Federal Judge Gives Middle Finger to Higher Court Ruling, Blocks Trump’s New Asylum Policy Again Anyway

Migrant families cross the Rio Grande to get illegally across the border into the United States, to turn themselves in to authorities and ask for asylum, next to the Paso del Norte international bridge, near El Paso, Texas, Friday, May 31, 2019. It’s almost like the federal judiciary have no respect for constitutional dictations at all.

If you recall, Trump won a surprising victory in the 9th Circuit Court of Appeals last month when they ruled in favor of him implementing new asylum rules that he clearly has the constitutional authority to enact. Those revolved around requiring migrants to apply for asylum in the first safe country they arrive in before proceeding to the United States. This is not only common sense, it’s the world standard and the recommendation of the United Nations (who the left constantly tells us we should listen to). Asylum is not for country shopping. It’s to remove yourself from supposed immediate danger, nothing more.

Well, the very same judge who was slapped down originally decided to throw up a middle finger at the higher court that overruled him previously. He made the same judgement again, blocking Trump’s asylum policies on a national level.

This per Axios.

A California federal judge re-issued a nationwide injunction on Monday, blocking the Trump administration from denying asylum to migrants who have not first applied for refuge in a “third country” they’ve traveled through.

Last month, the 9th Circuit Court of Appeals narrowed federal Judge Jon Tigar’s first preliminary injunction to apply only to the 9th circuit. The move allowed the Trump administration to enforce the policy — which would all but deny asylum to Central American migrants — in Texas and New Mexico. The policy will now be blocked nationwide once again.

To recap, this is a single, low level federal judge who’s jurisdiction does not expand past the 9th circuit. The 9th Circuit Court of Appeals made that clear by narrowing his original ruling and removing the nationwide injunction. What’s he do? Puts it right back in place with no better of an explanation for doing so.

Judge Tigar is of course an Obama judge, something I’m assured doesn’t exist by Justice John Roberts. This is just more proof of how wrong he is though.

The judge in question here is ruling completely based on partisan politics. There is no constitutional case for overriding the President’s delegated powers to control immigration policy, nor do non-citizens have a right to claim irreparable harm for him doing so, thereby forcing nationwide injunctions. By that logic, every single part of the constitution could be suspended to prevent some form of irreparable harm to someone on the globe. It’s nonsensical garbage and it’s exactly why nationwide injunctions are terrible policy for the courts. They also have no basis in the delegated powers of the judiciary, seemingly being invented out of nowhere and being in direct contradiction with the Judiciary Act of 1789.

But as I’ve said many times, this will never stop until Justice Roberts gets some courage and deals with this issue. The Supreme Court needs to take on the question of nationwide injunctions and stop this idiocy. Nowhere in our system of governance was it meant for a single, un-elected judge to dictate policy for the entire country. As long as the highest court sits on its hand though, judges will keep going rogue.

Hopefully the 9th Circuit slaps this guy down hard again. They can’t be to happy about being so directly defied.

The Washington Post Smears Pro-Lifers As White Supremacists Because No One Is Safe

Westlake Legal Group planned-parenthood-tx2-620x432 The Washington Post Smears Pro-Lifers As White Supremacists Because No One Is Safe the washington post Steve King sanger Pro-Life pro-abortion Politics political planned parenthood media bias J.D. Vance Gross Front Page Stories Front Page Featured Story Disgusting democrats Brostoff

The Washington Post is just awful.

If you’d like more evidence of that, here’s a piece they put out today tying pro-lifers to white supremacy and suggesting that J.D. Vance subscribes to the white nationalist replacement theory. The author of the article is someone names Marissa Brostoff, who epitomizes the know nothing nature of so many current journalists.

Her proof of such a stupid, ahistorical claim? That Steve King is pro-life. Really, that’s pretty much what here argument boils down to. I hear Steve King also drives a car, thereby cars are clearly white nationalist garbage.

Last fall, speaking to a far-right Austrian magazine, the Iowa Republican congressman Steve King succinctly laid out his theory of Western decline. The problem, he suggested, was a demographic born at the nexus of reproduction and immigration. “If we continue to abort our babies and import a replacement for them in the form of young violent men, we are supplanting our culture, our civilization,” King said.

King’s views are certainly problematic, especially if you take the worst interpretation of them (to be fair, he doesn’t actually say “white” anywhere in his comments). But King is hardly dispositive that the greater pro-life movement is somehow tied to white supremacy. History tells quite the opposite story.

In fact, Brostoff’s article is an exercise in contradiction. Abortion is a form of eugenics, one she supports. 36% of all babies aborted are black. Planned Parenthood exists today because a founder who sought to use abortion to eradicate minorities founded it. What does any of this have to do with the largely religiously based pro-life movement?

Take this word salad for example.

This juxtaposition has been particularly cruel over the past year, as revelations about the imprisonment of migrant children in concentration camps have coincided with a wave of draconian antiabortion legislation. (Just last week, a federal appeals court approved Trump administration rules cutting off federal funds from health-care providers that offer abortions or even discuss the procedure with patients, effectively slashing the budget of organizations like Planned Parenthood.) But understanding this confluence as ironic can actually mislead us. In fact, as King and his white nationalist allies have become increasingly comfortable admitting, state crackdowns on reproductive and immigrant rights are inextricably linked.

In other words, she’s essentially asserting that Republicans are evil and want to kill everyone, but also they are pro-life and that’s super evil as well. If you are struggling to square that circle logically, don’t be too hard on yourself. It makes absolutely no sense.

Here’s the reality. Being pro-life means eliminating abortion for all races. It means more black and Hispanic babies being born, not less. There is absolutely nothing even resembling white supremacy is such a viewpoint. It’s actually the complete opposite. Pro-abortion advocates, on the other hand, are an ally of the white nationalist movement because they largely target minority women and their unborn children.

To assert that being against abortion is actually helping white supremacists is ludicrous on its face. In short, this writer is attempting to link two diametrically opposed ideas simply to cram the circle of her politics into the square of what abortion actually does and who it affects the most.

As you read Brostoff’s piece, it’s lack of any actual citation for her claims is notable. What she’s attempting to do is claim that because white supremacists are concerned with falling birthrates (of white people), that this means all people encouraging more births (of all races) are white supremacists. This is nonsense. It’s like saying that because the Christchurch shooter was concerned about the environment that environmentalism is therefore white supremacy. An idea can be adopted by bad actors. It does not make the idea defined by those bad actors.

Falling birthrates are actually an issue for economies and we’ve seen countries of all different racial makeups encouraging parenthood. That movement has exactly nothing to do with white nationalism and everything to do with nations acting in their own self-interests. If someone wants to argue for abortion and be against governments encouraging more births, fine. But trying to connect that to white supremacy and then claim pro-lifers are white supremacists is disgusting garbage.

To end her piece, Brostoff then smeared J.D. Vance by claiming he was touting white nationalist replacement theory. This despite him clearly spelling out what he was talking about.

J.D. Vance’s wife is a minority and his children are half Asian. The modern woke movement has no room for critical thinking or facts though, so Brostoff ran with her gross insinuation anyway. The Washington Post has since scrubbed that paragraph and offered a correction, no doubt to avoid being sued. What she had originally written was likely actionable defamation.

I’ll end by reiterating that the modern white supremacist movement, however tiny it actually is, is largely pro-abortion. Richard Spencer, for example, supports abortion. Brostoff, whether she wants to accept it or not, is finding far more common cause with racists than pro-lifers are. Her entire piece smacks of looking in the mirror and not liking what she sees. Instead of reflecting on the immorality of her own views though, she sought to project evil on others via illogical nonsense lacking any and all evidence.

While many conservatives on social media acted shocked that the Post would even publish this, I’m not surprised at all. This is who these people are. This is their agenda. We either push back against it vehemently or we collapse under its weight.

The Media and Global Elites Are Lying to You About the Amazon Fires

Westlake Legal Group 281460a8-8b0a-4a9d-bb75-4a60d090268f-620x317 The Media and Global Elites Are Lying to You About the Amazon Fires Propaganda Politics political Marcon lying Hysteria Global Warming g7 Front Page Stories Front Page France Featured Story democrats Climate Change burning Brazil Amazon Fires

For the past decade, we’ve seen normal events become sensationalized to the point of hysteria. Take hurricanes for example.

In order to push climate change as a means for acquiring political power, the left have decided to present every hurricane as proof positive of the vast negative, deadly effects of the earth warming. It doesn’t matter that we are actually seeing less hurricanes in the current decade than the decade before or that 2019 has been incredibly quiet as far as hurricanes go. The moment a storm finally appears this year, it will be bandied about for political reasons.

We are seeing much the same tactics used in regards to the fires currently burning in the Amazon. Celebrities and politicians the world over are shouting on Twitter, sharing photos, and making wild claims about the severity of what is going on.

That’s not to say that the fires are good or that there aren’t more of them this year. It is to say the overall picture being painted is almost wholly false and sowing unnecessary fear to play politics.

Here’s Mike Shellenberger, someone who’s studied this for a long time and lived among the people of the area, writing in Forbes to try to bring some levity to the situation.

Singers and actors including Madonna and Jaden Smith shared photos on social media that were seen by tens of millions of people. “The lungs of the Earth are in flames,” saidactor Leonardo DiCaprio. “The Amazon Rainforest produces more than 20% of the world’s oxygen,” tweeted soccer star Cristiano Ronaldo. “The Amazon rain forest — the lungs which produce 20% of our planet’s oxygen — is on fire,” tweeted French President Emanuel Macron.

And yet the photos weren’t actually of the fires and many weren’t even of the Amazon. The photo Ronaldo shared was taken in southern Brazil, far from the Amazon, in 2013. The photo that DiCaprio and Macron shared is over 20 years old. The photo Madonna and Smith shared is over 30. Some celebrities shared photos from Montana, India, and Sweden.

It should surprise no one that same group of people who are always beating the drum that the earth is on the verge of calamity chose to purposely lie and share fake photos to push their narrative. Their lying, misleading, and misrepresentations are nothing new.

But let’s deal with the actual claims being made.

Is the Amazon really producing 20% of the world’s oxygen and is it the “lungs of the earth?” It sure sounds dire, but in reality it’s a mostly nonsensical claim.

I was curious to hear what one of the world’s leading Amazon forest experts, Dan Nepstad, had to say about the “lungs” claim.

“It’s bullshit,” he said. “There’s no science behind that. The Amazon produces a lot of oxygen but it uses the same amount of oxygen through respiration so it’s a wash.”

What about the assertion that the Amazon is burning at an 80% higher rate than 2018? As with many things, context matters and the media are purposely leaving it out.

But the “lungs” myth is just the tip of the iceberg. Consider that CNN ran a long segment with the banner, “Fires Burning at Record Rate in Amazon Forest” while a leading climate reporter claimed, “The current fires are without precedent in the past 20,000 years.”

While the number of fires in 2019 is indeed 80% higher than in 2018, it’s just 7% higher than the average over the last 10 years ago, Nepstad said.

One, the idea that anybody could possibly know with any actual authority that these fires haven’t happened for 20,000 years is ludicrous. Secondly, the reason the reason fires are 80% higher this year than last is because last year was an unusually low year for fires. There is no actual existential emergency here.

In fact, there were higher incidences of burning over the course of 2003-2008 than the current five years. The Amazon wasn’t “lost” or destroyed. Amazingly, trees grow back.

What is happening in the Amazon is not exceptional,” said Coutinho. “Take a look at Google web searches search for ‘Amazon’ and ‘Amazon Forest’ over time. Global public opinion was not as interested in the ‘Amazon tragedy’ when the situation was undeniably worse. The present moment does not justify global hysteria.”

And while fires in Brazil have increased, there is no evidence that Amazon forest fireshave.

Further, deforestation is down 70% from the early 2000s. Over half the Amazon is completely protected from deforestation by law and the increase in fires this year is not from climate change, but rather from farmers needing to burn land for crops and cattle.

In other words, what’s happening is completely preventable. It’s not an uncontrollable, environmental threat to the world due to global warming. You are not going to stop getting oxygen to your lungs because of a 7% increase in Amazon fires over the last decade.

Enough of the lying. It’s incredibly transparent that this is political given the same climate change hysterics who freak out about hurricanes and thunderstorms are latching onto this. Brazil doesn’t owe the rest of the world anything and they need to be allowed to manage the situation without the French president or Hollywood celebrities injecting false information into the debate. It only creates division and makes it harder to work with the farmers in question.

Marcon and others should stay in their lane. This isn’t it.

A fun little leftover from last night to cleanse the palate. I grudgingly admire this guy’s ability to chum the social-media waters with a tweet distilling incestuous Washington elitism to its purest essence and then to complain about the entirely predictable reaction.

Try to imagine the clammiest snooty D.C. scene you can imagine. What is it? It’s a cocktail party, of course — in Georgetown. The fabled Georgetown cocktail party is so closely identified with elitism that it’s been used on the right for years as an insult aimed at establishment media, to accuse centrists of having sold out. (“You wrote this RINO column because you’re afraid you wouldn’t be invited to any more Georgetown cocktail parties if you hadn’t.”) It’s so shopworn and cliche by now that you’re more likely to hear establishmentarians joke about it themselves than you are to see populists using it in earnest. “I published a piece today defending Never Trump. See you at tonight’s cocktail party in Georgetown.” Etc.

Who would be at this clammy, snooty hypothetical cocktail party we’re imagining? Obviously some very well-known politicians, as the eagerness of attendees to kiss the asses of the powerful is a basic part of why this scene is so repulsive. So, let’s say, Chuck Schumer or Nancy Pelosi. There’d also be lots of media types, as it’s the spectacle of the “watchdog” press doing most of the ass-kissing that makes the tableau particularly gross. Any media people will do but obviously the more famous they are and the more closely they’re associated with journalistic starf***ing, the more odious the scene becomes. So, think Maureen Dowd, say.

Fortunately, such a ludicrous scene would never happen in reality. Or would it?

Westlake Legal Group f2-1 Howard Fineman: Why does it make people so mad to see political elites and media elites hobnobbing at a Georgetown cocktail party? The Blog schumer political party Nancy Pelosi Media maureen dowd Howard Fineman georgetown elites cocktail

It’s almost suspiciously perfect. The dictionary definition of an elitist Washington cocktail party becomes reality — just hours after Democrats’ big Mueller impeachment show turns out to be a total dud, with Pelosi seemingly evincing not a care in the world?

And the party was being thrown to celebrate a book about Supreme Court confirmation fights, a subject on which Senate Democrats have failed spectacularly not once, not twice, but three times in the span of three years? And there’s Chuck Schumer, also seeming to be having a grand old time?

And the journalist hosting it just so happens to have been the conduit for Pelosi’s recent trash talk about the left’s heroes, the Squad?

It’s as if this image was forged in some populist lab, a deepfake designed to encourage the total overthrow of the Democratic establishment.

The reaction on Twitter from both sides was swift and brutal and foreseeable to everyone in the universe. Except, somehow, to the man who posted it.

“All establishments are hated.” Any theories why?

Anyway, congrats to all involved for the collective Beltway-corridor gross-out. Until the White House Correspondents Dinner is restored to its Obama-era grandeur as the Super Bowl of establishment politico/media starf***ing, stuff like this will have to suffice.

Protestors Tear Down and Desecrate U.S. Flag, Raise Mexican Flag Over ICE Facility in Colorado

In this Tuesday, Feb. 7, 2017, photo released by U.S. Immigration and Customs Enforcement, foreign nationals are arrested during a targeted enforcement operation conducted by U.S. Immigration and Customs Enforcement (ICE) aimed at immigration fugitives, re-entrants and at-large criminal aliens in Los Angeles. Advocacy groups said that Immigration and Customs Enforcement officers are rounding up people in large numbers around the country, with roundups in Southern California being especially heavy-handed, as part of stepped-up enforcement under President Donald Trump. (Charles Reed/U.S. Immigration and Customs Enforcement via AP)

If there are any moderate Democrats left out there, they must be tearing their hair out. All their party had to do was not be absolutely crazy and they simply can’t do it.

Yesterday, protestors gathered outside an ICE facility in Aurora, CO to scream at officials who are simply trying to carry out lawful deportation orders. We’ve now reached the point in our country where one side of the aisle is literally saying that you can’t even deport criminals anymore.

The protestors decided it’d really win hearts and minds to storm the front of the facility, bring down the three flags present, and hoist a Mexican flag. They tried to burn the U.S. flag and spray painted “**** the cops” on the Thin Blue Line flag for good measure.

Per The Washington Times.

The incident saw activists take down three flags and replace them with the Mexican flag, a spray-painted “USA Thin Blue Line” flag, and a flag that said “F*** the Cops,” according to Aurora police.

Some activists also tried to burn the American flag, but officers declined to intervene, citing the need to protect the safety of officers and the “large majority who were acting peacefully” at the rally, which drew as many as 2,000.

What sense any of this makes is beyond any rational person’s comprehension. If they idea is that Latin American countries are so terrible that people must be allowed to come here illegally, why would you want to celebrate Mexico while desecrating the country’s flag you are fleeing to? If Mexico is so awesome that people feel the need to tear down the American flag and raise the Mexican flag, then illegal immigrants are welcome to apply for asylum there. It’d probably be less of a culture shock.

If you are wondering whether anyone was punished for the act of vandalism, nah. The Police Chief there didn’t do anything and actually blamed ICE for not putting up enough barriers.

“Beyond the removal, attempted destruction of the US flag, replacement of the flags, and some signs and poles being put on the main doors and windows, the protesters did not engage in behavior that warranted immediate intervention,” said Aurora Chief of Police Nick Metz in a Saturday statement.

Chief Metz also faulted ICE and the GEO Group, which runs the detention facility, for failing to heed the department’s advice to secure the bridge leading to the facility with water barrels to prevent pedestrians and vehicles from entering…

…At least one Democrat, Aurora city councilmember Nicole Johnston, said in a tweet that she attended the rally and thanked Aurora police for “keeping us safe and respecting our first amendment rights.”

Perhaps it wasn’t worth intervening at that moment, but were people arrested afterward? Of course not. Anarchy is the name of the game at these protests and the 1st amendment now apparently covers trespassing and destroying federal property. Nice to see an elected Democrat official showing up to be part of it all. That really sends the right message.

After the incident, some asked Democrats to condemn what happened.

Colorado’s rabidly liberal governor did finally chime in with this snarky nonsense.

Publicizing a picture of two dead migrants, who died trying to swim across a river outside of the United States, having absolutely nothing to do with the actions of Border Patrol, is just disgusting.

Furthermore, where are the cages in his other photos? Or are we now calling huge rooms cages for extra effect? These people have to be held somewhere for processing. There’s noway around that and it’s beyond tiring that some morons keep pretending CBP can snap their fingers and teleport kids to foster homes immediately. What exactly would Polis like CBP to do with unaccompanied minors (who make up the vast majority of detained children)? Would he like to give his address out and arrange them being dropped off on his doorstep? Of course not, because he’s a do-nothing, hypocritical politician who’s just grand-standing for political reasons.

The intellectual dishonesty surrounding the immigration debate has reached unbelievable levels. The same people who deny funding and call for the abolition of the agencies taking care of these people then turn around and complain about overcrowding and sub-par conditions. It’s the worst kind of politics and the only reason they are getting away with it is because the media are nearly 100% compliant and complicit.

In the end though, this is going to backfire. A sizable majority of voters do not want open borders, they do not blame the Border Patrol for being in a lose/lose situation, and they are against abuse of our asylum laws. The continued insanity coming from the left over this issue is going to drive more and more people to the Republican party and it’ll be well deserved.

The sheer amount of irony here is hard to grasp.

The Washington Post has continually defended the Obama administration’s abuses of power during the 2016 election. In fact, we just learned today that the FBI is now admitting to sending a covert agent (i.e. spy) to target George Papadopoulus. The details aren’t even really in doubt anymore. Despite that, we’ve gotten every excuse in the book and not once has the Post ran a news story that does anything but obfuscate and deflect from what happened.

Now, all the way in (checks notes)…mid-2019…they are finally concerned that a President might use Federal authority to target a political opponent. You can’t make this stuff up.

The 2020 election is going to be ugly in many different ways. If you thought Donald Trump ran a rancid campaign when he was trying to make it to the White House, just you wait until he’s fighting to preserve his power. It has been obvious for some time that President Trump is planning to promote hatred and division, but one thing we haven’t yet focused on is how he will use the resources of the federal government to make sure he wins reelection.

Yeah, he might even have the FBI spy on his opponents. Wouldn’t that be crazy?

We got a hint of it Wednesday when Attorney General William P. Barr testified before the Senate Judiciary Committee. Sen. Kamala D. Harris (D-Calif.) asked Barr, “Has the president or anyone at the White House either asked or suggested that you open an investigation of anyone?”

Barr reacted as though she had asked him to calculate the speed of light in nanometers per second in base 8. He sputtered a bit, asked her to repeat the question, repeated it himself, then gazed off into the distance, prompting Harris to say, “It seems you’d remember something like that,” which indeed you’d think he would. After musing for a moment on the nature of word “suggest,” Barr gave no answer.

Which suggests the strong likelihood that the actual answer is “yes.”

Wait, you think Trump might have the DOJ/FBI to open an investigation into the opposing party’s candidate and use the FISA system to gather information on them? Well, that would just be unprecedented.

But in this case, the Times acknowledges the story’s provenance right in the headline: “Biden Faces Conflict of Interest Questions That Are Being Promoted by Trump and Allies.”

Regular readers will know that I’m hardly Joe Biden’s biggest fan, but this story seems particularly weak in its implication that Biden did anything remotely wrong. What it comes down to is that, as vice president, he advanced Obama administration policy by pressing Ukraine to fight corruption, a perfectly worthy goal shared by lots of countries.

So the story here isn’t that Biden threatened Ukrainian officials to stop investigating a company his son worked for. No, the story is that “Trump and allies” are promoting the news. How exactly are Biden’s actions “pressing” Ukraine to fight corruption anyway? Sounds pretty much like the opposite.

So get ready. Trump is going to order the Justice Department to launch an investigation of his opponent — probably more than one — and Barr will likely do so eagerly. It doesn’t matter how trivial the substance is, as we learned in 2016 when the fact that Hillary Clinton used the wrong email became the dominant issue of the campaign.

You mean like the Obama administration did or are we still pretending that Strzok saying the investigation was being run through the White House isn’t proof they were involved? I also love the line about Hillary simply using the wrong email. Oh, that’s all it was? It wasn’t that she setup a private server and illegally trafficked in classified material to avoid FOIA transparency. She just accidentally signed into the wrong account or something. Got it.

I’ll stop there so as not to violate fair use rules, but the entire thing just keeps going on like that.

The Washington Post is an absolute joke and this article is pure projection. It’s basically a one to one comparison of everything the Obama administration did while asserting that it’s actually Trump that will do all those things.

The real truth is that people like this author are not actually concerned with Federal overreach. They are just concerned someone they oppose might use it. When it’s a Democrat, they are all for the FBI investigating opponents and running informants against their campaign. Now that the shoe is on the other foot as far as power goes, they suddenly want the rules to go back to what they were.

Perhaps they should but it’s still worth pointing out the laughable hypocrisy on display here.

The Gloves Come Off As Even Ben Shapiro Hits Mueller for His Underhanded Behavior

Westlake Legal Group energizer-mueller-620x599 The Gloves Come Off As Even Ben Shapiro Hits Mueller for His Underhanded Behavior whining Summary Robert Mueller Politics political obstruction of justice Mueller report Mueller Letter Front Page Stories Front Page Featured Story donald trump bill barr Ben Shapiro

Lots of eyes are being opened over the past two days in regards to Mueller’s behavior.

That behavior made it increasingly clear that the special counsel was more concerned with media perception and sliming Trump than his bottom line conclusions being put out . This culminated in a “bombshell” letter that was leaked by Mueller (there’s no other logical possibility) purporting to show that he was upset with how AG Bill Barr had characterized the report in his 4 page press release.

In reality, it was actually just a whiney, made for media complaint that Barr hadn’t done the dirty work for the special counsel in the absence of Mueller not having the courage to recommend charges for Trump. Mueller wanted to the report to come out piece-meal and serve as a roadmap to impeachment and Barr wasn’t going to play his games.

Mueller getting upset about media perceptions when he knew the entire report was being prepared for release anyway tells you a lot about the mindset and true purpose of his “investigation.” A special counsel shouldn’t give two shakes about media perception.

This revelation has led some conservative voices who formally defended Mueller to wake up and smell the stink in the air. Andy McCarthy had a savage piece this morning about the entire ordeal. Another is Ben Shapiro, host of the “fastest growing conservative podcast in the nation.”

I actually really like Ben and while I’ve sworn off almost all political commentary (including Fox News), I do listen to his show and enjoy it. It’s good to see him finally realize the truth of what Mueller is doing.

Mueller’s team uncovered very little new damning material with regard to collusion, and in fact refused to issue any finding at all with regard to obstruction of justice. Barr probably didn’t release Mueller’s summary because Mueller’s summary likely didn’t contain a bottom line with regard to obstruction. Which means that the American public would have been left bewildered as to whether Trump was in fact guilty of prosecutable obstruction of justice.

That confusion was Mueller’s fault. (NOTE: This is coming from someone who has defended Mueller’s integrity for years, called on Trump consistently to stop attacking Mueller, and stated that if Trump fired Mueller, impeachment ought to be on the table.) Mueller had the full capacity to recommend prosecution on obstruction of justice. He had full authority to state that in his view, Trump had obstructed justice. But he didn’t. His 448 page report is a listing of ugly details about Trump’s internal administration behavior, but does not recommend obstruction charges — and indeed, doesn’t substantiate activity that could sustain a prosecution. Mueller knew that.

The highlighted part is the key. If Mueller really wanted to stick it to Trump, he should have manned up and made the decision that he felt the President obstructed justice. Instead, the special counsel’s office wanted to wage warfare via leaks and innuendo, setting the stage for a Democratic House to act.

That’s not what prosecutors are supposed to do. Its improper and unethical on its face, no matter what you think of Trump personally.

So what Mueller actually wanted is what he eventually got with the release of the full report: he wanted the media and Democrats to hone in on a political case for impeachment, rather than the criminal bottom line. And he didn’t like that Barr did what the Attorney General is supposed to do: avoid smearing unprosecutable people for unspecified crimes. Barr instead issued a statement explaining that no prosecution would take place.

In the end, that’s what this boils down to. Mueller wanted his report to be released in such a way (i.e. via his “summary”) that it could be weaponized to maximum extent against the administration. Barr cut him off at the pass and did things the right way. So Mueller got pissy and wrote a letter.

I’ll point out that the letter was intentional so it could be leaked. A simple phone call to his “good friend” Bill Barr would have sufficed in this situation. Instead, just like James Comey, Mueller wanted to get it in writing so his henchmen could ambush Barr with it the day before his testimony.

It’s dirty pool and it’s exactly why all the stuff about Mueller being a straight shooter and above reproach is nonsense. He has a long history of questionable actions and his latest behavior on this is just another line item on the list.

In case you read that headline and thought “who cares?”, the answer is: Trump and all of his fans, hopefully. He’s supposed to be the populist-in-chief, the guy who brought the white working class in the Rust Belt back into the Republican fold after they blanched at Romney. He was certainly the more populist option on the ballot in 2016.

Would he be the most populist option on the ballot in 2020 if it’s Bernie Sanders on the other side?

Even if he lucks into facing another elitist technocrat next fall, you can treat the numbers among independents here as a sort of referendum on Trump’s first two years in power. WaPo doesn’t provide historical data so we can’t measure how opinion has changed over time, but we can safely say that most indies don’t think Trump’s populist revolution has led to any economic revolution yet.

This might be an artifact of partisanship. Republican opinion is surely being influenced by a bias in favor of the status quo since it’s their guy who’s presiding over that status quo. On Earth 2, where Hillary Clinton is in power, Democratic anxiety about the economy working for the rich is probably milder even though she had a friendlier relationship with Wall Street in 2016 than Trump did. But you look at these numbers and wonder how potent Sanders’s message (or any other Democrat’s message) might be with some disaffected blue-collar Trump fans. “He signed a tax cut that ended up being a giveaway to the rich,” Bernie will say. “He’s pushing for health-care reforms that’ll end up as a giveaway to the insurance industry.” Tariffs will be a trickier subject for protectionist Democrats but they’ll find a way to mention in Wisconsin that Trump’s trade policies are killing middle America’s dairy farmers. Sanders won’t have to reach far for evidence to support the argument that the great right-wing populist reboot of the system is a bust.

To which Trump has a potent counterargument, of course. All he has to do is point to the monthly jobs numbers and say “Scoreboard.” Democrats will spend the next 18 months straining to come up with an answer to that.

The poll numbers get worse when you ask whether the political system, rather than the economic system, works to mainly benefit people in power:

You can understand why independents would be frustrated with a two-party duopoly. I’m a little surprised by the degree of Republican opposition, though, especially given Trump’s branding as champion of “the forgotten man.” It may be that GOPers are less likely now to see the political system working in favor of the powerful than they’ve been in years past — again, no historical data here — and yet even a majority of Trump’s own party still thinks the little guy is getting screwed with him in power. The eternal tension between the base and the GOP’s congressional leadership contributes to that, I’d bet. To populists, the vote in the Senate on whether to override Trump’s border emergency was a sort of referendum on this question. Trump was at odds with America’s powerful business class in wanting to wall off the border; a bunch of Republican senators crossed the aisle and voted with Democrats to try to stop him, advancing the business class’s goals. They failed to override his veto but may yet succeed in blocking him thanks to a judiciary that’s been hostile to Trump’s policies, especially on immigration. Go figure that even a Trump-led government might be seen as too friendly to powerful interests to the GOP base.

One more number for you:

Westlake Legal Group n-4 WaPo: Dems, indies way more likely than Republicans to believe economic system works for the powerful WaPo Trump The Blog system socialism populism poll political Obama economic

You might shrug that off on grounds that it’s a survey of all adults, not likely voters. After all, some of the NeverTrumpers in that 55 percent bloc won’t bother to register to vote; some who are registered won’t bother to turn out on election day; and some who do turn out will eventually be swayed by the roaring economy to pull the lever for POTUS in the end. Just note that we do have some historical data in this case. Per WaPo, the share during Obama’s first term who vowed they definitely wouldn’t vote for him was 47 percent — coincidentally the exact percentage that Mitt Romney got in the 2012 election. If Trump ends up with 55 percent against him next year, he’d better hope there’s a prominent third-party candidate in the race squeezing votes from the Democratic nominee or he’s a dead duck.

Exit question: Which state do these results, published recently by Emerson, come from?
