California Gov. Gavin Newsom has given his blessing for film and TV production to resume Friday, subject to approval from county public health authorities.

The state Department of Public Health also issued extensive guidelines for schools, day cares and casinos. But it put out just a single paragraph on music, film and TV production, essentially punting detailed rules to local health officials and labor-management negotiation.

Production has been halted since early March, and it remains uncertain when it will actually restart.

The Alliance of Motion Picture and Television Producers drafted a 22-page “white paper” on the topic, and submitted it on Monday for approval to officials in New York, California and Los Angeles County.

But union officials have said that job-by-job protocols remain to be worked out. The industry report called for regular testing of crew members, six-foot physical distancing, and widespread use of face coverings.

Industry sources have projected that the new protocols could increase production costs as much as 20 percent.

Los Angeles County health authorities have been waiting for the state to authorize production before issuing their own guidelines, and they are expected to do so as early as next week.

Universal film chief Donna Langley asked county officials on Tuesday to quickly review the white paper and to lift restrictions in accordance the industry’s plan, in hopes of resuming production as soon as possible.

The state gave its blessing on Friday for sporting events to be held without spectators, also beginning Friday, subject to labor agreement and local approval. The department published detailed guidance for schoolsday camps, and casinos on tribal land.

“As we continue to release guidance on how different sections can reopen with modifications, it is important to remember guidance doesn’t mean ‘go,’” Dr. Sonia Angell, the director of the CDPH, said in a statement. “Your local health officer will make the final decision about which sectors will open, guided by data specific to your community.”

The film and TV production guidelines have been delayed over the last couple of weeks.

In an entertainment roundtable discussion on May 20, Newsom said he expected to issue the guidelines the following Monday. The following week, however, he said the guidance would be postponed as his office worked with labor and industry stakeholders to refine the rules.

California film, TV production guidelines to be announced next week

California Gov. Gavin Newsom said the state will issue guidelines next Monday that would allow film and TV production to start up in some counties in the state, perhaps even as soon as next week.

Newsom hosted a virtual roundtable on Wednesday with industry leaders, including Netflix chief content officer Ted Sarandos and director Ava DuVernay.

Sarandos reported that production is already underway in South Korea, Sweden and Iceland, and that protocols in those areas can be transferred to other places once production resumes.

“The choices that we have to make today are not staying home or not, it really is how do we get back to work safely,” Sarandos said. “It can definitely be figured out. We have the smartest people in the world working on it.”

Production is not expected to be allowed to resume until the state reaches “Stage 3” of its reopening plan. However, the state is allowing some counties where the virus is more controlled to start up sooner than others.

Newsom said that Los Angeles County continues to represent a disproportionate share of the state’s cases, however.

“It remains a challenging part of the state for us still,” he said. “We are concerned they will be a few weeks behind everybody else.”

Newsom asked Sarandos how California is faring compared to other states, particularly Georgia. Sarandos said that while no one in the U.S. is filming yet, there has been “a lot more talk about moving faster” in other states.

Danny Stephens, representing IATSE Local 80, noted that the new protocols will come at a cost, and said he worries that if restrictions are too aggressive, productions might move elsewhere.

“The last thing we want to do is price ourselves out of business,” he said, and made a pitch for further state tax incentives for production.

Newsom seemed at least open to the idea, while he did not make any commitments.

“I appreciate the need for this state to be more competitive in this space,” Newsom said. “We cannot rest on our laurels.”

DuVernay said she appreciated that California has been strict about imposing measures to control the virus, in contrast with other states that have opened sooner. She also said it was important to keep the victims of the virus in mind.

“There are too many lives lost, and too much we have to learn so those deaths aren’t in vain,” DuVernay said.

Kevin Spacey has settled a lawsuit with the estate of a man who had accused him of sexual assault, following the accuser’s death in September.

The accuser, a massage therapist, had alleged that Spacey forced him to grab his genitals and tried to kiss him during a session in Malibu in October 2016. Spacey denied the allegation.

A trial was set to take place in federal court in June 2020, but the accuser died, reportedly of cancer, on Sept. 6.

KEVIN SPACEY SEX ASSAULT ACCUSER DEAD

The accuser’s estate filed a notice dismissing the lawsuit on Monday. Each side agreed to pay their own costs. Any other terms of the agreement were not disclosed.

The Los Angeles County Sheriff’s Department had investigated the man’s allegations and forwarded the case to the district attorney’s office. After the accuser died, prosecutors announced they would not bring charges in the matter.

The plaintiff’s attorneys had intended to call two other massage therapists who would also claim that they were assaulted by Spacey. All three massage therapists did not want to be publicly identified.

Spacey had faced a separate criminal charge in Nantucket, stemming from an alleged groping of a busboy. That case was dropped in July, however, after the accuser in that case invoked his Fifth Amendment privileges during an evidentiary hearing. Spacey’s attorneys had accused the man and his mother of tampering with text messages used as evidence in the case. That accuser also dropped a civil suit.

Last week, Spacey released a video in which he portrayed Frank Underwood, his character from “House of Cards.”

“You didn’t really think I was going to miss the opportunity to wish you a Merry Christmas, did you?” he asked.

Harvey Weinstein being probed in Los Angeles for 8 sexual misconduct cases amid New York rape trial

Harvey Weinstein is set to go on trial next month in New York on charges of rape and sexual assault. But no matter how that case turns out, he will still face criminal jeopardy in Los Angeles.

The Los Angeles County District Attorney’s Office is now reviewing eight cases against the disgraced producer, according to D.A. spokesman Greg Risling.

The D.A.’s office has received four cases each from the Los Angeles Police Department and the Beverly Hills Police Department, and has yet to decide whether to file charges on any of them. Two of those cases were submitted within the last few months, and have not been previously reported.

Weinstein has adamantly denied all allegations of non-consensual sex.

Risling declined to give details of any of the charges. The office has been reviewing most of the charges for nearly two years. The Beverly Hills Police Department submitted two cases involving Weinstein in January 2018. The LAPD submitted three investigations the following month, and Beverly Hills detectives submitted their third case in June 2018. Until last week, the D.A.’s office had not provided an update on its Weinstein cases since August 2018.

One of the cases involves an Italian model who alleges that Weinstein raped her at the Mr. C Beverly Hills hotel in February 2013. The LAPD interviewed the woman in October 2017, shortly after the Weinstein scandal broke, and submitted her case to the D.A. for review.

In August of this year, the Manhattan D.A.’s office disclosed that it would call three witnesses to testify about Weinstein’s alleged “prior bad acts.” The D.A. did not identify the witnesses, but said that one of them would testify about an incident that occurred at a hotel in Beverly Hills on the night of Feb. 19, 2013. Risling declined to comment on whether the D.A.’s office is cooperating with Manhattan prosecutors on that aspect of the case. Weinstein’s trial begins on Jan. 6, and is expected to take two months.

The Los Angeles D.A.’s office set up a task force to review Hollywood sex assault cases in November 2017, but has yet to bring any charges. The office has declined to prosecute many allegations because they fell outside the statute of limitations, which is 10 years for most serious sex crimes. In one case, the office declined to prosecute actor Kevin Spacey because his accuser had died.

Weinstein is also facing civil litigation. Earlier this month, The Weinstein Company insurers agreed to terms on a $25 million “global settlement” of sexual misconduct litigation. Several accusers have opted not to participate in the settlement, including Kaja Sokola, a Polish model who alleges that Weinstein sexually assaulted her when she was 16. Sokola filed suit last week in New York, naming Weinstein, his brother Bob, Miramax and Disney as defendants.

Charlie Kessler has dropped his idea theft lawsuit against Matt and Ross Duffer on the eve of trial, acknowledging the brothers came up with the idea for the Netflix show “Stranger Things” on their own.

Kessler had alleged that the Duffer brothers stole his idea for the series after the trio got to talking at a reception for a 2014 screening of “Honeymoon” at the Tribeca Film Festival. Kessler said he pitched the brothers an idea for a project based on urban legends about a decommissioned military installation in Montauk, New York. He said he was stunned a year later when Netflix announced the Duffer brothers’ show, which contained similar themes and was originally titled “Montauk.”

The trial was set to begin on Tuesday, but in a statement on Sunday afternoon, Kessler acknowledged that the brothers have demonstrated that they conceived the idea independently. The brothers produced emails and Google documents showing that they were working on the concept as early as 2010. Kessler pared back his suit last week, dropping allegations that the brothers cribbed from his feature screenplay.

“After hearing the deposition testimony this week of the legal expert I hired, it is now apparent to me that, whatever I may have believed in the past, my work had nothing to do with the creation of ‘Stranger Things,’” he said in the statement. “Documents from 2010 and 2013 prove that the Duffers independently created their show. As a result, I have withdrawn my claim and I will be making no further comment on this matter.”

The Duffer brothers maintained all along that they came up with the idea independently, and had no memory of even meeting Kessler at the fateful cocktail party.

Netflix was not a party to the suit, but issued a statement Sunday saying the company is pleased the case has been dropped.

“We are glad to be able to put this baseless lawsuit behind us,” a Netflix spokesperson said in the statement. “As we have said all along, ‘Stranger Things’ is a ground-breaking original creation by The Duffer Brothers. We are proud of this show and of our friends Matt and Ross, whose artistic vision gave life to ‘Stranger Things,’ and whose passion, imagination and relentless hard work alongside our talented cast and crew made it a wildly successful, award-winning series beloved by viewers around the world.”

In Kessler’s account of the 2014 cocktail reception, Matt Duffer said, “We should work together. What are you working on?” He said he told the brothers a short film he had made about a mysterious disappearance in Montauk, and said he was seeking to produce a feature. He told the brothers where to find more information about the project online. He never heard from them again, and assumed they had no interest.

The Duffer brothers showed that they, too, had been exploring the Montauk conspiracies for years, and had even planned to take a scouting trip to Montauk around the time of the film festival.

“This is not some deep cut conspiracy,” Matt Duffer testified in a deposition, saying he had first heard about it in high school. “If you know anything about urban legends, you know this. You know about the Montauk Project.”

The setting for the show was later changed to a fictional town in Indiana due to the difficulty of shooting at Montauk, and because there were several other works about the same conspiracies with a similar title.

Idea theft lawsuits are fairly common, but they are usually thrown out before they reach a jury. Judge Michael Stern, however, found Kessler’s claims sufficiently plausible to send the case to trial. Had Kessler’s suit prevailed, it could have had a chilling effect on Hollywood social gatherings.

“It would create a situation where any reputable director or producer should never go to cocktail parties,” argued Aaron Moss, a partner at Greenberg Glusker who specializes in intellectual property cases. “If the mere act of asking somebody ‘What are you working on?’ and saying ‘We ought to work together’ is going to give rise to an obligation to pay for whatever happens to come out of the person’s mouth, I think we’re all in trouble.”
