and issued an ankle monitor. When I learned of this event, I directed an immediate internal investigation to look at all factors in this matter to ensure that all are held accountable for this violation.

In his wrap-up, the chief championed diversity while lamenting the damage caused by the officer — who was dadgum suspended:

Our county is one of the most diverse counties in the nation and no one should have the perception that FCPD is acting as a civil immigration agent for ICE. This matter damages our reputation and the longstanding policy that I have stated many times that our officers shall not act as immigration agents. The officer involved in this event has been relieved of all law enforcement duties pending the outcome of this investigation. It is my duty to enforce our FCPD – and Fairfax County – policies and hold all accountable for their actions.”

Does a press release strike you as a surprising bit of much in this case?

It certainly struck some. As a bit of hooey.

The Washington Times reports:

[O]ffers of assistance and support for the officer poured in…and Chief Roessler was harshly criticized for attempting to make an example out of the officer.

But surprise! Due to the public outcry, there was a flip-flop:

Fairfax County Police Chief Edwin C. Roessler Jr. announced Wednesday that he had canceled the suspension and restored to duty an officer who had turned an illegal immigrant over to ICE.

This was surely a disappointment to activists, who’d praised Edwin for his bold step and solidarity with their community.

“We have one of the best police forces in the U.S. and I have confidence that our officer will represent us well throughout his career.”

Well, that was nice.

But not too nice — the investigation’s ongoing.
